The subject property is located on the west side of Nichols Street 640 ft. north of Slater Avenue. It was noted by -the Acting Secretary that correspondence had been received from the applicant requesting a continuance to January 4, 1972. USE PERMIT NO.'71-50 - Continued for decision only ;= Applicant: McKeon Construction Company To allow the construc- tion of a 176 unit Planned Residential Development on an 11 acre parcel of land in the R2 Two Family Residence District. The subject property is located on the north side of Heil Avenue and 410 f t. east of Algonquin Street. Darrell Boyer, representing the applicant, addressed the Planning Commission and reviewed the revised plot plans which incorporated the tot lots previously requested Ly the Commission. Mr. Boyer also reviewed plans for the private patios and schematics of the floor plans which complied with the floor area requirements of Code Amendment No. 71-22. The Commission questioned the location of the tot lots and size of the private patios. Commission discussion followed. A MOTION WAS MADE BY SLATES AND SECONDED BY BAZIL TO APPROVE USE PERMIT NO. 71-50 WITH THE FOLLOWING CONDITIONS: 1. The plot plan received December 3, 1971 shall be the approved layout. 2. The flood control channel shall be fenced with a 6 ft. high masonry wall. Such -wall shall be constructed to City standards. A substitute plan incorporating land- scaping and a chain link fence may be used to satisfy this requirement subject to approval of the Department of Public Works and Planning Department. 3. If the project is developed in increments, a plan sllowing sufficient vehicular circulation shall b(- submitted to the Board of Zoning Adjustments for approval. 5. A curved curb with a minimum radius of 40 ft. shall be provided where dead-end driveways exceed 150 ft. in length. A plan depicting the manner in which this improvement will be installed shall be submitted to the Planning Department for approval. 6. All streets within the project shrill be private streets. 7. A 6 ft. high separation wall shall be provided between this project and the property to the east and west. 8. The conditions, covenants and restrictions shall contain a clause limiting the total number of votes allocated to rental units to fifty (50%) percent of the total vote of the association. 9. Tree planting shall be equivalent to one 30 inch box tree per unit. A landscape plan for the total complex shall be approved by the Planning Department and Street Tree Superintendent. 10. Provisions shall be made to provide facilities for storing equipment and materials required by the association for maintentance of the project. Such areas shall be shown on the plot plan prior to issuance of building permits. 11. Trash collection areas shall be designed so as to eliminate visual and noise intrusion on adjacent properties. 12. A complete plan of landscaping, screening, recreational facilities and trash pickup shall be submitted to the Planning Department for approval prior to issuance of building permits. 13. Elevations of the units to be constructed within the project shall be submitted to the Planning Commission for approval prior to issuance of building permits. 14. All applicable provisions of Code Amendment No. 71-22 pertaining to standards for planned residential developments shall be complied with. 15. The landscape plan shall include tot lots and private patios. 16. There shall be four tot lots outside the major recreational areas provided within the residential modules. AND FOR THE FOLLOWING REASON: 1. The development complies with the Planned Residential Development ordinance. Planning Commission Tuesday, December 7, 1971 Page No. 4 MINORITY REPORT: Commissioners Duke and Kerins stated they felt the plan does not meet the --intent of the Planned Residential Development Ordinance, nor, the standards of the Planned Residential Development Ordinance -in that it has the same attributes as an apartment development; therefore, the City would be granting additional units per acre if this use permit is approved. - ZONE CASE NO.-71-28 - Continued Applicant: Covington Brothers - A change of zone from R2 Two Family Residence District, R1 Single Family -Residence District and RA Residential Agricultural District to R1 Single Family Residence District, R2 Two Family Residence District and-R3 Limited Multiple Family Residence District. The subject property is located approximately 283 ft. east of Beach Boulevard and 462 ft. north of Ellis Avenue. It was noted by the Acting Secretary that a letter of intent on development of Tentative'Tract No. 7S12 is on file. The hearing was opened to the audience. Mike Tugwell, adjacent property owner, spoke in opposition to the zone change. He felt high density was not desirable in such close proximity to the R1 area. Gerry Burns, representing the applicant, addressed the Planning Commission and spoke -in favor of the development. There being no further comment, the hearing was closed. Planning Commission discussion followed. A MOTION WAS MADE BY SLATES AND SECONDED BY BAZIL TO APPROVE ZONE CASE NO. 71-28 AS AMENDED WHICH INCLUDED LOTS 7 AND 8 R1 LOTS. FOR THE REASONS: 1. This property is ,designated as a non-structural blight area. The configuration of the property is such that it could not be developed except through consolidation under single ownership. 