The subject property is located on the west side of Graham Street, 130 ft. north of the centerline of Edinger Avenue and consists of 35 acres of land. The Acting Secretary informed the Commission that this application was filed with the Planning Department in July, 1971. Planning Commission Tuesday, March 7, 1972 Page No. 5 CONDITIONAL EXCEPTION NO. 72-1 Ap2licant: Tustin Village Incorporated To permit the subdivision of a 20 acre parcel of land into 147 lots with 30 ft. frontage and an average area of 3000 sq. ft. in lieu of the required 60 ft. frontage with 6000 sq. ft. of lot area. Also, to permit single family homes to be constructed along one side property line with common wall construction between adjacent lots. The opposite side yard setback will be 5 ft. in lieu of the 10 ft. required when one side yard setback is reduced to zero. The subject property is located between Florida Street and Delaware Street north of Adams Avenue, in the R2 Two Family Residence District and R3 Limited Multiple Family Residence District. The hearing was opened to the audience. Mike Jagger, representing the applicant, explained the request. Mr. Jagger informed -the Commission that the proposed development will consist of 2, 3, and 4 bedroom homes with a maximum of 1600 to 1700 sq. ft. per unit and the lot coverage will be less than 50%. John Henricksen, 618 Adams Avenue, opposed the development on grounds that the proposed development will be detrimental to the area, unless it is developed as an adult community. There being no other comment, the hearing was closed. Commission discussion followed. Commissioner Bazil stated that he feels the proposed lot size will deviate greatly from the code requirements. Com- missioner Higgins stated he feels there is not sufficient parking provided and the open space should relate the unit size. Commissioner Kerins stated the applicant did not show sufficient hardship. MASTER PLAN AMENDMENT NO. 72-3 Initiated by the Planning Commission A Master Plan Amendment as initiated by the Planning Commission to a portion of Study Area "B". The proposed amendment is for a change from Office Professional to Commercial for a .96 acre parcel of land located on the north side of Slater Avenue, approximately 268 ft. east of Beach Boulevard. Slides were shown of wr the subject property. The hearing was opened to the audience. Margaret Preninger, property owner of subject property gave'a zoning history of her property and how it was zoned R5 by the City without her knowledge. Commissioner Bazil stated the City policy is that commercial zone is not placed on secondary highways. Also, there is a surplus of commercial property in the area.. Commissioner Kerins stated if this property is zoned commercial, it will degrade the area. A MOTION WAS MADE BY KERINS AND -SECONDED BY DUKE TO RECOMMEND DENIAL OF MASTER PLAN AMEND- MENT NO. 72-3 TO THE CITY COUNCIL FOR THE FOLLOWING REASONS: 1. A secondary highway is not the proper place for commercial zoning. 2. There is a sufficient amount of commercial zone in the area. 3. If zoned commercial, it would be detrimental to surrounding property. 4. This zone change would encourage strip zoning along Slater Avenue. ZONE CASE NO. 72-10 Initiated by the Planning Commission A change of zone from R5 Office Professional District to C4 Highway Commercial District, as initiated by the Planning Commission. The subject property is located on the north side of Slater Avenue approximately 268 ft. east of Beach Boulevard and consists of .96 acres. The hearing was opened to the audience. Mrs. Preninger informed the Commission that the property across the street on the south side of Slater is -zoned commercial and developed with a fast food restaurant. There being no other comment the hearing was closed. Commission discussion followed. CONDITIONAL EXCEPTION NO. 72-2 Applicant: Mercury Savings and Loan Association To permit a 54 sq. ft. off -site advertising sign in lieu of the requirement of S.9764.6 which does not permit off--site-advertising signs. The subject property is located on the south side of Edinger Avenue, 550i ft. east of the intersection -of Sher Lane. . Slides were shown of the proposed location and sign structure. The hearing was opened to the audience. Mel Kapson, representing Mercury Savings and Loan Association addressed the Commission and explained the request. The Acting Secretary pointed out that when reviewing the application for Angels, it was determined by the Board that the main entrance for Angels and Mercury Savings and Loan should be combined into one driveway and moved westerly because of the placement of traffic signals and the medium on Edinger Avenue. Mr. Harlow pointed out that this also facilitated the movement of on - site traffic. The primary objective however, was to reduce the -number of driveways on the south side of Edinger Avenue to help improve the traffic problems at that location. Mr. Harlow stated that because of this action, only one drive- way serves both uses for west bound traffic and the entrance sign for Mercury Savings and Loan no longer serves the the function for which it was designated: --- There being no other comment the hearing was closed. Commission discussion followed. A MOTION WAS MADE BY BAZIL AND SECONDED BY