AGENDA ITEMS TO BE CONTINUED OR WITHDRAWN: USE PERMIT NO. 72-47 - Continued Applicant: Adrian 0. Hubbell To permit the construction of retail stores and business and professional offices as required by S.9472, 9472.1, and 9471.4. Subject property is located 135 ft. northwest of Goldenwest Street and Edinger Avenue in the C4 Highway Commercial District. It was noted that Board policy is to hear applications on the same property at the same time and that Conditional Exception No. 72-51 had been continued _from 'a )irevious meeting to' August 309 1972 to be heard in corijunction with this use permit. Board of Zoning Adjustments August 23, 1972 Page 2 ADMINISTRATIVE REVIEW NO. 72-71 - Continued Applicant: Irving J. Snyder To permit a driveway for drive-thru food service for Taco Si Drive-in located at the northwest corner of Magnolia Street and Adams Avenue. There was no one present to represent the applicant. It was indicated by the Board that the applicant should have filed a use permit application as this request was for an addition to a nonconforming use because of yard requirements. Therefore, the Board declined to act on Administrative Review No. 72-71 and instructed the staff to notify the applicant. DIVISION OF LAND NO. 72-22 Applicant: VTN - Orange County To divide one legal parcel of land into two legal parcels located at the northeast corner of Yorktown Avenue and Brookhurst Street in the RA Residential Agricultural District. There was no one present to represent the applicant. It was noted that this application was filed as a condition of approval for Use Permit No. 72-40. Discussion was held with regard to easements, ingress, and egress. The conditions of approval were then defined and reviewdd. A MOTION WAS MADE BY PALIN AND SECONDED BY MCFARLAND TO APPROVE DIVISION OF LAND NO. 72-22 WITH THE FOLLOWING CONDITIONS: 1. The plot plan received July 27, 1972 shall be the approved layout. 2.- Yorktown Avenue and Brookhurst Street shall be dedicated and fully improved to City standards at the time each parcel is developed. 'Improvements shall include street trees, street signs, street lights, fire hydrants, sewer and water main extensions. 3. Water supply shall be through the City of Huntington Beach's water system at the time each parcel is developed. 4. Sewage disposal shall be through the City of Huntington Beach's sewage system at the time each parcel is developed. 5. The property shall participate in the local drainage assess- ment district at the time each parcel is developed. 6. All utilities shall be installed underground at the time each parcel is developed. 7. All applicable City Ordinances shall be complied with 8. A reciprocal easement shall be provided between parcels one and two to facilitate,vehicular access between said parcels. ADMINISTRATIVE REVIEW NO. 72-69 - Continued Applicant: Elden Bainbridge To permit the construction of a tv70 story office building pursuant to S.9471.4. IN CONJUNCTION WITH DIVISION OF LAND NO. 72-23 - Continued Applicant: Elden Bainbridge To divide one lot into two lots located 475 ft. southeast of the intersection of Beach Boulevard and Talbert Avenue. Mr. Bainbridge, the applicant, was present to discuss his applications. It was noted that the applicant had filed Administrative Review No. 71-24 and Division of Land No. 71-13 petitioning the same request on subject property. These applications were approved in 1971, however, the applicant needs an extension of time and as there are no provisions for granting an extension for these types of applications, he has filed anew. The Board discussed the parking lot, reciprocal parking and circulation as it. pertains to the subject property. They indicated a need for a revised plot plan eliminating 4 of the parking stalls to increase the circulation in the -parking lot. The applicant was asked if he would comply with the same condi- tions as designated in the two previously approved applications. Mr. Bainbridge said he would. A MOTION WAS MADE BY MCFARLAND AND SECONDED BY PALIN TO APPROVE ADMINISTRATIVE REVIEW NO. 72-69 WITH THE FOLLOWING CONDITIONS: 1. A revised plot plan shall be submitted to the Board of Zon- ing Adjustments prior to the issuance of building permits. 2. Beach Boulevard shall be dedicated and fully,improved to City and/or State standards at the time each parcel is developed. Improvements shall include street trees, street signs, street lights, fire hydrants, sewer and water main extensions. 3. Water supply shall be through the City of Huntington Beach's water system. 4. Sewage disposal shall be through the City of Huntington Beach's sewage system. 5. The water, sewer and fire hydrant system shall be approved by the Department of Public Works and Fire Department. 6. Soil reports as required by the Building Department and the Department of Public Works shall be submitted to the City prior to issuance of building permits. 8. All utilities shall be installed underground. 