Thursday, September 23, 1971
Mayor McCracken called the regular adjourned meeting of the City
Council of the City of Huntington Beach to order at 7:30 P.M.
The Pledge of Allegiance was given by all present in the.Council
Chamber.
ROLL CALL
Councilmen Present: Bartlett, Green, Matney, Coen, McCracken
Shipley - (arrived at 7:40 P.M.)
Councilmen Absent: Gibbs
FORMATION OF ASSESSMENT DISTRICT
The Acting City Administrator informed Council of a request from the
Director of Public Works for Council direction concerning the pro-
posed formation of an assessment district in the northwestern section
of the. City, on which Council held discussion at the meeting of
September 20, 1971.
The Director of Public Works stated that it was necessary that he be
given direction as to whether Council wishes the assessment district
to be a Council initiated action or formed through petition of the
property owners.
Following discussion, Council directed that the formation of said
assessment district in the northwestern section of the City, be
accomplished through a citizens initiated action.
PUBLIC HEARING - AREA "E" ZONE CASE 71-20 P.C. RES OF INTENT -APPROVED
Mayor McCracken announced that this was the day and hour set for the
continuance from the September 20, 1971, Council meeting of a public
hearing on Area "E", Zone Case No. 71-20 - Planning Commission Res-
olution of Intent, which proposes a change of zone on property
located east of Bolsa Chica Street and north of Heil Avenue from R5
Office -Professional District to MH Mobilehome District.
The Clerk informed Council that all legal requirements for notifi-
cation, publication and posting had been met, and.that he had re-
ceived no communications or written protests to Area "E" Zone Case
No. 71-20 or to the recommendation of approval of the Planning
Commission.
The Assistant Planning Director used a viewgraph to display the area
under consideration and presented a resume' of the Planning Commission's
reasons for recommending approval of the zone change.
There being no one present to speak on the matter, and there being no
protests filed either oral or written, the hearing was closed by the
Mayor.
On motion by Shipley, Council sustained the decision of the Planning
Commission; approved the change of zone in Area "E" - Zone Case No.
71-20, and directed the City Attorney to prepare an ordinance ef-
fecting same, by the following vote:

Mayor McCracken announced that this was the day and hour set for the
continuance from the September 20, 1971, Council meeting of a public
hearing on Area "F", Zone Case No. 71-20 - Planning Commission Res-
olution of Intent, which proposes a change of zone on property lo-
cated on the south side of Heil Avenue, approximately 660 feet east
of Bolsa Chica Street, from Rl Single Family Residence District to
R2 Two Family Residence District; also, from R1 Single Family Res-
idence District to MH Mobilehome District.
The Clerk informed Council that all legal requirements for notifi-
cation, publication and. posting had been met, and that he had re-
ceived no communications or written protests to Area "F" - Zone
Case No. 71-20, or to the recommendation of approval of the Plan-
ning Commission.
The Assistant Planning Director displayed the area under consider-
ation through the use of a viewgraph, and presented a resume' of
the Planning Commission's reasons for recommending approval of
the zone change.

Mayor McCracken announced that this was the day and hour set for
the continuance from the September 20, 1971, Council meeting of a
public hearing on Area "G", Zone Case No. 71--20 - Planning Com-
mission Resolution of Intent, which proposes a change of zone on
property located. on the north side of Warner Avenue, south of
Pearce Street, east of Bolsa Chica Street and west of Roosevelt
Street, from R1 Single Family Residence District to R2 Two Fam-
ily Residence District, R5 Office -Professional District and C4
Highway Commercial District, with a 50 foot setback from the
ultimate right-of-way line.
The Clerk informed Council that all legal requirements for notifi-
cation, publication and posting had been met, and that he had re-
ceived no communications or written protests to Area "G" - Zone
Case No. 71-20 or to the recommendation of approval of the Planning
Commission.
The Assistant Planning Director used a viewgraph to display the area
under consideration and presented a resume' of the Planning Comnis-
sions's reasons for recommending approval of tiie zone change.

Mayor McCracken announced that this was the day and hour set for the
continuance from the September 20, 1971, Council meeting of a public
hearing on Area "I", Zone Case No. 71-20 - Planning Commission Res-
olution of Intent, which proposes a change of zone on property lo-
cated on the west side of Springdale Street, approximately 350 feet
south of Heil Avenue.
The Clerk informed Council that all legal requirements for notifi-
cation, publication and posting had been met, and that he had re-
ceived no communications or written protests to Area "I" - Zone:
Case No. 71-20 or to the recommendation of approval of the Plan-
ning Commission.

Mayor McCracken announced that this was the day and hour set for the
continuance from the September 20, 1971, Council meeting of a public
hearing on Area "K" - Zone Case No. 71-20 - Planning Commission Res-
olution of Intent, which proposes a change of zone on property lo-
cated on the east side of Springdale Street, 660 feet west of Edwards
Street, north of Warner Avenue and. south of the Orange County Flood
Control District channel, from R5 Office -Professional District to
MH Mobilehome District.

cated approximately 200 feet south of Warner Avenue and. approximately

District and R3 Limited. Multiple Family Residence District, to Rl
Single Family Residence District.

Following discussion, on motion by McCracken, Council continued the
public hearing on Area "L" - Zone Case No. 71-20, to the November 15.
1971, meeting and referred same back to the Planning Commission for
further study. The motion was passed by the .following vote:

Intent, which proposes a change of zone on property located. at the
northwest corner of Bolsa Chica Street and Los Patos Avenue, from
R2 Two Family Residence District, R3 Limited Multiple Family Resi-
dence District and C2 Community Business District, to Rl Single
Family Residence ]District.

