AGENDA ITEMS TO BE CONTINUED OR WITHDRAWN: ADMINISTRATIVE REVIEW NO. 71-55 - Continued Applicant: William S. Rader To permit the care of five (5) handicapped, non -related persons which is located 180 ft. north of the centerline of Springfield Street on the west side of Lake Street in the R2-0 Medium Density Residence District combined with oil production. It was noted by the Acting Secretary that the applicant had informed him he is in the process of attaining a license from the County but cannot indicate the date when the license will be issued. REGULAR AGENDA ITEMS FOR PUBLIC HEARING: ADMINISTRATIVE REVIEW NO. 72-73 - Continued Applicant: Golden West Partnership To permit an adjustment of the approved plot plan for parking requirements as per S.9106, located on the southwest corner of Clay and Goldenwest Avenue in the R1-0 Single Family Residence District combined with oil production. It was noted that the applicant was not present and had not submitted his revised plot plan for review. Board of Zoning Adjustments August 30, 1972 Page 2 USE PERMIT NO. 72-51 - Continued Applicant: Patscheck - Veiga Construction Company To permit the construction of an 11 unit apartment complex pursuant to S.9162.3.1 IN CONJUNCTION WITH CONDITIONAL EXCEPTION NO. 72-65 Applicant: Patscheck - Veiga Construction Company To permit a zero ft. side yard setback in lieu of the minimum 5 ft. as per code S.9163.2.1 in order to construct garages for an 11 unit apartment complex located on the east side of 17th Street approximately 350 ft. south of Huntington Street in the R2 Two Family Residence District. The hearing was opened to the audience. Mr. Patscheck, applicant, addressed the Board and explained the request. The Board discussed dedication of property, right-of-way, rear and side yard setbacks, and the type of structures with the applicant. Mr. Patscheck further indicated to the Board that the trash area would be fenced off. . The conditions of approval were reviewed with the applicant, along with height limitations and fire hydrant locations. There being no further comment, the hearing was closed. Board discussion followed. A MOTION WAS MADE BY MCFARLAND AND SECONDED BY PALIN TO APPROVE USE PERMIT NO. 72-51 WITH THE FOLLOWING CONDITIONS: 1. The plot plan received August 10, 1972 shall be the approved layout. 2. 17th Street shall be dedicated and fully improved to City standards at the time said parcel is developed. Improvement shall include street trees, street signs, street lights, fire hydrants, sewer and water main extensions. 3. Water supply shall be through the City of Huntington Beach's water system. 4. Sewage disposal shall be through the City of Huntington Beach's sewage system. 5. The water, sewer, and fire hydrant system shall be approved by the Department of Public Works and Fire Department. 6. The property shall participate in the local drainage assess- ment district. 7. Soil reports as required by the Building Department and the Department of Public Works shall be submitted to the City prior to issuance of building permits. 8. All utilities shall be installed underground. 9. Off-street parking facilities shall conform to Article 979. 10. Parking compounds shall be screened with a combination of fencing and landscaping. No structures, other than those shown on the approved plot plan, shall be constructed within the project. 12. All private streets shall meet the minimum standards for apartment developments as adopted by the Planning Commission. 13. All applicable City Ordinances shall be complied with. 14. A ten ft. rear yard shall be provided at the south property line. 15. The trash area shall be screened with fencing. 16. Elevations shall be submitted to the Board of Zoning Adjust- ments for review prior to issuance of building permits. ROLL CALL VOTE: AYES: McFarland, Spencer, Palin NOES: None THE MOTION CARRIED. A FURTHER MOTION WAS MADE BY MCFARLAND AND SECONDED BY PALIN TO APPROVE CONDITIONAL EXCEPTION NO. 72-65 WITH THE FOLLOWING CONDITION: 1. A masonry block wall shall be constructed along the zero ft. property line. AND FOR THE FOLLOWING REASON: 1. This type of construction provides utilization of what would otherwise be a 5 ft trash area. ROLL CALL VOTE: AYES: Spencer, McFarland, Palin NOES: None THE MOTION CARRIED. ADMINISTRATIVE REVIEW NO. 72-75 Applicant: Standard Oil Company To permit a locker room addition to an existing pipeline terminal facility pursuant to S.9530, which is located on the north side of Talbert Avenue where Gothard Street intersects with the property. Mr. Oxman, representing the applicant, addressed the Board and explained the request. Discussion pursued in regard to dedication and street enclosure. Mr. Oxman asked the Board about improvements on the property and discourse continued relative to fire berming around the tanks and storage facility. The Board also discussed landscaping along that property line common with the Central Park. The Board went on to inform Mr. Oxman the applicant that this property was in the Civic District zone. A MOTION WAS MADE BY PALIN AND SECONDED BY SPENCER TO APPROVE ADMINISTRATIVE REVIEW NO. 72-75 WITH THE FOLLOWING CONDITIONS: 1. Talbert Avenue shall be dedicated to City standards. 