Burns To permit a reduction of 'residential minimum setback of a side entry garage from the required 10 ft. to 7 ft. -The subject property is. -located at 8671 Viceroy Cir. in the R1 Single Family Residence District. The -hearing was opened to the audience. Mr. Burns addressed the Board and explained his request. There being no other comment, the hear- ing was closed. Board discussion followed. A MOTION WAS MADE BY MCFARLAND AND SECONDED BY SPENCER TO APPROVE CONDITIONAL EXCEPTION NO. 71-98 WITH THE FOLLOWING CONDITION: 1. The encroachment shall be permitted only at the corner of the garage and such encroachment is not to exceed 7 ft. of the front property line. All other portions of the struc- ture shall observe the required setbacks. AND FOR THE REASONS: 1. The encroachment is only for 3 ft. x 5 ft. triangular area. 2. Subject property is a cul-de-sac lot abutting a flood con- trol channel and an Edison easement. ROLL CALL VOTE: AYES: McFarland, Spencer, Palin NOES: None THE MOTION CARRIED. CONDITIONAL EXCEPTION NO. 71-99 Applicant: Gary W. Connell To permit the construction of a fence for the purpose of creating a courtyard which will encroach 8 ft. 3 in. into the front yard setback in lieu of the required 10 ft. and to exceed the height limitation within the front yard setback to 7 ft. 6 in. in lieu of the required 42 in. The hearing was opened to the audience. Gary Connell and Mrs. Rosen-, property owner, addressed the Board and explained the request. It was noted by the Board that the application did not state fully the request as shownion the plot plan and would therefore have to be readvertised.- There being no other comment, the hearing was closed. A MOTION WAS MADE BY MCFARLAND AND SECONDED BY SPENCER TO CONTINUE CONDITIONAL EXCEPTION NO. 71-99 TO DECEMBER 299 1971 TO ALLOW TIME FOR APPLICATION TO BE READVERTISED. Applicant: Atlantic Engineering Inc. To permit modernization of an existing service station. The subject property is located at the northwest corner of Brookhurst St. and Adams Ave. in the C2 Community Business District. The hearing was opened to the audience. Mr. Adnan Khatib, representing the applicant, addressed the Board and explained the request. Landscaping requirements were 'discussed as well as the type of lighting for the canopies. There being no other comment, the hearing was closed. Board discussion followed. A MOTION WAS MADE BY PALIN AND SECONDED BY MCFARLAND TO -APPROVE USE PERMIT NO. 71-58 WITH THE FOLLOWING CONDITIONS:' 1. The required landscaping of 1230 sq. ft. shall be pro- vided at locations to be approved by the Planning Department, 2. Two 15 gal. on -site trees shall be provided compatible with landscaped areas. 3. Diffused lighting shall be installed in canopies. 4. Signing shall be as shown on the photographs. 5. The elevations and photographs received December 15, 1971 shall be the approved plan for the main structure and the signing. ROLL CALL VOTE: .AYES: McFarland, Spencer, Palin NOES: None THE MOTION CARRIED. USE PERMIT NO. 71-59 Applicant: Atlantic Engineering Inc. To permit modernization of an existing service station. The subject property is located at the northwest corner of Beach Blvd. and Edinger Ave. in the C2 Community Business District. The hearing was opened to the audience. Mr. Adnan Khatib, representing the applicant, addressed the Board and explained the request. It was noted by the Board that the City would like to add an extra land of traffic on this corner and asked whether dedication would be possible. The Board also discussed the height of wall along the east property line. Mr. Khatib stated they could not afford to give up the space for a traffic lane nor did they have a desire to lower the wall. There being no further comment, the hearing was closed. Board discussion followed. A MOTION WAS MADE BY PALIN AND SECONDED BY SPENCER TO APPROVE USE PERMIT NO. 71-59 WITH THE FOLLOWING CONDITIONS: 1. PLOT PLAN AMENDMENT NO. 71-10 Applicant: Tropical Enterprises To permit an increase in lot sizes and a change in the