This conditional exception will result in an increase in density from one unit for each 950 sq., ft. of lot area to one unit for each 534 sq. ft. of lot area. - The subject property is located on the north side of 16th Street, east of Olive Avenue in the R4 Multiple Family Residence District. TENTATIVE TRACT MAP NO. 7421 - 143 lots on 36.7 acres of land In Conjunction With CONDITIONAL EXCEPTION NO. 71-29 Applicant - Green Hills Development, Inc. To allow lots within an R1 Subdivision to have panhandle (flag) lots with a minimum of 20 ft. of frontage in lieu of the required 45 ft, of frontage for cul-de-sac and knuckle lots. The subject property is located on )the southwest corner of Clay Avenue and Goldenwest Street in the R1 Single Family Residence District. The hearing was opened to the audience on Conditional Exception No. 71-29, Bill Lusk, developer, addressed the Commission and offered to answer questions. Commissioner Bazil stated that he is opposed to panhandle lots because this design eliminates those large lots normally found on cul-de-sac streets. - G.B. Hardy, 19441 Surfdale Lane, Huntington Beach, and H.D. Andrews, 1118 Pacific Coast Highway, Huntington Beach, opposed the request on grounds that this proposal will create traffic problem and increase the density in the area. There being no other comment the hearing was closed. Chairman Slates stated that the Commis- sion should permit this particular request to serve as an experimental pro- ject to determine whether or not this type of development is;desirable. Commissioner Porter stated that he is in agreement with flag lots adjacent to the golf course a4 this design maximized the number of view lots but that those flag lot3 within -.the in- terior of the subdivision and those backing up to Goldenwast Street.were undersirable. w Commission discussion followed. The minimum area of flag lots exclusive of street approach extension shall be 6000 sq. ft. The minimam+► dimension of the building site so described shall be 60 ft. x 100 ft. 2. Panhandle lots shall only be permitted abutting the golf course. 3. The lots on F. G and H Street shall be redesigned as standard lots. AND FOR THE FOLLOWING REASON: 1. The golf course frontage will create a unique situation and will not be detrimental to the neighborhood. A MOTION WAS MADE OY SLATES AND SECONDED BY PORTER TO APPROVE TENTATIVE TRACT MAP NO. 7421 UPON THE FOLLOWING CONDITIONS: 1. The tentative map received May 10, 19719 shall'be the approved layout. 2. A petition for rezoning to remove the "0" designation from property not under oil production shall be filed prior tq submitting a final map to the City Council for acceptance. 3. Provisions shall be made to provide planters and landscaping along Goldenwest Street similar to the planters and landscaping south of subject tentative tract. 4. The oil operation site located on lot 86 and on lots 64, 65 and 66 shall be enclosed with a six (6) ft. high masonry wall and landscaped. A plan showing the,wall location and proposed landscaping shall be sub- mitted to the Planning Department for approval. The oil operation on lot 9 located at the southwest corner of Clay Avenue and Goldenwest Street whall be screened and landscaped ip A manner approved by the Planning Commission, 5. An agreement for miaintenance of the oil lines within the street right- of-way shall be entered into with the City and approved by the Depart- ment of Public Works and City Attorney's office. 6. The plot plan for the homes constructed on flag lots and lots adjacent to the flag lots shall be substantially the same as shown on the typical layout on file in the Planning Department. 7. A revised map shall be submitted to the Planning Department incorporating the above conditions. 8. All standard conditions of approval that are applicable shall be complied with. George Stringer, engineer for the developer, stated that this proposal will be a good plan as it relates to freeway and the Master Plan. Mr. Stringer informed the Commission that the developer has reduced the area and density of -the R2 proposal. r , -4- 5/18/71 - PC Minutes: H.B. Planning Commission Tuesday, May 18, 1971 Page 5 Bob Dingwall, representing the Home Council, opposed the request on grounds that the people in the area would prefer single family residences or planned residential development rather than the apartments of conventional type. Mr. Dingwall further asked for continuance