USE PERMIT NO. 71-47 - Continued Applicant: Shell Oil Co. To permit the modernization of an existing service station including roof line, canopies, pump islands, etc. Subject property is located on the northwest corner of Springdale Street and Heil Avenue in the C4 Highway Commercial District. The hearing was opened to the audience. Mr. Parikh, representing the applicant, ad- dressed the Board and explained the request. He informed the Board that the same modernization was to take place on all three sites. The Board reviewed the revised plot plan with required screening walls for rest rooms and landscaping. closed. The screening walls of restrooms shall be of the same, or similar to, the material used on the main structure. 2. Two 15 gal. trees shall be planted on -site at locations that will complement the planter area. 3. The plot plan received November 3, 1971, shall be the approved layout. 4. There was no one present to represent the Board discussion followed. A MOTION WAS MADE BY PALIN AND SECONDED BY SPENCER TO CONTINUE ADMINISTRATIVE REVIEW NO. 71-64 TO NOVEMBER 10, 1971 TO ALLOW THE APPLICANT TO BE PRESENT FOR DISCUSSION OF THE PLOT PLAN LAYOUT. CONDITIONAL EXCEPTION NO. 71-88 Applicant: Carl S Linda Westelin To permit a reduction in open space to 812 sq. ft. in lieu of the required 900 sq. ft. The subject property is located in the R1 Single Family Residence District. Address: 16201 Howland Lane. Minutes: H.B. A petition signed by adjacent home- <' owners for the request was also presented to the Board. was closed. There being no further comment, the hearing Board discussion followed. A MOTION WAS MADE BY PALIN AND SECONDED BY MCFARLAND TO APPROVE CONDITIONAL EXCEPTION NO. 71-88 FOR THE FOLLOWING REASONS: 1. 'The request is within the policy currently established by the Board for reduction in the open space. 2. The addition will upgrade the value of the property. 3. This proposed structure is on the rear portion of a lot which abuts directly on an arterial street with the proper setback. ROLL CALL VOTE: AYES: McFarland, Spencer, Palin NOES: None THE MOTION CARRIED. CONDITIONAL EXCEPTION NO. 71-85 Applicant: Huntington Shorecliffs In conjunction with SIGN PERMIT #72635 - Continued - Review for possible revocation. Applicant: Huntington Shorecliffs To permit the continued use of a nonconforming ~ sign, for a period of one year. Subject property located on the northwest corner of Beach Blvd. and Atlanta Ave. in the R5 Office -Professional District. The hearing was opened to the audience. Ray Ellman, representing the applicant, ad- dressed the Board and explained the request. He stated it would cost $1000.00 to move this sign. Dr. Kaufman, neighboring property owner, ad- dressed the Board and questioned the issuance of an application when indeed the sign was illegal and Dr. Kaufman questioned if a financial hardship could be con- sidered. Dr. Kaufman was informed that the Sign Code does allow a consideration of financial hardship. Dr. Kaufman spoke in opposition to the request stating this was an illegal sign and should be removed. closed. There being no further comment, the hearing was Board discussion followed. A MOTION WAS MADE BY PALIN AND SECONDED BY SPENCER TO DENY CONDITIONAL EXCEPTION NO. 71-85 FOR THE FOLLOWING REASONS: 1. The applicant has not sufficiently justified the sign at this location. 2. Issuance of a permit by the City does not create a legal sign. 3. An Administrative Review Application had been filed to allow the model complex at the intersection of Atlanta and Beach which would have been the proper location for this sign., Minutes: H.B. A MOTION WAS MADE BY MCFARLAND AND SECONDED BY PALIN TO REVOKE SIGN PERMIT NO. 72635 FOR THE FOLLOWING REASONS: 1. The location shown on the permit was improper. 2. The sign does not conform to the Sign Ordinance. ROLL CALL VOTE: AYES: McFarland, Spencer, Palin NOES: None - THE MOTION CARRIED. USE PERMIT NO. 71-51 Applicant: Leonard E. Lichter To permit the storage of trailers, boats and campers. Subject property is located on the east side of Gothard St., approximately 1000 ft. north of Talbert Ave. in the Ml Light Industrial District. The hearing was opened to the audience. Mr. Lichter addressed the Board and explained the request. The grading on Gothard St., setbacks and wall materials were discussed. Also, surfacing to be used on drives and parking pads and the required landscaping were discussed with the applicant. was closed. There being no further comment, the hearing Board discussion followed. A MOTION WAS MADE BY MCFARLAND AND SECONDED BY PALIN TO CONTINUE USE PERMIT NO. 71-51 TO NOVEMBER 10, 1971 TO ALLOW THE APPLICANT TIME TO REVISE PLANS PURSUANT TO BOARD RECOMMENDATIONS. ROLL CALL VOTE: AYES: McFarland, Spencer, Palin NOES: None THE MOTION CARRIED. The applicant made a plea for a reconsidera- tion of the motion as time was of the essence to him. Board discussion was held. A MOTION WAS MADE BY MCFARLAND AND SECONDED BY SPENCER TO RECONSIDER HIS MOTION. THIS MOTION CARRIED. A MOTION WAS MADE BY MCFARLAND AND SECONDED BY SPENCER TO APPROVE USE PERMIT NO. 71-51 WITH THE FOLLOWING CONDITIONS: 1. Gothard St. shall be dedicated and fully improved to City standards at the time each parcel is developed. Improvements shall include street trees, street signs, street lights, fire hydrants, sewer and water main extensions. 