In Conjunction With USE PERMIT NO. 71-65 - Applicant: Pizza Hut To permit the construction and opera- tion of a Pizza Hut. The subject property is located on the east side of Beach Blvd., northeast corner of Holland St. in the C4 Highway Commercial District. It was noted by the Board that a development plan for total property had not been received. Dave Kirchener, representing the applicant, addressed the Board and requested a continuance of these two items. Board discussion followed. A MOTION WAS MADE BY MCFARLAND AND SECONDED BY PALIN TO CONTINUE DIVISION OF LAND NO..71-32 AND USE PERMIT NO. 71-65 TO JANUARY 26, 1972 TO ALLOW TIME FOR THE APPLICANT TO SUBMIT ADDITIONAL DOCUMENTATION. ROLL CALL VOTE: AYES: McFarland; Spencer, Palin NOES: None THE MOTION CARRIED. DIVISION OF LAND NO. 72-1 - Continued Applicant: Donald P. Jones To adjust the lot line of two adja- cent legal parcels of land. In Conjunction With CONDITIONAL EXCEPTION NO. 72-1 Applicant: Donald P. Jones To permit zero rear yard setback on a portion of a motorbike sales agency in lieu of the required 10 ft. rear yard setback. The subject property is located on the west side of Beach Blvd., approximately 180 ft. north of Utica_St. in the C2 Community Business District. The hearing was opened to the audience. Don Jones, applicant, addressed the Board and explained the request. It was noted by the Acting Secretary that an Administrative Review application would be required to be filed to allow the use as the applicant had only requested a reduction of the rear yard setback on Conditional Exception No. 72-1 Various recommendations were made to the applicant with regard to the walls, etc. Zero rear yard setback was discussed. The applicant agreed to a continuance of these items to allow time to file an Administrative Review application. Minutes: H.B. A MOTION WAS MADE BY MCFARLAND AND SECONDED BY PALIN TO CONTINUE DIVISION OF LAND NO. 72-1 AND CONDITIONAL EXCEPTION NO. 72-1 TO ALLOW TIME FOR THE APPLI- CANT TO SUBMIT AN ADMINISTRATIVE REVIEW APPLICATION AND TO SUBMIT REVISED PLOT PLANS. ROLL CALL VOTE: AYES: McFarland, Spencer, Patin NOES: None THE MOTION CARRIED. ADMINISTRATIVE REVIEW NO. 71-89 - Continued Applicant: Joseph & Norma De Sues To permit the operation of a retail interior decorator shop business. The subject property is located on the west side of Main St. between 6th and 7th Sts. in the C3 General Business District. It was noted by the Board that the City Attorney's office had been contacted. Also, that the commercial use was not the non -conforming use, therefore, no abatement could be considered. However, the residential use is.non-conforming but had not been abated. Access to the resi- dence was discussed and compliance with the parking requirements. A lengthy Board discussion was held. The applicant agreed to a continuance. A MOTION WAS MADE BY MCFARLAND AND SECONDED BY SPENCER TO CONTINUE ADMINISTRATIVE REVIEW NO. 71-89 TO ALLOW ADDITIONAL TIME FOR THE BOARD TO MEET WITH THE CITY ATTORNEY TO DISCUSS THE NEW INFORMATION REVIEWED WITH THE BOARD BY THE APPLICANT ON THE USE OF THE PROPERTY. ROLL CALL VOTE: AYES: McFarland, Spencer, Patin NOES: None THE MOTION CARRIED. It was the consensus of the Board that a field trip should be made to review the use. USE PERMIT NO. 71-66 Applicant: Charles J. Wilmot To permit a'garage conversion and the construction of a carport. The subject property is located at 16561 Trudy Lane in the R1 Single Family Residence District. audience. The hearing was opened to the Charles Wilmot, applicant, addressed the Board and explained the request. It was noted that a field trip had been made to the property to check the driveway loca- tion and it was fine. the hearing was closed. There being no other comment, Board discussion followed. A MOTION WAS MADE BY PALIN AND SECONDED BY MCFARLAND TO APPROVE USE PERMIT NO. 71-66 WITH THE FOLLOWING CONDITIONS: 1. Design and materials as shown on photographs submitted January 19, 1972. AND FOR THE REASON: 1. The structure is compatible wi-:h existing structure and the surrounding area. CONDITIONAL EXCEPTION NO. 71-103 Applicant: Charles Geers To permit a reduction in the required landscaping of 5 ft. to a 3 ft. planting strip. The subject property is located on the southwest corner of Adams Ave. and Huntington St. in the C4 Highway Commercial District. The hearing was opened to the audience. Mr. Geers, applicant, addressed the Board and explained the request. The applicant was advised that sup- plementary documentation would be required before the appli- cation could be acted on. Also, that the Conditional Exception would have to state the request for a reduction in parking for a service type commercial building and would have to be readvertised. There being no further comment, the hearing was closed. Board discussion followed. A MOTION WAS MADE BY MCFARLAND AND SECONDED