PUBLIC HEARING - ZONE CASE NO-17-PLANNING COMMISSION RES OF INTENT
Mayor McCracken announced that this was the day and hour set for a
public hearing on Zone Case No. 71-17, which proposes a change of
zone as follows:
C4 Highway Commercial District to C4-CD Highway Commercial District
Civic District; from RA Residential Agricultural District and RA-0
Residential Agricultural District, combined. with oil production, to
RA -CD Residential Agricultural District Civic District, and RA-0-CD
Residential Agricultural District, combined with oil production, Civic
District; from RA-01 Residential Agricultural District, combined with
oil production, to RA-01-CD Residential Agricultural District, com-
bined with oil production, Civic District; from Rl Single Family Res-
idence District to Rl-CD Single Family Residence District Civic Dis-
trict; from R5 Office -Professional District to R5-CD Office -Pro-
fessional District Civic District; and from MI Light Industrial Dis-
trict and. Ml-0 Light Industrial District, combined with oil produc-
tion, to Ml-CD Light Industrial District Civic District and M1-0
Light Industrial District, combined with oil production, Civic Dis-
trict.
Subject Resolution of Intent establishes a zoning district generally
around Huntington Central Park. Said district is referred to as a
Civic District Suffix and is designated -to attach to the base zone.
A CD suffix does not alter the base zone, but it subjects development
in the suffix to a review process. The intent of the CD is to estab-
lish a method. whereby the City may regulate the orderly, harmonious,
attractive and. aesthetic development of private property around
Huntington Central Park.

Case No. 71-17.
Mayor McCracken declared the hearing open.
Mr. Jerry Shea, representing the Huntington Beach Company, 2110
Main St., City, addressed. Council in opposition to the proposed
zone change.
Mr. Glen Kimmel, 6732 Via Angelina, addressed Council and stated
that he believed the area encompassed by the zone change should.
be expanded.
Mr. Wilbur Metzler, 11143 S. Budlong Ave., Los Angeles, addressed
Council and stated his opposition to the proposed zone change as
he believed it discouraged industry from moving into the City.
There being no one further present to speak on the matter, and
there being no further protests filed either oral or written,
the hearing was closed by the Mayor.
On motion by Green, Council sustained the decision of the Plan-
ning Commission; approved. Zone Case No. 71--1.7 and directed the
City Attorney to prepare an ordinance effecting the change of

Mr. Jerry Shea, representing the Huntington Beach Co., 2110 Main
St., City, addressed. Council and stated that he believed the area
encompassed in the proposed zone change was ton broad. in scope.
Considerable discussion was held between the Council and the Assis-
tant Planning Director regarding the matter.
On motion by Green, Council continued the public hearing on Zone
Case No. 71-18 to the November 1, 1971, Council_ meeting, referred
same back to the Planning Commission to revise the boundaries as
follows:
Beginning at the intersection of Lake Street and Springdale Avenue
westerly along Springfield Avenue to Huntington Street, north on
Huntington Street to a point 660 feet north of Yorktown Avenue,
then westerly along a line parallel to and 660 feet north of the
centerline of Mansion Avenue to a point 660 feet east of Golden -
west Street and. south along a line parallel to and 660 feet west
of Main Street to the intersection of Utica Avenue then easterly
along Utica Avenue to Lake Street and. south to Lake Street to
the point of beginning.
The motion was passed by the following vote:

Draft - Moratorium Resolution on Residential Construction
A draft of the proposed moratorium resolution was distributed by the
City Attorney for the consideration of Council.
Disc ssion wa:y held by Council concerning, the direction given to the
City Attorney at the September 20, 1971, meet:l..ng coxicre r•ning t,}le pre-
paration of the moratorium resolution covering residential construc-
tion only, in Study Area "B" (Central quarter of City from Edwards
Street to the easterly City limits) and Study Area "C" (northwest
portion of City to Edwards Street doen to and including freeway
alignment, northwesterly to Warner Avenue and westerly from Warner
Avenue to Pacific Coast Highway).
The City Attorney was directed by Council to exclude from the Mora-
torium those permits necessary for the construction of condominiums
and planned residential developments.
Delay - Beach Boulevard. Median3Opening
Mr. Wendell Pearson, owner of Liberty Park Liquors, 17685 Beach Blvd.,
City, addressed Council concerning the delay in the reopening of the
left turn median on Beach Boulevard and Liberty Street.
The Director of Public Works informed Council that the change order
had been approved and that the work would be done as soon as possible.
The Lirector of Public Works was directed by Council to contact the
State Engineer to expedite the reopening of the median.
RECESS - EXECUTIVE SESSION
Mayor McCracken called an Executive Session of the Council at 9:20 P.M.
The meeting was reconvened at 1:20 A.M. by the Mayor Pro Tempore
Matney.
RESOLUTION NO. 3369 - ADOA D - MEMORANDUM OF AGRMT -- HBMEO
The Clerk read Resolution No. 3369 by title - "A RESOLUTION OF THE
CITY COUNCIL OF THE CITY OF HUNTINGTON BEACH APPROVING AND IMPLE-
MENTING IN PART THE MEMORANDUM OF AGREEMENT BETWEEN THE CITY AND THE
HUNTINGTON BEACH MANAGEMENT EMPLOYEES' ORGANIZATION AND TANAGEMENT
PERSONNEL NOT INCLUDED WITH THE MANAGEMENT UNIT."
On motion by Bartlett, Council waived further reading of Resolution
No. 3369 by the following roll call vote:

PUBLIC HEARING SET - CITYrADMINISTRATOR
On motion by Green, Council directed that 5:00 P.M. on October 11,
1971, be the time and date for the public hearing requested by the
City Administrator, pursuant to Section 606 of the City Charter, in
the Murdy Park Community Center, the regular meeting place of tie
City Council. The motion was passed by the following vote:
