The Minutes of March 21, 1972 and corrected Minutes of March 28 and April 18, 1972, were accepted as transcribed and mailed by the Secretary. To allow the construction of 15 units, Planned Residential Development, located at the north- west corner of the intersection of Marina View Place and Los Patos Avenue in the R1 zone. The Acting Secretary informed the Commission that the subdivider and their engineer have been in contact with the staff to request additional time for revisions to the map; therefore, the staff is recommending a continuance to June 20, 1972. CODE AMENDMENT NO. 72-6 Said amendment is a proposal to provide for dedication of the required right-of-way prior to issuance of a drilling permit on property zoned 1102". The Acting Secretary informed the Commission that this code amendment was to have been heard by the Commission on May 16, 1972; however, the matter was continued at the request of a representative of the Huntington Beach Company. Mr. Harlow stated that the purpose of the continuance wab to allow time for the Huntington Beach Company to investigate the effect of the code amendment on their property. Also, that it was suggested that the Huntington Beach Company could perhaps offer to dedicate the land needed for street widening and that the city would accept such offers at the time additional right- of-way was needed. Mr. Harlow informed the Commission that the city entered into a similar agreement with the Huntington Beach Company approximately one year ago when their property located at the southwest corner of Garfield Avenue and Goldenwest Street was rezoned 1102"; therefore, the staff recommends a continuance to June 24th pending submission of an agreement by the Hunting- ton Beach Company. (C4 zone pending) The subject property is located at the northeast corner of Yorktown Avenue and Education Lane. The Acting Secretary read a letter submitted by Earl G. Peterson, Regional Coordinator, Gerber Products Company, requesting withdrawal of Conditional Exception No. 72-14. Planning Commission Tuesday, June 6, 1972 Page No. 3 TENTATIVE TRACT MAP NO. 7771 Subdivider: Meadow Homes To permit 137 lots on 29 acres of land, located at the northwest corner of Ellis Avenue and Newland Street. The Commission received a letter submitted by the Archaeological Research, Inc., _Ztat,ing that it would be difficult to discuss the impor- tance of any single archaeological site without a complete inventory and preliminary testing of several different types of sites within an area. The Acting Secretary informed the Commission that the City Council will consider the request for acquisition of the bluff. Mr. Harlow stated that the staff will be reporting to the Commission as to the action taken by the Council. He further informed the Commission that _if the Council recommends that the site be acquired, it will,necessitiate a major revision of the tentative map. Also, if the archaeological site provep.significant and the City decides to acquire this site, it will also require further revision of the map. Tom Shelton, engineer for the developer, stated that he did not have objections to contin- uance of said tract. A MOTION WAS MADE BY BAZIL AND SECONDED BY KERINS TO CONTINUE DECISION ON TENTATIVE TRACT NO. 7771 TO JULY 5, 1972, TO ALLOW TIME FOR THE CITY COUNCIL TO DETERMINE THE AMOUNT OF LAND TO BE ACQUIRED FOR PUBLIC PURPOSES. ROLL CALL VOTE: AYES: Slates, Bazil, Kerins, Porter, Boyle, Higgins NOES: None ABSENT: None THE MOTION CARRIED. ZONE CASE NO. 72-16 Applicant: Huntington Beach Co. Island "F" located 1130 ft. west of the intersection of Main Street and Utica Avenue. Island "G" located 439 ft. east of the intersection of Goldenwest Street and Palm Avenue. Island "L" located on the west side of 17th Street 37 ft. south of Adams Avenue extended, and Island "T" located at the north- westerly corner of 17th Street and Palm Avenue. A change of zone for the purpose of correctly describing existing oil drilling islands and to conform to the boundaries of Tentative Tract No. 7155. Said zone changes are described as follows: Island "F" - R1-0 to R1-01 and from R1-01 to RI-0 Single Family ems cTence District combined with oil production. CODE AMENDMENT NO. 72-10 A proposed code amendment to permit adjunct, ancillary, and special uses in the MI -A and M1 Industrial Districts subject to a use permit and to permit any use that is permitted in the MI -A to be permitted in the M1 subject to an Administrative Review before the Board of Zoning Adjustments. The hearing was opened to the audience, there being no comment the hearing was closed. Commission discussion followed. CODE