The subject property is located south of
Edinger Avenue, 1000 feet westerly of Saybrook Lane.
The Tentative Tract request is for one lot
subdivision on 32.96 gross acres to allow 230 Townhouses.
The Use Permit is to allow the construction of a Planned
Residential Development consisting of 230 Townhouses and
related facilities on a 32.96 gross acre parcel of land.
Slides were shown of the area and the applicant
had slides of the elevations. Mr. Palin presented aerial
slides of the area.
The chair opened public hearing and Mr. Martin
Fento, President of Christianana Corporation, and Mr.
Herbert McLaughlin, architect, were present to describe
the development. The applicant indicated he was trying to
provide a better living environment and to continue the water-
front approach. He further indicated that there would be
tennis courts, totlots, walkways, etc. providing a community
building for 300 people.

:Ir. hlil;ton izayeholt indicated that he was neither in
LaVOT' or uppost�d to the project. The project, requires consider-
able construction. "Will the Corps. of Engineers be involved
and will they be preparing an environmental impact report?" was
Mr. Baychok's question.
Commissioner Porter asked if we could compel the Corps.
of Engineers to provide an environmental impact statement.
Mr. Baychok further indicated that it would be in the
applicant's own interest to seek out these statements.
Mr. Harlow, Secretary Planning Commission, indicated
that the Staff could write to the Corps. if the Planning Commission
desires.
Mr. John Wirt, Vice -President of Huntington Harbour
Property Owners' Association, was in opposition to the proposal.
He said there would be an increase in the density and he doubts
about the lagoon problem which would lead to an Increase in muddy
water of the channel.
Mr. Don Eggleston, Vice -President of the Home Council,
indicated that they would like to have a balanced area and not to
have more apartments than single family homes.
There being no further speakers, the chair closed the
public hearing.
The chair asked the applicant what studies had been
completed to date.
Mr. Nichols indicated that they had studied the water
and the tide gauge systems.
Commissioner Kerins asked how does this plan control
the water quality.
Mr. Nichols indicated that they are required to have
a discharge permit.
Commissioner Slates indicated that the flood control
district puts more polution into the bay than this project would.
Commissioner Higgins indicated that he was concerned
with parking and would like to see'another half car per unit required.
Commissioner Boyle indicated the type of pe rs ons living
here would not be raising a family and he would like to see a
separation between pedestrian traffic and car traffic.
Commissloner Porter would like to eliminate about nine
(9) units and would like to see a revised plan.

1. The tentative map and precise plan received May 5, 1972 shall

2. Additional open parking spaces shall be provided in areas~ where

Fire Department, and Department of Public Works.

4. A bulk head shall be provided along all lots that abut the
public waterway and private lagoon.
5. A detail plan, showing pedestrian circulation, shall be
approved by the Planning Department prior to issuance of
building permits, grading permits or recordation of a final
map.
6. A decorative masonry wall shall be constructed along Edinger
Avenue. Said wall shall be 6 inches wide and 6 feet high.
The height of said wall shall be measured from whichever side
is higher at finished grade. The architectural design of
said wall shall be approved by the Planning Department.
Structural design shall be approved by the Department of
Public Works and shall be included as a part of the street
improvement plan.
Vista points shall be provided along the wall to permit the
view of green areas within the project.
7. The architectural design of the perimeter wall and the tYpgF-
and placement of street trees shall create unity and interest
in the street scene.
8. The parkway along Ldinge r Avenue shall include provisions for
an 8 ft. wide landscaped strip which shall conform to the
plans and specifications on file in the Department of Public
Works and the requirements of the Planning Commission. It is
the developer's responsibility to landscape such planters and
provide irrigation facilities in accordance with Department
of Public Works' specifications and requirements.
9. The precise number of mooring spaces for larger boats and the
distribution of such spaces shall be approved by the Depart-
ment of Public Works and Department of Harbor and Beaches.
10. There shall be no rental of boat slips to persons residing
outside of this development.
11. The width of the channel and the distance between the pierhead
lines shall be approved by Department of Public Works and
Department of Harbor and Beaches.
The intent of this condition is to provide for sufficient
circulation for boats within the harbor. The construction
details of the rescue ramps and location of such ramps shall
be approved by the Fire Department and Department of Harbor
and Beaches.
12. Approval of this map is conditioned upon a favorable report
from the State Clearinghouse. In the event such report is
unfavorable, the map shall be reviewed by the Planning Com-
mission to add such conditions of approval as deemed necessary.
13. All applicable requirements of the Policy Statement for
Planned Residential Developments adopted by the Planning Com-
mission on February 8, 1972 shall be complied with.
14. All standard Conditions of Approval for tentative tracts that
are applicable shall be complied with.
15. A revised plot plan to be reviewed by the Planning Commission.
16. Reduction of the bulk and opening up of the area along the

Mr. Nichols, the applicant, with Classic Development
addressed the Commission and indicated that they have been working
in the planning process of this project for one yeat.

Mr. Martin indicated that conditions outlined by the staff
are acceptable to the developer.
Mr. Harlow indicated that Archeological Research would like
to have a man on the job when the grading is conducted on subject
property.
Mr. Joe Schimtz, a property owner of the vicinity,
discussed the surrounding zoning and indicated that these units
are too close together.
Commissioner Bazil indicated that the developer is
coming in with less than half the permitted density.
Mr. Walter Plotter was concerned with the street
aligmmnet and Phase Ii of the development.
There being no further speakers, the chair closed
the public hearing.
Commissioner Higgins indicated that the parking is
not adequate and Phase lI is not acceptable as) laid out.

