MINUTES: On motion by Slates and second by Higgins, the Minutes of the Huntington Beach Planning Commission of March 23, 1971 were accepted as transcribed and mailed by the Secretary. Bray Board of Zoning Adjustments) To permit one parking space for every 400 sq. ft. of floor_ space in lieu of the present 200 sq. ft.,, pursuant to Article 979. In Conjunction With USE PERMIT NO. 71-3 (Continued - Referred by the Board of Applicant: Wm. C. Bray Zoning Adjustments) To permit the construc- tion of a commercial building in the C4 Highway Commercial District. The subject property is located on the south side of Adams Avenue, approximately 125 ft. west of Huntington Avenue, extending south to Portland Street. Vu-graphs of the subject property were shown. It was noted by the Acting Secretary that revised plans had been submitted which provides the required parking as discussed by the Commission at the previous meeting. to the audience. The hearing was opened Mr. William Bray addressed the Commission and explained the changes he had made in his plans, and that this parking requirements had been met. A MOTION WAS MADE BY SLATES AND SECONDED BY DUKE TO APPROVE CONDITONAL EXCEPTION NO. 71-45 AND USE PERMIT NO. 71-3 WITH THE FOLLOWING CONDITIONS: 1. The plot plan received January 19, 1971 shall be the approved layout. 2. Huntington Street and Portland Avenue shall be dedicated and fully; improved to City standards at the time each parcel is developed. Improvements shall include street trees, street signs, street lights, fire hydrants, sewer and water main extensions. 3. Water supply shall be through the City of Huntington Beach's water system. 4. Sewage disposal shall be through the City of Huntington Beach's sewage system. S. The water, sewer, and fire hydrant_system shall be approved by the Department of ` Publiic Works and Fire Department . __. . 6. All utilities shall be installed underground. 9. Off-street parking facilities shall conform to Article 979. 10. Parking compounds shall be screened with a combination of fencing and landscaping. Said plan shall be approved by the Planning Department. 11. There shall be no fence, structure or landscaping constructed or maintained over 3 1/2 ft. high within a 10 ft. by 10 ft. triangular area at the intersection of driveways and streets or within a 25 ft. by 25 ft. triangular area at the inter- section of streets. 12. No structures, other than those shown on the approved plot plan, shall be constructed within the project. 13. All applicable City Ordinances shall be complied with. AND FOR THE FOLLOWING REASON: 1. Because the building area is based on outside dimensions, the reduction of two parking spaces does not have a detrimental effect on the plan. ZONE CASE NO. 71-29 Applicant: James Nowell Change of zone from R5 Office - Professional District to R3 Limited Multiple Family Residence District. The subject property is located on the south side of Baltimore Street, 130 ft. east of Huntington Avenue. It was noted by the Acting Secretary that the applicant desires a single family residence which is not permitted in the R3 zone but perhaps the applicant would accept an R2 zone which permits single family dwellings. The hearing was opened to the audience. James Nowell, applicant, addressed the Commission stating he was not aware of the restriction on single family construction in the R3 zone and that an R2 zone is acceptable. There being no further comment, the hearing was closed. Commission discussion followed. A MOTION WAS MADE BY SLATES AND SECONDED BY KERINS TO RECOMMEND APPROVAL OF ZONE CASE NO. 71-29 TO THE CITY COUNCIL FOR AN R2 ZONE RATHER THAN AN R3, AS REQUESTED FOR THE FOLLOWING REASON: 1. An R2 zone more closely follows the Top -of -Pier Plan and the present zone is not compatible with the surrounding area. -3- 9/8/71 - PC Minutes: H. B. USE PERMIT NO. 71-11 - Appealed Applicant: Stanley Fann To permit the construc- tion of the following: 1) a 350 seat theatre; 2) avvroxi- mately 8200 sq. ft. of additional retail shop area; and 3) an 800 sq. ft. take-out restaurant. The subject property is located on the northwest corner of Springdale and Warner Avenue. The hearing was opened to the audience. Mr. Bob Sutake, representing the applicant, addressed the Commission, explained the request and stated he felt the development would greatly enhance the general area and would be an asset to the City as there was no similar theater in the City at present. Also, the landscaping would enhance the area. Mr. Sutake, also stated that the County would only give a five-year lease on the property to be used for parking. No one spoke in opposition. Commissioner Porter questioned the legality and the problem of enforcing the parking requirement. There being no further comment, the hearing was closed. Commission discussion followed. A MOTION WAS MADE BY DUKE AND SECONDED BY KERINS TO UPHOLD THE DECISION OF THE BOARD OF ZONING ADJUSTMENTS AND APPROVE USE PERMIT NO. 71-11 WITH,THE FOLLOWING CONDITIONS. 1. Development shall conform to plot plan approved on March 24, 1971. 2. A landscape plan shall be approved by the Department of Public Works. 3. A precise plan for driveway location along Warner Avenue -shall be submitted to the Department of Public Works and the Planning Department. 4. The applicant shall comply with all conditions of approval for Use Permit No. 68-15. 5. Elevations shall be reviewed by the Board of Zoning Adjustments prior to issuance of building permits. 6. Signs advertising the on -site uses shall be submitted to the Board of Zoning Adjustments for approval and shall maintain continuity with the existing structures. 