AGENDA ITEMS TO BE CONTINUED OR WITHDRAWN: CONDITIONAL EXCEPTION NO. 72-1 Applicant: Tustin Village Incorporated To permit the subdivision of a 20 acre parcel of land into 147 lots with 30 ft. frontage in an average area of 3000 sq. ft. in lieu of the required 60 ft. frontage with 6000 ft. of lot area. The subject property is located between Florida Street and Delaware Street, north of Adams Avenue in the R2 Two Family Residence District and R3 Limited Multiple Family Residence District. And also to permit single family homes to be constructed along one side property line with common wall construction between adjacent lots. The opposite side yard setback will be 5 ft. in lieu of the 10 ft. required when one side yard setback is reduced to zero. The Commission noted a letter received by the Planning Department from Michael B. Jagger, representing the applicant, requesting withdrawal. Schaeffer To permit the construction of three apartment units on an R2 lot having 5875 sq. ft. Said request will result in one unit per 1958 sq. ft. of lot area in lieu of the minimum requirement of 2000 sq. ft. per unit. Also to allow open space to be provided according to proposed Code Amendment No. 71-23 which permits open space to be provided at a ratio of .25 sq. ft. per 1 sq. ft. of residential floor area with a minimum dimension of 7 ft. per ground f000r unit. The subject property is'located approximately 100 ft. west of Palm Avenue on the south side of 15th Street. The proposed development exceeds existing requirements of 900 sq. ft. of total open space•but has a minimum dimension as low as 9 ft. in lieu of the required minimum dimension of 20 ft. The Commission noted that a letter was received by the Planning Department requesting withdrawal of.the application. DISCUSSION: CONDITIONAL EXCEPTIONS The Acting Secretary requested the Planning Commission to state the following when approving a request for a conditional exception: "With reference to hardship we find that the property in this conditional exception case will suffer a legal hardship if the request for this conditional exception is denied. USE PERMIT NO. 72-9 - Continued from March 21, 1972 Applicant: Pacific Sands Cabana Club To permit an expansion of recreational facilities at a private club including construc- tion of sauna bath and a move -in structure, 10 ft. x 20 ft. to be used for a children's playroom. The subject property is located on the northwest corner of Atlanta Avenue and Schooner Lane in the Rl Single Family Residence District. There were no comments by the staff, however a videotape was shown that had been taken on the subject property. A letter from the City Attorney's office was noted by the chair stating that the objection expressed by the Vahlco Corporation at the March 21, 1972 meeting did not prevent the Planning Commission from acting on subject request. The hearing was opened to the audience. A representative of the Pacific Sands Cabana Club described fencing and the condition that is being appealed. He stated that a concrete wall will duplicate the two existing screening fences on subject property, and the construction of the wall will be more costly than the members may wish to pay. He indicated that it appears Pacific Sands is caught in an economic bind if the wall is to be required. He also indicated that the wall will have no benefits as to sound because that is being taken care of at the present time. Chairman Porter asked what the cost of the improvements would be excluding the,wall. A representative of the Pacific Sands Club indicated that the sauna would be about $1700 installed and th t the move -in which is not now available would have been 1900. In this lapse the move -in has become unavailable but the Pacific Sands Club would continue to look for another facility such as the one that they had found. There being no other comment, the hearing was closed. The Commission discussed the need for a separation wall and the reason the Board of Zoning Adjustments required such a wall. A MOTION WAS MADE BY SLATES AND SECONDED BY BAZIL TO DENY APPEAL AND SUSTAIN THE DECISION OF THE BOARD OF ZONING ADJUSTMENTS. A MOTION WAS MADE'BY DUKE AND SECONDED BY KERINS TO APPROVE THR APPEAL AND REVERSE THE DECISION OF -THE BOARD OF ZONING ADJUSTMENTS WITH RESPECT TO THE REQUIREMENT OF THE WALL FOR THE FOLLOWING REASON: 1. ZONE CASE NO. 71-55 Applicant: Signal Landmark Incorporated A change of zone from R1 Single Family Residence District to C4 Highway Commercial with a 50 ft. setback from the ultimate right -cif -way line. The subject property is located on the southwest corner of Adams Avenue and Magnolia Street consisting of 6.78 acres of land. The hearing was opened to the audience. Mr. Stringer, representing the applicant, indicated that this request is asking for no more than the other three corners have, and that a market study was prepared to substantiate the need for additional commercial. It was noted that there is to be a high turnover of commercial uses across the street. There being no other comment, the hearing was closed. Commission discussion followed. The Planning Commission discussed the market study supplied by the applicant, other commercial developments in the area and the meritsof the zone change. A MOTION WAS MADE BY DUKE AND SECONDED BY KERINS TO DENY THIS APPLICATION FOR THE FOLLOWING REASONS: 1. There is a surplus of vacant commercial property in the vicinity. 