The.Pledge of Allegiance was given by all present in the Council Chamber. ROLL CALL Councilmen Present: Shipley, Bartlett, Gibbs, Green, Matney, Coen, McCracken Councilmen Absent: None CALL FOR SPECIAL MEETING The City Clerk read the Call for Special Meeting which had been received and.consented to by all Councilmen prior to 7:30 P.M., on Sunday, February 13, 1972, for the purpose of discussing and being prepared to act on the MWD proposal for an off -shore island, utility corridor and -.- switching yard: CALL FOR SPECIAL MEETING OF CITY COUNCILMEN George C. C( .en Page #2 - Council Minutes - 2/14/72 The Assistant Planning Director called the roll of the Planning Commission as follows: Present: Slates, Bazil, Porter, Kerins, Boyle Duke (arrived at 8:32 P.M.) Absent: Higgins The Acting City Administrator stated the city's position regarding the proposal of the Metropolitan Water District for the acquisition of rights -of -way for the Bolsa island Project Utility Corridor and Switch Yard to be. located in Huntington Beach. He then read the communica- tion which, pursuant to Council direction at the February 7, 1972 meeting his office had sent to the Environmental Unit of the Attorney General's Office, requesting that they legally intervene to effect a delay -in the development of the over-all project until a full environmental impact report had been completed. The Acting City Administrator requested the Planning Director to present the Planning Commission's report on the matter. The Planning Director presented a progress report concerning the events which had occurred since January 4, 1972, when the Planning Commission first received the environmental report from the Metropolitan Water' District. He presented slides of the area where the project would be located and referred to the fact that two entities are involved as,the proposed utility corridor would be located in County territory with the switching.station to be located in the City of Huntington Beach. Following presentation of the slides, Mr. H. T. Holt, Project Engineer for Metropolitan Water District, addressed Council concerning the pro- posed project. He stated that the District believes it has sufficient facilities to provide water to the area for the next 20 to 30 years; however they are looking ahead to the feasibility of a combined power and desalting plant to be located offshore from Balsa Chica State Beach and connected to the mainland by a causeway. He presented a resume of the events which had transpired concerning this project since 1964, and stressed the fact that the present plans of the Metropolitan Water District are only for the acquisition of property for the location of the proposed plant. Considerable discussion was held between the Council and Mr. Holt. Mr. Al Hovanec,, Manager of Right of Way, Land Division of the Metropol- itan Water District, gave a brief presentation concerning the requested utility easement. Mr. Willis Mevis, Deputy City Attorney, spoke regarding the legal ramifi- cations of the matter. Mayor McCracken turned the meeting over to Plannirg Commission Chai-man Porter who presented the opinions of the Planning Commission regarding the proposed project. Considerable discussion was held by the Council, Planning Commissioners, and representatives of the Metropolitan Water District, toldhive tc the city's concern that the Environmental Report submLtted by the District is totally inadequate and incomplete, and does not cover the entire project or the environmental issuc,s involved. The possibility that the Me -ropol-- itan Water District might agree to an extension of time for Council. to consider the report and any additional material on the matter, was also discussed. 2173 Page #3 - Council Minutes - 2/14/72 Mrs. Margaret Carlberg, Chairman of the Environmental Council-, spoke concerning the environmental aspects of the proposed project. Mr. Paul Bradley, President of the Community Council of Sunset Beach. and member of the Attorney General's Voluntary Advisory Committee, in- formed Council that their organization concurred with Council's deter- mination that any action on this matter be delayed until a full impact report is received. Following considerable discussion between the Council, the Planning Commission and representatives of the Metropolitan Water District of Southern California, on motion by Shipley, Council determined that it should be a basic requirement for any individual or governmental agency which holds a public trust to follow this policy: "Wherever or whenever there is reasonable doubt concerning the public interest, the matter must be resolved in favor of the public interest" - therefore the Council must ask for a comprehensive environmental impact report in connection with the entire Bolsa Island project; and request an exten- sion of time for at least 90 days from February 15, 1972, to consider the report which has been submitted and any additional material which may be hereafter forthcoming, as the Council finds and determines that there is a reasonable doubt concerning the public interest in this matter. Motion carried by the following vote: AYES: Councilmen: Shipley, Bartlett, Gibbs, Green, Matney, Coen, McCracken NOES: Councilmen: None ABSENT: Councilmen: None Mayor McCracken requested the presence of Councilman Matney and Mrs. Margaret Carlberg, Environmental Council Chairman, at the Board of Supervisors meeting on February 15, 1972. The Mayor directed that copies of the foregoing minute action be transmitted to the Metropolitan Water District, the Orange County Board of Supervisors, and the State Attorney General's Office. j ADJOURNMENT On motion by Shipley, the Special meeting of the City Council of the City of Huntington Beach adjourned at 9:4.5 P.M.
