Jones To permit the operation of a commer- cial firewood sales lot in the C2 Community Business District. The subject property is located on the west side of Beach Blvd., approximately 212 ft. north of Utica St. It was noted by the Acting Secretary that the applicant had requested continuance of this item to January 5, 1972. A MOTION WAS MADE BY PALIN AND SECONDED BY MCFARLAND TO CONTINUE USE PERMIT NO. 71-62 TO JANUARY 5,. 1972 AT THE REQUEST OF THE APPLICANT. ROLL CALL VOTE: AYES: McFarland, Lovejoy, Palin NOES: None THE MOTION CARRIED. CONDITIONAL EXCEPTION NO. 71-99 - Continued Applicant: Gary W. Connell To permit the construction of a 6 ft. high fence to within 1 ft. 9 in. of the front property line and a 10 ft. high trellis to within 7.5 ft. of the front pro- perty line in lieu of the required 15 ft. front yard setback. The subject property is located on the north side of Niantic Circle, 131 ft. from Mistral Dr. in the R1 Single Family Resi- dence District. The hearing was opened to the audience. Gary Connell, addressed the Board and explained the request. The type of materials and design of the proposed structure were discussed. The applicant stated that he felt the addition would add esthetically and upgrade the property. There being no other comment, the hearing was closed. Board discussion followed. A MOTION WAS MADE BY PALIN AND SECONDED BY LOVEJOY TO DENY WITHOUT PREJUDICE CONDITIONAL EXCEPTION NO. 71-99 FOR THE FOLLOWING REASON:* 1. The applicant did not demonstrate sufficient hardship. Zinngrabe To permit a combination block and grapestake fence not to exceed 6 ft. above finished grade along the south property wall running east from Florida St. for approximately 450 ft. and a 42 in. high block wall on the remaining 150 ft. continuing east to property line on Delaware St. The subject property is located on the east side of Florida St., approximately 600 ft. north of Garfield Ave. in the R3 Limited Multiple Family Residence District. The hearing was opened to the audience. Robert Zinngrabe, applicant, addressed the Board and discussed the request. It was taken under considera- tion that the applicant filed a letter subsequent to filing the application for the fence along the south property line and construction thereof, relieving the City of all responsibility. There being no further comment, the hearing was closed. Board discussion followed. A MOTION WAS MADE BY PALIN AND SECONDED BY MCFARLAND TO APPROVE PLOT PLAN AMENDMENT NO. 71-11 WITH THE FOLLOWING CONDITION: 1. Conditions of Approval of Conditional Exception No. 70-67 shall be complied with with an amendment to condition no. 13 to read, "at such time as the adja- cent property develops residential". ROLL CALL VOTE: AYES: McFarland, Lovejoy, Palin NOES: None THE MOTION CARRIED, USE PERMIT NO. 71-60 Applicant: Standard Oil Co. of Calif. To permit oil and gas well drilling in the R1-01 Single Family Residence District combining oil. The subject property is located approxi- mately 850 ft. west of the western terminus of Utica Ave. audience. The hearing was opened to the Dick Buhr, representing Standard Oil Co., addressed the Board and explained the request. It was noted by the Board that the applicant would have to participate in the local drainage assessment district for the area and that specific details could be obtained from the Department of Public Works. There being no further comment, the hearing was closed. Board discussion followed. A MOTION WAS MADE BY PALIN AND SECONDED BY MCFARLAND TO APPROVE USE PERMIT NO. 71-60 WITH THE FOLLOWING CONDITIONS: 1. The plot plan received December 14, 1971 shall be the approved layout. 2. All applicable City ordinances shall be complied -with. ROLL CALL VOTE: AYES: McFarland, Lovejoy, Palin NOES: None THE MOTION CARRIED. ADMINISTRATIVE REVIEW NO. 71-87 Applicant: Ernest A. Laurin To allow the care of three non -related persons under the provisions of Section 9730.26 of the Huntington Beach Ordinance Code. The subject property is located approximately 160 ft. south of Reilly Dr., east of Goshawk Ln. in the R1 Single Family Residence District. The hearing was opened to the audience. Mr. Laurin addressed the Board and explained the request. Mr. Rous, property owner, addressed the Board and questioned the number of persons requested by the applicant. He was informed by the Board that approval could not exceed that number requested on the application. The Board questioned the documentation of the application and was informed by the applicant that his license is presently pending and that he would have them forthcoming. It was the consensus of the Board that proper documentation had not been submitted; therefore, the request should be continued. The applicant so requested. There being no further comment, the hearing was closed. Board discussion followed. A MOTION WAS MADE BY MCFARLAND AND SECONDED BY PALIN TO CONTINUE ADMINISTRATIVE REVIEW NO. 71-87 TO JANUARY 5, 1972 TO ALLOW TIME FOR THE APPLICANT TO FILE HIS LICENSE WITH THE CITY. ROLL CALL VOTE: AYES: McFarland, Lovejoy, Palin NOES: None THE MOTION CARRIED. USE PERMIT NO. 71-61 Applicant: Robert August To permit a restaurant in the C4 High- way Commercial District. The subject property is located at the southeast corner.of Beach Blvd. and Atlanta Ave. The hearing was opened to the audience. Robert August, applicant, addressed the Board and explained tihe request. `The Acting Secretary informed the Board that the applicant has a site plan on file with the Planning Department for on -premise sale of alcoholic beverages. There being no further comment, the hearing was closed. Board discussion followed. Construction Co. To allow the southeast corner of a garage to encroach 2 ft. into the required 5 ft. side yard setback. The subject property is located at 16741 Carousel Lane in the R1 Single Family Residence District. the audience. The hearing was opened to Dick Ashby, representing the applicant, addressed the Board and explained that the encroachment due to mis-plotting and the bearing of a side property line as shown on the original plot plan submitted to the Building Department caused the building to be constructed within 3 ft. of the side property line. There being no further comment, the hearing was closed. Board discussion followed. A MOTION WAS MADE BY MCFARLAND AND SECONDED BY PALIN TO APPROVE CONDITIONAL EXCEPTION NO. 71-101 FOR THE FOLLOWING REASONS: 1. The lot is irregular in size and shape with numerous off -sets in the property line and has frontage of only 28 ft. 2. The request is only for a small triangular area at one corner of the structure with an encroachment of 2 ft. into the side property line. 3. The home has been constructed and finalled-off by the City with subject encroachment. 4.
