HomeMy WebLinkAbout1971-04-13MINIITES HUNTINGTON BEACH PLANNING COMMISSION Council Chambers, Civic Center Huntington Beach, California TUESDAY, APRIL 13, 1971 - STUDY SESSION COMMISSIONERS PRESENT: Bazil, Higgins, Slates, Miller, Duke, Kerins COMMISSIONERS ABSENT: Porter DISCUSSION: a) Code amendment to allow an additional unit in multi -family zones where 3/4 of the requir- ed land area for such unit has been met. b) Change in code regarding Use Permit require- ments. Discussion was held by the Planning Commission whether a Conditional Exception applica- tion should be required for said additional unit where 3/4 of the required land area has been provided. Mr. Reynolds, Planning Director, noted that in the past, the Planning Com- mission has both approved and denied such requests. It was felt that this should only be applied to the town lot area because most lots were only 125 square feet shy of meeting the requirement. The Staff advised that they would like to further explore the land use intensity system for the town lot area of the city rather than this method. It was the consensus of the Commission to set for public hearing the Use Permit portion of said Code Amendment and to hold in abeyance that portion for the additional unit pending further study. A MOTION WAS MADE BY KERINS AND SECONDED BY HIGGINS TO SET FOR PUBLIC HEARING THAT POR- TION OF THE PROPOSED CODE AMENDMENT FOR USE PERMIT APPLICA- TION REQUIRED FOR APARTMENTS ON THE SECOND DRAFT AS CORRECTED APRIL 7, 1971. ROLL CALL VOTE: AYES: Higgins, Slates, Miller, Kerins NOES: None ABSENT: Bazil, Duke, Porter THE MOTION CARRIED. COMMISSIONER BAZIL: Commissioner Bazil arrived at 2:00 P.M. to assume his duties. DISCUSSION: Care of Non -Related Persons The Commission reviewed a memo from the Staff on a study of the types of non -related persons that could reasonably be construed to come under the provi- sion of this'proposed code amendment. Chief Spickard, Fire Department, informed the Commission that the number of eight persons, as outlined --in the amendment, was chosen to be compatible with the Welfare Department regulations which allows six non -re- lated charges. -1- 4/13/71 - PC Minutes: H. Planning Commission Tuesday, April 13, 1971 Page No. 2 The Acting Secretary inform- ed the Commission this item was for information only as Code -Amend- ment No. 70-14 has been set for a public hearing. Commissioner Miller asked if the City has received complaints from residents regarding the care of non -related persons in the neighborhood. Chief Spickard advised that he has received a few minor complaints pertaining to the number of non -related person, however, these have mostly been day care charges and not 24 hour care patients. COMMISSIONER DUKE: Commissioner Duke arrive at 2:15 P.M. to assume his duties. Mr. Ronald Frank, State of California Department of Social Welfar6, addressed the Commission and advised that the State would allow six (6) mentally retarded charges in one home but would not allow any dangerous persons in the home. He advised that the State screens all patients before sending them to a care -home. Commissioner Bazil asked what type of screening "is 3one: " Mr. Frank advised that the screening is done by.medical teams at the state hospital and social workers who deal with social problems of the patient. Chairman Slates asked if other cities have public hearing on these type of cases at which time nearby property owners could express their opinions. Mr. Frank advised that other cities do have public hearings. Chairman Slates stated that he feels there should be a provision in the code which would allow denial if nearby residents do not wish the use in their neigh- borhood. Commissioner Bazil stated he feels the code amendment should be left as it is except to re- duce the number of persons allowed to four (4) and a yearly review to be made of each request. Mr. Pritchett, Department of Social Welfare, County of Orange, stated that his department is primarily concerned with patients 16 years of age and under, or 64 years of age.and over. He explained that no license is required for care of persons from age 16 to 64 years except through the State Deaprtment of Mental Hygiene. He also stated that the rates paid for the care of patients do not permit this type of care to be a business. Mr. Frank advised that the Department of Social Welfare does interview neighbors along with the families which would be caring for the patients. They allow only the number`of non -related persons to be in the home that they feel the home can handle. Discussion was held. It was felt that the Board of Zoning Adjustments should review each request and that the Fire Department should investigate the res- idence and report to the Board of Zoning Adjustments prior to the hearing. -2- 4/13/71 - PC Minutes: H. B. Planning Commission Tuesday, April 13, 1971 Page No. 3 It was the consensus that the Staff should revise Code Amendment No. 70-14 to allow no more than six (6) non -related persons. DISCUSSION: Revision to the Master Plan - Area "A" Jere Murphy, Associate Planner, presented the changes in the Master Plan and explained that the northwest boundary has been changed to include that por- tion of the City up to the Proposed,Route 39 Freeway. He explained changes made in densities, hotel and motel, mobile - home park, and commercial areas. He also reviewed the zone changes which would be required as a part of the proposed master plan. Bill Hartge, City Engineer„ discussed drainage problems in various areas and the flood control channel east of Beach Blvd. Mr. Reynolds, Planning Director, expressed concern that a change of the RA zones presently be- ing used for farming purposes and to R1 zone would create a non -conforming use. Mr. Murphy discussed differ- ences between the Planned Residential and Apartment Standards densities. A MOTION WAS MADE BY KERINS AND SECONDED BY DUKE TO SET MASTER PLAN AMENDMENT - STUDY AREA "A" FOR PUBLIC HEARING. ROLL CALL VOTE: AYES: Bazil, Higgins, Slates, Miller, Duke, Kerins. NOES: None ABSENT: Porter THE MOTION CARRIED. BEAUTIFICATION AWARDS: A committee was appointed with Commis- sioner Higgins as Chairman, Commissioner Duke, and Commissioner Kerins to review and compile a list,of recommendations for the Beautification Awards. It was agreed that the list shall be reviewed by the Planning Commission before being transmitted to City Council. DISCUSSION: ZONE CASE NO. 70-26 Applicant: Brookhurst-McFadden Company Recommendation to City Council to withhold second reading of an ordinance on said Zone Case. The subject property is located on the northwest corner of Yorktown Avenue and Brookhurst Street. The Chairman advised that the Planning Commission had recommended to the City Council that the hold in abeyance the hearing on subject zone change for 60 days and that the 60 days is now over. He recommended that the Commission request the,City Council'to hold the second reading for Zone Change No. 70-26 in abeyance until Mr. Reynolds, Planning Director, advises the Council to proceed and that Mr. Reynolds would advise the City Council to_proceed with the hearing at such time as a Building Permit is issued to the applicant by the Building Department, and construction underway. A MOTION WAS MADE BY SLATES AND SECONDED BY MILLER TO TRANSMIT A REQUEST TO THE CITY COUNCIL REQUESTING THE PROCEEDINGS FOR ZONE CASE NO. 70-26 TO BE HELD IN ABEYANCE UNTIL SUCH TIME THAT THE PLANNING DIRECTOR ADVISES THE COUNCIL TO PROCEED WITH THE SECOND READING. -3- 4/13/71 - PC Minutes: H.
