HomeMy WebLinkAbout1971-09-29MINUTES HUNTINGTON BEACH BOARD OF ZONING ADJUSTMENTS Administrative Annex 523 Main Street Huntington Beach, California WEDNESDAY, SEPTEMBER 29, 1971 BOARD MEMBERS PRESENT: McFarland, Spencer, Palin BOARD MEMBERS ABSENT: None MINUTES: On motion by Spencer and seconded by McFarland the minutes for April 21, 1971 and April 28, 1971 were continued to the meeting of October 6, 1971. CONDITIONAL EXCEPTION NO. 71-74 Applicant: Huntington Beach Industrial Park To allow zero sideyard setback for an industrial development. The subject property is located on the south side of Research Dr., 238.50 ft. east of Graham St. in the M1-A Restricted Manufacturing District. The hearing was opened to the audience. Mr. George Lusk, representing the applicant, addressed the Board and explained the request. It was noted by the Board that a minimum of 30 ft. between buildings was desirable. The applicant explained that foundations had already been poured on property adjacent to subject property. There being no further comment, the hearing was closed. Board discussion followed. It was the consensus of the Board that the remainder of the Industrial Park should be precise planned to allow zero setbacks on common or opposite property lines, thereby achieving additional sepa ration between structures. A MOTION WAS MADE BY MCFARLAND AND SECONDED BY PALIN TO APPROVE CONDITIONAL EXCEPTION NO. 71-74 WITH THE FOLLOWING CONDITIONS: 1. A revised plot plan shall be submitted prior to issuance of building permits. 2. All standard conditions that are applicable shall be com- plied with. AND FOR THE FOLLOWING REASONS: 1. This will allow better utilization of the property. 2. It affords greater separation between buildings on Lots 47 and 48. ROLL CALL VOTE: AYES: McFarland, Spencer, Palin NOES: None THE MOTION CARRIED. CONDITIONAL EXCEPTION NO. 71-75 Applicant: Huntington Beach Industrial Park To allow a zero side yard setback and a 5 ft. setback on the rear property line of an industrial development. The subject property is located on the south side of Research Dr., 131.50 ft. east of Graham St. in the M1-A Limited Manufacturing District. Minutes:: H.B. There being no further comment, the hearing was closed. Board discussion was held. A MOTION WAS MADE BY MCFARLAND AND SECONDED BY PALIN TO APPROVE CONDITIONAL EXCEPTION NO. 71-75 WITH THE FOLLOWING CONDITIONS: 1. The sujbect property is located on the west side of Newland St., 320 ft. south of Slater Ave. in the R2 Two Family Residence District. The hearing was opened to the audience. Mr. Ayres addressed the Board and explained their need for additional classrooms. There being no further comment, the hearing was closed. Board discussion followed. A MOTION WAS MADE BY MCFARLAND AND SECONDED BY PALIN TO APPROVE PLOT PLAN AMENDMENT NO. 71-8 WITH THE FOLLOWING CONDITION: 1. The plot plan received September 13, 1971 shall be the approved layout. 2. All applicable ordinances shall be complied with. ROLL CALL VOTE: AYES: McFarland, Spencer, Palin NOES: None THE MOTION CARRIED. CONDITIONAL EXCEPTION NO. 71-73 Applicant: Wm. Lyon Development Co.,, Inc. To permit a 5 ft. side yard setback on a cul-de-sac abutting an arterial highway in lieu of the required 10 ft. setback. The subject property is located on the southwest corner of Slater Ave. and Edwards St. in the RA Residential Agricultural District. audience. It was noted by the Board that a recommendation be made to the Planning Commission to define this type of lot. Minutes: H.B. A MOTION WAS MADE BY PALIN AND SECONDED BY MCFARLAND TO APPROVE CONDITIONAL EXCEPTION NO. 71-73 FOR THE FOLLOWING REASONS: 1. This specific type of lot is not clearly defined in the Huntington Beach Ordinance Code. 2. The policy of the Planning Commission is to interpret these lots the same as corner lots, therefore, the filing of this application was required. 3. There is sufficient justification as the homes are under construction. 