AGENDA ITEMS TO BE CONTINUED: CONDITIONAL EXCEPTION NO. 71-59 Applicant: McWhorter -Gardner -McWhorter To permit the construction and operation of a boarding stable for 50 horses, expanding to 100 over a 5 year period on 4.59 acre parcel of land in the M1 Light Industrial District. The subject property is located one thousand (1000) f t. north of Talbert Avenue and east of Gothard Street. The Acting Secretary informed the Commission that the staff has previously recommended continuance of all equestrian applications pending the outcome of the equestrian standards and at this time the staff recommends continuance of Mr. McWhorter's application for a commercial horse stable to March 21, 1972. Mr. Harlow informed the Commission that the applicant has been contacted by telephone and has agreed to a continuance. A MOTION WAS MADE BY BOYLE AND SECONDED BY KERINS TO CONTINUE CONDITIONAL EXCEPTION NO. 71-59 FOR THE AFOREMENTIONED REASONS. COMMISSIONER DUKE AND CHAIRMAN PORTER: Commissioner Duke arrived at 7:15 P.M. and Chairman Porter arrived at 7:18 P.M. to assume their duties. ZONE CASE NO. 71-16 - Continued from December 21, 1971 Applicant: Gladys Bealo A change of zone from RA Residential Agricultural District to R3 Limited Multiple Family Residence. The subject property is located on the west side of Goldenwest Street approximately 1200 f t. south of Talbert Avenue. -1- 2/15/72 - PC Minutes: H. B. Planning Commission Tuesday, February 15, 1972 Page No. 2 The Acting Secretary informed the Commission that the City Council on December 13, 1971, decided to expand the Huntington Central Park to include the properties 660 f t. south of the present park boundary. Mr. Harlow pointed out that this expansion includes the property in question. Don Jones, representing the applicant, stated that neither he, nor his client were contacted regarding the proposed expansion. Commissioner Duke stated that he feels this zone case should be denied because the City Council has directed the city to acquire the subject property to be included within the Central City Park. Com- missioner Bazil stated that he felt the applicant had this zone case continued for approximately 9 months and that the Commission should grant Zone Case No. 71-16 for an R1 as previously suggested by the Commission. The Acting Secretary suggested to the Commission to continue this item to April 18, 1972, to allow the staff to consider this property along with Phase III of the Master Plan Amendment for Study Area "B". Don Jones, representing the applicant, stated that he does not want another continuance. Commission discussion followed. A MOTION WAS MADE BY SLATES AND SECONDED BY BAZIL TO RECOMMEND APPROVAL OF ZONE CASE NO. 71-16 TO THE CITY COUNCIL FOR THE FOLLOWING REASON: 1. This zone change is in compliance with the Master Plan of Land Use. ROLL CALL VOTE: AYES: Slates, Bazil, Higgins NOES: Porter, Duke, Boyle, Kerins ABSENT: None THE MOTION FAILED. A MOTION WAS MADE BY DUKE AND SECONDED BY KERINS TO RECOMMEND DENIAL OF ZONE CASE NO. 71-16 TO THE CITY COUNCIL FOR THE FOLLOWING REASONS: 1. The applicant wanted an'immediate decision. 2. The City has contacted the property owner to purchase her property which will be included in the third phase of Central Park. 3. There is no reasons to change the zone at this time. Planning Commission Tuesday, February 15, 1972 Page No. 3 ZONE CASE NO. 71-46 - Continued from December 21, 1971 Applicant: Walter Taylor A change of zone from RA-0 Residential Agricultural District combined with oil production to M2 Heavy Industrial District. The subject property is located on the east side of Edwards Street 990 ft. north of Garfield Avenue, consisting of a 5.0 acre parcel of land. The hearing was opened to the audience. Mr. Alcog, representing the applicant stated that he would accept an MI zone. Mr. Taylor, applicant, stated that he would prefer an answer at this meeting. Commissioner Bazil asked the applicant if he would agree to a continuance. Mr. Alcog stated that this property is master planned for industrial. William Wren, representing property owners to the west stated that they consider their land as prime residential property. Mr. Wren further pointed out that there is no way to tell how long the oil producing will last; perhaps another ten years. There being no other comment the hearing was closed. Commission discussion followed. A MOTION WAS MADE BY KERINS AND SECONDED BY DUKE TO RECOMMEND DENIAL OF ZONE CASE NO. 71-46 TO THE CITY COUNCIL FOR THE FOLLOWING REASONS: 1. Future use of this property is residential and not industrial. 