2. There is an existing high commercial turnover rate. 3. The added commercial zoning tends to degenerate existing commercial zoning. -5- 4/4/72 - PC Minutes: H. B. Mr. Duke withdrew his motion and Mr. Kerins withdrew his second. A MOTION WAS MADE BY BAZIL AND SECONDED BY DUKE TO ACCEPT THE APPLICANT'S REQUEST - FOR WITHDRAWAL OF HIS APPLICATION. MINORITY REPORT: Mr. Slates indicated that this was not a proper action and that we need comprehensive commercial development. Chairman Porter appointed Commissioner Slates and Jere Murphy of the Planning Department to forma committee of two to study the commercial need. COMMISSIONER DUKE: Commissioner Duke was excused from participation at 8:10 P.M. TENTATIVE TRACT NO. 7692 - Continued from March 21, 1972 Subdivider: Signal Landmark, Incorporated 541 lots on 115.6f acres. The subject property is located south of Adams Avenue and west of Magnolia Street. Mr. Harlow"indicated that there were'some,tvpogranhical errors on the conditions number three and four on the second page to be corrected as follows: Condition Number 3: The word "all" the first time is to be .changed to the word "th(9". The -condition shall read as follows: 3. A 6 ft. high masonry wall shall be constructed along the exterior side lot lines of all corner lots. Condition Number 4: The words "buildings constructed on" will be added to that condition. The condition shall read as follows: 4. The exterior elevations of all buildings constructed on lots siding or backing on to the arterial highways shall be subject to approval by the Planning Department. -6- 4/4/72 - PC Minutes: H. B. Planning Commission Tuesday, April 4, 1972 Page No. 7 COMMISSIONER BOYLE: Commissioner Boyle arrived at 8:15 P.M. and assumed his duties. Mr. Harlow also indicated that in view of the withdrawal of Zone Case No. 71-55 that there should be an additional condition added to the list which would call for a revision of the plan of the tentative tract map to exclude the commercial area and to include the cul-de-saced streets. The City Engineer requested that the street "BB" be moved and realigned to the north with the street which is on the west side of Newland Street. Mr. Kerins was concerned with the off -site improvements on the southeast corner of the property. Mr. Hartge indicated that the corner is signalized and that sufficient right-of-way has been obtained. A MOTION WAS MADE BY SLATES AND SECONDED BY KERINS TO APPROVE TENTATIVE TRACT NO. 7692 WITH THE FOLLOWING CONDITIONS AND THE REALIGNMENT OF "BB" STREET FURTHER TO THE NORTH AS REQUESTED BY THE CITY ENGINEER. 1. The tentative map received March 24, 1972, shall be the approved layout. 2. Landscaped planters shall be provided along all arterial highways. Such planters shall conform to the plans and specifications on file in the Department of Public Works and the requirement of the Planning Commission. It is the developer's responsibility to landscape such,planters and provide irrigation facilities in accordance with Department of Public Works specifications and requirements. 3. A 6 ft. high masonry wall shall be constructed along the exterior side lot line of all corner lots. 4. The exterior elevations of all buildings constructed on lots siding or backing on to the arterial highways shall be subject to the approval by the Planning Deparment. The intent of this requirement is to improve the street scene by having the developer provide architectural features on the exterior surface of buildings that are viewed from an arterial highway. S. A realignment of "BB" Street further to the north shall be required subject to the approval of Department of Public Works. 6. All standard conditions of approval for tentative tracts that are applicable shall be complied with. The Commission had further discussion on the cul-de-sac at the northwest corner of Indianapolis Avenue and Magnolia Street. The developer shall enter into a new agreement with the City to provide full street improvements along "J" Street in accordance with Department of Public Works requirements. COMMISSIONER DUKE: Commission Duke returned to the Commission meeting and assumed the Chair at 8:45 P.M. CHAIRMAN PORTER: Chairman Porter was excused from the meeting at 8:50 P.M. CONDITIONAL.EXCEPTION NO. 72-10 Applicant: J & L Industries To permit an automobile reclamation and recycling business to be conducted in the M2-0 Heavy Industrial District combined with oil production. The subject property is located on the north side of Edison Way 250 ft. east of Newland Street. The hearing was opened to the audience. The applicant indicated that such a use would bring in tax and wages to the City. He also stated he had no major objection with the conditions except for item No. 6 which states all on site utilities shall be installed underground. The applicant indicated the reason for this is the area does not warrant undergrounding. -9- 4/4/72 - PC Minutes: H. B. Planning Commission Tuesday, April 4, 1972 Page No. 10 Slides of subject property and the surrounding area were shown. The applicant presented elevations to the Commission and staff. Mr. Harlow read a letter from the adjacent property owner opposing the request. Mr. Robert Lindon Mort, Jr. in behalf of the Mills Land and Water Company addressed the Commission in opposition to Conditional Exception No. 72-10. Mr. Mort indicated that this company owns considerable property in the area and subject property is in the path of expanding residential and recrea- tional uses which he considers being the highest and best use. There being no other comment the hearing was closed. Commission discussion followed. Mr. Bazil stated there is a need for this type of use in the city. There is somewhat in the vicinity of 200 cars per month that leave the streets. Mr. Bazil further indicated the safeguards placed on the Gothard CCC Dismantling Facility