2. Marinacci To permit the construction of a duplex with open space to be provided with a minimum dimension of 13 ft. as per proposed Code Amendment No. 71-23 in lieu of the existing minimum re- quirement of 20 ft. (S.9163.3.1.1). Subject property is located on the west side of 14th Street, 150 ft. north of Pecan Avenue in the R2 Medium Density Residence District. The hearing was opened to the audience. Mr. Marinacci, applicant, addressed the Board and explained the request. It was noted that identical open space requests have been approved and the City Council has held reading of the proposed Code Amendment No. 71-23. There being no further comment, the hearing was closed. A MOTION WAS MADE BY PALIN AND SECONDED BY MCFARLAND TO APPROVE CONDITIONAL EXCEPTION NO. 72-69 WITH THE FOLLOWING CONDITIONS: 1. The patio equipment shall be as designated on the approved plot plan. AND FOR THE FOLLOWING REASONS: 1. The open space as proposed allows more usability and flexibility of the lot. 2. The City Council and Planning Commission have approved an ordinance to allow this type of open space. 3. The applicant has provided more than the minimum requirement of open space. USE PERMIT NO. 72-52 Applicant: Sheldon Elliott Needle To permit the operation of a screen repair shop within an existing building pursuant to S.9430.7.1 of the Huntington Beach Ordinance Code. Subject building is located at 315 Third Street in the C3 General Business District. It was noted by the Board that the application was filed in error and that a recommendation would be to refund the applicant's money. A MOTION WAS MADE BY MCFARLAND AND SECONDED BY SPENCER TO REFUND THE APPLICANT'S MONEY AS THIS APPLICATION WAS FILED IN ERROR. Board of Zoning Adjustments August 30, 1972 Page 5 ADMINISTRATIVE REVIEW NO. 72-76 Applicant: Huntington Harbour Corp. To permit the construction of sales office and townhouse models on a portion of Tentative Tract No. 7850 pursuant to S.9730.25.4 located 330 ft. west of Santa Barbara Lane and 450 ft. south of Edinger Avenue. Mr. James Turnbull, Mr. Dick Stickler and Mr. Dale Dunn, repre- senting the applicant, addressed the Board and explained their request. The Board discussed temporary directional, signing and code requirements for a model complex with the applicants. Mr. Dunn indicated they had not anticipated a temporary directional sign at the present time. The Board further reviewed tentative tract time limits, extensions and final recordation of maps. Discourse continued as to the Corps of Engineers review of lagoons and deep water channels. A MOTION WAS MADE BY PALIN AND SECONDED BY MCFARLAND TO APPROVE ADMINISTRATIVE REVIEW NO. 72-76 WITH THE FOLLOWING CONDITIONS: 1. The location of the directional signs shall be reviewed by the Board of Zoning Adjustments. 2. All applicable conditions of approval for Tentative Tract No. 7850 shall be complied with. 3. S.9730.25.4 of the Huntington Beach Ordinance Code shall be complied with. ROLL CALL VOTE: AYES: McFarland, Spencer, Palin NOES: None THE MOTION CARRIED. ADMINISTRATIVE REVIEW NO. 72-77 Applicant: Gerald E. Sparks To permit the relocation of a construction office -trailer pursuant to S.9730.25.3 located on the south side of Warner Avenue, 400 ft. east of Springdale Street in the C2 Community Business District. There was no one present to represent the applicant. Relocation of the trailer was discussed by the Board. A MOTION WAS MADE BY PALIN AND SECONDED BY SPENCER TO APPROVED ADMINISTRATIVE REVIEW NO. 72-77 WITH THE FOLLOWING CONDITIONS: 1. S.9730.25.3 of the Huntington Beach Ordinance Code shall be complied with. 2. Subject trailer shall be removed immediately upon completion of construction of the bank. Board of Zoning Adjustments August 30, 1972 Page 6 MISCELLANEOUS: EDISON - Landscaping Plans Mr. Bob Burbank representing the applicant, discussed the tanks, plant material, fence location and contours of the Edison tank location. The Board recommended an on -site review with the applicant to work out the landscaping and fence location. LETTER FROM JAYCEES The Board reviewed a letter from the President of the Huntington Beach Jaycees requesting the closure of Slater Avenue between Gothard and Goldenwest Streets for the Orange Crate Derby on September 30, and November 18, 1972. The Board reviewed and discussed this request and offers the following recommendations to be submitted to the Jaycee President, Mr. Walter L. Peterson, and a copy sent to Mr. Rowlands, the City Administrator: 1. The Police Department requests the applicant provide a plan showing the placement of barricades for said closure and indicate the hours of operation for periodic police patrol of the area. 2. A plan showing the placement of the street barricades shall be submitted to the traffic engineer including the date and time the Derby will be held. 3. The Building Department suggests the applicant provide sanitation facilities for public use either by use of .•existing,(General-Telephone) or portable facilities. 4. The Fire Department requests notification of the hours of closure. 5. The applicant shall supply sufficient trash and litter control. REVIEW: Tract No. 7639 - Landscaping Plan Subdivider: McKeon Construction Company Pursuant to the requirement of the Huntington Beach Ordinance Code, the Board is required to review landscaping plans for Planned Residential Developments. The Board reviewed the subject plans. A MOTION WAS MADE BY PALIN AND SECONDED BY SPENCER TO APPROVE THE LANDSCAPING PLANS FOR TRACT NO. 7639. ADMINISTRATIVE REVIEW NO. 72-50 Applicant: Don Connors To permit the construction of a fully enclosed patio structure to be located between existing dwelling and carports located at 10174 Ascot Circle, Huntington Beach, California. Board discussion was held. The Board reviewed the request. A MOTION WAS MADE BY MCFARLAND AND SECONDED BY PALIN TO APPROVE THE REQUEST FOR BANNERS FOR PRESTIGE PREMIER YAMAHA WITH THE FOLLOWING CONDITIONS: 1. The applicant shall comply with S.9763 of the Huntington Beach Ordinance Code. 2. Subject approval shall be for a period of 30 days only.