so the homeowners in the area could meet with the developer to work out these problems. Henry Ruley, 17941 Orkney Circle, Huntington Beach, submitted a petition signed by 964 property owners opposing the request. Mr. Ruley stated that he is opposed to the R2 portion of the request. Chairman Slates informed Mr. Ruley that the Master Plan reflects medium density for this area. Richard Nelson, 6261 Braemar Drive, Huntington Beach, stated that he is opposed to the request on grounds that the density will considerably increase demands on utilities and services. Mr. Nelson questioned whether there is sufficient utility service available to serve this development and surrounding property. Russell Meltzer, 5742 Padua Drive, Huntington Beach, stated that he is opposed, because it will in- crease traffic problem, trash collection and police protection. He further pointed out that schools will be taxed considerably and that students will have to be transferred to other schools. Alice Tannler, 17672 Wrightwood Lane, Huntington Beach, opposed the request. Mrs. Tannler stated that there should be more parks and schools provided in this area instead of apartments. Charlene Bauer, 16911 Bedford Drive, Huntington Beach, suggested that the entire Signal property be planned at one time. Roberta Doolittle, 5332 Kellingsworth Drive, Huntington Beach, asked the Commission how this project will effect their taxes. Richard Raun, 17612 Collie Lane, Huntington Beach, stated that he feels the future freeway should serve as a buffer rather than the R2. There being no other comment the hearing was closed. Commissioner Kerins stated that R2 zone should border the freeway at a ratio of 3 single family units to each apartment unit and`not be allowed to extend to Edwards Street. Also, that more discussion regarding this project should be done with the school district. Commissioner Duke,agreed with Mr. Kerin's statement. Commission discussion followed. ZONE CASE NO. 71-12 RESOLUTION OF INTENT A change of zone from RA Residential Agricultural District to R1 Single Family Residence District, RA-0 Residential Agricultural District combined with oil production to RI Single Family Residence District, RA-01 Residential Agricultural District combined with oil production to R1 Single Family Residence District, R5 Office -Professional District to MH Mobilehome District. The subject property is bounded by Beach Boulevard on the west, Garfield Avenue on the north, Indianapolis Avenue on the south, and the Santa Ana River on the east. Jere Murphy, Associate Planner, made a presentation of the proposal. Mr. Murphy stated that the subject zone change proposes to rezone several parcels within Study Area "A", to conform to the proposed Master Plan of Land Use. The hearing was opened to the audience. Two property owners addressed the Com- mission and opposed the proposal on grounds that there is a need for more open space, parks and schools. There being no other comment the hear- ing was closed. CONDITIONAL EXCEPTION NO. 71-26 Applicant - B.G. Williams To permit the construction of third units with 125 sq. ft. less than the required 2,000 sq. ft. of lot area. The subject property is located on the south side of Palm between 15th and 16th Streets. The hearing was opened to the audience. Bob Williams, applicant, addressed the Commission and explained the proposal. Leonard Wright, 606 15th Street, submitted a petition signed by 13 property owners in the area opposing the request. Mr. Wright also stated that he would like to know the quality of proposed buildings. There being no other comment the hearing was closed. Commission discussion followed. The applicant shall dedicate sufficient right-of-way to facilitate curb returns at the intersection of 15th and 16th Streets with Palm Avenue. 2. An additional 2� ft. of right-of-way shall be dedicated to the city for widening the alley. 