ZONE CASE NO. 71-40 - Continued from January 18, 1972 Applicant: Huntington Beach Industrial Park A change of zone from M1-A"Restricted Manufacturing District to R3-PD.(15) Limited Multiple Family Residence District - Planned Development 15 units per acre. The property consists of 35 acres of land -and-is located on the west side of Graham Street, 130 ft. nor-th of the centerline of.Edinger Avenue. The hearing was reopened to the audience. The Acting Secretary suggested ,that Master Plan Amendment No. 72-2 (Item #17) be heard in conjunction with Zone Case No. 71-40. John Lusk, applicant, explained the proposal. Mr. Lusk informed the Commission that the density will be reduced from 25 units per acre to 13.91 units per -acre. Mr. Lusk stated that the price of the units proposed would be from $18,995 to$24,000. Katherine Wallin, 6782 Baker Drive, Huntington Beach, asked about the status of the property. Mrs. Wallin stated that she was concerned with erosion of tax base and, further pointed out that a density of 15 units per acre is too high. A MOTION WAS MADE BY SLATES AND SECONDED BY BAZIL TO APPROVE ZONE CASE NO. 71-40 FOR AN R3-PD (15) -Commissioner Bazil withdrew his second because he felt the applicant should submit a precise legal description for all three phases, as such legal descrip- tion will be needed for three separate ordinances which would be required for this request. A FURTHER MOTION WAS MADE BY BAZIL AND SECONDED BY HIGGINS TO CONTINUE ZONE CASE NO. 71-40 TO MARCH 7, 1972, FOR THE FOLLOWING REASONS: 1. To allow time for the City Council to establish a phasing plan of the development and, to make a decision on the Master Plan Amendment. 2. The owner should submit three separate legal descriptions for phasing development of said property. ROLL CALL VOTE: AYES: Bazil, Higgins, Duke, Porter, Kerins NOES: Slates ABSENT: Boyle THE MOTION CARRIED. MASTER PLAN AMENDMENT NO. 72-2 A Master Plan Amendment to a portion of Study Area "C". The proposed amendment is for a change from light industrial to medium density residential for a 36.5 acre parcel located at the northwest corner of Edinger Avenue and Graham Street. The hearing was opened to the audience, there being no comment the hearing was closed. Commission discussion followed. A MOTION WAS MADE BY HIGGINS AND SECONDED BY BAZIL TO RECOMMEND APPROVAL OF MASTER PLAN AMENDMENT NO. 72-2 TO THE CITY COUNCIL FOR THE FOLLOWING REASON: 1. To uphold the gentlemen's agreement between the developer and the city as evidenced by the rezoning of 10 acres of land. Lusk, that -'the--- 4-4 -. 5acres * of -property Iodated on both sides of Graham Street and north of Edinger Avenue would -be. -zoned to a multiple - density (R3) , .subject only. to - a building phasing program. As part of this commitment, a zone change to_R3 was.granted-on.the ten acre parcel located on the east side of Graham Street. Later the City acquired_ five of the- ten acres, for-,a_park. , 2. The 35- acre parcel of­propertysubject to Master Plan Amendment 72-2 is now zoned MI -A and is -surrounded -on three sides by non-industrial",land uses (residential)..-. Because of these uses on -the surrounding property, I do not think .the_ subject property lends -itself._to .industrial uses. _. 3. This Master Plan Amendment and subsequent.zone change (low to middle income --townhouses) will allow, -the developer to build housing -of a type and.price that will f ill - a critical need in the- area;.._as -evidenced :by surveys presented io the -Planning,.Commission by the `staff. These surveys "indicated absolutely no homes for sale or sold in the area for less than $22,500.00 4. The availabili-ty_ of:,reasonable-:priced new -housing - immediately adjacent�,to an -industrial area, -is something most +industrial developments have not been in a position to offer. This -will allow the Huntington Beach Industrial Park to be mare compe_ti.tive with other industrial areas outside .of Huntington Beach (ie. Irvine, Segerstrom, etc.) S. The R3-PD :(15-), development that will be built if the Master Plan_Amendment is approved, will result in a lower unit density._than a R3 apar.tment development (approximately 350 housing. units lees) ., - It -should not_ --be- overlooked that the -proposed development"will allow --individual ownership of housing rather than absentee ownership -,which generally exists -in a -normal- multiple- family (R3--ap-t.) development. : -4- - 2/t/72 - PC Minutes: 11. B. Planning Commission Tuesday, February 1, 1972 Page No. 5 For these reasons, I feel the City Council should definitely approve Master Plan Amendment 72-2. A brief review of the reasons for approval are: 1. A Commitment by the City was made for Multiple Family density. 2. The area is not prime industrial land. 3. A lower density than what was originally proposed and approved will be developed. 4. A housing type (individually owned townhouses) in a price range not available in the immediate area and critically needed will be built. COMMISSIONER BAZIL: Commissioner Bazil changed his vote From -No so the matter could be transmitted to the City Council for consideration and stated that his vote did not reflect his opinion on this matter. The following reasons were given for denial of the proposal: 1. Said amendment will have a detrimental effect on the tax base. 2., There is sufficient housing in the area for workers that will be employed in this industrial area. 3. The gentlemen's agreement with the Lusk Company should be backed up by ordinance. Additional Information: It was the consensus of the Commission that if the City Council approved this request, it be done in a phasing program and this program be evaluated by the Commission. ZONE CASE NO. 71-42 (Continued from December 21, 1971) Applicant: Classic Development Corporation A change of zone from M2-0 and M2-01 Heavy Industrial District combined with oil production to R2-PD Two Family Residence District - Planned Residential Development Suffix and R2-PD-01 Two Family Residence District - Planned Residential Development Suffix combined with oil production. The subject property is located on the south side of Ellis Avenue and west of Huntington Street. Commissioner Higgins stated that he would abstain on this item. The hearing was opened to the audience. Morree Nickle, representing the applicant, stated that this parcel lends itself to residential development. Mr. Nickle submitted a petition signed by fifty (50) property owners endorsing said zone change for residential purposes. Bill Wren, Huntington Beach Company, informed the Commission that the drainage cost to develop the property is approximately $80,000 or $10,000 per acre. The topography prohibits development of this property for residential purposes. 