2. This proposal would create "Hodge-Podge" development. 3. A freeway in the future is questionable. 4. _The applicant requested an immediate decision. 5._ The Commission needs more time to study the area. ZONE CASE NO. 72-4 - Continued from February 1, 1972 Initiated by the Planning Commission A change of zone from R2 Two Family Residence District to R2-PD (10) Two Family Residence District - Planned Residential Development (10 units per acre). The subject property is located 260 ft. west of the centerline of Newland Street and 660 ft. north of the centerline of Talbert Avenue and consists of 4.6 acres of land. -3- 2/15/72 - PC Minutes: H. B. Planning Commission Tuesday, February 15, 1972 Page No. 4 The hearing was opened to the audience. Tom White, represent- ing Derby Land Company, spoke in favor of the change of zone to R2-PD (12). There being no other comment the hearing was closed. Commission discussion followed. Commissioner Kerins stated that he feels R2-PD (10) is sufficient for subject property. Commissioner Duke also expressed his opinion stating that R2-PD (10) was sufficient. A MOTION WAS MADE BY BAZIL AND SECONDED BY BOYLE TO RECOMMEND APPROVAL OF ZONE CASE NO. 72-4 TO THE CITY COUNCIL FOR R2-PD (12) RATHER THAN AS ORIGINALLY INITIATED BY THE COMMISSION FOR R2-PD (10) FOR THE FOLLOWING REASONS: 1. Property located on both sides of the subject property are similarly zoned. 2. No street frontages to raise the density in calculating the next yield. Porter, Boyle, Slates PRECISE' PLAN ALIGNMENT NO. 72-1 - Continued from February 1, 1972 Said plan proposes to precise plan the alignment of a cul-de-sac street parallel to and approximately 290 ft. east of the Southern Pacific Rail- road right-of-way from Talbert Avenue to a point 780 ft. south of the centerline of Talbert Avenue. The hearing was opened to the audience. Henry Clock, attorney, representing property owner fronting on Talbert Avenue, opposed the proposed alignment. Mr. Harpold asked questions regarding the development of future street. Mr. Harpold was informed by the Commission that this proposed alignment will be implemented as property in the area develops. There being no other comment the hearing was closed. Commission discussion followed. Commissioner Slates stated that he feels this alignment will not serve the community at present time and that there is no need to adopt said align- ment at this time. PRECISE PLAN ALIGNMENT NO. 72-2 - Continued from February 1, 1972 Said plan proposes to precise plan the street alignment for the extension of Franklin Drive and a cul-de-sac street parallel to and approximately 470 f t. west of the centerline of Beach Boulevard, from Ellis Avenue to a point approximately 770 ft. north of the centerline of Ellis Avenue. The Acting Secretary informed the Commission that he has received two requests from property owners to continue this item to April 4, 1972, in order to further study said proposal. A MOTION WAS MADE BY SLATES AND SECONDED BY BAZIL TO CONTINUE PRECISE PLAN ALIGNMENT NO. 72-2 TO APRIL 4, 1972. ROLL CALL VOTE: AYES: Slates, Bazil, Higgins, Porter, Kerins, Boyle, Duke NOES: None ABSENT: None THE MOTION CARRIED. ZONE CASE NO. 72-8 Applicant: Classic Development Corporation A change of zone from M2-01 and M2-0 Heavy Industrial District combined with bil production to R1 Single Family Residence District. The subject property is located on the south side of Ellis Avenue extended between Huntington Avenue and the Southern Pacific Railroad right-of-way and