MI U'F�S: The minutes of May 23, 1972 were accepted as transcribed. DISCUSSION: An oral presentation of the "Open Space and Conservation Plan Phase II" by Jim Funk of the Orange County Plan- ning Department. This plan has been accepted by the Orange _County Planning Commission in June 1972. The Orange County Planning Staff requests comments, reaction and input from Huntington Beach :Plan- ning Commission for their public hearing before the Orange County Board of Supervisors on June 28, 1972. Jere Murphy, Planning Department, introduced Mr. Jim Funk. Mr. Funk indicated that Orange County has been studying this open space plan for one and one-half years. Mr. Funk then referred to several sections of the report; specifically, Appendix G on page 121 of the Phase II 1972 report. He then reviewed the Phase II report maps. He further indicated that controls should be established which measure the allowable impact to the environment. After going through the report with the Commt::sioners, Mr. Funk requested some form of support. A MOTION WAS MADE BY BOYLE AND SECONDED BY KERINS TO ADOPT BY RESOLUTION, THE CONCEPTLJAL PLAN OF THE OPEN SPACE AND CONSERVATION PLAN - PHASE II. Commissioner Slates arrived to the meeting. Planning Commission Tuesday, June 27, 1972 Page 2 TENTATIVE TRACT NO. 7850 and USE PERMIT NO. 72-26 `uUbdivider: Huntington Harbgur Coro. This request is to review a tentative map for approval action pursuant to Condition #18 of the Conditions of Approval. It was indicated that the Condition #2 is in conflict with Condition-k-and that Condition #14 would lead to an increase in parking•spaces provided by .5 spaces per unit. And that the applicant--has-increased-this by .4 spaces per unit. Mr. -Harlow, Planning Department, reviewed the changes on the map and•indicated that they had changed from 54 residential units to 52. Commissioner Porter indicated that he was satisfied with the original parking allocation. - Commissioner Higgins indicated that a lack of -increased parking would lead to an increase of congestion. This would be a detriment to the overall development. He stated that the distribu- tion of guest parking has not been good. Considerable discussion was held as to the distribution of parking as opposed to,the number of parking spaces. The open vistas'of 30 ft. wide and several such openings,is preferred by the architect to -be more desirable than one large vista. The arch- itect would like to provide one boat slip per unit. A MOTION WAS MADE BY HIGGINS AND SECONDED BY KERINS TO REQUIRE'THE FOLLOWING: 1. That a decrease of two units -along the main channel be incorporated to lead to an expanding of vistas. 2. To decrease the open parking along Edinger side of the project. This would lead to an increase in the green area along Edinger. 3. To review the possibility of consolidating the parking structure by the tennis courts which would lead to an increase in the open space. 4. To increase the guest parking and the parking structures noted above. _5. To provide parking with the least encroachment into the, green area. Considerable discussion was then held on the requirement of an environmental impact statement. Mr. Fenton addressed the Commission and asked what is required as to the environmental impact. He indicated that we are using a term that is not defined, mainly the "environmental impact statement". Commissioner Porter indicated that he was concerned with circulation of the back area water and with the water quality. -2- 6/27/72 PC SS Minutes: H. B. Planning Commission Tuesday, June 27, 1972 Page 3 Commissioner Boyle indicated that the Corps of Engineers would probably have a program as to environmental Impact. The Chair directed the staff to seek the answers to the environmental questions and to express interest in this statement to the Corps of Engineers. Mr. Nichols indicated that parallel or independent agencies require considerable study. He indicated that they need discharge permits, Coast Guard permits for the construction of the channel and for de-waterization of the channel for con- struction. A MOTION WAS MADE BY SLATES AND SECONDED BY BAZIL TO AMEND CONDITION #12 TO INFORM THE CORPS OF ENGINEERS THAT THEY WOULD BE MOVING AHEAD WITH THE MAP BASED ON THE ANSWER. ROLL CALL VOTE: _ AYES: Bazil, Boyle, Porter, Higgins, Slates NOES: Kerins ABSENT: None THE MOTION CARRIED. it was noted that on July 19, 1972, Golden West College was to hold a hed:ring on an Environmental Impact Statement as to reactivation of Los Alamitos Airport. A MOTION WAS MADE BY BOYLE AND SECONDED BY KERINS TO STATE Ib' THE ARMY CORPS OF ENGINEERS DOES NOT REQUIRE AN ENVIRON- MENTAL IMPACT STATEMENT THAT THE DEVELOPER SHOULD ANSWER THE QUESTIONS AS REQUIRED BY THE STATE. DCSCUSSION: Tentative Tract No. 7771 (Hearing continued to July 5, 1972) The revised layout has provided for the bluff and midden as an open space through subject tract. This review is to apprise the Commission of current negotiation of subject tract. Mr. Harlow, Planning, Department, reviewed the snap with ro-spect to the bluff areas, trees, and archeological sites. The Administrator is to pursue acquisition but would like the Commission to respond to the resubmitted map for further direction. Commissioner Kerins indicated that he is only interested in the bluff. Commissioner Bazil indicated that the solution for this development of' this property is a -PD suffix. Commissioner Boyle wanted to add the condition to require that colleges and universities