To permit modernization of an exist- ing service station. The subject property is located at the northwest corner of Beach Blvd. and Edinger Ave. in the C2 Community Business District. The staff requested continuance of this request. The applicant concurred. A MOTION WAS MADE BY PALIN AND SECONDED BY SPENCER TO CONTINUE USE PERMIT NO. 71-59 TO FEBRUARY 90 1972 AT THE REQUEST OF THE STAFF FOR THE FOLLOWING REASON: 1. USE PERMIT NO. 71-40 - Continued Applicant: Robert F. Nease To permit the construction of a 52 unit apartment complex in the R3 Limited Multiple Family Residence District. The subject property is located on the east side of Green St., 330 ft. north of Warner Ave. It was noted by the Acting Secretary that correspondence had been received requesting a continuance of this item to March 22, 1972. A MOTION WAS MADE BY PALIN AND SECONDED BY SPENCER TO CONTINUE USE PERMIT NO. 71-40 TO MARCH 22, 1972 AT THE REQUEST OF THE APPLICANT. CONDITIONAL EXCEPTION NO. 71-103 - Continued To permit (1) a reduction in the required landscaping of 5 ft. to a 3 ft. planting strip; and, (2) to permit a reduction in the amount of required parking from 1 space for every 200 sq. ft. or a total of 23 spaces to 1 space for every 300 sq. ft. or a total of 15 spaces pro- viding that at least 50% of the gross floor area shall be devoted to service -type uses. In Conjunction With Minutes: H.B. Board of Zoning Adjustments February 2, 1972 Page 2 USE PERMIT NO. 72-8 Applicant: Charles S. Geers To permit the construction of a 4500 sq. ft. commercial building for service -type uses. The subject property is located at the southwest corner of Adams Ave. and Huntington St. in the C4 Highway Commercial District. The hearing was opened to the audience on both items. Charles Geers, applicant, addressed the Board and explained the request. He stated that the 3 ft. planter strip, as requested, is the same set- back as exists on his property to the west. The Board discussed the merits of the parking of one space for every 300 sq. ft. for service -type uses. The applicant was informed that he would have to comply with the same conditions as required of the service -type use to the south. Mr. Geers informed the Board that he was agreeable to the condition that not more than 50% of the floor area be used for retail sales. There being no further com- ment, the hearing was closed. Board discussion followed. A MOTION WAS MADE BY PALIN AND SECONDED BY MCFARLAND TO APPROVE CONDITIONAL EXCEPTION NO. 71-103 WITH THE FOLLOWING CONDITION: 1. The screening wall for the planter area shall be constructed of the same material as on the abutting property to the west. FOR THE FOLLOWING REASONS: 1. The 3 ft. setback exists on property to the west. 2. Service -type operations traditionally have large service and storage areas with only a small portion of the floor area used for retail sales. 3. The applicant has agreed to the condition that not more than 50% of the floor area be devoted to retail sales. 4. The Planning Commission has approved similar uses within this area with a parking ratio of one space for every 300 sq. ft. A MOTION WAS MADE BY PALIN AND SECONDED BY SPENCER TO APPROVE USE PERMIT NO. 72-8 WITH THE FOLLOWING CONDITIONS: 1. The plot plan received Janugry 19, 1972 shall be the approved layout. 2. Adams Ave. and Huntington St. shall be dedicated and fully improved to City standards at the time said parcel is developed. Improvements shall include street trees, street signs, street lights, fire hydrants, sewer and water main extensions. 3. Water supply shall be through the City of Huntington Beach's water system. 4. The water, sewer and fire hydrant system shall be approved by the Department of Public Works and Fire Department. 6. The property shall participate in the local drainage assessment district. 7. All utilities shall be installed underground. 9. -Off-street parking facilities shall conform to Article 979. 10. Parking compounds shall be screened with a combination of fencing and landscaping. Said plan shall be approved by the Board of Zoning Adjustments. 11. There shall be no fence, structure or landscaping con- structed or maintained over 3� ft. high within a 10 ft. x 10 ft. triangular area at the intersection of driveways and streets or within a 25 ft. x 25 ft. triangular area at the intersection of streets. 12. No structures, other than those shown on,the approved plot plan, shall be constructed within the project. 13. All applicable City Ordinances shall be complied with. 14. Conditional Exception No. 71-103 and Use Permit No. 72-8 shall become null and void if more than 50% of the total floor area is used for retail uses. DIVISION OF LAND NO. 71-32 - Continued Applicant: Pizza Hut To divide a legal parcel of land into three separate parcels. In Conjunction With USE PERMIT NO. 71-65 - Continued Applicant: Pizza Hut To permit the construction and operation of a Pizza Hut. The subject property is located on the east side of Beach Blvd., northeast corner of Holland St. in the C4 Highway Commercial District. This item was tabled until later in the meeting at the request of the applicant. CONDITIONAL EXCEPTION NO. 72-9 Applicant: Scottfield Building Corp. To permit a zero rear yard setback in lieu of the required 5 ft$ setback and to permit a 3 ft. interior yard setback in lieu of the required 5 ft. interior yard setback. In Conjunction With USE PERMIT NO. 72-5 - Continued Applicant: Scottfield Building Corp. To permit the construction of a 104 unit apartment complex. The subject property is located at the northeast corner of Garfield Ave. and