HomeMy WebLinkAbout1972-04-12MINUTES HUNTINGTON BEACH BOARD OF ZONING ADJUSTMENTS Administrative Annex 523 Main Street Huntington Beach, California WEDNESDAY, APRIL 12, 1972 BOARD MEMBERS PRESENT: McFarland, Spencer, Palin BOARD MEMBERS ABSENT: None CONDITIONAL EXCEPTION NO. 72-25 Applicant: Ken Rodgers To permit second floor balconies of a proposed four-plex to project into the required 4 ft. front yard setback to within 2 inches of the front property line and to with- in 6 in. of the exterior side yard setback. The subject property is located at 304 17th Street in the R4 Multiple Family Residence District. The hearing was opened to the audience. Ken Rodgers, applicant, addressed the Board and explained the request. Eave overhangs were discussed with regard to the interpretation of the Ordinance. Also support posts. Harold Ewell, property owner, addressed the Board, stating this project was already built and that he felt the balconies should not project over the sidewalk, which in fact, they do.. ,r It was noted that new sidewalks had been constructed recently. There being no further comment; the hear- ing was closed. Board discussion followed. A MOTION WAS MADE BY MCFARLAND AND SE- CONDED BY SPENCER TO CONTINUE CONDITIONAL EXCEPTION NO. 72-25 TO APRIL 19, 19729 TO ALLOW TIME FOR A FIELD CHECK OF THE PROJECT UNDER CONSTRUCTION AND DETERMINE THE ACTUAL ENCROACHMENT OF BALCON- IES. ROLL CALL VOTE: AYES: McFarland, Spencer, Palin NOES: None THE MOTION CARRIED. CONDITIONAL EXCEPTION NO. 72-28 Applicant: Michael Maior To permit a 150 sq. ft. sign to be lo- cated 53 ft. from the north property line in lieu of the required 70 ft. setback. The subject property is located on the west side of Beach Boulevard approximately 1000 ft. south of Ellis Avenue in the C4 Highway Commercial District. The hearing was opened to the audience. It was noted by the Board that a modification would have to be make to accommodate the proposed sign. Location of the sign was discussed with regard to utilities and whether or not they were underground. The applicant stated all utilities were along the rear. There being no other comment, the hearing was closed. Board discussion followed. A MOTION WAS MADE BY PALIN AND SECONDED BY MCFARLAND TO APPROVE CONDITIONAL EXCEPTION NO. 72-28 WITH THE FOLLOWING CONDITIONS: 1. Subject sign shall be located 542 ft. from the north property line. 2. The sign shall not exceed 140 sq. ft. and a height of not more than 35 ft. AND FOR THE FOLLOWING REASONS: 1. The driveway is located at the center of property because of a break in the raised median in Beach Blvd. 2. The sign is only located 5.5 ft. off required location because of driveway location on subject property. ROLL CALL VOTE: AYES: McFarland, Spencer, Palin NOES: None THE MOTION CARRIED. CONDITIONAL EXCEPTION NO. 72-27 Applicant: Joe& Melba Pulliam To permit an existing addition to a single family residence to come to within 8 ft. 6 in. of the rear property line in lieu of the minimum rear yard setback of 10 ft. The subject property is located on the southwest corner of Shinkle Lane and Glenwood Avenue in the R1 Single Family Residence District. The hearing was opened to the audience. There being no one present to speak for or against the request, the hearing was closed. Board discussion was held. A MOTION WAS MADE BY MCFARLAND AND SECONDED BY PALIN TO DENY CONDITIONAL EXCEPTION NO. 72-27 FOR THE FOLLOWING REASON: 1. The applicant failed to demonstrate hardship. Board of Zoning Adjustments April 12, 1972 Page -3- CONDITIONAL EXCEPTION NO. 72-24A Applicant: Cambro Manufacturing Co. To permit 79 parking spaces in lieu of the minimum requirement of 119 parking spaces to satisfy the parking requirement of an existing manufacturing and warehousing facility with a proposed 19,200 sq. ft. addition. The subject property is located on the northwest corner of Huntington Avenue and Clay Street in the MI Light Industrial District. The hearing was opened to the audience. Dick Hammond, representing the applicant, addressed the Board and explained the request. It was noted that the applicant was advised that he could request at the time of filing an Administrative Review for the expanding of the manufacturing area. Parking requirements were discussed. Mr. Hammond stated that the operation is three -shifts with a total of 105 employees divided into shifts of 50 employees and 40 employees. He also stated there were no retail sales, it was strictly manufacturing and they ship from the facility. There being no further comment, the hearing was closed. A MOTION WAS MADE BY MCFARLAND AND SECONDED BY SPENCER TO APPROVE CONDITIONAL EXCEPTION NO. 72-24A WITH THE FOLLOWING CONDITION: 1. The Board of Zoning Adjustments reserves the right to review subject operation to determine future parking needs as deemed necessary. AND FOR THE FOLLOWING REASONS: 1. -This manufacturing operation is of such a nature that it requires considerable floor area without a corresponding need for parking. 2. The applicant has additional land available if added parking is needed. ROLL CALL -VOTE: AYES: McFarland, Spencer, Palin NOES: None THE MOTION CARRIED. USE PERMIT NO. 72-17 To permit the construction of a 8,805 sq. ft.