AGENDA ITEMS TO BE CONTINUED OR WITHDRAWN: USE PERMIT NO. 71-40- Continued Applicant: Robert F. Neese To permit the construction of a 52 unit apartment building complex located on the east side of Green Street, 330 feet north of Warner Avenue, in the R3 Limited Multiple Family Residence District. It was noted by the Acting Secretary that the applicant had requested a continuance of this item to December 1, 1971, to allow time to prepare elevations as requested by the Board. A MOTION WAS MADE BY PALIN AND SECONDED BY SPENCER TO CONTINUE USE PERMIT NO. 71-40 TO DECEMBER 1, 1971 AT THE REQUEST OF THE APPLICANT. CONDITIONAL EXCEPTION NO. 71-86 Applicant: Standard Pacific Corporation To permit the reduction in rear yard open space minimum dimension from the required 25 feet to as low as 22 feet. The subject property is located at the southwest corner of Adams Avenue and Newland Street, in the RA-0 Residential Agricultural District combining oil and the RA-01 Residential Agricultural District combining oil. The hearing was opened to the audience. Dave Langlois, representing the applicant, addressed the Board and explained the request. There being no other comment, the hearing was closed. Board discussion followed. A MOTION WAS MADE BY PALIN AND SECONDED BY MCFARLAND TO APPROVE EXHIBIT "A" LOT 39 and EXHIBIT "B" LOT 40 OF CONDITIONAL EXCEPTION NO. 71-86 FOR THE FOLLOWING REASONS: 1. The request is only for a 6 inch reduction in the required 25 feet minimum dimension and a 55 square foot reduction in the required 900 square feet in one area on Lot 39 and for a two foot reduction with a 45 square foot reduction in the required 900 square feet in the one area on Lot no. 40. 2. The design and layout of the units within this model complex affords better storage areas within the side yards. 3. The developer has provided 1600 square feet of open space for each of the lots. CONDITIONAL EXCEPTION NO. 71-87 Applicant: Standard Pacific To permit a reduction in the minimum dimension for open space in the rear yard to 23 feet in lieu of the required 25 foot minimum dimension. Located on the south side of Atlanta Avenue, 600 feet east of Newland Street in the Rl Single Family Residence District. The hearing was opened to the audience. Dave Langlois, representing the applicant, addressed the Board and explained the request stating the homes would have wood roofs. The setback elevations to the entire subdivision were discussed_ with the applicant. It was noted that these lots are within 50 square feet of the open space requirements. Mrs. Ezratty, adjacent property owner, addressed the Board and expressed opposition to the new layout and the flexibility it would afford for storage or vehicles within the side yard setback. There being no other comment, the hearing was closed. Board discussion followed. A LOTION WAS MADE BY MCFARLAND AND SECONDED BY PALIN TO APPROVE CONDITIONAL EXCEPTION NO. 71-87 FOR THE FOLLOWING REASONS: 1. The applicant is providing open space area in excess of that required by code. 2. Floor plans, designated in exhibits "A« and "B", which provide a 10 foot interior side yard setback that facilitates utilization of the setback for boat and trailer storage, shall be the approved plans. 3. This development is compatible with the existing tract which was developed with a 900 square foot open space requirement. 4. The proposed layout affords 1600 square feet of open space for each lot within subject 'development. USE PERMIT NO. 71-47 Amplicant: Shell Oil Company To permit the modernization of an existing service station including roof line, canopies, pump islands, etc. Located at the northwest corner of Springdale Street and Heil Avenue in the C4 Highway Commercial District. The hearing was opened to the audience. Kenneth Sample, representing the applicant, addressed the Board and explained the request. It was noted by the Board that the plot plan submitted does not comply with the requirements of the Huntington Beach Ordinance Code Section 948. was closed. To permit the modernization of an existing service station including roof line, canopies, pump islands, etc. The subject property is located at the northeast corner of Beach Blvd. and Terry Street in the C4 Highway Commercial District. The hearing was opened to the audience. Kenneth