Florida Street in the R3 Limited Multiple Family Residence District. -3- 2/2/72-BEA Minutes: H.B. Board of Zoning Adjustments February 2, 1972 Page 4 The hearing was opened to the audience. Charles Christianson, representing the applicant, addressed the Board and explained the development. The Board informed Mr. Christianson that the 3 ft. setback area on the east property line would have to be landscaped and permanently maintained. A detailed calculation of the project was reviewed with the applicant. It was noted by the Board that there was not sufficient open space within the project. Also that the southerly curb cut on Florida St. would have to be eliminated and a 40 ft. turn -around be provided to meet the requirements of the Apartment Standards. It was the consensus of the Board that this item should be continued to allow the applicant time to revise his plot plan prior to final action. There being no further comment, the hearing was closed. DIVISION OF LAND NO. 72-3 Applicant: Huntington Beach Industrial Park To allow lots 15, 16, 17, 26 and 27 and 28 of Tract 7090 to be divided into three separate legal parcels of land. In Conjunction With ADMINISTRATIVE REVIEW NO. 72-5 Applicant: Huntington Beach Industrial Park To permit the construction of a 30,000 sq. ft. concrete tiltup manufacturing facility. The subject property is located on the east side of Commerce Lane and west side of Computer Lane in the MI -A Restricted Manufacturing District. The Board was informed that a letter had been received from the applicant requesting a continuance of Administrative Review No. 72-5 to be heard in conjunction with Conditional Exception No. 72-10. Mr. George Lusk discussed the request for continuance and his request for the Division of Land. Mr. Lusk informed the Board that he would like action taken at this time on the Division of Land because of financing of the proposed industrial use. Suggested conditions of approval were discussed with the applicant. Board discussion followed. A MOTION WAS MADE BY PALIN AND SECONDED BY SPENCER TO APPROVE DIVISION OF LAND NO. 72-3 WITH THE FOLLOWING CONDITIONS: 1. The plot plan received January 21, 1972 shall be the approved layout. 2. ROLL CALL VOTE: AYES: McFarland, Spencer, Palin NOES: None ABSENT: None THE MOTION CARRIED. ADMINISTRATIVE REVIEW NO. 72-3 Applicant: Cambro Manufacturing Co. To permit an 80 ft. x 240 ft. addition to an existing warehouse. The subject property is located at the northwest corner of Huntington Ave. and Clay Street in the MI Light Industrial District. Dick Hammond, representing the applicant, addressed the Board and discussed the proposed storage addition for their industrial use. Mr. Hammond was informed that a detailed calculation on the parking requirements indicates that he is a. -number of spaces short for the overall use. Also that the Board would be unable to make a final decision on this application without a revised plot plan indicating the required parking pursuant to Article 979 for manufacturing and warehouse uses. Mr. Hammond requested a continuation to allow time to evaluate and revise the plot plan. Board discussion followed. Board of Zoning Adjustments February 2, 1972 Page 6 USE PERMIT NO. 72-7 Applicant: Firehouse Gallery To permit a retail arts and crafts store. The subject property is located on the west side of Beach Blvd., approximately 288 ft. south of Cypress St. in the C4 Highway Commercial District. to the audience. The hearing was opened Ms. Silesky and Ms. Engle, applicants, addressed the Board and explained the request. The Board informed the applicants that the parking, as shown, was insufficient and did not comply with Article 979 of the Huntington Beach Ordinance Code as to setback from the front property line with required landscaping and screening wall. The applicants stated that they could increase the parking area and would revise the plot plan with at least 10 parking spaces. There being no further comment, the hearing was closed. Board discussion followed. A MOTION WAS MADE BY MCFARLAND AND SECONDED BY PALIN TO CONTINUE USE PERMIT NO. 72-7 TO FEBRUARY 9, 1972 TO'ALLOW TIME FOR THE APPLICANT TO SUBMIT REVISED PLOT PLANS. CONDITIONAL EXCEPTION NO. 72-7 Applicant: Ambassador Builders To permit a reduction in the front yard setback to 12 ft. 6 in. in lieu of the required 15 ft. setback; and, a reduction in open space minimum dimension to 10 ft. in lieu of the required 20 ft. dimension. The subject property is located on the north- west corner of Sims, Street and Orion Avenue in the R2 Two Family Residence District. The hearing was opened to the audienc John Rose and Jerry Butts, represent- ing the applicant, addressed the Board and discussed the request. Mr. Rose stated that they are proposing the structure in this direction be- cause of its orientation to the topographic features in the area and view of the ocean. Jerry Butts stated that their ope space was in excess of that which is required by Code Amendment No. 71 There being no further comment, the hearing was closed. Board discussion followed. A MOTION WAS MADE BY MCFARLAND AND SECONDED BY PALIN TO APPROVE CONDITIONAL EXCEPTION NO. 72-7 FOR THE FOLLOWING REASONS: 4. The City has adopted Code Amendment No. 71-23 which allows open space to be allocated in this manner. 2. The applicant has provided additional open space with a balcony over the garages. 