AMENDMENT NO. 72-9 Said amendment is as follows: S.9685.2-Drilling and Re -drilling allowed on Oil Operation Site Only: No person or persons shall drill or re -drill or cause to be,drilled or re -drilled any oil well except on an oil operation site. S.9686.3-Drilling and Re -Drilling Allowed on Oil Operation Sire Only: No person or persons shall drill or re -drill or cause to be drilled or re -drilled any oil well except on an oil operation site. The hearing was opened to the audience. Margaret Brown, owner of a 13 acre parcel of land upon which there is an oil lease, addressed the Commission and opposed the amendment. Planning Commission Tuesday, June 6, 1972 Page No. 6 PRECISE PLAN NO. 72-6 Said plan proposes to precise plan the realignment of Ellis Avenue between Huntington Street and Gothard Street along with the proposed extension of Huntington Street for a distance of 132 feet north of the centerline of Ellis Avenue. The hearing was opened to the audience, there being no comment the hearing was closed. Commission discussion followed. A FURTHER MOTION WAS MADE BY SLATES AND SECONDED BY BAZIL TO INSTRUCT THE STAFF TO PREPARE A RESOLUTION FOR ADOPTION OF SAID PRECISE PLAN. CODE AMENDMENT NO. 71-32 A proposed code amendment to establish equine standards for commercial horse stables and require submittal for a use permit application before the Planning Commission for such use. The hearing was opened to the audience, there being no comment the hearing was closed. A MOTION WAS MADE BY KERINS AND SECONDED BY BOYLE TO ADOPT SAID AMENDMENT. THE MOTION WAS WITHDRAWN BY COMMISSIONER KERINS AND COMMISSIONER BOYLE IN ORDER TO BRING IT BACK LATER ON THE AGENDA IN CONJUNCTION WITH CODE AMENDMENTS NOS. 72-8 AND 72-1. RECESS CALLED: The Chairman called a recess at 8:00 PM. COMMISSION RECONVENED: The Commission was reconvened at 9:OOPM. MASTER PLAN AMENDMENT NO. 72-4 A preliminary plan for recreational trails which are an element of the Master Plan. This plan proposes the development of bicycle, equine and jogging trails. -6- 6/6/72 PC Minutes: H. B. Planning Commission Tuesday, June 6, 1972 Page No. 7 The Planning Director made a presentation of said plan. Mr. Reynolds pointed out that the nature of this plan is a break down into three categories; Bicycle, equine and jogging trails. Vu-graphs were shown of various locations for all trails in the city. The hearing was opened to the audience. Mrs. Robert Horner opposed to the location of the equine trails as proposed. Mr. Bill Wren, Huntington Beach Company, asked if the plan was to be flexible, because of a possible conflict around the Huntington Seacliff development and golf course. Margaret Carlberg made a presentation on the plan. Five people spoke in favor. A petition signed by 254 people endorsing the proposal was submitted for the record. There being no other comment the hearing was closed. Commission discussion followed. A MOTION WAS MADE BY KERINS AND SECONDED BY BAZIL TO RECOMMEND APPROVAL OF MASTER PLAN AMEND- MENT NO. 72-4 TO THE CITY COUNCIL. A MOTION WAS MADE BY KERINS AND SECONDED BY BAZIL TO ADOPT RESOLUTION NO. 1093 FOR A PRELIMINARY PLAN FOR TRAILS. ROLL CALL VOTE: AYES: Slates, Bazil, Porter, Kerins, Boyle, Higgins NOES: None ABSENT: None 'I 9--RTESOLUTION WAS ADOPTED. CODE AMENDMENT NO. 71-32 A proposed code admendment to establish equine standards for commercial horse stables and require submittal for a use permit application before the Planning Commission for such use. The hearing was reopened to the audience. Mrs. Robert Horner addressed the Commission and opposed,the amendment on grounds that it would be unrealistic to say five horses is a commercial use. Mrs. Horner suggested that at least 8 to 10 horses should be allowed. Mrs. Horner also objected to the 300 ft. setback. A. C. Marion stated that he was opposed to the 5 year maximum time of approval. MINORITY REPORT: Commissioner Bazil stated the reason for voting against the code amendment was that most cities require 50 ft. setback which is sufficient and that a buffer zone would be more significant rather than a 300 ft. setback. CODE AMENDMENT NO. 72-8 A proposed code amendment to establisk,,def 'nitions for colt, commercial horse stable, corral, equestrian, equine, filly, foal, geldingjgrazing, mare, non- commercial horse stable, stall and stallion, and to establish provisions for horse stable signing and parking. The hearing was opened to the audience, there being no comment the hearing was closed. The hearing was opened to the audience. Janet Burcher and Mrs. Kerr spoke in opposition on grounds that said amendment is much too restrictive. the hearing -was closed.