2. Subject property would be a good industrial property if Ellis Avenue is extended. 3. This would constitute further erosion onto industrial zoned property. ROLL CALL VOTE: AYES: Duke, Bazil, Porter, Kerins NOES: Slates ABSENT: Boyle ABSTAINED: Higgins THE MOTION CARRIED. MINORITY REPORT: Commissioner Slates stated that he feels the City shou-7 make an effort to develop this property regardless of the land use. Chairman Porter stated that replacement of subject property with other property which could be -zoned and used as an industrial use in order to retain tax base. ZONE CASE NO. 72-7 Applicant: Lawrence J. Rink A change of zone from R2 Two Family Residence District to R3-PD Limited Multiple Family Residence District - Planned Residential Development. The subject property is located on the southeast corner of Algonquin Street and Pearce Avenue consisting of approximately 4.48 acres of land. Vice -Chairman Duke took over' the chair. The hearing was opened to the audience. Slides of a similar project were shown indicating the type of development proposed. Lawrence Rink, applicant, explained the request. Mr. Dick Tom, architect, reviewed the proposed plan with the Commission. Chairman Porter assumed his duties. Two persons from the Huntington Harbour Home Owners -Association spoke in opposition. A petition signed by nine: owners of commerical_rusiness in the Huntington Harbour Boardlralk Shopping Center, endorsing said proposal was submitted to'the-Secre.tary. COMMISSIONER SLATES: Commissioner Slates was excused from further participation at 9:40 P.M. CONDITIONAL EXCEPTION NO. 71-101 (Appeal - Board of Zoning Applicant: J.M.C. Construction Company Adjustments) To allow the southeast corner of a garage to encroach 2 ft. into the required 5 ft. side yard setback. The subject property is located at 16741 Carousel Lane in the R1 Single Family Residence District legally described as Lot150, Tract No. 5481. Video tape was shown of the subject property and surrounding area. The hearing was opened to the audience. The applicant addressed the Commission and explained the request. Mr. and Mrs. Linden, 6110 Flight Drive spoke in opposition. the hearing was closed. There being no other comment Commission discussion followed. A MOTION WAS MADE BY BAZIL AND SECONDED BY HIGGINS TO SUSTAIN THE BOARD OF ZONING ADJUSTMENTS DECISION AND DENY THE APPEAL FOR THE FOLLOWING REASONS: 1. The lot is irregular in size and shape with numerous off -sets in the side property lines and has frontage of only 28 ft. 2. The request is only for a small triangular area at one corner of the structure with an encroachment of 2 ft. into the side property line. 3. The applicant filed this application to legalize the encroachment on his own initiative. 5. Similar requests have been granted within this general area in the past. 6. Visual obstruction is no more than that of an architec- tural feature which could be constructed with the same setback. 7. Removal of this encroachment would remove one off-street parking space. The subject property is located on the west side of Goldenwest Street, 820 f t. south of the centerline of Warner Avenue and consists of a 0.62 acre parcel of land. The hearing was opened to the audience. Two persons spoke in opposition and one property owner spoke in favor. There being no other comment the"hearing was closed. Commission discussion followed. The Commission reviewed the staff report pertaining to all three items. The Acting Secretary informed the Commission that the Board of Zoning Adjustments referred these applications to them for decision because it was felt by the Board that this great an encroach- ment into the required 50 ft. setback should be acted upon by the Commission. Mr. Harlow'further pointed out that the applicant discussed the need for the 7 ft. setback from Gothard Street and the fact -that the building would screen the parking areas. Planning Commission Tuesday, February 1, 1972 Page No. 16 DISCUSSION: CENTRAL INDUSTRIAL STUDY ASSUMPTIONS - LOWER PORTION Jere Murphy, Associate Planner, reviewed with the Commission a work outline which the staff felt should be approved prior to a study because of the assumptions on freeway construction and the 3rd phase of the Central City Park. It was the consensus of the Commission that the staff proceed with the Central Industrial} Study as outlined. METROPOLITAN WATER DISTRICT SWITCHING YARD - DISCUSSION: Jere Murphy, Associate Planner, made a presentation regarding the proposal of the Metropolitan Water District for the acquisition of rights -of - way for the Bolsa Island Project Utility Corridor and Switch Yard to be located in Huntington Beach. Viewgraphs were presented of the area where the project would be located. Mr. Murphy referred to the fact that two entities are involved as the proposed utility corridor would be located in County territory with the switching station to be located in the City. The Commission held a lengthy discussion. A MOTION WAS MADE BY DUKE AND SECONDED BY KERINS TO ADOPT A RESOLUTION, OPPOSING METROPOLITAN WATER DISTRICT'S PROPOSAL TO ACQUIRE RIGHTS - OF -WAY IN THE BOLSA AREA FOR A UTILITY CORRIDOR AND SWITCH - 'YARD FOR THE FOLLOWING REASONS:' 1. Said proposal is not in conformance with the adopted Master Plan of Land Use for this area. 2. The proposed switching yard and/or desalting facility . should not be placed within'a residential portion of the city. 3. Alternative sites for this project are available and should be investigated. The Commission directed the staff to transmit this action and said resolu- tion to the City Council for adoption.
