WEDNESDAY, APRIL 14, 1971 BOARD MEMBERS PRESENT: McFarland, Spencer, Palin DIVISION OF LAND NO. 71-9 (Continued) Applicant: Wm. Lyon Development Co., Inc. To permit the division of a legal parcel of land into four separate parcels. In Conjunction With CONDITIONAL EXCEPTION NO. 71-20 (Continued) Applicant: Wm. Lyon Development Co., Inc. To permit the construction of carports at zero (0) setback within a 150 unit apartment development in the R3 Limited Multiple Family Residence District. The subject property is located on the North side of Holland Drive, 187 feet east of Beach Blvd. In Conjunction With USE PERMIT NO. 71-13 (Continued) Applicant: WM. Lyon Development Co., Inc. To permit the construction of a 150 unit apartment development on a 5.5 acre parcel of land in the R3 Limited Multiple Family Residence District. The hearing was opened to the audience. Mr. Bob Dutton and Mr. Tim Kraft, architect, representing the applicant, addressed the Board and explained the request. Mrs. Robert Oswald, homeowner, addressed the Board and stated -that the homeowners requested a wall at the end of the cul-de-sac to prevent circulation through their development. The following requirements of the Huntington Beach Ordinance Code were discussed with the applicant: 1. Holland Drive shall be dedicated and fully improved to City standards at the time said parcel is developed. Improve- ments shall include street trees, street signs, street lights, fire hydrants, sewer and water main extensions. 2. Water supply shall be through the City of Huntington Beach's water system. 3. Sewage disposal shall be through the City of Huntington Beach's sewage system. 4. The water, sewer, and fire hydrant system shall be approved by the Department of Public Works and Fire Department. S. All utilities shall be installed underground. -1- 4/15/71 - BZA Minutes: H. B. A masonry wall shall be constructed along the north, east and west property line. The height of said wall shall be such that the top will be six (6) feet above the highest ground surface within twenty (20) feet of the common property line. There being no further com- ment, the hearing was closed. Board discussion followed. A MOTION WAS MADE BY MCFARLAND AND SECONDED BY SPENCER TO APPROVE DIVISION OF LAND NO. 71-9 WITH THE FOLLOWING CONDITIONS: 1. The plot plan received March 11, 1971 shall be the approved layout. 2. Beach Blvd. and Holland Dr. shall be dedicated and fully improved to City and/or State standards at the time each parcel is developed. Improvements shall include street trees, street signs, street lights, fire hydrants, sewer and water main extensions. 3. Water supply shall be through the City of Huntington Beach's water system at the time each parcel is developed. 4. Sewage disposal shall be through the City of Huntington Beach's sewage system at the time each parcel is developed. S. The water, sewer, and fire Hydrant system shall be approved by the Department of Public Works and Fire Department. 6. The property shall participate in the local drainage assessment district at the time each parcel is developed. 7. All utilities shall be installed underground at the time each parcel is developed. 8. All applicable City Ordinances shall be complied with. 9. A Parcel Map shall be filed with the City and recorded prior to framing inspection of any structures on any parcel. 10. The Division of Land shall not be effective until an agreement is signed and recorded agreeing to the conditions listed above. Easements for utilities or walkways shall be provided to Department of Public Works standards. 3. The property shall participate in the local drainage asses- ment district. 4. Soil reports as required by. the Building Department and the Department of Public Works shall be submitted to the City prior to issuance of building permits. S. There shall be no fence, structure or landscaping construct- ed or maintained over 3 1/2 feet high within a 10 ft. by 10 ft. triangular area at the intersection of driveways and streets or within a 25 ft by 2S ft. triangular area at the intersection of streets. 6. No structures, other than those shown on the approved plot plan, shall be constructed within the project. 7. All Private streets shall meet the minimum standards for apartment developments as adopted by the Planning Commission. 8. The structural street section of all private drives shall be approved by the Department of Public Works. 9. All applicable City Ordinances shall be complied with. 10. Holland Drive shall be terminated as shown on plan submitted subject to the Department of Public Works standards, to prohibit vehicular traffic of any nature. 11. CONDITIONAL EXCEPTION NO. 71-7(a) Applicant: Henry & Louise Leftige To allow 583 s ft. of open space with a 15.5 ft. dimension within the rear 2�3 of a 27 ft. by 122.5 ft. R2 lot in lieu of the required 900 sq. ft. of open.space and minimum dimension of 20 ft. Also to allow the garage to be located within 5 ft. of the exterior property line in lieu of the minimum 6 ft. setback required by ordinance. The subject pro- perty is located on the Northeast corner of Delaware St. and Knoxville Ave. The hearing was opened to the audience. Tom Wilson, representing the appli- cant, addressed the Board and explained the request. hearing was closed. There being no other comment, the Board discussion followed. The applicant shall dedicate sufficient property for a 20 ft. radius curve at intersection of Knoxville Ave. and Delaware St. for street right-of-way. AND FOR THE REASON: 1. CONDITIONAL EXCEPTION NO. 71-25 , Applicant: Glenn C. Brockman To allow an industrial building to be constructed to within 40 ft. of property zoned and developed as Rl Single Family Residence District, in lieu of the requirement that said structure set back 45 ft. In Conjunction With ADMINISTRATIVE REVIEW NO. 71-18 Applicant: Glenn C. Brockman To permit an M-1 Building to be located 40 ft. from adjacent effective residential property line. The subject property is located at the end of Murdy Circle, approximately 400 ft. from Gothard St. in the M1 Light Industrial District. The hearing was opened to the audience. Mr. Brockman, applicant and Mr. Riley, architect, addressed the Board and explained the re- quest. Mr. and Mrs. Lenell, adja- cent property owners, addressed the Board and stated that the noise level within the existing industrial development was impos- sible to live with and it was impossible to sell their home be- cause of excessive noises. Mr. Lenell informed the Board that this type of construction will reduce the noise level. The following requirements of the Huntington Beach Ordinance Code were discussed with the applicant: 1. Murdy Circle shall be dedicated and fully improved to City Standards at the time each parcel is developed. Improvements shall include street trees, street signs, street lights, fire hydrants, sewer and water main extensions. 2. Water supply shall be through the City of Huntington Beach's water system. 3. All buildings on lots abutting a City easement shall be set back five (5) feet from the edge of such easement. 4. The flood control channel shall be fenced to Flood Con= trol District standards and City standards. S. The property shall participate in the local drainage assessment districtt. 6. Soil reports as required by the Building Department and the Department of Public Works shall be submitted to the City prior to issuance of building permits. 7. The subject property is located on the south side of Warner St., from 633 ft. to 970 ft. west of Goldenwest St. Dave de Pierro and Bill Bethmann, representing the applicant, addressed the Board and explained their request. The acting secretary informed the Board that the applicant has filed a Use Permit which should be heard in conjunction with this Division of Land. Board discussion followed.
