Ken Rodgers, applicant,
addressed the Board and explained the request.
It was noted by the Board
that this item had been continued in order to receive an
attorney's opi-pion. The City Attorney's office had been
conferred with and the Board does not have the authority to
act on this application as the structure projects over the
property line. It was noted that the Uniform Building Code
does not allow projection over'the property line and that the
application is improper as the request is not as it appears
in the field.

150 feet south of Terry Avenue in the C4 Highway Commercial
District.
It was noted by the Board
that this item had been continued to allow, time for the
applicant to submit revised plot plans.

It was noted that pursuant
to a staff meeting, revised plot plans had been submitted,
and conditions of approval updated. It was suggested that
the service buildings be moved to all a 10 foot setback to
afford better landscaping and maintenance along the east
property line.

AND SECONDED BY SPENCER TO APPROVE USE PERMIT NO. 72-16 WITH
THE FOLLOWING CONDITIONS:
1. The plot plan received April 19, 1972 as amended shall
be the approved layout.
2. Beach Boulevard and Terry Drive shall be dedicated and
fully improved to City and/or State standards at the time
each parcel -is developed. Improvements'shall include -
street trees, street signs, street lights, fire hydrants,
sewer and water main extensions.
3. Water supply shall be through the City of Huntington
Beach's water system.
4. Sewage disposal shall be through the City of Huntington
Beach's sewage system.

5. The water, sewer and fire hydrant system shall be approved
by the Department of Public Works and Fire Department.
6. The flood control channel shall be fenced to Flood

7. The property shall participate in the local drainage
assessment district.
8. Soil reports as required by the Building Department and
the Department of Public Works shall be submitted to
the City prior to issuance of building permits.
9. All utilities shall be installed underground.
10. Fire alarm system conduit and appurtenances shall be
installed by the developer at locations and to specifica-
tions provided by the Fire Department.
11. Off-street parking facilities shall conform to Article 979.
12. Parking compouinds shall be screened with a combination
of fencing and landscaping. Said plan shall be approved
by the Planning Department.
13. No structures, other than those shown on the approved
plot plan shall be constructed within the project.
14. All lighting within the development shall be directed
away from abutting property.
15. The speaker system shall be located only within the
proposed building to eliminate noise from being directed
onto abutting properties.
16. All applicable City Ordinances shall be complied with.
17. A Division of Land application shall be filed on future
phase to the south or landscaping shall be provided at
the ratio of 3% for the entire parcel.
18. All buildings shall setback 10 feet from the east
property line.

Karcher and Warren LeFivre, applicant and representatives,
addresses the Board and explained the request.
The sit-down structure was -
discussed with regard to the parking requirements. A lengthy
discussion was held with regard to improvments, landscaping
and easements. °

THE FOLLOWING CONDITIONS:

Lester Zingone,,,applicant,
addressed the Board and explained the request.
Mrs. Launders, adjacent
property owner and Joe Campbell, prospective buyer in the area,-'
addressed the Board asking for clarification of the zoning
and the density. Mr. Campbell felt the open space was inadequate
for children and that they would evetually be playing in the
streets.
It was noted byy the Board
that calculation on the actual floor area would be required
prior to Board action on the request.
