MINORITY REPORT: Commissioner Slates indicated that Zone Case No. 71-40 is not relative to the Master Plan. ZONE CASE NO. 72-14 Applicant: Grover Collins To permit a change of zone from R2 Two Family Residence District to R2-01 Two Family Residence District combined with oil production. The subJject property is located east of Algonquin Street, approximately 360 feet north of Pearce Avenue. Photographs of the existing oil site were reviewed with the Commission. The hearing was opened to the audience. Don Eggleston, Vice President of the Home Council, spoke in opposition. He stated that in 1969 this operator allowed oil to be spilled into the harbor and onto public right-of-way. There being no further comment, the hearing was closed. The Commission discussed the manner in which this oil site has been operated. It was noted that a memo had been received from the oil field superintendent indicating "this department has on record the following malfunc- tions which have occurred since this lease began operation: (1) oil spill confined, enclosure February 4, 1967; (2) broken hi h pressure oil line confined to enclosure October 25, 1967; (3 oil spill, oil in street and drainage channel; (4) malfunc- tioning clarifiers, oil in sanitary sewer system March 26, 1968; (5) oil spill, oil in street drainage channel and Huntington Harbour January 27, 1969; (65 brass valve on 40 lb. pressure gas line broken by truck, no other gas shut -off -on lease at the time April 9, 1969; (7) oil spill, oil in street, drain- age channel and Huntington Harbour February 24, 1970.11 ON MOTION BY KERINS AND SECOND BY BAZIL THE COMMISSION MOVED TO DENY ZONE CASE NO. 72-14 FOR THE AFOREMENTIONED REASONS GIVEN BY THE OIL FIELD SUPERINTENDENT. Planning Commission Tuesday, May 2, 1972 Page No. 3 USE PERMIT NO. 72-21 - Referred by the Board of Zoning Adjustments Applicant: ICR Corporation To permit a printing establishment for multi -color paper products within an existing 80,000 sq. ft. building on a 5.47 acre parcel of land. The subject property is located on the north side of Terry Drive approximately 200 ft. east of Beach Boulevard in the C4 Highway Commercial District. Photographs of the existing 80,000 sq. ft. building were reviewed with the Commission. The hearing was opened to the audience. Mr. James M. Thompson, representing ICR Corporation, spoke in behalf of this request and indicated that there has been quite a bit o, misunderstanding on this request. He stated there woul be no outside storage, there would be 61 employees, adequate parking, and it would upgrade the building. He further explained they have taken steps to baffle the noise within the building and there would be no noise outside the building. Commissioner Bazil expressed concern as to trucking and how often trucks would be leaving the building. Mr. Thompson stated that there were only three trucks and they would have two deliveries per day. Mr. Macy addressed the Commission requesting the definition of a "printing plant", and further stated that expansion of business could lead to the use of plastics, foil, etc., and that they would be processing raw materials. He added that Mr. Powell, who had spoken in behalf of the applicant,is the son-in-law of the president and an employee of the company. Considerable discussion followed. There being no further comment, the hearing was closed. Commissioner Kerins indicated that the Commission should determine whether this is a commercial or a manufacturing use. Commissioner Higgins pointed out that they would have to think about how the business affects the environment. Various commercial uses can legally come in such as restaurants, hotels, motels, etc. which are more offensive than a print shop. Commissioner Slates explained that he had checked the industrial classification of the federal government which lists this use into commercial zones, where as, making of boxes out of heavy corrugated material would be an industrial use. He added they would have more control through the use permit procedure and that such use permit should be carefully structured. -3- 5/2/72 