1. This tract was originally constructed with 20 ft. setbacks for
garages entered directly from the street.
2. It has been the policy of the Board to approve this type of
request where substantial justification has been shown.

It was noted by the Acting,
Secretary that the Board has not approved any car washes other than
at intersections. This request would fall under the Service Station
Standards, therefore must be referred to the Planning Commission for

7:00 P.M. WITH THE BOARD'S RECOMMENDATION THAT THE PLOT PLANS RE-
CEIVED WERE ACCEPTABLE WITH CONDITIONS AS SUGGESTED.

To permit a reduction in the open
space requirement from 900 sq. ft. to 784 sq. ft. for a dwell-
ing. The subject property is located at 10362 Monitor Dr. in
'che R1 Single Family Residence District.
The hearing was opened to the
audience.
Mr. and Mrs. Capozzi addressed
the Board and explained their request. A petition was pre-
sented to the Board signed by adjacent neighbors who were in
favor of the proposal. Mr. Capozzi listed reasons why it
would be a hardship for them to construct the addition within
the code requirements: 1) to add a second story would be
financially unfeasible; 2) adding on to the front of the
dwelling would require relocating the driveway, plumbing and
renovations that would be financially unfeasible; 3) addi-
tional living space is needed due to a growing family; 4)
total usable recreation area equals 1124 ft.
There being no further comment,
the hearing was closed.

AND SECONDED BY PALIN TO APPROVE CONDITIONAL EXCEPTION NO.
71-34 WITH THE FOLLOWING CONDITION:
1. A minimum of 800 sq. ft. of open space shall be provided
in the rear yard and the area to the rear of the new addition
shall be developed as recreation area.

1. The applicant can provide 800 sq. ft. of open space with
minimum dimension of 20 ft. in addition to a 300 ft. open
space behind the proposed room addition which can be used for
recreation.

AND SECONDED BY MCFARLAND TO DENY CONDITIONAL EXCEPTION NO. 71-35
FOR THE FOLLOWING REASONS:
1. Granting a 6 ft. rear yard setback from an arterial highway
would set a precedent.
2. The applicant has not sufficiently justified the request.
3. A room addition of approximately the same sq. f t. can be con-
structed which would comply with all requirements of the Huntington
Beach Ordinance Code.

and explained the request. The Board discussed with the applicant
suggested conditions of approval.

LAND AND SECONDED BY LOVEJOY TO APPROVE DIVISION OF LAND NO. 71-14
WITH THE FOLLOWING CONDITIONS:
1. The plot plan received April 28, 1971 shall be the approved
layout.
2. All applicable conditions of Tentative Tract Map 6948 shall be
complied with.
3. Commerce Lane shall be dedicated and fully improved to City
standards at the time each parcel is developed. Improvements shall
include street trees, street signs, street lights, fire hydrants,
sewer and water main extensions.
4. Water supply shall be through the City of Huntington Beach's
water system at the time each parcel is developed.
S. Sewage disposal shall be through the City of Huntington Beach's
sewage system at the time each parcel is developed.
6. The property shall participate in the local drainage assessment
district at the time each parcel is developed.
7. All utilities shall be installed underground at the time each
parcel is developed.
8. All applicable City Ordinances shall be complied with.
9. A Parcel Map shall be filed with the City and recorded prior
to framing inspection of any structures on any parcel.
10. The Division of Land shall not be effective until an agreement
is signed and recorded agreeing to the conditions listed above.

To permit the construction of
a 22 unit apartment complex on a parcel of land having 11,750
sq. ft. of area in lieu of the maximum 12 units permitted by
ordinance. The subject property is located on the southwest
corner of 15th St. and Pecan Ave. in the R3 Limited Multiple
Family Residence District.
There was no one present to represent
the applicant.
The acting secretary informed the
Board that the applicant had telephoned about the meeting at
which time the suggested conditions and requirements of the
Huntington Beach Ordinance Code were reviewed with him.

2. Fifteenth St. and Pecan Ave. shall be dedicated and fully
improved to the City standards at the time each parcel is
developed. Improvements shall include street trees, street
signs, street lights, fire hydrants, sewer and water main
extensions.
