TENTATIVE TRACT NO. 7495 - Extension of Time
Subdivider: Signal Landmark Inc.
The subject property is located southwest of the
Huntington Beach boundary from Ellis Avenue, northwest to Bolsa
Chica Street and north of the adopted route of Pacific Coast
Freeway. The request is to allow 960 R1 lots on 392 acres.
This item was continued to September 19, 1972.
ZONE CASE NO. 72-24
Applicant: Dick Nerio
The subject property is located on the south side of
Terry Drive, 417 feet east of Beach Boulevard. The request is a
change of zone from C4 highway Commercial District to R1 Single
Family Residence District.

Avenue and Newland Street.

TENTATIVE TRACT NO. 5613 - Extension of Time (Continued 7/18/72)
Subdivider: Sunbeam Homes, Inc.
The subject property is located east of Bushard Street,
approximately 1; 345 feet south of Yorktown Avenue. The request
is to permit 26 lots on 12.14 acres of land.
Mr. Gindling addressed the Commission. He indicated to the
Commission that he would prepare an entirely new plot plan but
that the problem for today is the two lots that he is seeking to
develop. Ile informed the Commission that he is only asking
about two lots with 6i„ht (8) units.
Commissioner Higgins asked how l'ar alon;; are the units?
Mr. Gindling presented some slides showing the foundations
being done and the forms are laid. He further indicated that all
properties are sold. They have deposits on all units.
The staff showed some aerial slides of the subject property.
Mr. Gindling further indicated that the streets were in and
that recreation facilities are in.
Mrs. Wallin asked the question, "How is this possible?"
Mr. McFarland, Building Department, replied and indicated
the initial plans called for two bedroom units and now there has
been a change. Since then the map has expired and permits expired
by ten (10) months. lie further indicated that there would be no
need for additional reviewing if the plans are still coming in
under the code.
Mr. Gindling indicated that it would cost him in the neigh-
borhood of $47,000 to pull out the existing forms and to regrade
the property.
Commissioner Kerins indicated that we are dealing with
Tentative Tract No. 5613 but what is being brought up is Final
Tract No. 7313.
Commissioner Porter indicated that Tentative Tract No. 5613
was approved and the request before them deals with a portion
thereof. He -indicated to Mr. Gindling that their company forward
a letter of the bUance of the development.
Commissioner Boyle indicated that this is an unfortunate
situation in view of the fact that forms are laid and that he
would be willing to approve the two lots in question.
Commissioner Bazil indicated that he would like them to
submit a patio plan on the two lots.

1. The tentative map received June 16, 1971, shall be the

Map No. 5613 shall be complied with.

ZONE CASE NO. 72-22
Applicant: J. W. Klua Development Co. Inc.
The subject property is located southeast corner of
Talbert Avenue and the Pacific Electric Railroad.
The request is a change of zone on approximately 11.5 acres
of land from M1 Light Industrial District to R1 Single -Family
Residential District.
A representative of the Klug Development Company addressed
the Commission and asked them to by-pass this item temporarily
because their representative Is on his way from San Diego.
ZONE CASE NO. 72-23
Applicant: Miller and Weaver
The subject property is located west of Crystal Street
approximately 275 feet south of Garfield Avenue. The request is
a change of zone on approximately one acre of land from RA-0
Residential Agricultural combined with oil to Ml Light Industrial
District.
The reason given by the applicant is to permit the construction
of a storage yard. Relocate Ldle equipment from the Townlot area.
The chair opened the public hearing.
There being no speakers, the hearing was closed.

THIS REQUEST BECAUSE IT IS IN CONFORMANCE WITH THE MASTER PLAN.
Commissioner Higgins indicated that this shouldn't carry over
to Goldenwest Street because of the possible scenic detriment to
that street.
Mrs. Wallin indicated that she would like to see more land-
scaping.
Mr. Harlow, Planning Department, indicated that the Board
of Zoning Adjustments could consider this item if the Planning
Commission would like.
Commissioner Porter indicated that the chair concurred with
Mrs. Wallin's suggestion to enter landscaping as part of the record