PC Minutes: H. B. Planning Department Tuesday, May 2, 1972 Page 4 Commissioner Boyle asked the staff if they would allow this use or into which district would they put it. Mr. Harlow, 'Acting Secretary of the Planning Commission, explained he would permit it in an industrial district. Further Commission discussion followed as to the affect on the environment. ON MOTION BY SLATES AND SECOND -BY HIGGINS THE COMMISSION MOVED TO APPROVE USE -PERMIT -- NO. 72-21. ROLL CALL VOTE: AYES: Slates, Higgins NOES: Bazi1, Kerins, Porter, Boyle ABSENT: None THE MOTION FAILED. ON MOTION BY BOYLE AND SECOND BY KERINS THE COMMISSION MOVED TO DENY USE PERMIT -- NO. 72-21 FOR THE FOLLOWING REASONS: 1. The use is not compatible with commercial, and it lies somewhere between a commercial and an industrial use in what might be termed a twilight zone. 2. There are too many unanswered questions. ROLL CALL VOTE: AYES: Bazil, Kerins, Boyle, Porter NOES: Slates, Higgins ABSENT: None THE MOTION CARRIED. The Commission directed the staff to take care of the "twilight zone" and to define "printing plant" and "printing shop" and relate them to the size of the operation. PRECISE PLAN ALIGNMENT NO. 72-4 A precise plan of street alignment proposing to precise plan the street align- ment for future streets south of Warner Avenue and east of Bolsa Chica Street. Mr. Palin, Planning Dept- artment, outlined the alignment. The hearing was opened to the audience. Mr. David St. Ange spoke in favor, and requested that the water be installed prior to the paving of the street. Mr. Hartge, City Engineer, • explained that a plan for the water line would have to be dropped if all of the property owners in the area cannot get together. -4- 5/2/72 PC Minutes: H. B. Planning Commission Tuesday, May 2, 1972 Page No. 5 Mr. Kirk was interested in the access to the R1 property that has frontage on Warner and frontage on the local street. He further indi- cated that R1 does not seem to be an appropriate zone for that parcel. Mr. Poppy, representing a landlock parcel, stated that Dunbar Street should be run straight through and that everything north of Dunbar Street should be rezoned to an Office -Professional District. There being no other comment, the hearing was closed. Mr. Hartge stated that running Dunbar Street through would lead to an exception grade in that street. Commissioner Bazil indicated that cul-de-sacing of B Street could be accomplished and this would lead to a rezoning. Mr. Hartge pointed out that the zoning is a controlling factor. Mr. Slates indicated a cul-de-sacing of A Street and eliminate B Street altogether. Mr. Harlow explained the precise alignment could be adopted by resolution which would make it easier to change at a later date. Mr. Reynolds, Planning Director, indicated that without B Street the City would be faced with a rezoning of the property on Warner Avenue which might lead to strip zoning. QN MOTION BY SLATES AND SECOND BY BOYLE THE COMMISSION MOVEb TO"CONTINUE PRECISE PLAN ALIGNMENT NO. 72-4 TO A STUDY SESSION ON MAY 91 1972. ROLL CALL VOTE: AYES: Slates, Higgins, Bazil, Kerins, Porter, Boyle NOES: None ABSENT: None THE MOTION CARRIED. PRECISE PLAN NO. 72-5 To precise plan the easterly extension of HH Drive within Tentative Tract No. 7692 to terminate in a cul-de-sac. The subject property is located at the northwest corner of Indianapolis and Magnolia Street. Mr. Reynolds indicated that the Planning Commission had directed the staff to contact the owner, but the owner had not replied. The hearing was opened to the audience. Mr. Allan Eisler, the property owner, spoke in opposition to this proposed alignment. -5- 5/2/72 PC Minutes: H. B. Commissioner Porter pointed out that the policy of the Commission is to have commercial zoning on the half mile intersection. ON MOTION BY BOYLE AND SECOND BY SLATES THE COMMISSION MOVED TO CONTINUE PRECISE PLAN NO. 72-5 TO A STUDY SESSION ON MAY 99 1972 TO ALLOW TIME FOR THE STAFF TO REVIEW SUBJECT ALIGNMENT WITH THE PROPERTY OWNER. ROLL CALL VOTE: AYES: Slates, Higgins, Bazil, Kerins, Porter, Boyle NOES: None ABSENT: