JUNE 20, 1972 COMMISSIONERS PRESENT: Bazil, Porter, Kerins, Boyle Slates, Higgins COMMISSIONERS ABSENT: None NOTE: A TAPE RECORDING OF THIS MEETING IS ON FILE IN THE PLANNING DEPARTMENT OFFICE. MINUTES: The minutes of April 25 were accepted as transcribed. AGENDA ITEMS TO BE CONTINUED: The Acting Secretary noted that the applicant had requested a continuance on Tentative Tract No. 7899 and Use Permit No. 72-35. A MOTION WAS MADE BY SLATES AND SECONDED BY BAZIL TO CONTINUE TENTATIVE TRACT NO. 7899 AND USE PERMIT NO. 72-35 TO JULY 59 1972 AT THE REQUEST OF THE APPLICANT. ROLL CALL VOTE: AYES: Bazil, Porter, Kerins, Boyle, Slates, Higgins NOES: None MOTION CARRIED. TENTATIVE TRACT NO. 6948 Subdivider: John D. Lusk and Son The subject property is located on the.southwest corner of Bolsa Ave. and Springdale St. The request is to permit 33 lots on 319 acres. Mr. Palin, Planning Depart- ment, reviewed some slides of the area and vu-graphs of three alternate street sections proposed as experimental street sections for a portion of this industrial development. Commissioner Slates said that since this was just a portion of the tract that he would like to see the development with reduced street sections as an experiment and noted that Huntington Beach had been noted as an innovative city. Mr. Palin discussed a survey that had been conducted by the staff depicted that other cities do not require sidewalks in industrial areas. Commissioner Kerins indicated the minimum sidewalk, at least on one side of the street, should be required. Mrs. Wallin indicated she was in favor of the additional landscaping. Commissioner Higgins stated that if a sidewalk was to be put in it should be put in on both sides of the street and a minimum of 30 inches sidewalk would be sufficient. He further stated that 22 ft. sidewalk Minutes: H. B. Planning Commission Tuesday, June 20, 1972 Page No. 2 on both sides of the street would be his recommendation which is exhibit C. Commissioner Bazil would like to see a 6 ft. landscape area with no parking in front of the facility in lieu of the 3 ft. planter and 3 ft. sidewalk. Mr. Lusk indicated that he would like to discourage pedestrian traffic in industrial zones and would rather provide customers parking on site. He further stated that the nature of the industrial area does not lend itself to pedestrian traffic. Commissioner Kerins indicated that this is an industrial "park" and that it should be attract- ive with additional landscaping. Mrs. Wallin would like to see the median retained from an aesthetic point -of -view. Mr. Steffensen indicated that if there were no reduction in the size of the sidewalk or removal of the median the increase in development cost for this industrial park could not be justified. Mr. Palin indicated that the centerline of McFadden had been moved northerly to afford the developer the use of the existing pavement and consequently his costs were reduced. Commissioner Slates recommended that a condition no. 11 be added which would move the north - south street further to the west. Mr. Reynolds, Planning Director, further indicated such a condition would necessitate rezoning of some MI -A property to C-4; approximately a 60 to 70 ft. strip. A MOTION WAS MADE BY KERINS AND SECONDED BY SLATES TO ACCEPT TENTATIVE TRACT NO. 6948 WITH THE CONDITIONS AS DELINEATED BY STAFF AND AS AMENDED BY ADDING CONDITION 11 WHICH WOULD ADJUST THE NORTH -SOUTH STREET TO THE WEST AND FURTHER THAT "A" STREET BE STUBBED INTO LOT 3. A MOTION WAS MADE BY SLATES AND SECONDED BY BAZIL TO ASK THE STAFF TO INITIATE A RESOLUTION TO REZONE THE M1-A PROPERTY TO C4. ROLL CALL VOTE: AYES: Bazil, Porter, Kerins, Boyle, Slates, Higgins NOES: None MOTION CARRIED. CODE AMENDMENT NO. 72-6 (Continued from June 6, 1972) To provide for dedication of right-of-way when property abutting any highway, street or alley has the -02 suffix. It was noted that Mr. Shea, Huntington Beach Company, had discussed this code amendment with the Planning Commission at a prior meeting. -2- 6/20/72 PC Minutes: H. B. Mr. Buhr, representing Standard Oil, opposed the proposed code amendment: he indicated it was premature as the City Council has indicated in the past that it isn't necessary for street improvements within undeveloped areas of the city. Mr. Buhr indicated that there was no agreement to his knowledge for street improvements within undeveloped areas of the city. Mr. Bill Wren, Huntington Beach Company, indicated that they have an agreement on the Garfield site and the only other parcel that is effected by this code amendment is Edwards St. site which, as yet, is not aligned. Commissioner Boyle requested to know what the agreement was with the City. Mr. Wren indicated that the agreement was to require off -site improvements at the request of the Department of Public Works. Mr. Wren further indicated that oil drilling does not create a traffic problem; therefore, there is no need for street improvements. There being no other comments, the public hearing was closed. Commissioner Slates indicated that this code amendment calls for dedication and" improvement prior to the issuance of a drilling permit. He asked the question of why do we want to get this dedication. Would a waiver be needed for each drill permit on a forty acre site? The chair polled