have benefitted the area and the subject conditional exception is in a good location. Mr. Kerins asked whether there was a hardship on the property. Mr. Slates explained the costs to operate such a facility are too much and the fire department does not permit this type of dismantling in a building. He further stated it is not feasible to do this type of work within a building and the CCC Dismantling Facility speaks well for itself. The applicant submitted elevations of the facility to be constructed, and they were accepted as part of the submittal. A MOTION WAS MADE BY SLATES AND SECONDED BY BAZIL TO APPROVE CONDITIONAL EXCEPTION NO. 72-10 WITH THE FOLLOWING CONDITIONS: 1. Edison Way shall be dedicated and fully improved to City standards if requested by the Department of Public Works. Improvements shall include street trees, street lights, fire hydrants, sewer and water main extensions. 2. Water supply shall be through the City of Huntington Beach's water system. 3. The water, sewer and fire hydrant system shall be approved by the Department of Public Works and Fire Department. 5. The property shall participate in the local drainage assessment district. 6. All on -site utilities shall be installed underground. 7. Access throughout the yard shall be approved by the Fire Department. 8. The use shall conform with requirements of S.9533.1 Motor Vehicle Storage Yard, except the required masonry, wall along the north, east and west property line may be constructed of a material approved by the Planning Commission. The wall along the front of the use shall be an 8 ft. high slump stone wall. 9. A plot plan depicting storage area, off-street parking, landscaping, sales areas, setbacks, etc. shall be submitted and approved by the Planning Department prior to issuance of permits. 10. Stacking of all material, other than auto stacking which shall not be allowed, shall not exceed 6 ft. in height. 11. Driveways within the yard area shall be constructed to Building Department requirements. 12. A landscaping and irrigation plan shall be submitted to the Board of Zoning Adjustments for approval. 13. All applicable City ordinances shall be complied with. 14. Conditional Exception No. 72-10 shall be subject to an administrative review before the Board of Zoning Adjustments prior to April 4, 1982 to determine whether the conditions existing at present have materially changed to an extent requiring a new application to the Planning Commission. Such administrative review shall be required everty five years thereafter. AND FOR THE FOLLOWING REASONS: I. This type of use is permitted in.the M1 District. IF 2. It is not feasible to conduct this entire operation within a fully enclosed building. Planning Commissi-ii Tuesda)7, April 4, 1972 Page No. 12 PRECISE PLAN ALIGNMENT NO. 72-2 Said plan proposes to precise plan the street alignment for the extension of Franklin Street and a cul-de-sac street parallel to and approximately 470 ft. west of the centerline of Beach Boulevard from Ellis Avenue to a point approximately 770 ft. north of the centerline of Ellis Avenue. Mr. Porter returned to the Commission meeting at 9:10 P.M. and assumed the chair. The staff presented slides on the subject property and recommended that the plan be adopted by resolution which offers flexibility. The hearing was opened to the audience. Mr. Mike Turner addressed the Commission in opposition to the alignment. There being no further comment the hearing was closed. Commission discussion followed. The Commission was advised that there was no apparent urgency to adopting the plan. A MOTION WAS MADE BY SLATES AND SECONDED BY DUKE TO WITHDRAW PRECISE PLAN ALIGNMENT NO. 72-2. The Staff was then directed to seek alternate solutions to this precise alignment, to contact the property owners and seek their recommendations, and this item be considered a low priority item. DISCUSSION: MEADOWLARK AIRPORT A comprehensive plan request by Orange County Airport Land Use Commission. The staff presented a land use map of one mile radius east and west and one and one-half miles north and south. The map indicated the flight pattern around the Meadowlark Airport. The staff stated they had received a letter from the County Airport Land Use Commission requesting the City to adopt planning boundaries for the Meadowlark Airport and to advise them of any proposed use within such boundaries. -12- 4/4/72 - PC Minutes: H. DISCUSSION: STANDARD OIL LETTER REQUESTING TO ADDRESS THE PLANNING COMMISSION ON PROGRESS OF LANDSCAPING PLANS FOR THE OIL OPERATION SITES. ' Mr. Buhr presented a schematic of landscaping on Edwards Street. Mr. Kerins stated he would like to see the fence removed or set back further. Mr. Porter indicated he would like to see some plantings along the road. Mr. Buhr explained he would have his people work with the City staff to establish meaningful landscaping. The Planning Commission directed the staff to coordinate the landscaping plan with the applicant on Garfield and Edwards Avenues. They also indicated the staff is not to authorize any redrill permits until the Planning Commission is satisfied with the land- scaping plan, and that Standard Oil is to provide the improve- ments when requested by the Public Works Department. The Commission indicated they would like to see some action soon. Mr. Kerins indicated he would like to see this restudied in a Study Session. Mr. Higgins said he would go along with the rezoning for R2. It was noted the City Council wants R2 zoning instead of R3 zoning. A MOTION WAS MADE BY BAZIL AND SECONDED BY DUKE TO RECOMMEND R2 ZONING FOR AREAS "A" AND "B" FOR THE FOLLOWING REASON: 1.
