The subject property is located on the north side of llth Street and east of Orange Avenue in the R3 Limited Multiple Family Residence District. The Acting Secretary informed the Commission that the applicant agreed to continuance of Conditional Exception No. 71-24 in order to allow time for a committee of the Commission to review the proposed standards for the town lot area. A MOTION WAS MADE BY DUKE AND CONDITIONAL EXCEPTION NO. 71-24 THE AFOREMENTIONED REASONS. Miller, Duke, Kerins, Porter TENTATIVE TRACT MAP NO. 7442 Subdivider: The McMichael Co., Inc. Twenty-five lots on 6.64 acres of land located on the north side of Oswego Street, between Huntington and Delaware Avenues. -1- 6/15/71 - PC Minutes: H. B. Planning Commission Tuesday, June 15, 1971 Page No. 2 The Commission reviewed the Subdivision Committee Report. The Acting Secretary informed the Commission that Section 9921.6 (m) of the Huntington Beach Ordinance Code requires: "If the subdivision is within a known oil field the map shall include the location of all existing oil wells and appurtenances and „a plan of their disposition or treatment including abandonment,_ underground placement, screening, fencing, landscaping, conversion of pumping units, etc. Such plan shall include disposition or treatment of all future wells, drill sites and operations. -Such plan shall also include the written concurrence of the oil lessee or operator conderned". Mr. Harlow pointed out that the applicant has not provided this information. Also, that the Oil Field Department has requested that the sump and/or rotary mud on Lot No. 9 be moved. The Commission held a discussion. A MOTION WAS MADE BY SLATES AND SECONDED BY BAZIL TO REFER TENTATIVE TRACT MAP NO. 7442 BACK TO THE SUBDIVISION COMMITTEE. THAT MOTION WAS WITHDRAWN. IT WAS POINTED OUT THAT THE APPLICANT MUST AGREE TO A CONTINUANCE OR THE MAP IS DEEMED APPROVED ACCORDING TO THE SUBDIVISION MAP ACT. A FURTHER MOTION WAS MADE BY DUKE AND SECONDED BY PORTER TO DENY TENTATIVE TRACT MAP NO. 7442 FOR THE FOLLOWING REASONS: 1. The applicant was neither present at the Subdivision Committee meeting nor at the Planning Commission meeting. 2. There are several concerns of the Planning Commission as expressed in the Subdivision Committee Report. MASTER PLAN OF LAND USE AMENDMENT NO. 71-2 - Continued A master plan of land use generally bounded on the north by Garfield Avenue, on the east by by the Santa Ana River, on the south by the Pacific Ocean, on the west by Beach Boulevard, and on the northwest by the proposed Route 1 Freeway. ZONE CASE NO. 71-13 - Continued Resolution of Intent A Ehange of zone from RA-0 Residential Agricultural District Combined with Oil Production -to - RI Single Family Residence District; R2 Two Family Residence District to R1 Single Family Residence District; R2-0 Two Family Residence District with Oil Production to R1 Single Family Residence District; RA-0 Residential Agricultural District Combined with Oil Production to R2 Two Family Residence District; R3 Limited Multiple Family Residence District to R2 Two Family Residence District; R5 Office - Professional District to R2 Two Family Residence District; and C4 Highway Commercial District to RA Residential Agricultural District. -2- 6/15/71 - PC Minutes: H. Planning Commission Tuesday, June 15, 1971 Page No. 3 The subject property is bounded by Beach Boulevard on the west, Indianapolis Avenue on the north, Pacific Coast Highway o_ni the south, and the Santa Ana River on the east__ _ ZONE CASE NO. 71-19 Resolution of Intent A Resolution of Intent of the Planning Commission to change the zone of property located on on the east side of Bushard Street, approximately 170 feet south of Hamilton Avenue from RA Residential Agricultural District to R1 Single Family Residence District. The Acting Secretary informed the Commission that Master Plan of Land Use Amendment