7. The applicant shall guarantee sufficient parking for this shopping center per City requirements. CONDITIONAL EXCEPTION NO. 71-44 Applicant: Wm. H. Thomas To permit the construction of three dwelling units on a lot having 5875 sq. ft. or 1958 sq. ft. of lot area per unit in lieu of the required 2000 sq. ft. of lot areas per unit. Also, to allow garages to setback 3 ft. from the interior property line in lieu of the required 5 ft., and 9 ft. from the exterior side property line in lieu of the required 10 ft. and, to allow second floor dwelling unit to cantilever to the rear property line. The subject property is located at the southeast corner of Palm Avenue and 14th Street. The hearing was opened to the audience. Mr. Thomas, applicant, addressed the Commission and explained his request. the hearing was closed. No one spoke in opposition. There being no further comment, Commission discussion followed. A MOTION WAS MADE BY SLATES AND SECONDED BY BOYLE TO APPROVE CONDITIONAL EXCEPTION NO. 71-44 WITH THE FOLLOWING CONDITONS: 1. The applicant shall dedicate sufficient right-of-way to facilitate the curb radius at the intersection of Palm Avenue and 14th Street. 2. An additional 2 1/2 ft. of right-of-way shall be dedicated to the City for widening the alley. 3. All applicable City Ordinances shall be complied with. AND FOR THE FOLLOWING REASONS: 1. It is the policy of the Planning Commission to allow an additional unit when 3/4 of the required lot area has been provided. 2. The use will not significantly effect the land use pattern in this general area. 3. The reduction of lot width is caused by required street dedication. Marion To permit" an idle well to be reactivated using existing equipment: The subject property is located on the southwest corner of loth Street and Olive Avenue in the R4 Multiple Family Residence District. The Acting Secretary, reviewed with the Commission action on,=a previous application to re -activate this well. The hearing was opened\ to the audience. Mr. A. C. Marion, applicant, addressed the'Commission and related some of the background of this case. No one spoke in opposition. There being no further comment, the hearing wa"s closed. Commission discussion followed. It was determined that the Planning Commission is required to find a hardship. It.was noted by the Commission that this Resolution off Intent was only initiated to allow this request to be heard under the proper procedure and that it did not mean that the outcome -of the zone change was predetermined. • CONDITIONAL EXCEPTION NO. 71-47 Applicant: Ron Montgomery To permit the construction of an addition to an existing office building for architectural and engineering purposes in the RA-0 Residential Agricultural District combined with oil produc- tion. Also, to permit an extension of time for Use Variance No. 758 which allowed said use. A MOTION WAS MADE BY DUKE AND SECONDED BY BOYLE TO APPROVE CONDITIONAL EXCEPTION NO. 71-47 WITH THE FOLLOWING CONDITIONS: 1. Use Variance No. 71-47 shall become null and void on September 1, 1974. 2. Garfield Avenue shall be dedicated and fully improved to City standards. 3. All provisions of the Huntington Beach Ordinance Code, with regard to off-street parking, shall be complied with. 4. The plan shall be referred to the Board of Zoning Adjustments to establish such conditions of approval as deemed necessary. AND FOR THE FOLLOWING REASON: 1. CODE AMENDMENT NO. 71-21 (Continued) A proposed Code Amendment to permit that portion of a two story dwelling which is constructed over a garage or carport abutting an alley to be set back ten (10) feet from the centerline of such alley. Planning Commission Wednesday, September 8, 1971 Page No. 8 - MISCELLANEOUS: Letter from Signal Landmark regarding Use Permit No. 70-43 The Acting Secretary read a letter received from Signal Landmark Company requesting that they be allowed -to lower the age of the residents within their project from 45 to 40 years. Mr. Akerman, representing Signal Landmark Incorporated, addressed the Commission and explained the request._ Commission discussion followed. f_ A MOTION WAS MADE BY BOYLE AND SECONDED BY SLATES TO APPROVE SIGNAL LANDMARK'S REQUEST TO LOWER THE AGE OF RESIDENTS IN THEIR PROJECT FROM 45 YEARS TO 40 YEARS. ROLL CALL VOTE: AYES: Kerins,'Boyle, Porter, Duke, Higgins, Slates NOES: None - ABSENT: Bazil THE MOTION CARRIED. The staff was directed to prepare a resolution amending the conditions of approval for Use Permit No. 70-43 to this effect. OPEN SPACE REQUIREMENTS IN THE R2, R3, and R4 ZONES The staff was instructed to set for public hearing a code amendment to consider open space requirements in the R2, R3, R4 zones and to establish an administrative review procedure for all residential construction in the town lot area. CD - CIVIC DISTRICT SUFFIX A resolution was adopted pertaining to the placement of the Civic District. Suffix on property located adjacent to a community facility. A letter received from K. Vance pertaining to traffic in the downtown area was received by the Planning Commission and filed. A copy was sent to the Traffic Engineer. RESOLUTION OF INTENT (South of Adams Avenue, 1300 ft. west of Newland Street) The staff was directed to prepare a Resolution of Intent to apply an "0" zone on property located south of Adams Avenue, approximately 1300 ft. west of Newland Street. POLICY REGARDING ADOPTION OF CODE AMDENDMENTS The following procedure was adopted with regard to adopting code amendments: After public hearing by the Planning Commission, a code amendment will be transmitted to the City Council for public hearing. After the ordinance is prepared in final form by the City Attorney's office, the City Attorney's office will transmit a copy of the code amendment -8- 9/8/71 - PC -,Minutes: H. B. Planning Commission Wednesday, September 8, 1971 Page No. 9 to the Planning Department for review. If there are no substantial changes, the item will be scheduled for first reading. If there are changes, the Planning Department shall advise the Commission and will act at their discretion.