-bank building. In conjunction with DIVISION OF LAND NO. 72-12 Applicant: K-D Venture To divide a legal parcel of land into three separate parcels. The subject property is located on the southeast corner of Atlanta Avenue and Beach Boulevard in the C4 Highway Commercial District. -3- 4/12/72-BZA Minutes: H.B. Earl Stump and Jerry Murphy, representing the applicant, addressed the Board and explained the request. Parking layout was discussed at,some length. It was recommended that the design of the building should be coordinated with the architect so that any mechanical roof -top equipment could be screened with parapet other than slat -type. comment, the hearing was closed. There being no further Board discussion followed. It was the consensus of the Board that a meeting should be held with the Traffic Engineer ;and Planning Staff. USE PERMIT NO. 72-16 Applicant: Bill Langston To permit the construction of an auto sales and service facility on a 3.6 acre parcel of land. The subject property is located on the east side of Beach Boulevard, 150+ ft. south of Terry Avenue in the C4 Highway Commercial District. Bill Langston, applicant, addressed the Board and explained the request. It was noted by the Board that the plans showed insufficient dimensioning and land- scaping. Also, the arrangement of the buildings and site layout were questioned and discussed by the Board. It was the majority of the consensus that the location and orienta- tion of the service buildings should be arranged in a manner that would have the least detrimental effect on the adjoining property. Based upon these considerations, it was felt that the item should be continued to allow the applicant to meet with the staff to review these items. There being no further comment, the hearing was closed. Board discussion followed. A MOTION WAS MADE BY PALIN AND SECONDED BY MCFARLAND TO; -CONTINUE USE,PERMIT NO. 72-16 TO ALLOW TIME FOR THE APPLICANT TO MEET WITH THE STAFF. Board of Zoning Adjustments April 12, 1972 Page -5- USE PERMIT NO. 72-19 Applicant: Signal Oil & Gas Co. To permit drilling and operating for the discovery or production of oil, gas, hydrocarbons and/or kin- dred substances in their natural state, including the installation and use of equipment, structures, tools and other facilities incidental, necessary and accessory to the drilling, production, repressuring and processing of substances produced by such wells for shipment to pipeline. The subject property is --located on the northwest corner of Goldenwest Street and Pacific Coast Highway extending approximately 150 ft. westerly along Pacific Coast High- way to a point contiguous with existing Oil Field Operation Site in the M2-02 General Manufacturing District combined with oil pro- duction. The hearing was opened to the audience. Bill Woods, representing the applicant, addressed the Board and explained the request and stated this is an extension of an existing use and is a redrilling operation only. Requirements of the Huntington Beach Ordinance Code were reviewed with the applicant. There being no other comment, the hearing was closed. Board discussion followed. A MOTION WAS MADE BY PALIN AND SECONDED BY SPENCER TO APPROVE USE PERMIT NO. 72-19 WITH THE FOLLOWING CONDI- TIONS: 1. The plot plan received March 29, 1972, shall be the approved layout. 2. The water, sewer and fire hydrant system shall be approved by the Department of Public Works and Fire Department. 3. All applicable City Ordinances shall be complied with. ROLL CALL VOTE: AYES: McFarland, Spencer, Palin NOES: None THE MOTION CARRIED. USE PERMIT NO. 72-18 Applicant: H. C. Stovall To permit the construction of a 400 sq. ft. addition to an existing dwelling with a nonconforming side yard setback. The subject property is located on the south side -of llth Street, approximately 200 ft. to Lake Street on the east, in the R1 Single Family Residence District. Board discussion followed., A MOTION WAS MADE BY MCFARLAND AND SECONDED BY PALIN TO APPROVE USE PERMIT NO. 72-18 FOR THE FOLLOWING REASON: - 1. The proposed addition conforms to the Huntington Beach Ordinance Code Division 9 with regard to setback and open space requirements: ROLL CALL VOTE: AYES: McFarland, Spencer, Palin NOES: None THE MOTION CARRIED. MISCELLANEOUS: Dan McFarland, representa- tive of the Building and Safety Department, informed the Board that he had received a complaint on Wm. Enos & Son, 8481 Lomonde Dr., Home Occupation. Upon investigation it was determined that violation did exist; therefore, he was request- ing that the Board review for a possible revocation of home occupation. It was the consensus of the Board to notify the applicant of a public hearing at the April 26, 1972 meeting. USE PERMIT NO. 72-1 Applicant: Bob's Big Boy A requirement of approval of Use Permit No. 72-1 was a review of the landscaping plan. The Board reviewed and approved said landscape plan received April 5, 1972, pursuant to conditions of approval of Use Permit No. 72-1. Elevations - Review Tentative Tract No. 7512 Elevations were reviewed and approved as submitted April 12, 1972 as required by the Planning Commission, Conditions of Approval for Tentative Tract No. 7512.