2. Water supply shall be through the City of Huntington Beach's water system. 3. Sewage disposal shall be through the City of Huntington Beach's sewage system. 4. The water, sewer, and fire hydrant system shall be approved by the Department of Public Works and Fire Department. 5. The property shall participate in the local drainage assessment district at the time said parcel is developed. 6. Soil reports as required by the Building Department and the Department of Public Works shall be submitted to the City prior to issuance of building permits. Minutes: H.B. Board of Zoning Adjustments November 3, 1971 Page 5 7. All utilities shall be installed underground. 8. Off-street parking facilities shall conform to Article 979. 9. Parking compounds shall be screened with a combination of fencing and landscap- ing. Said plan shall be approved by the Planning Department. 10. A masonry wall shall be constructed along the west property line. The height of said wall shall be such that the top will be six (6) feet above the highest ground surface within twenty (20) feet of the common property line. 11. Drives shall be of asphalt paving to the requirements of the Department of Public Works with gravel in the storage areas. 12. A revised plot plan and landscape plan for the north and west property lines shall be submitted for approval by the Board of Zoning Adjustments prior to issuance of building permits. 13. Driveways shall be common on easement to the south in conjunction with abutting use subject to approval by the Department of Public Works. 14. All applicable City Ordinances shall be complied with. ROLL CALL VOTE: AYES: McFarland, Spencer NOES: Palin THE MOTION CARRIED. MINORITY REPORT: James Palin stated his reasons for nay vote: 1. This is setting a dangerous precedent to approve a plot plan that does not contain sufficient information as we have indicated the difficulties this has created in the past. 2. Unique treatment should be given this facility because it is across the street from the Central City Park and the plot plan should show the area for the required landscaping. CONDITIONAL EXCEPTION NO. 71-90 Applicant: Roy Leonard Day To permit a reduction in the required open space of 900 sq. ft. to 531 sq. ft. on a 25 ft. lot. Subject property is located on the north side of Acacia Ave. on the east side of Loth Street in the R2 Two Family Residence District. The hearing was opened to the audience. Mr. Day addressed the Board and explained the request. It was noted that the request falls within the new ordinance approved by the City Council. There being no further comment the hearing was closed. Board discussion followed. A MOTION WAS MADE BY MCFARLAND AND SI.CONDED BY PALIN TO APPROVE CONDITIONAL EXCEPTION NO. 71-90 FOR THE FOLLOWING REASONS: 1. The applicant's proposed development falls within the newly adopted code amend- ment reflecting a .25% sq. ft. open space for each square foot of floor area. 2. It is only a 25 ft. lot. Board of Zoning Adjustments November 3, 1971 Page 6 CONDITIONAL EXCEPTION NO. 71-91 Applicant: Regatta Boats To allow 31 fully improved parking spaces (with area for an additional 66 on -site parking spaces, unimproved at the present time) to serve as the required parking in lieu of the 97 spaces required by ordi- nance until such time as interior portions of the building are determined to be used for boat manufacturing and boat warehousing. Subject property is located on the northeast corner of Slater Ave. and Gothard St. in the M1 Light Industrial District. The hearing was opened to the audience. Mr. Wilkerson, representing the applicant, addressed the Board and explained the request. He stated because of the nature of boat manu- facturing large floor areas are needed for warehousing during assembly. Also, that before any expansion could be made, an Administrative Review would have to be. filed at which time the Board could require additional parking. was closed. There being no further comment, the hearing Board discussion followed. A MOTION WAS MADE BY PALIN AND SECONDED BY MCFARLAND TO APPROVE CONDITIONAL EXCEPTION NO. 71-91 WITH THE FOLLOWING CONDITIONS: 1. Conditional Exception No. 71-91 shall be reviewed in November, 1973, to determine the need for additional parking. 2. All applicable conditions of the H.B. Ordinance Code shall be complied with. AND FOR THE FOLLOWING REASONS: 1. The nature of the use in relation to the floor area used is a small ratio compared with other types of manufacturing. 2. The size of the parcel is such that additional parking can be provided when re- quired by the Board on any expansion. ROLL CALL VOTE: AYES: McFarland, Spencer, Palin NOES: None THE MOTION CARRIED. ADMINISTRATIVE REVIEW NO. 71-67 Applicant: Michael Patrick Dav To permit the retail sale of handcrafted goods within an existing building. Subject property is located on the southeast corner of Orange Ave. and llth St. in the C3 General Business District. Mr. Weber, representing the applicant, ad- dressed the Board and explained the request. Board discussion followed. A MOTION WAS MADE BY MCFARLAND AND SECONDED BY PALIN TO APPROVE ADMINISTRATIVE REVIEW NO. 71-67 WITH THE FOLLOWING CONDITION: 1. The applicant shall comply with the requirements of the Planning Department, Building Department and Fire Department for approval of a Certificate of Occupancy.