Public hearing was opened by the chair.
Mr. Lewis I.eets, architect., prepared the elevations and
renderings and indicated that there were 11.2 units per acre which
is less than half the permitted number of units. He indicated that
the same landscape architect that designed the Harbour Lights land-
scaping would be doing this project.
Mr. Don Eggleston stated opposition to several aspects
of this project but not to the project itself. He would like to
eliminate Pickwick Street which would bring traffic from the project
by the school. He would like to see a ban against any TV antenna.
There being no further speakers, the Chair closed the
public hearing.
Mr. Hartge indicated that Pickwick Street is serving
existing units. There was considerable discussion as to the
separation of both facilities, a planned residential development
and the apartment. Separation of open space and also the possibility
of incorporatLng a two foot high wall separator.
Mr. Reynolds, Planning DLrector, Indicated the Council
did not consider the blending of these two projects.
A MOTION WAS MADE BY PORTER AND SECONDED BY KERINS TO
DENY USE PERMIT NO. 72-20 BECAUSE OF THE INCOMPATIBILITY PROPOSED
AND PHASE II ENCROACHES INTO THE APARTMENT COMPLEX AND DOES NOT
RELATE TO R3.
The Commission had some discussion and the motion and
second were withdrawn. Commissioner Higgins felt that the use
was wrong and Commissioner Boyle indicated that they should go
ahead to the Council to get a decision at that level.
A MOTION WAS MADE BY HIGGINS AND SECONDED BY BOYLE TO
REINSTATE THE PREVIOUS MOTION FOR USE PERMLT NO. 72-20 AND FURTHER
NOTED THE INCOMPATIBILITY AND THAT THE COUNCIL IMPOSED THE CONDITION
THAT HAS CREATED THE PROBLEM AND THAT THE COUNCIL SHOULD RESOLVE
THIS PROBLEM.

The request is to permit the construction AAd operation
of a boarding stable for 50 horses, expanding to 100 over a five
year period on 4.59 sere parcel of land in the M1 Light Industrial
District.
It was noted by the Acting Secretary that a recent
opinion from the City Attorney's office prohibits the processing
or approving of "use variances". The applicant was informed of
this opinion and Xs withdrawing his application on this basis.

The chair opened the public hearing.
Ron Martin, the architect, indicated that the construction
would be of concrete block with a stucco finish. He made a note
that the parking for the offices would be different than for the
industrial use.

1. The plot plan received April 5, 1972 shall be the approved
layout.
2. Gothard Street shall be dedicated and fully improved to City
standards at the time said parcel is developed. Improvements
shall include street trees, street signs, street lights, fire
hydrants, sewer and water main extensions.
3. Water supply shall be through the City of Huntington Beach's
water system.
4. Sewage disposal shall be through the City of Huntington Beach's
sewage system.
5. The water, sewer, and fire hydrant system shall be approved
by the Department of Public Works and Fire Department.
6. The property shall participate in the .local drainage assess-
ment district.
7. Soil reports a,3 required by the Building Department and the
Department of Public Works shall be submitted to the City
prior to issuance of building permits.-
8. All utilities shall be instAlled underground.
9. Off-street parking facilities shall conform to Article 9'79.
10. No structures, other than those shown on the approved plot
plan, shall be constructed within the project.
11. Retail sales shall be conducted only in the front portion of
the building and not to exceed 25% of the total volume of

RESOLUTION NO, 1092 A resolution of the City Planning Commission
requesting that a Transportation Committee
be established to implement a comprehensive study and creation of

Commissioner Higgins indicated that "we are becoming
greatly overwhelmed with projects of great urgency".
Commissioner Porter indicated that the administrative
staff would be involved with transportation.

CODE AMENDMENT N0. 72-9 (Continued from May 2, 1972)
This code amendment is proposed to clarify the provisions
of 5.9685.2 and S.9685.3 by specifically stating that redrilling
may be conducted on an oil operation site. The code permits
redrilling; however, because the definition nection of the code
distinguished between drilling and redrilling, the staff initiated
this amendment for clarification.

LETTER FROM OSCAR TAYLOR
This is in reference to a proposed development on
property between 9th and loth Streets on the north side of Pacific
Coast Highway.
Mr. Taylor had indicated that a condominium is the
most feasible development for that property.
Mr. Harlow, Secretary of the Planning Commission, indicate
that there Is no height limit and that condominiums are not permitted
He further indicated that there are four ways to permit such a use
in the C3.
1. To amend the C3 zoning to permit high-rise density.
2. To rezone the property to F4 and amend the R4 to allow condo-
miniums.
3. By special use permit.
4. By specific plan.
Commissioner Bazil Indicated that we should have C3 to
permit condominiums since the C3 is only in the Townlot area.
Mr. Taylor indicated that he had been talking with the
City for four months and that he further stated that the median
strip on Coast Highway prohibits access into 9th or loth Streets.
The property is 250 feet long and the buildings is proposed to be
96 feet wide. There would be 63 units and 16 stores.
Commissioner Kerins indicated chat the use is feasible
and that it is a legimate use.
Commissioner Porter indicated that there would be 25%
of the rooms in kitchens and that they should put an R use within
the C3 zoning.

This is in regard to a proposal to reduce the height of
the wall to be constructed along the south boundary of Irby Park to
4 ft. 6 in. and to -permit a gate connecting his property to the park.
Comment: The Standard Conditions of Approval require the
developer to construct a six (6) ft. high wall at this location and
the Planning Commission is the only body that can modify this require-
ment. The request was reviewed by the Recreation and Park Commission
on May loth and approval was recommended.

Comment: The Planning Commission has discussed the

Comment: Planned residential developments were not
permitted in the: R4 zone when the ordinance regulating planned
residential developments was adopted. This was done because it
was felt that the R4 zone would only be u,ed in the Tofrnlot area.
The staff feels that a code amendrlent to permit planned
residential developments in the R4 zone is reasonable and could be
adopted with relatively little effort.