be afford the opportunity to explore the property first. Ken Reynolds, Planning Director, indicated that the Planning Commission should initiate a rezone to -PD. - 3- 6/2'(/ l2 PC 33 Minutes: H. B. Planning Commission Tuesday, June 27, 1972 Page 4 Commissioner Porter wanted to have a meeting with the City Administrator so as not to hold up transmittals from the Planning Commission to the City Council. The Chair directed the staf'1' to advertise for a -PD suffix zoning. _. _ Commissioner Higgins indicated that there are ways to design without loosing open space. A MOTION WAS MADE BY KERINS AND SECONDED BY BOYLE TO MOVE TO SET FOR A ZONE CHANGE FROM R1 TO Rl-PD. ROLL CALL VOTE: AYES: Slates, Higgins, NOES: None ABSENT: None THE MOTION CARRIED. Porter, Kerins, Bazil, Boyle Ken Reynolds indicated that the issue is really the entire bluff. The Chair indicated that the staff should look into the'' slope ordinance; stating further that this is one way to permit a development on certain,percentage grade. Also that the staff should study alternatives to our bluff ordinance. DISCUSSION: Code Amendment No. 72-12 "Service Station Suffix" A MOTION WAS MADE BY HIGGINS AND SECONDED BY BOYLE TO CONTINUE THIS ITEM UNTIL ORDINANCES ARE OBTAINED FROM OTHER JURIS- DICTIONS. DISCUSSION: Development of two twenty-five (25) foot lots in the R2 District within the Townlot area held under the same ownership. Proposed development to be two (2) detached single-family dwellings to conform with yard requirements of a 25 ft. lot. Jim Palin, Planning Department, presented the vu-graphs of proposed layouts on twenty-five foot with respect to the six (6) applications before the Board of Zoning Adjustments. It was further -indicated that this would require zero side yard setback waiver -and required a means of conveyance. - 11 It was asked if within the R2 the Commission would want this type of development. Commi'ssione r Bazil indicated that he would like -to have the` other side yard setback have a normal five (5) .foot -set- back. ' Mr. McFarland indicated that there would be a decrease in density from three units to two,units. And that there would be a pride of ownership. It was indicated that the Planning Commission concurred wLth this concept. PROPOSED CODE AMENDMENT NO. 72-14 TO S.9764.5.6 (Open House Signs) SIGN ORDINANCE AND S.9730,20 (Home Ogeunation): Mr. McFarland indicated that he would like to forestall temporarily because the City Administrator would be forwarding this to the Chamber of Commerce to establish a committee to recommend. Commissioner Slates indicated 50% of sales are from a sign. The real estate profession should come up with a solution. A MOTION WAS MADE BY BAZIL AND SECONDED BY KERINS TO CONTINUE UNTIL THE COMMISSION COMES UP WITH AN ANSWER. It was indicated that Chuck Delving would like to come up with the solution. POLE SIGN: Pole sign_for a liquor sign at the northeast corner of Beach Boulevard and Ellis Avenue behind the Jack - in -the -Box. A MOTION WAS MADE BY SLATES AND SECONDED BY BAZIL TO APPROVE BECAUSE THE SIGN CONFORMS WITH THE ORDINANCE. ROLL CALL VOTE: AYES: Slates, Higgins, Kerins, Pb rte r, Boyle, Bazil NOES: None ABSENT: None THE MOTION CARRIED. Commissioner Higgins asked why are sign permits coming before the Commission. Commissioner Porter indicated that because of the secondary signs that are being constructed. Commissioner Boyle further indicated that administrators make decisions as to the interpretations of the legislative advisory bodies and that they get a feeling of what the Planning Commission wishes by bringing these sign permits before the Commission. COD AMENDMENT N0, 72-14 The Commission went back to the item for proposed Code Amendment No. 72-14 relative to the Home Occupation. It was discussed that the code amendment had two sections in it: one pertained to open house signs and the other pertained to home occupation and possibly the Commission would wish to continue the section relative to open house signs but allow the home occupation provisions to move ahead. MISCELLANEOUS: A MOTION WAS MADE BY HIGGINS AND SECONDED BY SLATES TO RECOMMEND A MORATORIUM ON RESIDENTIAL DEVELOPMENTS BETWEEN 17th STREET AND GOLDENWEST AVENUE AND BETWEEN PALM AVENUE AND PACIFIC COAST HIGHWAY FOR 120 DAYS FOR THE FOLLOWING REASONS: 1. To resolve the assessment district. 2. To get results from the Townlot Study. BIA MEETING: It was noted that there would be a BIA meeting. Commissioners'Kerin's,'Hi;gins*`Slates, Bazil, and Boyle and Mrs. Wallin signed up to attend. SERVICE STATION AT ADAMS AND MAGNOLIA: Commissioner Kerins discussed the Use Permit for the re -opening of service station at Adams and Magnolia. Question: Would this meet the new standards? PEPPERDINE LAW SCHOOL: Commissioner Mates discussed the editorial of Pepperdine Law School. He indicated that Pepperdine has contacted them to locate in Huntington Beach. It was indicated that a major landowner may want to donate land to the law school. They would probably need between 25-30 acres. It was indicated that the staff should contact Pepperdine to find out the requirements for a site to develop a law school. This should go to the City Administrator Mr. Rowlands. The chair directed that this action should be taken. CQMMISSIONERS COMMENTS: Commissioner Boyle was interested in flood plain zoning and would like to know more about it and also some staff direction as to what the Planning Commission should be doing with regard to flood plain zoning.
