WEDNESDAY, AUGUST 4, 1971 BOARD MEMBERS PRESENT: Vasquez, Spencer, Lipps BOARD MEMBERS ABSENT: None MINUTES: The acceptance of the minutes for March 24, 1971 was continued to August 11, 1971. CONDITIONAL EXCEPTION NO. 71-9 Review (Continued) Applicant: David E. Miller This item was referred to the Board of Zoning Adjustments for review of the landscape plan and to establish conditions as deemed necessary. Mr. David Miller addressed the Board and explained his plans. The Board reviewed the plans and applied the following conditions: 1. All applicable City ordinances shall be complied with. 2. Plans of the masonry walls shall be submitted to the Planning Department for review. DIVISION OF LAND NO. 71-24 (Continued) Applicant: C S T Engineering Company To permit the division of a legal parcel of land into two legal parcels. The subject property is located on the southeast corner of Brookhurst Street and Atlanta Avenue. Mr. Walden, representing the applicant, addressed the Board and explained his request. He submitted proposed plans for the parcel. The Board also reviewed the applicants' development plan and required a re- ciprocal driveway easement. Board discussion was held. A MOTION WAS MADE BY SPENCER AND SECONDED BY VASQUEZ TO APPROVE DIVISION OF LAND NO. 71-24 WITH THE FOLLOWING CONDITIONS: 1. The plot plan and development plan received July 20, 1971 and July 29, 1971 shall be the approved layouts, respectively. 2. Atlanta Avenue and Brookhurst Street shall be dedicated and fully improved to City and/or State standards at the time each parcel is developed. Improvements shall include street trees, street signs, street lights, fire hydrants, sewer and water main extensions. 3. Water supply shall be through the City of Huntington Beach's water system at the time each parcel is developed. 4. Sewage disposal shall be through the -City of Huntington Beach's sewage system at the time each parcel is developed. -1- 8/4/71 - BZA Minutes: H. B. The flood control channel shall be fenced to Flood Control District standards and City standards at the time each parcel is developed. 6. The property shall participate in the local drainage assessment district at the time each parcel is developed. 7. All utilities shall be installed underground at the time each parcel is developed. 8. All applicable City Ordinances shall be complied with. 9. A Parcel Map shall be filed with the City and recorded prior to framing inspection of any structures on any parcel. 10. There shall be reciprocal easements between parcels for ingress and egress. 11. The Division of Land shall not be effective until an agreemen-.: is signed and recorded agreeing to the conditions listed above. ROLL CALL VOTE: AYES: Vasquez, Spencer, Lipps NOES: None ABSENT: None THE MOTION CARRIED. CONDITIONAL EXCEPTION NO. 71-48 Applicant: H. A. Day To permit a cantilever of the second story of a two -unit apartment building to within 1 ft. of the rear property line in lieu of the required 10 ft. setback. The subject property is located on the west side of 13th Street, approximately 80 ft. from the centerline of Acacia Avenue in the R2 Two Family Residence District. The hearing was opened to the audience. Herb Day addressed the Board and explained his request. There being no further comment, the hearing was closed. A MOTION WAS MADE BY SPENCER AND SECONDED BY LIPPS TO APPROVE CONDITIONAL EXCEPTION NO. 71-48 FOR THE FOLLOWING REASON: 1. The Planning Commission has directed the staff to prepare a code amendment allowing this exception. ROLL CALL VOTE: AYES: Vasquez, Spencer, Iipps, NOES: None ABSENT: None THE MOTION CARRIED. CONDITIONAL EXCEPTION NO. 71-49 Applicant: Lyndon A. USE PERMIT NO. 71-33 Applicant: Standard Oil Company To permit the drilling and operating for the discovery or production of oil, gas, hydro- carbons and/or kindred substances in their natural state, including the installation and use of.equipment, structures,' tools and other facilities incidental, necessary and accessory to the drilling, production, repressuring and processing of substances produced by such wells for shipment to pipeline. The subject property is located on Ciay Avenue between Main Street and Goldenwest Street in the C2-01-Community Business District combined with oil production. The hearing was opened.to the audience. Baxter Brown, representing the applicant, addressed the Board and explained the request, and stating this was located within the proposed civic district area. Also, that they had requested a waiver of the masonry wall and that this request had been granted at the Planning Commission meeting August 3, 1971. There being no further comment, the hearing was closed. Board discussion followed. A MOTION WAS MADE BY VASQUEZ AND SECONDED BY SPENCER TO APPROVE USE PERMIT NO. 71-33 WITH THE FOLLOWING CONDITIONS: 1. The plot plan dated July 21, 1971 will be the approved layout. 2. All applicable provisions of the Huntington Beach Ordinance Code shall be complied with. To permit a temporary directional sign to be constructed outside the sales complex within 50 ft. of a residential dwelling in lieu of the requirement that directional signs are to be located within the sales and model home complex when located within a residential development. The subject property is located on the south side of Adams Avenue, 500 ft. west of Brookhurst Street in the R1 Single Family Residence District. The hearing was opened to the audience. to represent the applicant. the hearing was closed. There was no one present There being no other comment, Board discussion was held. A MOTION WAS MADE BY VASQUEZ AND SECONDED BY SPENCER TO DENY CONDITIONAL EXCEPTION NO. 71-SO FOR THE FOLLOWING REASON: 1. No justification has been shown.
