Huntington Beach Industrial Park To permit a reduction in the number of parking .spaces to -six (6) in 1'ieu ,of the requited 12 spaces; and, to.permi°•t a .zero side yard setback in lieu of the required 15 ft-..setback. The subject property is located south of - Research Dr. between Commerce and Computer Lanes in,•the MI -A Limited:Manufacturing District. The hearing was opened to the audience. George Lusk, applicant, addressed the Board -and explained the request.. He stated'that because of the specific type of use proposed, which is a.cold storage facility., he .felt that the parking required by .ordinance would far exceed :the demands for the use. The Board reviewed the -minimum -parking and driveway dimensions with the applicant and informed him that the fence proposed along the west property -line would have to be•..readjusted to•allow for the minimum dimensions as required by Article 9.79. George Lusk, applicant, informed the Board that the adjacent property was held under the same ownership and there would be no problem in getting this fence .adjustment, between lots 44 and 43. hearing was closed. There being no further comment, the Board discussion followed. A MOTION WAS MADE BY PALIN-AND SECONDED BY .SPENCER 'TO .APPROVE CONDITIONAL EXCEPTION VO. .71-92 WITH THE 'FOLLOWING CONDITIONS: 1. The plot plan received 0ctober.28, '1971 as amended shall be' the .approved layout . 2. ."The.applicant shall comply with all conditions of approval for'Tract 7090. 3. Soil reports -as required by the Building Department and the Department of Public Works shall be submitted to the 'City pr1or to issuance of building permits. 4.. All utilities shall be installed underground.,- 5. Off-s`.tre_et ,parking facilities ,shall conform .to Article 979. 6, 'The fence between lots 43.and 44 shall be adjusted to .ali•ow minimum dimension -on parking spaces and driveway width.. 7. A11.applicable�City Ordinances shall'be complied with. AND FOR THE REASONS: 1. Zero side yard -was approved because this type of construction affords better utilization•of the property.and the applicant has proposed a zero side yard for the abutting lot creating a common zero side yard setback. 2. The nature of the business is such that•there-is only one or -two employees on -site at any time and the -building would -not lend itself to any other type of manufacturing or storage use. DIVISION OF LAND NO. 71-32 - Continued Applicant: Pizza Hut To allow the division'of a legal parcel of land into three separate parcels. The subject pro- perty is located on'the east side of Beach Blvd., northeast corner of Holland St. in the C4 Highway Commercial District. Dave Kirchener, representing the applicant, addressed the Board and explained the request. The Board informed Mr. Kirchener that a use permit application would be required for the pro- posed use. CONDITIONAL EXCEPTION NO. 71-102 - Continued Applicant: La_Cuesta To permit the following: Lot 12, a minimum dimension of 23 ft., in lieu of the required 25 ft. on the 900 sq.* ft. portion of open space provided, Lot 55 - A minimum dimension of 21 ft. in lieu of the required minimum dimension of 25 ft. for open space. The Acting Secretary informed the Board that the applicant had been -in contact and advised that the suggestions -of the Board of Zoning Adjustments to change models on lot 55 was successful -therefore, he no longer needed the exception�on,,subject-lot. Board discussion was held. A MOTION WAS MADE BY PALIN AND SECONDED BY SPENCER TO APPROVE THE REQUEST FOR LOT 12 ONLY AND TO DENY THAT PORTION OF THE REQUEST FOR LOT 55 FOR THE FOLLOWING REASONS: 1. Lot 12 is a corner lot for which the developer has a specific single story model of Early California style architecture. 2. The subdivision was designed and recorded for another developer -who constructed small units. 3. The applicant ,is providing, over; 1600 sq" ft. of open space within one area of the lot having minimum dimen- sions of 23 ft. To permit drilling and'operating for the discovery or production of oil, gas, hydrocarbons and/or kindred substances in their natural state,: including the installation -and use of equipment, structures, tools and other facilities incidental, necessary and accessory to the drilling, production, repressuring and processing of substances produced by such wells for shipment to pipeline. The subject property is located east of 18th St., south -of Pacific Coast - Highway and west of 19th-St. in the C3 General Business'District and .C3-0:General Business District combining oil. The hearing was opened -,to -.the audience. Bill Woods, representing the applicant, addressed the Board and reviewed a revised plot plan which incorporated additional landscaping along 'Pacific Coast Highway as suggested by the Board at a previous meeting. The design of the perimeter wall and types of material were discussed and it was determined that slump stone block should be used. Charles Spencer, Public Works -Department, informed .the applicant that a special encroachment &rmit would be required to -allow landscaping within the ultimate right-of- way along .Pacific Coast Highway. There being no further comment, the bearing -was closed. Board discussion followed. A MOTION WAS MADE BY PALIN AND SECONDED BY SPENCER TO APPROVE USE PERMIT NO. 71-64 WITH THE FOLLOWING CONDITIONS: 1. The plot plan received Januaryl2, 1972 shall be the approved layout. 2. 18th St., 19th St. and Pacific Coast Highway and the alley shall be dedicated and fully improved to City and/or State standards at the time the parcel is developed. Sidewalk widths shall be approved by the Department of Public Works. Improvements shall include street trees, street signs, street lights, fire hydrants, sewer and water main extensions. 