BY PALIN TO CONTINUE CONDITIONAL EXCEPTION NO. 71-103 TO FEBRUARY 2, 1972 TO ALLOW THE APPLICANT TIME TO SUBMIT - SUPPLEMENTAL APPLICATIONS AND REVISE PLANS AS NECESSARY. ROLL CALL VOTE: AYES: McFarland, Spencer, Palin NOES: None THE MOTION CARRIED. CONDITIONAL EXCEPTION NO. 71-104 Applicant: Leonard 0. Lindborg To allow a reduction in open space dimension from the required 20 ft. to 10 ft. on lots 2, 4, 6, 81 149 16, 18, 20, 22, 24, 26 and 28 in the Huntington Beach 17th St. Section. The subject property is located at 17th St. (east) between Acacia and Pecan Aves. in the R2 Two Family Residence District. The hearing was opened to the audience. Lenny Lindborg, applicant, addressed the Board and explained the request. There being no other comment, the hearing was closed. Board discussion followed. A MOTION WAS MADE BY PALIN AND SECONDED BY MCFARLAND TO APPROVE CONDITIONAL EXCEPTION NO. 71-104 WITH THE FOLLOWING CONDITION: 1. The design and layout of patio areas received January 12, 1972 shall be the approved layout for open space. AND FOR THE FOLLOWING REASONS: -3- - 1/19/72 Minutes: H.B. A code amendment has been approved by the Planning Com- mission and City Council allowing this type of variation within the open space areas. 3. This concept provides -open space that relates to each unit. ROLL CALL VOTE:— AYES: McFarland, Spencer, Palin NOES: None THE MOTION CARRIED. CONDITIONAL EXCEPTION NO. 72-2 Applicant: Leonard 0. Lindborg To allow a 10 ft. and 12 ft. minimum dimension on open space in lieu of the required 20 ft. The subject property is located on the west side of 19th St. and south of Palm Ave. in the R2 Two Family Residence.District. The hearing was opened to the audience. The subject property is located on the south side of Warner Ave., west of Beach Blvd. in the C4 Highway Com- mercial District. The hearing was opened to the audience. Henry Chuba, J & B Sign Co., representing the applicant, addressed the Board and explained the request. He explained to the Board that this sign had been installed prior to issuance of.a sign permit. Also that the sign had been increased in size. Signs on the adjacent pro- perties were discussed. There be:Ing no further comment, the hearing was closed. Board discussion followed. A MOTION WAS MADE BY'MCFARLAND AND SECONDED BY PALIN TO CONTINUE CONDITIONAL EXCEPTION NO. 72-4 TO JANUARY 26, 1972 TO ALLOW TIME FOR THE BOARD AND APPLICANT TO SURVEY THE AREA AND DETERMINE THE -PRO- PER LOCATION FOR THE SIGN. ROLL CALL VOTE: AYES: -McFarland, Spencer, Palin NOES: None THE MOTION CARRIED. DIVISION OF LAND NO. 72-2 Applicant: Freeway Industrial Park To divide a legal.parcel of land into two separate legal parcels. In Conjunction With CONDITIONAL EXCEPTION NO. 72-5 Applicant: Bob's Big Boy To permit ornamental piers to project 5 ft. 10 in. beyond the 25 ft. maximum encroachment on Edinger Ave. and to permit the build- ing to project 18 ft. beyond the 25 ft. maximum encroachment on Gothard St, In Conjunction With USE PERMIT NO. 72-1 Applicant: Bob's Big Boy To permit the construction of a new restaurant. The subject property is located on the north side of Edinger Ave., west side of -5- 1/19/72-BZA E Minutes: H.B. Board of Zoning Adjustments January 19, 1972 Page 6 Gothard St. in the C4 Highway Commercial District. The hearing was opened ;to the audience. John Barringer, representing Bob's Big Boy, addressed the Board and explained the request. It was noted by the Board that the plan had not been revised to show a proper setback from Gothard St. There being no further comment, the hearing was closed. The Board held a lengthy discussion. It was the consensus of the Board that they could not act on the application because of the excessive encroachment. A MOTION WAS MADE BY PALIN AND SECONDED BY MCFARLAND TO REFER DIVISION OF LAND NO. 72-29 CONDITIONAL EXCEPTION NO. 72-5 AND USE PERMIT NO. 72-1 TO THE PLANNING COMMISSION MEETING FEBRUARY 1, 1972 IN THE COUNCIL CHAMBER AT 7:00 P.M. FOR THE FOLLOWING REASON: 1. These applications are proper for this request but it is beyond the scope of the Board to act on a variance of this magnitude. ROLL CALL VOTE: AYES: McFarland, Spencer, Palin NOES: None THE MOTION CARRIED. MISCELLANEOUS: A letter was received from E. F. Hartmann with regard to traffic problems and insufficient parking located on the north side of Warner Ave., approximately 1400 ft. west of Goldenwest St. at the main Huntington Beach Post Office. This letter was reviewed by the Board at the request of the Acting Secretary of the Planning Commission. The letter requested a revised layout for the parking at the main post office on Warner Ave. It was the consensus of the Board that because of additional parking along the side and to the rear of the structure, the proposed layout submitted by Mr. Hartmann was not acceptable and would create more pro- blems than currently exist.