No. 71-2, Zone Case No. 71-13 and Zone Case No. 71-19 should be considered under one public hearing. Also, that action on Zone Case 71-13 and Zone Case No. 71-14 should be taken before the Commission acts on Master Plan Amendment No. 71-2 The hearing was opened to the audience on all three items. Marshall Zolla, Attorney, represent- ing the property owner west of Bushard Street and north of the Orange County Flood Control channel, stated that he did not have all the information regarding this proposal and did not have sufficient time to prepare a presentation. Mr. Deeble, property owner on the east and west side of Brookhurst-Street, north of Banning Avenue, requested that the Commission consider an R2 zone on the west side of Brookhurst Street. Mr. Deeble sug- gested that the zone on the east side of Brookhurst Street should be retained until they determine what can be done with the property. Neal Thomas and John Fearnley spoke in favor of the proposed zone change. Joe Deeble, 19 Rancho View Road, Rolling Hills, stated that the city is in need for multiple zoning. Robert Bogner, property owner in Huntington Beach, spoke in favor of the proposed R1 changes. There beinggno other comment the hearing was closed. Commission discussion followed. A MOTION WAS MADE BY DUKE AND SECONDED BY KERINS TO RECOMMEND APPROVAL OF ZONE CASE NO. 71-19 TO THE CITY COUNCIL FOR THE FOLLOWING REASON: 1.- The proposed zone change will be compatible with the surrounding area. A MOTION WAS MADE BY DUKE AND SECONDED BY KERINS TO RECOMMEND APPROVAL OF ZONE CASE NO. 71-13 TO THE CITY COUNCIL EXCEPT THE TRIANGULAR AREA BOUNDED BY BROOKHURST STREET ON THE WEST, THE EASTERLY EXTENSION OF BANNING AVENUE ON THE SOUTH, THE SANTA ANA RIVER ON THE EAST AND ON THE NORTH BY A LINE PARALLEL TO AND 1320 FT. The subject property is located on the west side of Beach Boulevard and south of -Talbert Avenue. The hearing was. -opened to the audience. Donald Jones, agent for the applicant, explained the proposal. There being no other comment the hearing was closed. Commission discussion followed. `� _ ' A MOTION WAS MADE BY SLATES AND SECONDED BY BAZIL TO RECOMMEND APPROVAL OF ZONE CASE N0. 71-14 TO THE CITY -COUNCIL, EXCEPT THE WESTERLY 54 FEET THEREOF FOR THE FOLLOWING REASON: 1. The area is master planned for medium density and high density residential development. However, the master-plan,is presently -being reviewed and this property is tentatively designated for ---..commercial use along Beach Boulevard to a depth approximately------ 600 feet. ZONE RASE NO. 71-16 Applicant: Gladys Bealo To permit a change of zone from RA Residential Agricultural District to R3 Limited Multiple Family -Residence District. Donald Jones, representing the applicant,_stated that he realizes that the subject property is within Phase III of the proposed central park. Mr. Jones stated that the property is master planned high density and that the applicant is proposing to build 22 units per acre. Mr. Jones further stated that he would like continuance of Zone Case No. 71-16 to give the staff an opportunity to study this area. There being no other comment the hearing was closed. Commission discussion followed. It was pointed out that Talbert Avenue will be rerouted through the northerly 1/3 of the property in question and, the mushroom plan on the east side of Golden West Street is a heavy intense use. A MOTION WAS MADE BY MILLER AND SECONDED BY PORTER TO CONTINUE ZONE CASE NO. 71-16 TO SEPTEMBER S, 1971, IN ORDER THAT THE STAFF MAY HAVE TIME TO STUDY THE AREA. CONDITIONAL EXCEPTION NO. 71-35 - Appealed by Commissioner Duke Applicant: John H. Kay To permit the construction of a room addition to within 6 feet of rear property line in lieu of the required 10 foot rear yard setback in the R1 Single __Family_Residence District. The subject property is located at 9771 La Cresta Circle, Huntington Beach, California. The hearing was opened to the audience. Ben Londerea, representing the applicant, explained reasons for the request. John Kay, applicant, addressed the Commission and explained the proposal. Charles Willits, adjacent property owner spoke in favor of the proposed room addition. There being no other comment the hearing was closed. Commission discussion followed. A MOTION WAS MADE BY PORTER AND SECONDED BY BAZIL TO DENY CONDITIONAL EXCEPTION NO. 71-35 FOR THE FOLLOWING REASONS: 1. The applicant has not demonstrated sufficient hardship. 