3. Water supply shall be through the City'bf Huntington Beach's water system. 4. Sewage disposal shall be through the City of Huntington Beach's sewage system. 5. The water, sewer and fire hydrant system shall be approved by .the Department of Public Works and Fire Department. 6. The property shall participate in the local drainage assessment district if applicable. 7. All utilities shall be installed underground. 8. landscaping plan and water system shall be approved by the Board of Zoning Adjustments prior to certificate of occupancy on the operation site. 9. A masonry wall shall be constructed along 'all property lines. The height of said wall shall be such that the top will be eight (8) feet above the highest ground surface within twenty (20) feet of the common property line. The wall material shall be slumpstone and the design shall be approved by the Board of Zoning Adjustments at the time of review of a landscape plan. 10. No structures, other than those shown on the approved plot plan, shall be constructed within the project. 11. All applicable City Ordinances shall be complied with. -3- 1/12/72-BZA Minutes: H.B. ADMINISTRATIVE REVIEW NO.--71-89 Applicant: Mr. & Mrs. Joseph De Sues To., permit, the, operation- of a retail interior decorator shop business.-- The subject -pro- perty is located on the west side of Main St.- between 6th and 7th Sts. in,the C3 General Business District: Mr. -and -Mrs. DeSues addressed the Board and explained the request. It was noted by the Board that an Administrative Review was an improper application to re- establish a commercial business in a residential dwelling in the C3 zone where such commercial use had been,abated for more than.6 months. A lengthy discussion followed as to proper procedure in receiving approval of the City for this type of operation. The applicant was informed that the dual use of property within a residential dwelling in the C3 zone would require a Conditional Exception application before the Planning Commission. Board discussion followed. A MOTION WAS MADE BY SPENCER AND SECONDED BY PALIN TO CONTINUE ADMINISTRATIVE REVIEW NO. 71-89 TO ALLOW -TIME FOR THE BOARD TO INVESTIGATE THE DATE OF THE EXPIRED -BUSINESS LICENSE FOR THE PRIOR COMMERCIAL USE AND TO GET AN OPINION FROM THE ATTORNEY'S OFFICE IN ESTABLISH- ING A DUAL USE OF PROPERTY IN A COMMERCIAL DISTRICT. ROLL CALL VOTE: AYES: Lipps, Spencer, Palin NOES: None THE MOTION CARRIED. DIVISION OF LAND NO. 72-1 - Applicant: Donald P. Jones To adjust the lot line of two adjacent legal parcels of land. The subject property is located on the west side of Beach Blvd., 180 ft. north of Utica St. in the C2 Community Business District. Don Jones, applicant, addressed the Board and explained the request. It was -noted by the Board that a conditional exception application -would be required along with the Division of land application for the zero setback of the structure. Board discussion followed. A MOTION WAS MADE BY PALIN AND SECONDED BY SPENCER TO CONTINUE DIVISION -OF LAND NO. 72-1 TO JANUARY 19, 1972 TO ALLOW TIME FOR THE APPLICANT TO FILE A CONDITIONAL EXCEPTION APPLICATION. ROLL CALL VOTE: AYES: Lipps, Spencer, Palin NOES: None THE MOTION CARRIED. ADMINISTRATIVE REVIEW NO. 72-1 Applicant: Standard -Pacific Corp. To permit- -the- temporary use of a mobile unit to be used as a sales office for Tract 5972. The subject property is,located on the south side'of Atlanta Ave. between Miramar Dr. and Newland St. in the R1 Single Family Residence District. -4- 1/12/72-BZA Minutes: H.B. A MOTION WAS MADE BY PALIN AND SECONDED BY SPENCER TO APPROVE ADMINISTRATIVE REVIEW NO. 72-1 WITH THE FOLLOWING CONDITIONS: 1. Section 9730.25.4 of the Huntington Beach Ordinance Code shall be complied with. 2. Flags, as shown on the plot plan, shall not be allowed. ROLL CALL VOTE: I AYES: Lipps, Spencer, Palin NOES: None THE MOTION CARRIED. CONDITIONAL EXCEPTION NO. 71-68 - Review Applicant: Huntington Harbour Corp. To permit the change of copy on an existing temporary directional sign to include exposure for commercial development. The subject property is located 24 ft. north of Warner Ave., 26 ft. west of Algonquin St. in the R1 Single Family Residence District. The hearing was opened to the audience. It was noted by the Acting Secretary that this application had been continued to allow the applicant time to study the feasibility of establishing a permanent identification sign which would incorporate signing for all types of uses within their development. Dale Dunn, representing the applicant, addressed the Board and explained that they have not as yet established a specific theme and requested that the Board consider allowing the sign as it presently exists for the duration of the sign permit. Mr. Dunn was advised that Huntington Harbour will be developing residential units on the abutting property within the next year which will require that the present sign be removed as the City could not renew the sign permit. There being no further comment, the hearing was closed. Board discussion followed. A MOTION WAS MADE BY PALIN AND SECONDED BY LIPPS TO APPROVE CONDITIONAL EXCEPTION NO. 71-68 WITH THE FOLLOWING CONDITION: 1. Approval shall not exceed the expiration of the sign permit. AND FOR THE FOLLOWING REASONS: 1. This is a major land development project which incorporates all types of land uses requiring years to complete. 2. The traffic count on Algonquin, an Arterial Highway, has not reached the volume at this time to allow identification of the shopping center only at that location. 3. At the time the application was filed, there were six vacant stores within the shopping center which justifies the economic hardship for signing of this center on Warner Ave. ROLL CALL VOTE: AYES: Lipps, Spencer, Palin NOES: None THE MOTION CARRIED.