ZONE CASE: NO. 72-25
AP]alicant: Covington Brothers
The subject property is located at the southwest corner
of Edinger Avenue and Bolsa Chica Street, except for the
existing 140 ft. x 147 ft. commercial site.
The request is for a change of zone on 5.04 acres of land
from C2 Community Business District to R3 Limited Multiple
Family Residence District.
The reasons given by the applicant is that he proposes to
develop this property with an R3 development consisting of
nineteen^four-plex homes and income development. Proposed devel-
opment is compatible with the existing R3 development to the
south and west of proposed site.
The chair opened the public hearing.
Mr. Richard Huffman addressed the Commission. He indicated
that he had a slide presentation to present and thinks that the
medium density zoning is best.
Mr. George Kasarius addressed the Commission and indicated
that they are opposed to the development and have petitions to
present along with the arguments. He briefed the basic argu-
ments as follows:
1. He indicated that they don't want an increase in density for
the area because there are too many complexes now.
2. Schools are at the upper enrollment limit and they don't
want to crowd the schools.
3. There is a need for commercial development.
4. There are too many apartments along Edinger Avenue.
5. He would like to see more commercial development.
Ken Kerins, President of Home Council, addressed the
Commission. He indicated that this is the only commercial
property from here to the Sunset Bay area. He further stated
the staff report, items 5 and 6 in particular, sum up his feelings.
Mrs. Dorothy Boline addressed the Commission and asked for
a definition of the term "income development" as stated on the
agenda and further asked what assurance there is that there
would be nineteen four-plexes and riot more.
Commissioner Porter replied by saying that the developer
could develop whatever the zone permits.
There being no further speakers, the hearing was closed.
The petition of 135 people wars entered to be part of the
record.
Commissioner Boyle questioned item B on the staff report
and asked who did the survey.
B. "A survey for commercial need within one-half mile of the
subject property indicates a commercial deficit on 11.33
acres and a 2.21 deficit within one mile of subject property
if R3 were developed."

A MOTION WAS MADE BY BOYLE AND SECONDED BY KERINS TO DENY
ZONE CASE NO. 72-25 FOR THE FOLLOWING REASONS:
1. The reason as stated under a minority report which is as
follows: "The applicant has indicated that a market analysis
of this area indicated weaker or marginal need for additional
commercial; however, the applicant has not submitted infor-_
mation to substantiate this finding."
2. The staff survey is accepted.
3. The homeowners' argument as to the increase of density
and the increase of school enrollment.

Commissioner Slates indicated if this item is appealed
he would like the staff report, to be included in the transmittal
to the City Council.
ZONE CASE N0. 72-26
Applicant: Covington Brothers
The subject property is located 200 feet east of Beach
Boulevard, south of Holland Drive. The request is for a change
of zone on 3.59 acres of land from R5 Office Professional
District to R3 Limited Multiple Family Residence District.
The reason given by the applicant is to propose to develop
this area into thirteen four-plex homes.
The chair opened the public hearing.
Mr. Richard Huffman addressed the Commission and indicated
that the map is in error and there are no through -streets on
Holland. He also indicated this zone change request is approved
would create a buffer between the R1 and Commercial. He further
indicated that the opposition would be one that would be phil-
osophical (SIC) in nature.
Mr. Glen Ford addressed the Commission in opposition to the
four-plex development. He said this would lead to a decrease
in privacy for the people in the single-family homes and would
increase the school enrollment. He further indicated that the
City could use commercial development in the area and that the
applicant hat shown no need for -the R3 zoning.
Mr. Bickley addressed the Commission and indicated that the
Commission shouldn't increase the density in this area. He also
indicated that no one has made note of the apartments across
Beach Boulevard and that this would lead to an increase in the
potential slums.
There being no further speakers, the hearing was closed.
Commissioner Slates indicated that the R5 at one time did
permit units and further indicated that the Kinney's shoe store
or facility is about 6 ft. above the grade level of subject
property.
Commissioner Bazil indicated that the R5 was changed because
it was abused. It led to fast changing of the R5. It was further
indicated that the commercial development using Holland for access
is not realistic.

ZONE CASE NO. 72-26 FOR THE FOLLOWING REASONS:
1. This proposal or proposed use would increase the density.
2. This is not compatible with the R1 development.
3. There is already an abundance of multi -family zoning.
4. The property can be developed as R1 or R5.
5. The February 1972 decision on the Master Plan was to retain the
R5 and conditions have not changed since that date.
Commissioner Porter indicated that the grade differential
was similar to the project on Terry Drive. And that the property
is not incapable of being; developed.
Commissioner Bazil indicated that he would go along with the
motion, just to leave it at this time.