3. The applicant has provided a 15 ft. exterior side yard which in fact would be their front yard'setback and has provided a front yard setback of 12.6 ft. which would be the exterior side yard as the building is oriented. USE PERMIT NO. 72-9 Applicant: Pacific Sands Cabana Club To permit an expansion of recreational facilities at a private club -including (1) construction of a sauna bath, (2) and a move -in -structure (10 ft. x 20 ft.) to be used for children's playroom.. The subject property is located at the northwest corner of Atlanta Ave. and Schooner Lane in the Rl Single Family Residence District. The hearing was opened to the audience. Mr. Baslow and Mr.. Untredt,, representing -the applicant, addressed the Board and explained the request. Mr. Baslow informed the Board that the move -in structure would be used specifically for a children's play room. Dan McFarland, Chairman, reviewed with the applicants all prior history on the facility and informed them of the prior complaints by residents in the area and conditions imposed by the City. A lengthy discussion was held on the required masonry wall along the tennis court facilities. The applicant informed the Board that they could not justify the costs of said wall with this minor alteration to the recreational facility. It was the consensus of the Board that perhaps a legal interpretation was needed as to the applicability of prior conditions of approval. There being no further comment, the hearing was closed. ADMINISTRATIVE REVIEW NO. 72-7 Applicant: Goldenwest Partnership To allow garagges and walls to - within 7 ft. 6 in. of the front property line at the time of initial construction. The subject property is located at the southwest corner of Goldenwest St. and Clay Ave. in. the R1-0 Single Family Residence District combining oil. Bob Taylor, representing the applicant,. addressed the Board and explained the request. The Board informed Mr. Taylor that in all cases on.a 7� ft. setback for a garage structure, (1) on -street parking space would have to be provided. DIVISION OF LAND NO..71-32 In Conjunction With USE PERMIT NO. 71-65 Applicant: Pizza Hut These items were tabled earlier in the meeting, at the request of the applicant. The hearing was opened to the audience on Use Permit No. 71-65. Dave Kirchener, represent- ing the applicant, addressed the Board and explained the request, stating this application was a renewal of a previously approved use permit.for the same use on subject property. The Board informed Mr. Kirchener that a revision would have to'be made to the plot plan in front of the proposed main structure to allow proper turning radius for required parking to afford a 12 ft. parking stall adjacent to the screening wall. Mr. Kirchener submitted documents on the access easements along the north and rear property lines. There being no further comment, the hearing was closed. Board discussion followed. A MOTION WAS MADE BY SPENCER AND SECONDED BY PALIN TO APPROVE DIVISIONAF LAND NO.71-32 WITH THE FOLLOWING CONDITIONS: 1. The plot plan received December 10, 1971 shall be the approved layout. 2. Beach Blvd. and Holland Dr. shall be dedicated and fully improved to City and/or State standards at the time each parcel is developed. Improvements shall include street trees, street signs, street lights, fire hydrants, sewer and water main extensions. 3. Water supply shall be through the City of Huntington Beach's water system at the time each parcel is developed. 4. Sewage disposal shall be through the City of Huntington Beach's sewage system at the time each parcel is developed. 5. The water, sewer and fire hydrant system shall be approved by the Department of Public Works and Fire Department. 6. The property shall participate in the local drainage assessment district at the time each parcel is developed. 7. A Parcel Map shall be filed with the City and recorded prior to framing inspection of any structures on any parcel. 11. The Division of Land shall not be effective until an agreement is signed and recorded agreeing to the conditions listed above. All utilities shall be installed underground. 8. Fire alarm system conduit and appurtenances shall be installed by developer at locations and to specifications provided by the Fire Department. 9. Off-street parking facilities shall conform to Article 979. 10. Parking compounds shall be screened with a combination of fencing and landscaping. Said plan shall be approved by the Planning Department. 11. A masonry wall shall be constructed along the east property line. The hei ht of said wall shall be such that the top will be six (65 feet above the highest ground surface within twenty (20) feet of the common property line. Except within ten (10) ft. of the south property line in which case the height of -said wall shall be reduced to 42 inches. 12. No structures, other than those shown'on the approved plot plan, shall be constructed within the project. 13. All applicable City Ordinances shall be complied with. 14. A revised plot plan shall be submitted to the Board of Zoning Adjustments prior to the issuance of building permits to facilitate proper landscaping and turning radius for the parking at the front of the structure. -9- 2/2/72-BZA Minutes: H.B. A development plan delineating all structures and driveway access points shall be submitted to the Board of Zoning Adjustments on parcel no. 2 prior to the issuance of building permits. 16. Roof -top mechanical equipment shall be screened from view. A plan for said screening shall be reviewed by the Board of Zoning Adjustments for approval action prior to the issuance of building permits. 17. A Division of Land application, separating this parcel from the remaining property held under the same owner- ship, shall be filed with the City, approved and recorded.