consists of a 0.9 acre parcel of land. Commissioner Higgins abstained from participation on this item. The hearing was opened to the audience, there being no comment the hearing was closed. Commission discussion followed. A MOTION WAS MADE BY KERINS AND SECONDED BY BAZIL TO RECOMMEND APPROVAL OF ZONE CASE NO. 72-8 TO THE CITY COUNCIL FOR THE FOLLOWING REASONS: -5- 2/15/72 - PC Minutes: H. B. Said zone change was a condition of approval of Tentative Tract Map No. 7601. ZONE CASE NO. 72-9 Applicant: Don Leidecker and Frank Bond A change of zone from RA-0 Residential Agrictural District combined with oil pro- duction to M1-0 Light Industrial District combined with oil production. The subject property is located on the south side of Ellis Avenue, 660 ft. west of Goldenwest Street and consisting of 4.78 acres of land. The hearing was opened to the audience. Don Leidecker and Frank Bond, applicants, explained the proposal and requested approval. Ralph Ashton, property owner spoke in favor of said zone case. There being no other comment the hearing was closed. Commission discussion was held. A MOTION WAS MADE BY SLATES AND SECONDED BY DUKE TO RECOMMEND DENIAL OF ZONE CASE NO. 72-9 TO THE CITY COUNCIL FOR THE FOLLOWING REASONS: 1. There is no freeway access to the property. 2. There is an existing park north of the subject property. 3. The applicant did not agree to a continuance requested by the Commission to allow time for study of the subject property. ZONE CASE NO. 71-12 - RECONSIDERATION Applicant: Classic Development Company To change the zone from M2-0 and M2-01 Heavy Industrial District combined with oil production to R2-PD Two Family Residence District - Planned Residential Development Suffix combined with oil production. The Acting Secretary discussed the applicant's request for reconsideration. The Commission reviewed the proposal. A MOTION WAS MADE BY SLATES AND SECONDED BY PORTER TO RESCEND THE PREVIOUS ACTION FOR DENIAL OF SAID ZONE CASE. ROLL CALL VOTE: AYES: Slates, Porter NOES: Duke, Boyle, Bazil, Kerins ABSENT: None ABSTAINED: Higgins THE MOTION FAILED. A FURTHER MOTION WAS MADE BY BOYLE AND SECONDED BY DUKE TO RESTATE THE ORGINAL MOTION FOR DENIAL FOR THE FOLLOWING REASONS: 1. Approval would result in further erosion of the industrial base. 2. The realignment of Ellis Avenue improves the usability of this parcel for industrial purposes. 3. Property offered for trade by the property owner for industrial uses is being considered for industrial use on the Master Plan. DISCUSSION: Central Industrial Study - Lower Portion Jere Murphy, Associate Planner, made a presentation of the Central Industrial Study. Mr. Murphy suggested three possible ways to approach the freeway situation when conducting this study: 1) with complete freeway system; 2) Delete complete freeway with Route 39; and, 3) the realignment of Route 39 freeway with existing alignment of Route 1 freeway. A MOTION WAS MADE BY KERINS AND SECONDED BY BAZIL TO INSTRUCT THE STAFF TO PROCEED WITH STUDY AREA "B" CONSIDERING ALL THREE ALTERNATIVES OF THE FREEWAY. DISCUSSION: DEVELOPMENT STANDARDS WITHIN THE HUNTINGTON BEACH INDUSTRIAL PARK The Acting Secretary informed the Commission that the staff has met with representatives of the Lusk Company on November 11, 1971 and discussed the following items: 1. Landscaping requirements 2. Front and exterior side yard setbacks 3. Interior side yard setbacks 4. Trucking and loading facilities 5. Through traffic west of McFadden Avenue Commissioner Slates suggested that the Industrial Committee of the Chamber of Commerce review these changes. Chairman Porter directed the staff to refer this proposal to the Industrial Committee of the Chamber of Commerce for a report. DISCUSSION: Commissioner Kerins stated that he feels the Planning Commission -should be doing a better job in advising the public of the positive actions taken by the Commission. The Commission concurred and felt that as long as the press did not attend the meetings, the City Public Information Officer should perform this function.