Higgins, Kerins, Porter
It was further discussed that the Council decision puts
pressure as to the proper development of this area. The Council
involvement has led to a difficult decision as to the proper
planning for this property. The Planning Commission unanimously
indicated that the action of the City Council to go contrary to
the Planning Commission zoning decision led to an increase in
zone change request in this area.
The Commission then moved back to Zone Case No. 72-22.
ZONE CASE NO. 72-22
Applicant: J. W., Klug Development Co. Inc.
The subject property is located at the southeast corner of
Talbert Avenue and the Pacific Electric Railroad.
The request is for a change of zone on approximately 11.5
acres of land from M1 Light Industrial District to R1 Single
Family Residence District.
The reason given by the applicant is that he proposes
a planned unit development in accordance with plans submitted with
the application.
The chair opened the public hearing.
Mr. McNiff addressed the Commission and indicated that the
taxes on the property of $450 per acre and further that the
relationship of the property to the railroad tracks led to
difficulty for development and that there is a school in the
vicinity. Also that the property has been held under the same
ownership for 58 years.
Mrs. Wallin indicated that there is a school site and not
a school in the vicinity.

Commissioner Foyle asked the applicant what he meant
by the "sphere of R1 influence".
Mr. McNiff indicated that there is R1 In the immediate
area, both sides of the railroad tracks were Ml. With the
chance to lean toward the R1 or residential. He indicated that
the sphere of R1 influence means that this is the trend.
Mr. Rose addressed the Commission and explained the history
of the ownership. He indicated that the school board bought a
large parcel for a school site and that it would be best to
develop this property residentially next to the school. He
indicated that in April 1962 the school bought the property for
$170,000 and that the acreage was approximately 12.59 acres.
Mr. Womhoff Jr. addressed the Commission indicating that
he lived in the house on the site which has at different times
been used for a motorcycle riding area. He indicated that the
park has not been developed except for homeowners which have
graded the area for ball playing and that the school is not
overcrowded.
Mr. Joseph Blupridge addressed the Commission indicating
that he be only repeating the previous speaker. And that he
is in favor.
Mr. Williams addressed the Commission and indicated that
he is in favor. He further indicated that they can't have the
school or the park unless they have additional residential
development in the area.
MY'. Jim Reddy addressed the Commission and indicated that
he is in favor and that he would be repeating Mr. Womhoff's
reasons.
Mr. Ed Harpol addressed the Commission indicated that he
owns property next to the subject property and that the property
has been used for horses, dune buggies, and motorcycles and
this he doesn't want. He indicated that the property can't sell
as Ml and would like to see it R1.
Mrs. Billy Sucatchadorian addressed the Commission and stated
that she owned the sign shop in the area a,nd opposed the R1
development.on the other side of the railroad tracks. She
indicated that if R1 comes in M1 will go out. She further indicates
that now tt is the dust and later it will be the noise as far
as complaints.
There being no further speakers, the hearing was closed.
Commissioner Kerins advised the audience as the Planning
Commission's last action as to M1 development on Ml property.
Commissioner Porter indicated that the two previous zone
changes in the area led to a resolution to landbank M1 property
because this would lead to a strong tax base in the future. He
further indicated that the Planning Commission recognizes that
M1 won't develop tomorrow but that M1 property should be saved
for future development.
Commissioner Bazil indicated that they have been studying
the area for industrial development and that the Route 39 Freeway
hearing opened by Westminster and Huntington Beach City Councils
would effect this decision.
Commissioner Porter indicated that relocation of freeway may
lead to a bissecting of the property.

Commissioner Slates indicated that the property is not good
for industrial development as it is near the Central Park and that
the property will not ever develop as industrial. Further that
you can't predict a decision on the freeway and that the use aequest
is an excellent one.
Commissioner Porter asked if the property which was located
on the railroad tracks and arterial highway is not good for industrial
development then ghat is.
Commissioner Slates indicated that the location as to trucking
is not good.
A MOTION WAS MADE BY KERINS AND SECONDED BY BAZIL TO DENY
ZONE CASE NO. 72-22 FOR THE FOLLOWING REASONS:
1. It would be further erosion of the tax base.
2. The 1972 Master Plan review indicated the property to be
industrial.
3. The adjacent zones are industrial.
4. A change to residential zoning would lead to increase in
residential zone requests.
5. Potential re-routing of the freeway may lead to an increase
in industrial development.