KERINS.JO APPROVE CONDITIONAL EXCEPTION NO. 72-2 UPON THE FOLLOWING CONDITIONS: 1. Approval shall be limited.to the existing S4 sq. ft. sign. 2. This 54 sq. ft. sign shall be the only free-standing sign allowed for Mercury Savings and Loan. -8- 3/7/72 Minutes: H. B. It was the consensus of the Commission to direct the staff to study amending the sign ordinance to allow off -site signs when it serves the consolidation of on -site signs when there is an elimination of driveways on commercial centers. - CODE AMENDMENT NO. 71-33 The intent being to: 1) Amend the -definition of a family (S.9600.6) by excepting all non -related care homes and subjecting such homes to the Care of non -Related section of the Code; 2) Amend the intent and purpose of the Care of Non -Related section (S.9730.26) by specifying a residency requirement of a licensed operator; 3) Amend S. 9730.26.2(f) by specifying that a licensed resident -applicant be required in such home; and 4) add S. 9730.26.2(j) which states that "The care of non -related is not intended to permit board and care or non -licensed private care." Jim Palin, Associate Planner made a presentation. Mr. Palin suggested that with respect to the third draft of this proposed code amendment, the staff recommends the word "marriage" under the definition of a family (page 1, line 15) be changed to "affinity". The hearing was opened to the audience. Mr. Parker, representing Urbanetics, stated they will attempt to comply with requirements suggested by the Commission.. Commissioner Kerins stated he only agrees to lowering archways. Ed Moltz, architect for the project explained their proposal. There being no other comment the hearing was closed. Commission discussion followed. Dan McFarland, Building Department stated that the plans presented to the Commission do not conform with the plans as originally submitted. Commissioner Boyle stated that if this plan is approved, it will set a -precedent for future requests. DISCUSSION: Alternative Freeway Alignments Lower Portion of Central Industrial Study Jere Murphy, Associate Planner, made a presentation of four alternates for freeway alignments to be considered when reviewing the .Central Industrial Study. -10-4 " ` . ­ 3/7/72 - PC Minutes: H. A MOTION WAS MADE BY KERINS AND SECONDED BY BOYLE TO CONSIDER ALL FOUR ALTERNATIVES WHEN REVIEWING THE CENTRAL INDUSTRIAL STUDY AND TO TRANSMIT SAME - TO THE CITY COUNCIL FOR APPROVAL- . . 1. Construction will take place on the adopted alignments -- for both the.Route 1 and 39 freeways. 2. Construction wil-l-take place on the adopted alignment for Route l'and,-the Gothard Street alignment for Route 39. 3. Construction will take place on the adopted Route 39 alignment and Route 1 alignment south of the proposed freeway - to - freeway interchange. This option includes deletion of the Route 1 Freeway, northwest of the Route 39 junction. 4. Construction will take place on the Gothard Street alignment for -the Route 39 Freeway and on the adopted alignment for the Route Freeway southeast of the Route 1 and 39 junction. REVIEW BUILDING ELEVATIONS The Commission reviewed the building elevations for Tentative Tract Map No. 7289, located 600 ft. east of Edwards Street on the north side of Warner Avenue. It was the consensus of the . Commission that elevations as presented were not acceptable and the developer should submit new plans for the Commission's review. AMENDMENT TO CONDITION-#7 TENTATIVE TRACT MAP NO. 7489 Subdivider: Shapell Industries The Acting Secretary discussed with the Commission the possibility of amending condition #7 as previously approved by the Commission which read as follows: "That portion of the street right-of-way adjacent to the west boundary of the existing school site shall,be vacated prior to recordation of a final map." A MOTION WAS MADE BY KERINS AND SECONDED BY DUKE TO AMEND CONDITION #7 TO READ AS FOLLOWS: "No final map shall be recorded until a satisfactory agreement has been reached between the developer and the Department of Public Works and Planning Department for the vacation of that portion of the street right-of-way adjacent to the west boundary of the existing school site". -11- 3/7/72 - PC Minutes: H. DISCUSSION: RECREATIONAL TRAILS COMMITTEE (ENVIRONMENTAL COUNCIL RECOMMENDATION) The Planning Director informed the Commission that he has been in contact with Mrs. Margaret Carlberg to discuss the trails program. Mr. Reynolds informed the Commission that he advised Mrs. Carlberg that be ause there are many other items listed on the Commj. sio '""s'�1. 12"pro �`fec't'"program,' this item had been placed' on a lopriority. It was the consensus of.the Commission that a committee should be formally appointed to serve on the already established Trails Committee. Commissioners Kerins, Boyle,,and Higgins were appointed by the'Chairman to attend committee meetings to give the Planning Commission's input on this matter. It was further the consensus of the Commission that the staff report back with a work program regarding the trails program and to investigate the possibility of obtaining federal funds. DISCUSSION• The Commission suggested the Public Information Officer prepare news coverage in the Daily Pilot similar to that which is prepared for the City Council.