None THE MOTION CARRIED. TENTATIVE TRACT NO. 7771 (Continued from April 18, 1972) Subdivider: Meadow Homes The location is northwest corner of Ellis Avenue and Newland Street. The tentative tract request is for 137 lots on 29 acres. Mr. Harlow outlined the topographic features and subdivision layout and made reference to the archaeological site. And further informed the commission in that the park site has not been delineated by the City. The commission then reviewed some slides. Mr. Shelton addressed the commission and stated that the reason for acquistion for this property was because of the potential fill material. Commissioner Boyle then asked if their intent was to terrace the property. He also asked if there was not a park there what would be done with the trees. Mr. Shelton indicated that the trees are a nuisance and an attraction to narcotics. The trees are 90 years old and some of them are dying. Commissioner Slates asked if there should be a park here. And the question if a park should be purchased. And such a park is only to look at and not to use. Commissioner Porter indicated that we should have a slope ordinance. Commissioner Boyle stated that we should not think of this in just usuable open space. He is in favor of open space, save the bluffs to save the trees, etc. Mr. Jere Murphy, Planning Department, asked that we should question our street tree expert as to the trees and also archaeological research. Commissioner Porter stated what about the bluff. It is more than just trees and archaeology. -6- 5/2/72 PC Minutes: H. B. Planning Commission Tuesday, May 2, 1972 Page No. 7 Commissioner Higgins stated that this could be delved by clearing out the bad trees and planting new trees. This open space has to be maintained. Commissioner Kerins stated that they should not proceed with the present design and that the Bluffs should be preserved. And that the commission should establish a policy as to how the Bluffs best be utilized. Mr. Shelton stated that they are meanable to revise the plan to help preserve the Bluff but? Commissioner Higgins stated this would be an excellent plan development; should recommend single family home plan development for the City should establish a policy to require Bluffs as open space. Commissioner Porter stated the Bluffs should be preserved either in private or public hands. This could be done through (1) park acquisition or (2) plan residential development or (3) a map that would leave the Bluff. ON MOTION BY BAZIL AND SECOND BY SLATES THE COMMISSION MOVED TO CONTINUE FOR 30 DAYS, TO ESTABLISH A SET OF PRIORITIES AND TO PRESENT ALTERNATIVES TO THE CITY COUNCIL. Some of the alternatives are as follows: (1) outright dedication, (2) 13-14t'park acquisition, (3) acquisition of a lesser amount, (4) an R1-PD, (5) the staff was directed to explore other possi- bilities. CODE AMENDMENT NO. 72-3 A proposed code amendment to provide for combining of the -02 combiningg oil district, with the base zone RA Residential Agricul- tural District by amending 5.9686.1 to read: "Restricted Areas: The -02 district may be combined only with the Ml, M2, and RA District". ON MOTION BY SLATES AND SECOND BY BAZIL THE COMMISSION MOVED TO APPROVE CODE AMENDMENT NO. 72-3. Planning Commission Tuesday, May 2, 1972 Page No. 8 TENTATIVE TRACT NO. 7639 Subdivider: McKeon Construction Company In Conjunction With USE PERMIT NO. 71-50 Applicant: McKeon Construction Company To review building elevations for 176 units of a planned development on 10.54 acres pursuant to the condition of approval by the Planning Commission on November 16, 1971. The renderings were presented by Mr. Palin and Mr. Darrel Boyer was present to answer any of the Commissions questions. Commissioner Kerins asked questions as to the patio materials and was concerned with the brick veneer. Mr. Boyer indicated that they would use a rough sawn ply with built-up pilasters and the brick is actually brick. ON MOTION BY SLATES AND SECOND BY BAZIL THE COMMISSION MOVED TO APPROVE ELEVATIONS FOR MCKEON CONSTRUCTION CO. USE PERMIT NO. 71-50 AND TO REQUIRE THAT REDUCTIONS BE