3. All applicable City ordinances shall be complied with. AND FOR THE FOLLOWING REASON: 1. Day To permit the construction of two additional one -bedroom units and a four car garage on a parcel of land having 5875 sq. ft. or 1958 sq. ft. of lot area per unit in lieu of the required 2000 sq. ft. of lot area per unit. Also to permit the required usable open space to have a minimum dimension of 15 ft. in lieu of the required 20 ft. The subject property is located on the west side of 13th Street, approximately 80 ft. north of the centerline of Acacia Avenue in the R2 Two Family Residence District. The hearing was opened to the audience. Herbert Day, applicant, addressed the Commission and explained his request. Two petitions signed by 7 property owners, opposing the request were submitted to the Secretary. One petition signed by Mr. Ralph Moore endorsing the request was read by the Secretary. Lyndon Wells, Jr., 610 - 13th Street, Huntington Beach, and Charles Miller, 609 - 12th Street, Huntington Beach, addressed the Commission and spoke in favor of said request. David Borkenhagen, 623 - 13th Street, Huntington Beach, stated that the request does not meet minimum requirements and, if approved, the traffic will be increased considerably. Monte Cole, 613 - 13th Street, Huntington Beach, also opposed said request on grounds that the density in the area would be increased. Mr. Cole further stated that this proposal will be detrimental to the surrounding area. There being no other comment the hearing was closed. Commission discussion followed. The Acting Secretary stated that it was the consensus of the Staff that because the applicant has provided 230 sq. ft. more open space than required, and because the reduce dimension of 15 ft. only applies to a portion of this open space, approval of this portion of the request appears reasonable. CODE AMENDMENT NO. 71-8 USE PERMIT 5(R2), 9(R3), and 15 (R4) Said amendment proposesto: 1. Require a Use Permit where five (5) or more dwelling units are proposed for construction in the R2 Two Family Residential District and require compliance with the latest Standards for Apartment Developments; 2. Require a Use Permit where nine (9) or more dwelling units are proposed for construction in the R3 Limited Multiple Family Residence District and require compliance with the latest Standards for Apartment Developments; and, 3. Require a Use Permit where fifteen (15) or more dwelling units are proposed for construction in the R4 Multiple Family Residence District and require compliance with the latest Standards for Apartment Developments. A MOTION WAS MADE BY DUKE AND SECONDED BY MILLER TO RECOMMEND APPROVAL OF CODE AMENDMENT NO. 71-8 TO THE CITY COUNCIL. USE PERMIT NO. 71-20 - Referred by the Board of Zoning Adjustments Applicant - Grossman Crawford To permit the construction of a modern full service car wash with the sale of gasoline. The subject is located on the west side of Beach Boulevard, 150 feet south of Edinger Avenue in the C4 Highway Commercial District. Jim Palin, Associate Planner, reviewed the plot plan with the Commission. Mr. Palin pointed out that landscaping will be required along Beach Boulevard, and that there are existing curb cuts along Beach Boulevard which will have to be reconstructed to restrict access. A MOTION WAS MADE BY DUKE AND SECONDED BY BAZIL TO APPROVE USE PERMIT NO. 71-20 UPON THE FOLLOWING CONDITIONS AS AMENDED: 1. The plot plan received April 23, 1971, shall be the approved layout. 2. The property shall participate in the local drainage assessment district. 3. Soil reports as required by the Building Department and the Department of Public Works shall be submitted to the City prior to issuance of building permits. 4. Parking compounds shall be screened with a combination of fencing and landscaping. Said plan shall be approved by the Planning Department. 5. No structures, other than those shown on the approved plot plan, shall be constructed within the project. 6. A minimum 24 inch high wall shall be constructed along the front of the proposed building extending southerly to the south property line. 7. The height of the identification sign shall not exceed 35 feet. 8. All applicable City Ordinances shall be complied with. The Acting Secretary pointed out to the Commission that for information purposes, the following requirements of the Huntington Beach Ordinance Code must also be complied with for Use Permit No. 71-20: 1. Beach Boulevard and Aldrich Street shall be dedicated and fully improved to City and/or State standards at the time each parcel is developed. Improvements shall include street trees, street signs, street lights, fire hydrants, sewer and water main extensions. 2. Water supply shall be through the City of Huntington Beach's water system. 3. Sewage disposal shall be through the City of Huntington Beach's sewage system. 4. The water, sewer, and fire hydrant system shall be approved by the Department of Public Works and Fire Department. 5.
