WEDNESDAY, OCTOBER 13, 1971 BOARD MEMBERS PRESENT: McFarland, Spencer, Palin BOARD MEMBERS ABSENT: None MINUTES: On motion by Palin and second by Spencer, the minutes for May 12, 19,and 26, 1971 were accepted as transcribed. CONDITIONAL EXCEPTION NO. 71-78 (Continued). Applicant: Melven Genser Outdoor, Inc. To permit the continuation and maintenance for one year of an existing nonconforming sign. The subject property is located on the north line of Warner Avenue, approximately 470 ft. westerly of Magnolia Street in the Al Agricultural District. The hearing was opened to the audience. Mr. Ray Murphy, representing the applicant, addressed the Board and discussed the request. He explained that the sign could be relocated to accomplish a 157 ft. distance between signs. the hearing was closed. There being no further comment, Board discussion was held. A MOTION WAS MADE BY PALIN AND SECONDED BY MCFARLAND TO CONTINUE CONDITIONAL EXCEPTION NO. 71-78 TO OCTOBER 20, 1971 TO ALLOW TIME FOR THE PLANNING .COMMISSION TO SET A POLICY REGARDING NON -CONFORMING SIGNS. USE PERMIT NO. 71-44 Applicant: Downey Savings $ Loan Association To permit the construction of a two-story office building of approximately 9,600 sq. ft. in the C4 Highway Commercial District. The subject property is located on the southeast corner of Adams Avenue and Brookhurst Street. The hearing was opened to the audience. CONDITIONAL EXCEPTION NO. 71-82 Applicant: Huntington Beach Playhouse To permit the construc- tion of a 74 sq..ft. double-faced sign, advertising the Huntington Beach Playhouse in the R1-0 Single Family Residence District combining oil. The subject property is located on the east side of Main Street, approximately 100 yds. north of Mansion Avenue. The hearing was opened to the audience. Mr. Broderick, representing the applicant, addressed the Board and explained the request. comment, the hearing was closed. There being.no further Board discussion followed. A MOTION WAS MADE BY MCFARLAND AND SECONDED BY PALIN TO APPROVE CONDITIONAL EXCEPTION NO. 71-82 WITH THE FOLLOWING CONDITION: 1. Conditional Exception No. 71-82 shall become null and void on September 1, 1974. AND FOR THE FOLLOWING REASON: 1. It is an existing nonconforming use which is of a commercial nature and should have sign area permitted by Sign Ordinance for that type of use. The subject property is located on the northwest corner of Garfield Avenue and Edwards Street in the RA-0 Residential Agricultural District combining oil and RA-01 Residential Agricultural District combining oil. The hearing was opened to the audience. Dick Buhr, representing the applicant, addressed the Board and explained the request. It was noted by the Board that this property is in the process of being rezoned to permit the use. the hearing was closed. There being no further comment, Board discussion followed. A MOTION WAS MADE BY PALIN AND SECONDED BY MCFARLAND TO CONTINUE USE PERMIT NO. 71-43 TO OCTOBER 20, 1971 TO ALLOW TIME FOR ADOPTION OF A ZONE CHANGE ON SUBJECT PROPERTY, WHICH IS IN PROCESS AT THE PRESENT TIME. CONDITIONAL EXCEPTION NO. 71-84 Applicant: Low's Liquor $ Groceries To permit a second free-standing pole sign of 134 sq. ft. in lieu of S. 9764.3.1.2 (a) which permits one (1) free-standing sign for each detached building. The subject property is located on the east side of Springdale Street and 240 f t. from the centerline of and north of Bolsa Avenue in the C2 Community Business District. The hearing was opened to the audience. James Graves, representing the applicant, addressed the Board and explained the request. The Board discussed consolidation of the proposed and existing signs on subject property. There being no further comment, the hearing was closed. Board discussion was held. A MOTION WAS MADE BY MCFARLAND AND SECONDED BY SPENCER TO CONTINUE CONDITIONAL EXCEPTION NO. 71-84 TO OCTOBER 20, 1971 TO ALLOW TIME FOR APPLICANT TO INVESTIGATE CONSOLIDATION OF EXISTING AND PROPOSED ,SIGNS AND COST OF NEW STRUCTURE. -3- 10/13/71 - BZA Minutes: H. CONDITIONAL EXCEPTION NO. 71-83 Applicant: Eldon Bagstad To permit the following: 1) garage with rear yard setback of 1 ft. in lieu of the required 10 ft. rear yard setback; 2) driveway width of 10 ft. in lieu of the required 20 ft. width; 3) 5 ft. separation between dwelling and garage in lieu of the required 10 ft. separation. The subject property is at 811 Alabama Avenue in the R3 Limited Multiple Family Residence District. The hearing was opened to the audience. Eldon Bagstad, addressed the -Board and explained the request. The Board discussed location for open space and orientation to each unit. There being no further comment, the hearing was closed. To allow a model complex and sales office with on -site feature signs in a planned residential development. The subject property is located on the east side of Bushard Street, north of Pettswood Drive in the R2 Two Family Residence District. There was no one present to represent the applicant. Board discussion was held. A MOTION WAS MADE BY PALIN AND SECONDED BY MCFARLAND TO APPROVE ADMINISTRATIVE REVIEW NO. 71-58 WITH THE FOLLOWING CONDITION: 1. DIVISION OF LAND NO. 71-28 Applicant: Pafford & Associates To divide a legal parcel of land into three legal parcels. The subject property is located 360 ft. south of Main Street, west of Beach Boulevard in the C4 Highway Commercial District. There was no one present to represent the applicant. Board discussion was held. A MOTION WAS MADE BY SPENCER AND SECONDED BY MCFARLAND TO APPROVE DIVISION OF LAND NO. 71-28 WITH THE FOLLOWING CONDITIONS: 1. The plot plan received October 5, 1971 shall be the approved layout. 2. Beach Boulevard shall be dedicated and fully improved to City and/or State standards at the time each parcel is developed. Improvements shall include street trees, street signs, street lights, fire hydrants, sewer and water main extensions. 3. Water supply shall be through the City of Huntington Beach's water system at the time each parcel is developed. 4. Sewage disposal shall be through the City of Huntington Beach's sewage system at the time each parcel is developed. S. The water, sewer, and fire hydrant system shall be approved by the Department of Public Works and Fire Department. 6. The property shall participate in the local drainage assessment district at the time each parcel is developed. 7. All utilities shall be installed underground at the time each parcel is developed. 8. All applicable City Ordinances shall be complied with. 9. A Parcel Map shall be filed with the City and recor-led prior to framing inspection of any structures on anv parcel. 10. The Division of Land shall not be effective until an agreement is signed and recorded agreeing to the conditions listed above. Board of Zoning Adjustments Wednesday, October 13, 1971 Page No. 6 MISCELLANEOUS: Temporary sign permits for a sales event conducted throughout a business chain as proposed by Shell Oil Company were reviewed at three different locations: Magnolia Street and Garfield Avenue; Warner Avenue and Newland Street; Brookhurst Street and Adams Avenue.' By minute action these locations were approved for sales signs for a period of 60 days. THERE BEING NO FURTHER BUSINESS, THE MEETING ADJOURNED. James W.