Commissioner Slates filed the following minority report:
"A zone change application Zone Case No. 71-36 to rezone this
property from M1 Light Industrial District to R2 Two Family
Residence District was heard by the Planning Commission on
October 1971. The Commission recommeded denial of the zone
change because the land is natural for industrial use. The
City Council at the November meeting sustained the decision
of the Planning Commission and denied the zone change."
A minority report submitted by Commissioner Slates stated
that he feels this property does not have the prerequisites for
industrial land. Also freeway access 1'or the subject property
would be through the Central Park.
CODE- AMENDMENT N0, 72-14 A proposed cede amendment to add a
provision for instruction in the home
for a home occupation. Said amendment shall'read as follows:
"When an occupation is the type that entails instruct Lon in the
home, such Instruction shall be limited to three individuals
per session."

RESOLUTION NO. 1095 (Continued from July 25, 1972) A resolution
of the Plan-
ning Commission of the City of Huntington Beach, California
recommending to the City Council creation of tax relief provision
for industrially zoned property.
A MOTION WAS MADE BY SLATES AND SECONDED BY KERINS TO APPROVE
RESOLUTION NO. 1095.

THE MOTION CARRIED.
Commissioner Boyle indicated that he wanted to point out
the way to go. He indicated that the Commission is in a bind
and can't plan because of the increased taxes.
The chair directed the Staff to advise the Council to contact
the Chamber of Commerce.
POLE SIGN REVIEW: A used car sign at the northeast corner of
Blaylock Drive and Beach Boulevard advertising
MacGregor Used Cars.
Mr. McFarland, building Department, indicated that the sign
size and property size is in the staff report and that the applicant
is in the audience.
Commissioner Kerins requested that his microphone be fixed.
Mr. MacGregor addressed the Commission and indicated that
Compact City is the name of the business.
Commissioner Kerins questioned the applicant as to the
ground sign.
Mr. MacGregor indicated that there would be only one stop
sign and the ground sign would not be visible.
Commissioner Kerins asked the applicant if he would be
agreeable to a roof sign.
Mr. MacGregor indicated that it would be uglier and that
the building does not lend itr:elf to a roof sign.
Mrs. Wallin indicated that too many signs turn people off.
Commissioner Porter indicated that the word "rotating" be
removed from the sign code.
Mr. MacGregor indicated that he had spent over $3,000 in
landscaping and now he has to sell cars.
Commissioner Boyle asked if rotating signs bring in more
people.
Mr. Chuba indicated that they are in a detail sign analysis
of studying the nature of client and business.

This request was withdrawn because the applicant withdrew

RESOLUTION N0, 1096
A MOTION WAS MADE BY SLATES AND SECONDED BY BAZIL TO ADOPT
A RESOLUTION TO APPROVE MR. KIRALLAIS REQUEST FOR AN ADDITION
TO A NON -CONFORMING USE. THE PLOT PLAN OF JULY 26, 1972 TO BE
THE APPROVED PLAN. THE APPLICANT MAY CALCULATE 10% OF THE TOTAL
BUILDINGS ON -SITE FOR THE FOLLOWING REASON:
1. The resolution would help to beautify the area.

The chair directed the Staff to cooperate with Mr. Taylor in

Planning Commission.
GARFIELD OIL OPERATION SITE, The Planning Commission requested
more trees to be planted and more
landscaping. The fencing was to be discussed at a Study Session.
THE ABANDONMENT OF MODALE DRIVE or the redesign. This item was to
be set for public hearing in con-
junction with the plan.
SIGN ORDINANCE
Commission discussed sign ordinance In great detail and
expressed concern for its effect.
COMMISSIONERS COMMENTS:
The chair directed the Staff to prepare a code amendment to
eliminate rotating and flashing signs and to limit sign height
to 25 ft.
The chair directed the Staff to prepare a code amendment to
update the "non -conforming use" provisions of the Huntingubon
Beach Ordinance Code.
LITTLE LEAGUE
A MOTION WAS MADE BY KERINS AND SECONDED BY PORTER TO
TRANSMIT A LETTER TO CITY ADMINISTRATOR AND TO THE SCHOOL
DISTRICT "VOICING CONCERN" WITH THE LITTLE LEAGUE'S AFFECT
ON THE TRAFFIC SAFETY, SITE MAINTENANCE, TRASH AND PARKING.
