MINUTES: The minutes of July 25, 1972 and August 8, 1972 were
accepted as transcribed and mailed by the Secretary.
AGENDA ITEMS TO BE CONTINUED OR WITHDRAWN:
TENTATIVE TRACT MAP NO. 7930
Subdivider: „William Rouseav
The request is to allow eighteen lots on 3.38 acres of land
located 315 feet east of Beach Boulevard, south of Terry Drive.
The Acting Secretary informed the Commission that subject
property is presently zoned C4; however, -a zone change application
has been submitted to rezone the property Rl. Mr. Harlow pointed
out that this zone change has been heard by the Commission and
recommended for approval to the City Council. Also, a master plan
to redesignate this property for low density was approved. It
was noted that the City Council will consider said zone change
and master plan amendment on September 18, 1972. Mr. Harlow
informed the Commission that the engineer for the developer has
been advised of the hearing by the City Council and has submitted
a letter agreeing to a continuance of Tentative Tract Map No. 7930
to September 19, 1972.

The Acting Secretary informed the Commission that the City
Council at a recent meeting denied Zone Case No. 72-25 and Zone
Case No. 72-26, a proposal to rezone the two separate properties
from C2 and R5 to R3. Mr. Harlow stated that inasmuch as these
tentative maps are inconsistent with the existing zoning, the _
applicant has requested withdrawal of Tentative Tract Map 96. `9�+9
and Tentative Tract -map No. 7950.

The hearing was opened to the audience on Use Permit No. 72-35.
Vu-graphs were shown of subject property.
Art Sullivan, representing the applicant, addressed the
Commission and explained that a number of revisions have been
made to the layout to accommodate the R1 development to the
south.
Fred Ward, representing Tideland Homeowners Association,
requested that the Planning Commission consider additional
landscaping along the south property line; relocation of the
trash area at the southeast corner; and an eight foot high
separation wall along the south property line.
There being no other comment, the hearing was closed.

APPROVE USE PERMIT NO. 72-35 UPON THE FOLLOWING CONDITIONS:
1. The Tentative Map received August 25, 1972 and Precise
Plan received August 25th shall be the approved layout.
2. Fencing material around all patios fronting onto Lochlea
Lane shall be approved by the Planning Department.
3. Trees shall be provided within the development equivalent
to one 30 inch box tree per unit. Subject plan shall be
approved by the Department of Public Works and Planning
Department.
4. CC&R1s to contain provisions to restrict boats and trailers
from being stored within the development.
5. Private street section shall comply with the Department
of Public Works requirements.
6. A lighting system shall be installed on all private
streets, walkways and common areas. Such lighting
systems shall be approved by the Department of Public
Works and Planning Department.
7. A detailed plan of pedestrian vehicular circulation
shall be approved by the Planning Department prior to
the issuance of building permits, grading permits, or
recordation of a final map.
8. The building elevation shall comply with the plans

13. The cul-de-sac constructed on Cupar Lane shall be subject

14. Developers shall work with staff in an endeavor to
relocate the trash areaa within the development.
15. The fire hydrant system shall be designed to provide
for adequate fire flow as determined by the Fire Marshal.
Planning and engineering caluclations for such system
shall be submitted to the Fire Marshal for approval.

Applicant: Lawrence Rink
The tentative tract request is to allow 75 units on 5.003
acres of land. The use permit is to allow the construction of
a Planned Residential Development in the R2 Medium Density
Residential District. The subject property is located at the
southeast Conner of Algonquin Street and Pearce Avenue.
The hearing was opened to the audience.
Richard Tom, architect rep resenting the developer, explained
the project and answered questJons. Mr. Bruce Gilrecht opposed
the Planned Residential Development. Mr. Gilrecht pointed out
that the traffic will be increased and schools will be overcrowded
if this project is allowed to be constructed.
There being no other comment, the hearing was closed.