the Commission as to this code amendment. ROLL CALL VOTE: AYES: Boyle, Kerins, Porter NOES: Bazil, Higgins, Slates The staff was directed to rewrite portions of the code amendment. A MOTION WAS MADE BY BOYLE AND SECONDED BY KERINS TO CONTINUE CODE AMENDMENT NO. 72-6 TO THE FIRST MEETING IN SEPTEMBER AND BECAUSE OF THIS CONTINUANCE SAID CODE AMENDMENT SHOULD BE READVERTISED. ROLL CALL VOTE: AYES: Boyle, Kerins, Porter, Bazil, Higgins, Slates NOES: None MOTION CARRIED. STUDY OF THE CENTRAL INDUSTRIAL AREA LOWER PORTION Mr. Brown, Planning Department, presented some vu-graphs and slides of the area in question: approximately 892 acres of industrial land. The oil production in the area is to be considered as an interim use. -3- 6/20/72 PC Minutes: H. B. Planning Commission Tuesday, June 20, 1972 Page No. 4 Commissioner Boyle indicated that the growth policy will have an effect on the need for industrial development. Commissioner Bazil indicated that the use of the Santa Ana labor market statistics includes comparison of Huntington Beach population and the need for industrial development. Commissioner Slates indicated that we'should not get locked into a population per industrial acreage ratio. Commissioner Porter indicated that alternate 4, although there was too much residential, was still the preferred alternate. It was recommended that the alternate approach be distributed to the Planning Commission for study and that this item be continued to July 5, 1972. The staff was directed to obtain the status of all freeway bills which have been signed or are pending. AN ORDINANCE OF CITY OF HUNTINGTON BEACH AMENDING THE ORDINANCE BY APPEALING ARTICLE 965 AND ADDING A NEW ARTICLE 965 ENTITLED "BEACH RECREATIONAL DISTRICT" Commissioner Higgins indicated that this ordinance or proposed ordinance is out of line and ill -times due to current litigation. That the results of the litigation may contradict the proposed ordinance. Commissioner Slates indicated that the BRD-2 is tantamount to inverse condemnation. Mr. Reynolds indicated the powers of the Subdivision Map Act requires access to all beach areas. Commissioner Bazil indicated the desire to continue this item until a court decision is made. A MOTION WAS MADE BY SLATES TO SET THIS PROPOSED CODE AMENDMENT FOR PUBLIC HEARING ON THE CONDITION THAT PUBLIC AUTO PARKING LOTS BE INSERTED IN BRD-3. The Commission then discussed the possibility of a joint study session with the City Council instead of setting for public hearing. Commissioner Slates with - drew his motion. The chair directed the staff to contact the City Administrator and set up a meeting with the City Attorney, City Council, and Planning Commission to discuss this item at a joint study session. A MOTION WAS MADE BY BOYLE AND SECONDED BY BAZIL TO CONTINUE THIS CODE AMENDMENT TO A STUDY SESSION WITH THE CITY COUNCIL, PLANNING COMMISSION AND ATTORNEY'S OFFICE. Planning Commission Tuesday, June 20, 1972 Page No. 5 REVIEW OF THE CONDITION OF APPROVAL OF TENTATIVE TRACT NO. 6954 Condition No. 5 which required that "a drainage easement over the Farnsworth property to the northwest be dedicated to the City prior to the record- ing of a final tract map for this subdivision." Commission reviewed the request. A MOTION WAS MADE BY SLATES AND SECONDED BY BAZIL TO TAKE THE SUGGESTED ACTION AND VACATE THE PEDESTRIAN WALKWAY EASEMENT. ROLL CALL VOTE: AYES: Boyle, Kerins, Porter, Bazil, Higgins, Slates NOES: None MOTION CARRIED. CODE AMENDMENT NO. 72-12 "Service Station Suffix" A MOTION WAS MADE BY SLATES AND SECONDED BY BAZIL TO SET THIS AMENDMENT FOR PUBLIC HEARING. Mrs. Wallin indicated that we should include more restrictive standards and it should be done at this time. Commissioner Higgins would like to look at the Irvine standards with reference to the service stations on Jamboree Rd. Commissioner Slates withdrew his motion and Commissioner Bazil withdrew his second. :commissioner Porter made reference to page 5 line 5 indicating lighting to be changed and page 5 line 24 that no bays should be opened to public right-of-way. It was the consensus of the Commission that this item be continued to a later date. It was further noted that the staff should notify all major oil companies of the public hearing of the code amendment. MISCELLANEOUS ITEM: The Commission discussed pole signs. Commissioner Kerins indicated that there should be notification within 300 ft. in addition to publication for the code amendment. DISCUSSION: Development of two 25 ft. lots in the R2 District within the Townlot area held under the same owner- ship. Proposed development to be two (2) detached single-family dwelling to conform with yard requirements of a 25 ft. lot. This item was continued to June 27, 1972. - RESOLUTION NO. 1094 A Resolution of the City Planning Commission of the City of Huntington Beach, California recommending approval of Precise Plan Alignment No. 72-6 of Ellis Ave. between Huntington Street and Gothard Street along with the proposed extension of Huntington Street for a distance of 132 ft. north of the centerline of Ellis Avenue. A MOTION WAS MADE BY SLATES AND SECONDED BY BOYLE TO ADOPT RESOLUTION NO. 1094 AND RECOMMEND ADOPTION BY THE CITY COUNCIL. ROLL CALL VOTE: AYES: Slates, Bazil, Kerins, Porter, Boyle, Higgins NOES: None MOTION CARRIED.