9. Off-street parking facilities shall conform to Article 979. 10. Parking compounds shall be screened with a combination of fencing and landscaping. Said plan shall be approved by the Planning Department. 11. No structures, other than those shown on the approved plot plan, shall be constructed within the project. 12. A 32 inch high screening wall shall be constructed 3 ft. back of the ultimate right of way on Parcel 1 at such time as Parcel 2 is developed. 13. A Division of Land application, separating this parcel from the remaining property held under the same ownership shall be filed with the City, approved and recorded. Board of Zoning Adjustments August 23, 1972 Page 5 ADMINISTRATIVE REVIEW NO. 72-70 Applicant: Beulah A. Maurer To permit the care of non -related pursuant to S. 9730 .269 located 120 ft. south of the intersection of Daren Circle and Hamden on the east side of Hamden Lane in the Rl Single Family Residence District. The hearing was opened on Administvative Review No. 72-70. Mrs. Maurer addressed the Board and explained her request. Mrs. Maurer presented her Department of Social Welfare license and building inspection record. She stated that the Depart- ment of Social Welfare control the number of placements at her home and the number of persons they place will not change at'the time of renewal of her license. There being no further comment, the hearing was closed. Board discussion followed. A MOTION WAS MADE BY PALIN AND SECONDED BY MCFARLAND TO APPROVE ADMINISTRATIVE REVIEW No. 72-70 WITH THE FOLLOWING CONDITIONS: 1. The applicant shall comply with S.9730.26 of the Hunting- ton Beach Ordinance Code. 2. The applicant shall submit a copy of the 1972-73 Depart- ment of Social Welfare of the State of California license upon receipt of same. 3. The changes placed in the home shall be limited to those indicated on the current license from the Social Welfare Department. CONDITIONAL EXCEPTION NO. 72-71 Applicant: Frank Ayers & Son Construction Company To permit a reduction in the minimum dimension of 25 ft. for the required 1200 sq. ft. open area per lot on 11 lots of a 157 lot subdivision. Subject property is located between Bushard, Banning and Brookhurst Streets in the R1 Single Family Residence District. _ E The hearing was opened to the audience. Mr. Mike Jager, representing the applicant, addressed the Board and explained the request. It was noted by the Board that this application was in compliance with a condition of approval for Tentative Tract No. 7703 in order to review the placement of all homes in the subdivision. Board discussion followed.• A MOTION WAS MADE BY PALIN AND SECONDED BY MCFARLAND TO APPROVE CONDITIONAL EXCEPTION NO. 72-71 WITH THE FOLLOWING CONDITIONS: 1. The applicant shall submit elevations of the proposed walls to the Board of Zoning Adjustments prior to issuance of building permits. - 2. The layout of layout of open space on the lots shall be the same as designated on the August 3, 1972 plot plan. AND FOR THE FOLLOWING REASONS: 1. The separation wall in excess of 42 incr,es provides 900 sq.ft. plus of open space within the front yarc. pursuant to the Huntington.Beach Ordinance Code. 2." CONDITIONAL EXCEPTION NO. 72-72 Applicant: Leonard 0. Lindborg To permit the construction of a duplex with open space to be provided with a minimum dimension of 13 ft. as per proposed Code Amendment No. 71-23 in lieu of the existing minimum requirement of 20 ft. in S.9163.3.1.1 of the Huntington Beach Ordinance Code. Subject property is located on the west side of 17th Street 100 ft. south of Acacia Avenue in the R2 Two Family Residence District. The hearing was opened to the audience. Mr. Clyde Cropper, representing the applicant, addressed the Board and explained the request. It was noted that the City Council had the first reading of the proposed Code Amendment No. 71-23 on August 21, 1972. There being no further comment, the hearing was closed. Board discussion followed. A MOTION WAS MADE BY MCFARLAND AND SECONDED BY PALIN TO APPROVE CONDITIONAL EXCEPTION NO. 72-72 WITH THE FOLLOWING CONDITIONS: 1. The City Council has had their first reading of the pro- posed Code Amendment No. 71-23. ROLL CALL VOTE: AYES: McFarland, Leyva, Patin NOES: None THE MOTION CARRIED. CONDITIONAL EXCEPTION NO. 72-73 Applicant: Leonard 0. Lindborg To permit the construction of a duplex with open space to be provided with a minimum dimension of 13 ft. as per proposed Code Amendment No. 71-23 in lieu of the existing minimum requirement of 20 ft. in S.9163.3.1.1 of the Huntington Beach Ordinance Code. Subject property is located on the west side of 16th Street north of Pecan Avenue in the R2-01 Two Family Residence District combined with oil production. The ' hearing was cpened to the audietice. Mr. Clyde Cropper, representing the applicant, addressed the Board and explained the request. This being the same request as Conditional Exception No. 72-72, there was no further discussion and the hearing was closed. A MOTION WAS MADE BY MCFARLAND AND SECONDED BY PALIN TO APPROVE CONDITIONAL EXCEPTION N0. 