configuration of the storage area. The subject property is located north of Heil Ave., east of Saybrook Lane in the MH Mobilehome District. The hearing was opened to the audience. Dave Smith and Alex Loustaunau, representing the applicant, addressed the Board and explained their desire to increase the lot size because of the require- ments of MH District. A lengthy discussion was held with regard to fencing the drainage channel along the north property line. There being no further comment, the hearing was closed. Board discussion followed. A MOTION WAS MADE BY-PALIN AND SECONDED BY MCFARLAND TO APPROVE PLOT PLAN AMENDMENT NO..71-10 WITH THE FOLLOWING CONDITIONS: 1. The arrangement and layout of the mobilehome spaces shall conform to plot plans received November 24, 1971. 2. A plan shall be submitted to the Board of Zoning Adjust- ments for review concerning the fencing and -screening of drainage channel along the north property line prior to occupancy of park. 3. All conditions of approval of Use Permit No.. 71-34 shall be complied with. ROLL CALL VOTE: AYES: McFarland, Spencer, Palin NOES: None THE MOTION CARRIED. CONDITIONAL EXCEPTION NO. 71-100 In Conjunction With USE PERMIT NO. 71-57 Applicant: Leonard E. Lichter To permit a trailer, boat, camper storage yard with a waiver of standard conditions of Section 9534.1 Motor Vehicle Storage Yard. The subject pro- perty is located north of Talbert Ave., east of Gothard St. in the M1 Light Industrial District. The hearing was opened to the audience. Leonard Lichter and Bill Sullivan addressed the Board and explained the request. There being no further comment, the hearing,was closed. Board discussion followed. A MOTION WAS MADE BY MCFARLAND AND SECONDED BY SPENCER TO APPROVE"CONDITIONAL EXCEPTION NO. 71-100 WITH THE FOLLOWING CONDITION: 1. Approval is for a 2k year period subject to review by - the Board of Zoning Adjustments at that time, June 1973. FOR THE FOLLOWING REASON: 1. The topography of the land and the location of the facility on the property provides sufficient screening to meet the intent of the code. Minutes: H.B. A MOTION WAS MADE BY MCFARLAND AND SECONDED BY SPENCER TO APPROVE USE PERMIT NO, 71-57 WITH THE FOLLOWING CONDITIONS: 1. Approval shall be limited to a period of 22 years subject to review by the Board of.Zoning Adjustments in June 1973. 2. The access road to the proposed storage lot of existing manufacturing concern is to be graded and oiled and maintained in a serviceable condition. 3. Storage ads are to be oiled in compliance with Section 9534.1(c) of the Huntington Beach Ordinance Code. 4. Driveways within storage lots shall be oiled and/or gravelled and maintained for dust control. 5. The subject property shall be fenced on all four sides with a 6 ft. high fence; fencing material to be reviewed by the Board and landscaping requirements will be stipu- lated at that time. A MOTION WAS MADE BY PALIN AND SECONDED BY SPENCER TO APPROVE ADMINISTRATIVE REVIEW NO. 71-87 WITH THE FOLLOWING CONDITION: 1. Section 9730.25.4 of the Huntington Beach Ordinance Code shall be complied with. ROLL CALL VOTE: AYES: McFarland, Spencer, Palin NOES: None THE MOTION CARRIED. CONDITIONAL EXCEPTION NO. 71-13 - Review Applicant: Vancie E. Coffey The Board of Zoning Adjustments reviewed plot plans for Conditional Exception No. 71-13 as required by Planning Commission conditions of approval, nos. 1 and 2. It was the consensus of the Board that they take action on the parking, parking lot screening wall and land- scaping required and that the action on the lumber storage screen fence or wall be deferred until.the Planning Commission has set a policy on these types of facilities on Reach Blvd. A MOTION WAS MADE BY PALIN AND SECONDED BY MCFARLAND TO APPROVE PLOT PLAN RECEIVED DECEMBER 15, 1971 FOR PARKING, 24 INCH HIGH MASONRY SCREENING WALL AND LANDSCAPING AS SUBMITTED AND THAT THE BOARD RESERVE THE RIGHT TO REVIEW ADDITIONAL SCREENING WALLS AT A FUTURE DATE AND MAY ESTABLISH CONDITIONS AS DEEMED -NECESSARY. -4- 12/15/71-BZA Minutes: H.B.