4. Similar lots in the City have been constructed with the same setback. A FURTHER MOTION WAS MADE BY PALIN AND SECONDED BY MCFARLAND THAT THE BOARD OF ZONING ADJUSTMENTS RECOMMEND TO THE PLANNING COMMISSION THAT A RESOLUTION BE ADOPTED REFLECTING THEIR DESIRES -FOR SETBACKS ON THIS TYPE OF LOT. ROLL CALL VOTE: AYES: McFarland, Spencer, Palin NOES: None THE MOTION CARRIED. CONDITIONAL EXCEPTION NO. 71-77 Applicant: Eugene E. Hougham To allow: 1) a sideyard setback of 4 ft. 6 in, in lieu of the required 5 ft. setback; 2) a second floor balcony to cantilever to within 2 ft. of the rear pro- perty line in lieu of the required 5 ft. rear yard setback. The subject property is located at 17072 Baruna Lane in the R1 Single Family Residence District. The hearing was opened to the audience. Mr. Hougham, architect, addressed the Board and explained his request. A scale model of the subject property was displayed for review by the_,Board. There being no further comment, the hearing was closed. Board discussion followed. A MOTION WAS MADE BY MCFARLAND AND SECONDED BY PALIN TO APPROVE CONDITIONAL EXCEPTION NO. 71-77 FOR THE FOLLOWING REASONS: 1. The request is for a corner encroachment -of only 1 ft. 2. The average side yard setback is in excess of 5 ft. ROLL CALL VOTE: AYES: McFarland, Spencer, Palin NOES: None THE MOTION CARRIED. CONDITIONAL EXCEPTION NO. 71-76 Applicant: Heath & ComDanv To permit a 213 sq. ft. pylon sign within an existing planter located approximately 79 ft. west of the easterly property line in lieu of 107 ft. as per Section 9763.3. The subject property is located on the south side of Edinger Ave., approximately 1000 ft. west of Beach Blvd. The hearing was opened to the audience. Mr. E. A MOTION WAS MADE BY MCFARLAND AND SECONDED BY PALIN TO APPROVE CONDITIONAL EXCEPTION NO. 71-76 FOR THE FOLLOWING REASONS: 1. The request is for only an 18 ft. deviation from the requirement that the sign be located within 10 ft. of the center of the lineal frontage and allows the sign to be located within a location planter island at the main driveway. 2. The driveway was fixed at subject location by a raised median in Edinger Ave. ROLL CALL VOTE: AYES: McFarland, Spencer, Palin NOES: None THE MOTION CARRIED. ADMINISTRATIVE REVIEW NO. 71-54 Applicant: Ideal Pallet System, Inc. To permit: 1) Manufacturing and distribution of wood pallets; 2) mobilehome unit permanently installed as caretaker's quarters. The subject property is located on the southeast section of Cedar St. and Palmdale Ave., 990 ft. south of Warner Ave., 300 ft. east of Gothard St. in the M1 Light Industrial District. James Thompson and Mel Mermelstein, representing the applicant, addressed the Board and explained the request. Board discussion followed. A MOTION WAS MADE BY MCFARLAND AND SECONDED BY PALIN TO APPROVE ADMINISTRATIVE REVIEW NO 71-54 WITH THE FOLLOWING CONDITIONS: 1. The plot plan received September 22, 1971 shall be the approved layout. 2. Cedar St. shall be dedicated and fully improved to City standards at the time said parcel is developed. Improve- ments shall include street trees, street signs, street lights, fire hydrants, sewer and water main extensions. 3. Water supply shall be through the City of Huntington Beach's water system. 4. Sewage disposal shall be through the City of Huntington Beach's sewage system. 5. The water, sewer and fire hydrant system shall be approved by'the Department of Public Works and Fire Department. 6. The property shall participate in the local drainage assessment district. 7. All utilities shall be installed underground. 8. Off-street parking facilities shall conform to Article 979. 9. No structures, other than those shown on the approved plot plan, shall be constructed within the project. 10. All applicable City Ordinances shall be complied with. 11. A landscaping plan shall be submitted to the Board of Zoning Adjustments for approval pursuant to the modified street section approved by the Department'of Public Works. A MOTION WAS MADE BY PALIN AND SECONDED BY SPENCER TO REMOVE CONDITIONS FROM PARCEL NO. 2 OF DIVISION OF LAND NO. 70-34 PURSUANT TO THE REQUEST BY THE CITY ATTORNEY'S OFFICE. ROLL CALL VOTE: AYES: McFarland, Spencer, Palin NOES: None THE MOTION CARRIED. USE PERMIT NO. 71-34 - Review Applicant: Tropical Co. It was noted by the Board that in accordance with the Mobilehome Ordinance, the Board of Zoning Adjustments is required to review the masonry block wall design and landscape plan for the mobilehome park located on the west side of Brookhurst St., approximately 700 ft. south of Garfield Ave. Board discussion followed. A MOTION WAS MADE BY PALIN AND SECONDED BY MCFARLAND TO APPROVE THE WALL AND LANDSCAPE PLANS FOR USE PERMIT NO. 71-34. ROLL CALL VOTE: AYES: McFarland, Spencer, Palin NOES: None THE MOTION CARRIED.