2. CONDITIONAL EXCEPTION NO. 71-32 Applicant: Garfield Convalescent Hospital To_permit_a portion —of an existing convalescent hospital to be used for the care of mentally retarded. The subject property is located approximately 300_feet west of Florida Street, north side of Garfield Avenue, in the R2 District. The Secretary received a letter submitted by Robert Zinngrabe, the owner of Garfield Conva- lescent Hospital, endorsing the proposal. The hearing,..was opened to the audience. Representative for the applicant explained the request. He pointed out that there is no other hospital nearby to facilitate mentally retarded persons except Fairview State Hospital in Costa Mesa. Also, that the re- quest would care f6r patients of age 5 throught_21. There being no other comment the hearing was closed. Commission discussion followed. A MOTION WAS MADE BY SLATES AND SECONDED BY MILLER TO CONTINUE CONDITIONAL EXCEPTION NO. 71-32 TO JUNE 29, 1971, STUDY SESSION FOR DECISION ONLY. ALSO, THAT ROBERT VASQUEZ, ASSISTANT PLANNER INTERVIEW THE APPLICANT REGARD- _ ING THE NUMBER OF RETARDED PEOPLE TO BE ACCOMOISATED-AND WHAT TYPE OF FACILITY WILL BE PROVIDED FOR SUCH PATIENTS. To permit a temporary parking lot in the R5 Office -Professional Business District. The subject property is located on the northwest corner of Brookhurst Street and Pacific Coast Highway. The hearing was opened to the audience. Roger Summers, represent- ing the applicant, informed the Commission that someone will be on duty all week, except at night. A MOTION WAS MADE BY KERINS : AND SECONDED BY DUKE TO DENY CONDITONAL EXCEPTION NO. 71-33 FOR THE FOLLOWING'REASONS: 1. The applicant has not shown sufficient hardship. 2. This use will not be beneficial to citizens of Huntington Beach. 3. The proposed parking lot will not help the parking problem in this area. USE PERMIT NO. 69-33 (a) Applicant: Huntington Shorecliffs Request from Huntington Shore - cliffs to be relieved of'the requirement that _they__provide_ mobile homes of unique exterior construction of roof lines along Beach Boulevard. This request is in connection with Use Permit No. 79-33 (a) which permitted construction of a mobilehome park on the west side of Beach Boulevard south of Frankfort Street. The Commission reviewed the request. Commissioner Porter stated that he feels the units should be staggered, i.e, every third unit to side on Beach Boulevard, and that the area between the unit and the wall should be planted in 'trees. Bob McIntosh, representing the applicant explained the request. It was the consensus of the Commission to continue this item to a study session on June 29, 1971, in order to review a new plot plan to be submitted by the applicant showing landscaping and variations in set- back of the mobilehomes. DISCUSSION: Chairman Slates suggested that the Commission adopt a resolution opposing the passage of AB 2294 regarding the location of mobilehomes and mobilehome parks and adoption by ordinance of land use standards for mobilehome parks, travel trailer parks, recreational trailer parks, temporary trailer parks and tent camps including minimum land parcel area, perimeter land parcel setbacks, perimeter landscaping, walls, signs, and access area criteria that should be estab- lished by either a city or county. -7- 6/15/71 - PC' Minutes:, H.`B.
