ELECTION OF OFFICERS: Pursuant to Section 2 of the Bylaws o e oard, election of officers was held. A MOTION WAS MADE BY PALIN AND SECONDED BY SPENCER TO APPOINT DAN MCFARLAND AS CHAIRMAN. THE MOTION CARRIED. A MOTION WAS MADE BY PALIN AND SECONDED BY MCFARLAND TO APPOINT CHARLES SPENCER VICE-CHAIRMAN. THE MOTION CARRIED. AGENDA ITEMS TO BE CONTINUED OR WITHDRAWN: USE PERMIT NO. 71-29 (Continued) Applicant: Fredricks Development Corp. To permit the construction of a 232 unit apartment complex pursuant to Section 9202.3.1.3 of the Huntington Beach Ordinance Code. The subject property is located at the southwest corner of Atlanta Ave. and Newland St. in the R3-0 Limited Multiple Family Residence District combined with oil production. audience. Mr. Severa stated he had made a comparative analysis of his development with the adopted March 9, 1971 Apartment Standards as follows: 1. The units would have to be reduced from 232 in number to 187. 2. Floor area on some of the units are less than minimum requirements. Some one bedroom units have 650 sq. ft. Some of their two bedroom units have 804 sq. ft. as opposed to 900 sq. ft. required. Some of their three bedroom units have 976 sq. ft. and 1049 sq. ft. where the Apartment Standards require 1100 sq. ft. 3. Garage doors on individual garages; carports only on side as long as there are no public alleys. 4. Open space - 57990 sq. ft* shown on plan - 46000 sq. ft. required, by ordinance; 54000 required in the new Stan- dards. His plan'shows an excess of open space. 5. Parking appaaces now reqquuired - 381. Have provided 404. Parking along the, Lie curb would have to be deleted thereby reducing the parking to 371. It was noted by the Acting Secretary that it is the policy of the City that the Board apply standards on all applications after adoption by the Planning Commission: Mr..-Severa requested that either the Board act on his plan today or that it be referred to the Planning Commission because of the length of time that had elapsed since the original application had been filed with the City. Board of Zoning Adjustments July 28, 1971 Page 3 CONDITIONAL EXCEPTION NO. 71-47 Applicant: Frank Woolsey To allow: 1) An average 10 ft. front yard setback for the total building width with a minimum of 5 ft. front yard setback on less than 50% of the building width in lieu of the required 10 ft. front yard setback; 2) allocating open space into two areas, one area to be situated within the front 1/3 of the lot with a mini- mum dimension of ten (10) ft. and the remaining open space to be located within rear 2/3 of lot with a minimum dimension of ten (10) ft, in lieu of the required 600 sq. ft. of open- s all on hg rear 2/3 of the lot. The Board discussed the possibility of including the balcony as open space providing it were stipulated as private. Also that the upstair units be pro- vided with private balconies. A MOTION WAS MADE BY MCFARLAND AND SECONDED BY PALIN TO APPROVE CONDITIONAL EXCEPTION NO. 71-47 WITH THE FOLLOWING CONDITIONS: 1. The applicant shall provide additional balcony area for units over garages. 2. The balcony shown on the front of structure shall be designated as private rather than entrance -exit. The Planning Commission has approved a code amendment that would allow this type of construction. USE PERMIT NO. 71-31 Applicant: Standard Oil Company To permit the drilling and operating for the discovery or production of oil, gas, hydrocarbons and/or kindred substances in their natural state, including the installation and use of equipment, structures, tools and other facilities incidental, necessary, and accessory to the drilling, production, repressuring and processing of substances produced by such wells for shipment to pipeline. __.The subiect property_ts located approximately 3000 ft. northwest of Goldenwest St. and Orange Avenue in the R4-01 Multiple Family Residence District combined with oil production. The hearing was opened to the audience. There was no one present to represent the applicant. There being no comment, the hearing was closed. Board discussion was held. USE PERMIT N0. 71-32 ADolicant: Standard Oil Co. of Calif. To permit the drilling and operating for the discovery or production of oil, gas, hydrocarbons and/or kindred substances in their natural state, including the Anstallation and use of equipment, structures, tools and other facilities incidental, necessary; and accessory to the drilling, production, repressuring and pro- cessing of substances produced by such wells for shipment to pipeline. The subject property is located at the northern -corner of 17th St. and Palm Ave. in the C1-01 Neighborhood Commercial District combined with oil production. The hearing was opened to the audience. A MOTION WAS MADE BY PALIN AND SECONDED BY SPENCER TO APPROVE USE PERMIT NO. 71-32 WITH THE FOLLOWING CONDITIONS. 1. The plot plan received July 14, 1971 shall be the approved layout. 2. Condition no. 9 of the conditions of approval for Tentative Tract No. 7155 shall be complied with. 3. All applicable provisions of the Huntington Beach Ordinance Code shall be complied with. To allow a legal parcel of land to be separated into two legal parcels. The subject property is located on the east side of Edwards St., approximately 800 ft. north of Warner Ave. Tom Shelton and John Spiak addressed the Board and explained the request. Board discussion was held. A MOTION WAS MADE BY PALIN AND SECONDED BY MCFARLAND TO APPROVE DIVISION OF LAND NO. 71-25 WITH THE FOLLOWING CONDITION: 1. Board of Zoning Adjustments July 28, 1971 Page 5 ADMINISTRATIVE REVIEW NO. 71-44 Applicant: Jagur Tractor To permit the storage of motor vehicles, trailers, boats, campers, etc. The subject property is located on the north side of McFadden Ave., approximately 250 ft. east of intersection of McFadden Ave. and Gothard St. in the M1 Light Industrial District. Jerry Jackson addressed the Board and explained his request. He stated he wished to install a wash rack on the property for convenience to his customers. It would not be used for commercial purposes. Board discussion was held. A MOTION WAS MADE BY MCFARLAND AND SECONDED BY PALIN TO APPROVE ADMINISTRATIVE REVIEW NO. 71-44 WITH THE FOLLOWING CONDITION: 1. A masonry wall shall be constructed along the southwesterly portion of the property of the same material as the existing masonry wall. MISCELLANEOUS: The Board reviewed Conditional Exception No. 71-3 with regard to establishing proof that acceptable access was available to the horse stables located at the westerly extension of Taylor Ave. Mr. Rex Reynolds, owner of the stables in question, submitted a document that provided a lease on the parcel ddjacent to his lot and contiguous to Taylor Ave. It was the consensus of the Board that a lease on the adjoining parcel provided adequate access to Taylor Ave. and therefore, was acceptable in satisfying condition no. 7 of Conditional Exception No. 71-3.