2. The density will not be increased over that as shown on the Master Plan of Land Use. 3. ZONE CASE NO. 71-40 - Continued Applicant: Huntington Beach Industrial Park A change of zone from M1-A Restricted Manufacturing District to R3-PD (15) Limited Multiple Family Residence District - Planned Development 15 units per acre. (The ordinance permitting planned development, 15 units per acre will be effective November 4, 1971.) The subject property is located on the west side of Graham Street, 130 ft. north of the centerline of Edinger Avenue. The Acting Secretary read a letter to the City Council from the applicant. The hearing was opened to the audience. Mr. William Lusk, applicant, addressed the Commission and explained the request. He felt there was a change in the concept and that home ownership is more desirable rather than apartment living as previously agreed. John Backen addressed the Commission and stated that industrial zoning is more desirable for tax base.' Also he would prefer to see the lower 12 acres developed as Phase I. Property owners spoke in opposition stating they felt there were no City benefits in apartments or Planned Residential Developments. the hearing was closed. There being no further comment, Commission discussion followed. MINORITY REPORT: 'Commissioners Porter, Duke, and Kerins stated the o owing reasons -for a nay vote:_ 1. The 14.32'acre,parcel of -land -at the southwest -corner of Edinger Avenue -and Goldenwest Street is zoned C2 Community Business District and although the 16.70 acre parcel of land -at the southeast corner of Edinger Avenue and Goldenwest Street -is zone RA, it is shown on,the Prelim- inary -Master Plan as, -being proposed for-community'shopping facilities: -6- 12/7/71, - PC' Minutes: H. There is an over -abundance -of commercial zoning in the area. 3. Some commercial businesses in this area are marginal. 4. Because of the imposingly substantial single family residence existing on the property adjacent, it could be rezoned R1. CONDITIONAL EXCEPTION NO. 71-54 Applicant: Robert Kerr To permit the boarding of 11 horses on a 16,800 sq. ft. parcel of land in the R2 Two Family Residence District. The subject property is located on the east side of Blanton Street approximately 135 ft. south of Prairie Drive, and legally described as Tract No. 349 Block D, Lots 13 and 15. James Palin, Associate Planner, showed vugraphs and video tapes of the subject property. The hearing was opened to the audience. Mr. and Mrs. Kerr, applicants, addressed the Commission and explained their request, noting its temporary nature. Mr. Kerr stated he felt there was an over -density of population in Huntington Beach and it is of value to have this stable in operation. Mrs. DeLoyola, adjacent neighbor, spoke in favor of this request. Mr. John Blake, owner of property to the east of this property, spoke in opposition stating he wishes to build on his parcel, and felt the stables were undesirable. Pauline Basascio stated there is a problem with flies and felt the stables were detrimental to health and that the horses were destructive to the land. Rubin Delgado, property owner, spoke in opposition to this request. There being no further comment, the hearing was closed. Commission discussion followed. Mr. Jones stated though his application requested waiver of the off -site improvements, he would be willing to install the improvements. He also noted that his request was for as temporary use. _ A letter of opposition was read to. the Commission from the owners of Lumberland, adjacent commercial property to the north. A MOTION WAS MADE BY SLATES AND SECONDED BY-HIGGINS TO APPROVE CONDITIONAL EXCEPTION NO. 71-56 WITH THE FOLLOWING CONDITIONS: 1. Conditional Exception No. 71-56 shall become null and void May 7, 1973. 2. Off -site improvements shall be made at this time. AND FOR THE FOLLOWING REASONS: 1. The use is not permitted in any commercial zone and is only a temporary use. 2. The applicant will improve the property as to curbs and sidewalks. ROLL CALL VOTE: AYES: Slates, Higgins NOES: Bazil, Duke, Porter, Kerins, Boyle ABSENT: None -THE MOTION DID NOT CARRY. A MOTION WAS MADE BY PORTER AND SECONDED BY BAZIL TO DENY CONDITIONAL EXCEPTION NO. 71-56 FOR THE FOLLOWING REASON: 1. The use is an unimproved open yard and the applicant can file a Use Permit application before the Board of Zoning Adjustments for the use with full on and off site improve- ments. MISCELLANEOUS: DISCUSSION - Formation of an assessment district within the area bounded by Palm Avenue, 17th Street, Goldenwest Street and Orange Avenue. This discussion was continued to the Study Session at 2:00 P.M. February 14, 1972. DISCUSSION - Planning Commission Goals - 1972 Schedule for a study session. Commissioner Kerins felt that the intent and==criteria •of- the -Planned Residential, - Development Ordinance,should be -reviewed.-,-'- It was the consensus of the Commission -'that the `staff update --the list and submit it back for -ranking -,of -the -,projects according to priority under each of the major headings. ORANGE COUNTY -PRELIMINARY HOUSING POLICIES•- RESOLUTIONS ' -F - - - -Jere=Murphy,, Associate Planner, discussed the resolution with-the'Commission. ;- It was the consensus of the Planning Commission that the staff -be instructed tot' prepare a- resolution' similar to -the SCAG resolution to= be-- , discussed at a study session. STAFF COMMENTS - Daniel McFarland, Building Department, -reported to -the -Commission on questions asked relative to,landscaping of'the trailer -park -at -Slater - Avenue and Beach Boulevard.- Also the signs,at-the Town $' Country Shopping Center.