72-73 WITH THE FOLLOWING CONDITIONS: 1. Mr. Wiley Blair and Mr. Franklin, representing the applicant, addressed the Board and explained the request. Mr. Blair explained that the buyer is interested only in develop- ing the parcel fronting on Beach Boulevard and, therefore, would need a division of land. There was discussion of the easements and driveways and location of an existing easement along the northwest corner of the property. A MOTION WAS MADE BY MCFARLAND AND SECONDED BY PALIN'TO APPROVE DIVISION OF LAND NO. 72-24 WITH THE FOLLOWING CONDITIONS: 1. A revised plot plan shall be'submitted to the Board of Zoning Adjustments for review. 2. Beach Boulevard and Stark Street shall be dedicated and fully improved to City and/or State standards at the time each parcel is developed. Improvements shall include street trees, street signs, street lights, fire hydrants, sewer and water main extensions. 3. Water supply shall be through -the City of Huntington Beach's ` water system at the time each parcel is developed. 4. Sewage disposal shall be through the City of Huntington Beach's sewage system -at the time each parcel is developed. 5. The property shall participate in the legal drainage assess- ment district at the time each parcel is developed. 6. The Board reviewed the plot plan and made recommendations to be transmitted to the applicant for revisions to the plot plan. ROLL CALL VOTE: AYES: McFarland, Leyva, Palin NOES: None THE MOTION CARRIED. CONDITIONAL EXCEPTION NO. 72-74 Applicant: John L. Peterson To permit the construction of a single family residence with open space to be provided with a minimum dimension of 7 ft. as per proposed Code Amendment No. 71-23 in lieu of the existing minimum requirement of 20 ft. in S.9163.3.1. Subject property is located on the east side of 22nd Street 100 ft. north of Pecan Avenue in the R2 Two Family Residence District. The hearing was opened to the audience. Mr. Peterson, the applicant, addressed the Board and explained the request. The Board discussed the proposed residence, the garage, and the sundeck. They further reviewed the setbacks from the alley with. the applicant in relation to code requirements. There being no further comment, the hearing was closed. Board discussion followed. A MOTION WAS MADE BY MCFARLAND AND SECONDED BY LEYVA TO APPROVE CONDITIONAL EXCEPTION No. 72-74 FOR THE FOLLOWING REASONS: 1. The applicant has complied with the open.space provisions as designated in Code Amendment No. 71-23. 2. The allocation of open space relates to the unit and provides two usable patio areas and a sun deck. 3. Subject lot is of a substandard 25 ft. in width and the appReant has proposed good allocation of the open space. _ ROLL CALL VOTE: AYES: McFarland, Leyva, Palin NOES: None THE MOTION CARRIED. A MOTION WAS MADE BY MCFARLAND AND SECONDED BY PALIN TO APPROVE ADMINISTRATIVE REVIEW NO. 72-74 WITH THE FOLLOWING CONDITION: 1. The applicant shall comply with S.9106.2.1.1 of the Huntington Beach Ordinance Code. ROLL CALL VOTE: AYES: McFarland, Leyva, Palin NOES: None THE MOTION CARRIED. ADMINISTRATIVE REVIEW NO. 72-75 — Applicant: Standard Oil Compare To permit a locker room addition to an existing pipeline terminal facility pursuant to S.9530 located on the north side of Talbert Avenue where Gothard Street intersects with the property. Mr. Ken Oxman, representing the applicant, addressed the Board and explained his request. It was noted that the Design Review Board had waived review of this application as it is considered a minor addition. The Board discussed code requirements for dedication and improve- ments of the subject property. Discourse continued as to the Civic District's requirements for screening, fencing, and land- scaping. It was suggested that'the staff meet with the applicant at the subject location to discuss the improvements. A MOTION WAS MADE BY MCFARLAND AND SECONDED BY PALIN TO -CONTINUE ADMINISTRATIVE REVIEW NO. 72-75 TO AUGUST 30, 1972 TO ALLOW THE STAFF TO MEET WITH THE APPLICANT PRIOR TO FINAL ACTION. ROLL CALL VOTE: AYES: McFarland, Leyva, Palin NOES: None THE MOTION CARRIED. ADMINISTRATIVE REVIEW NO. 72-64 Applicant: Robert C. Harvey To permit remodeling of a portion of an existing restaurant facility in the C2 Community Business District located 150 ft. southeast of the intersection of Springdale Street and Edinger Avenue. This item was heard and acted upon at the August 16, 1972 meeting. However, as it was an improper approval, the Board will reconsider the action. A MOTION WAS MADE BY MCFARLAND AND SECONDED BY PALIN TO RECONSIDER THE ACTION TAKEN ON ADMINISTRATIVE REVIEW NO. 72-64 DUE TO IMPROPER APPLICATION. REVIEW: ADMINISTRATIVE REVIEW NO. 72-67 - Review of revised plot plan Applicant: Kordick The Board discussed the setbacks for the gates as designated on the revised plans.