Sample, representing the applicant, addressed the Board and explained the request. There being no further comment, the hearing was closed. Board discussion was held. The Board informed Mr. Sample of a need for revised plot plans. A MOTION WAS MADE BY MCFARLAND AND SECONDED BY PALIN TO CONTINUE USE PERMIT NO. 71-48 TO NOVEMBER 3, 1971 TO ALLOW TIME FOR THE APPLICANT TO SUBMIT REVISED PLOT PLANS. To be located at the south side of Goldenwest Street, approximately 1300 feet east of Palm Avenue in the Rl-0 Single Family Residence District combining oil. Fred Vanier, representing the applicant, addressed the Board and explained the request. Board discussion followed. A MOTION WAS MADE BY MCFARLAND AND SECONDED BY PALIN TO APPROVE ADMINISTRATIVE REVIEW NO. 71-60 WITH THE FOLLOWING CONDITIONS: 1. The applicant shall comply with Section 9730.25.4 of the Huntington Beach Ordinance Code. 2. Subdivision directional signs and feature signs shall conform to the plans submitted. ROLL CALL VOTE: AYES: MC FARLAND, SPENCER, PALIN NOES: NONE THE MOTION CARRIED. ADMINISTRATIVE REVIEW NO. 71-64 Applicant: Ralph D. Parson To allow the construction of a concrete tilt -up building. Subject property located at the southeast corner of Graham Street and Research Drive in the M1A Limited Manufacturing District. Ralph Parson addressed the Board and explained the request. MINUTES: H. B. BOARD OF ZONING ADJUSTMENTS OCTOBER 27, 1971 PAGE 5 The Board discussed the utilization of the required 30 foot exterior side yard for uses other than landscaping or parking. It was noted that the plan provided 25% of the setback area in landscaping. The Board agreed that the question of the use of the 30 foot setback other than landscaping and parking should be discussed with the Planning Commission. Board discussion followed. A MOTION WAS MADE BY MCFARLAND AND SECONDED BY SPENCER TO CONTINUE ADMINISTRATIVE REVIEW NO. 71-64 TO NOVEMBER 3, 1971, TO ALLOW TIME FOR THE PLANNING COMMISSION TO DISCUSS THE LANDSCAPING VARIATION PROPOSED BY THE APPLICANT. ROLL CALL VOTE: AYES: McFarland, Spencer, Palin NOES: None THE MOTION CARRIED. ADMINISTRA TIVE REVIEW NO. 71-65 Applicant: Charles J. Wilmot To allow a temporary Christmas tree sales lot. To be located at the northeast corner of Heil Avenue and Springdale Street in the R1 Single Family Residence District. There was no one present to represent the applicant. Board discussion followed. A MOTION WAS MADE BY SPENCER AND SECONDED BY MCFARLAND TO APPROVE ADMINISTRATIVE REVIEW NO. 71-65 WITH THE FOLLOWING CONDITION: 1. Section 9730.25.2 of the Huntington Beach Ordinance Code shall be complied with. ROLL CALL VOTE: AYES: McFarland, Spencer, Palin NOES: None THE MOTION CARRIED. MISCELLANEOUS: CONDITIONAL EXCEPTION NO. 70-33 Applicant: Bill Williams Review of the operation of the horse stables at Ernest Avenue with regard to fencing and relocation of the exercise arena. The Board had met with Mr. Williams on October 22, 1971 at the stables to determine the location of the fencing and its design. Mr. Williams submitted a plot plan showing the location of the fencing as discussed by the Board during the field inspection. The plan provided for fencing around the operation with the exception of the driveway and adjacent to the riding area to the east. The plan also called for a gate at the west property line to control access to Goldenwest Street. It was the consensus of the Board that the fencing plan as submitted provided adequate control and containment of the horses on the property; and would prohibit them from trespassing onto neighboring property. Mr. Williams also presented a letter stating that the relocation of the arena at this time would be economically unfeasible due to the need to acquire additional land and remove several trees. A MOTION WAS MADE BY MCFARLAND AND SECONDED BY PALIN TO APPROVE THE FENCE PLAN AS SHOWN WITH THE FOLLOWING CONDITIONS: 1. The driveway entrance shall be reduced to 40 feet in clear width. 2. Fencing on the north side of Ernest Avenue is to continue easterly to the existing fence. 3. The plan indicates that the subject property will be fenced sufficiently to contain the animals except at the two driveway locations. 4. The plot plan received October 27, 1971 shall be the approved layout. MINUTES: H. B.