Commissioner Bazil stated that'. the Commission does not
have a legal right to deny this proposal as subject property
is properly zoned.
A MOTION WAS MADE BY SLATES AND SECONDED BY BAZIL TO
APPROVE USE PERMIT NO. 72-46 UPON THE FOLLOWING CONDITIONS:
1. The tentative map received July 31, 1972 and the precise
plan received August 25, 1972 shall be the approved layout.
2. The driveway adjacent to the parking structure shall have
a minimum width of 40 ft. per city requirements.
3. The driveway parallel to the south property line shall be
widened to 33 ft. opposite the three two -bedroom units
closest to the east property line.
4. Trees shall be provided with the alley between the units.
The type and placement of such trees shall be approved by
the Planning Department and Department of Public Works.
5. The street trees and on -site tree requirements shall be
determined by the Planning Department and Department of
Public Works.
The developer shall contact the Planning Department prior
to preparation of a landscape plan to determine this
requirement.
6. Private street structural section shall comply with the
Department of Public Works requirements.
7. The total number of votes allocated to rental units in
the homeowners association shall not exceed 49% of the
total votes of the association.
8. On -site trees equivalent to one 30 inch box tree for each
residential unit shall be provided. Additional trees and
shrubs shall be planted to provide a well-balanced land-
scape plan. For the purpose of this requirement, the
equivalent to a 30 inch box tree shall be of specimen
material as approved by the Planning Department.
9. The fire hydrant system shall be designed to provide for
adequate fire flow as determined by the Fire Marshal.
Plans and engineering calculations for such system shall
be submitted to the Fire Marshal for approval.
10. Sewer, water and fire hydrant :system shall be designed
to City standards and such system shall be located within
the streets, alleys or drives. A 5 ft. wide exclusive
easement shall be provided for each of these facilities.
11. The parkway width may be reduced to a minimum 5 ft. on
Algonquin Street to provide for additional landscaping.
12. A 42 inch decorative fence of materials compatible with
existing fence shall be constructed adjacent to parking

Applicant: Derby Land Company
The tentative tract request is for one lot subdivision
on 8.42 acres of land located west of Newland Street 326 feet
north of Talbert Avenue. The use permit is to allow the
construction of a Planned Residential Development consisting
of 102 unit air -space condominium in the R2-PD (12 units per
gross acre) .
The hearing was opened to the audience.
Tom White, representing Derby Land Company, informed the
Commission that they are providing a 264 sq. ft. patio for each
two bedroom unit. Mr. White also stated that he will submit
a pedestrian circulation plan to the Planning Department for
approval and showed slides of the elevations.
The Commission received a letter submitted by the City
of Fountain Valley opposing the proposed development.
There being no other comment the hearing, was closed.

deemed necessary by the Department of Public Works and
the Planning Department.
3. A decorative masonry 6 ft. wall shall be constructed
along the northeast and west property lines. The
requirement for masonry wall along south property line
shall be waived until such property develops.

CODE AMENDMENT N0. 72-6 A proposed code amendment to provide
for dedication of right-of-way when
properties that have the suffix -02 are abutting any highway,
street or alley.
The Commission received a memo submitted by the Assistant
City Attorney, stating that in his opinion the proposed code
amendment pertaining to dedication requirement is violative
of both statute and case law.

CODE AMENDMENT N0. 72 -17 A proposed code amendment to amend
Article 976 - Sign Code by amending
those sections governing sign height within the R5, Cl, C2,
C3, C4 and Industrial Districts and establishing a twenty-five
(25) ft. height limit for free-standing signs. Also to amend
Section 9762.4 to prohibit flashing, moving, and rotating signs.
The Commission received a letter submitted by Golden West
Homeowners Association endorsing the proposed code amendment.
The hearing was opened to the audience.
Don Eggleston, Vice -President of Home Council, spoke
in favor of the amendment.
The following representatives of various sign companies
opposed the section of the code amendment relative to height:

DISCUSSION: Proposed fencing around Standard Oil Company's
oil field at the northwest corner of Edwards Street
and Garfield Avenue.
The Acting Secretary informed the Commission that this
discussion was continued from a previous meeting in order
for the company's architect to be present to explain the
fencing. Richard Buhr, Standard Oil Company representative,
stated that the architect was present at a previous meeting,
also that he would like to have a city architect and their
architect to meet to resolve the type and placement of plant
material. Jerry Shea, Huntington Beach Company, stated that
the ordinance code requirement is that a masonry wall be
constructed within 5 years and not at this time.

COMMUNICATION: The P1annLns Commission received a communication
from Arthur Ashley requesting a review of a 38
acre parcel of land at the southwest corner of
Hamilton Avenue and Magnolia Street to be developed

It was the consensus of the Commission that it could not
render an opinion to Mr. Ashley without the benefit of a
public hearing.