PREPARED OF THE ELEVATIONS AND INSERTED INTO THE FILE. THE TOTAL NUMBER OF ELEVATIONS IS 5. ROLL CALL VOTE: AYES: Slates, Higgins, Bazil, Kerins, Porter, Boyle NOES: None ABSENT: None THE MOTION CARRIED. The Commission then directed the staff to make sure that veneers are stated on all plans. REQUEST: from Signal Oil & Gas Company to permit existing M in link fence with redwood slats to serve as substitute fencing around an oil operation site in lieu of the required masonry wall. Said oil operation site is located at the northwest corner of Pacific Coast Highway and Goldenwest Street. Mr. Wood presented his ideas to the Planning Commission and that he wanted an extension to the existing fencing in landscaping. He further stated that the requirement will not be visible with extensive land- scaping. ON MOTION BY SLATES AND SECOND BY BAZIL THE COMMISSION MOVED TO APPROVE WITH THE CONDITIONS AS OUTLINED. Planning Commission Tuesday, May 2, 1972 Page No. 9 REVIEW PLAN - Combination of open space and drainage aci ity at the northeast corner of Adams Avenue and Beach Blvd. (Tentative Tract No. 7742) Mr. Hartge reported to the Commission that the Environmental Council was in favor of alternate #2. And that the Environmental Council wanted to investigate acquistion of the rest of the property. reviewed the alternative. The Commission then ON MOTION BY BOYLE AND SECOND BY BAZIL THE COMMISSION MOVED TO ADOPT ALTERNATE #2 ON DRAINAGE FOR TENTATIVE TRACT NO. 7742. ROLL CALL VOTE: AYES: Slates, Bazil, Boyle, Porter, Kerins, Higgins NOES: None ABSENT: None THE MOTION CARRIED. The staff was further directe& to investigate the environmental impact. MISCELLANEOUS: FINAL TRACT 6808 Subdivider: Huntington Harbour The request to permit sandy beaches instead of bulkhead in Huntington Harbour. It was indicated by the Public Works Department that there seemed to be no problem with this request. The applicant expressed to offer a variation from the bulkhead. Commissioner Bazil indicated that the beaches were not allowed when Huntington Harbour was first developed. Commissioner Kerins stated that he does not concur and would like to have bulkhead as.the rest of the area had been developed with the bulkhead. He further indicated that it does not appear to be a better plan and is concerned with the swimming that might insue. Mr. Hartge indicated that there were the beaches to be permitted it would require 3 to 4 ft. of sand to be brought in. Commissioner Kerins indicated that at high tide there would be zerd-foot setback. ON MOTION BY KERINS AND SECOND BY PORTER THE COMMISSION MOVED TO DENY THE REQUEST INDICATING THAT THE REAR LINE WILL BE A FOOTING FOR THE HOUSE AND WILL NOT GO INTO THE DEPTH THAT THE BULKHEAD WILL. -9- 5/2/72 PC Minutes: H. GULF OIL WALL Gulf Oil indicated that they would like to ve 4 feet"setback in lieu of the 7k feet required. Commissioner Slates indicated that he cant see a need for deviation from the present policy. He further stated "I have yet to see an oil company do anything out of generosity." Commissioner Porter indicated that the commission wants more setback and that this should be communicated to Gulf Oil. J & L INDUSTRIES - The submitting of fencing material for the Commission's approval as required on their conditional exception approval. ON MOTION BY BAZIL AND SECOND BY KERINS THE COMMISSION MOVED TO APPROVE THE GREEN METAL FENCING MATERIAL AS SUBMITTED BY THE APPLICANT. ROLL CALL VOTE: AYES: Bazil, Kerins, Porter, Boyle, Slates, Higgins NOES: None ABSENT: None THE MOTION CARRIED. COMMISSIONERS COMMENTS: after 11:00 P.M. he would like before the Commission and that Planning Commission policy. Commissioner Kerins stated to see no more new items brought this should be established as Commissioner Porter indicated that the Commission would like to have something in writing before it is to be considered by the Planning Commission. STAFF COMMUNICATIONS: Mr. Reynolds reviewed the Council agenda of May 1, 1972 with the Planning Commission. 1ISCELLANEOUS: All items on the miscellaneous agenda for May 2, 1972 were continued to May 9, 1972.
