The Secretary indicated that a letter had been received from the applicant requesting a continuance of this item to October 17. ZONE CASE NO. 72-27 Initiated by the Planning Commission (Continued from August 15, 1972) The subject property consists of approximately 29 acres of land located at the northwest corner of Ellis Avenue and Newland Street. The request is for a change of zone from R1 Single Family Residence District to Rl-PD Single Family Residence District - Planned Development. The Secretary reviewed briefly the history of Planning Commission action on subject property. The Chairman opened the public hearing. Mr. Tom Severns, Director of Environmental Resources, addressed the Commission and stated that the Fountain Valley and Huntington Beach City Councilshad decided to follow the Planning Commission recommendation for acquisition of a 3.5 acre portion of subject property for open space. Mr. Ken Reynolds, Planning Director, indicated that the midden in question equals approximately 30,000 square feet and further stated that the midden and park could be purchased together. Mr. Tom Shelton, engineer for the developer of this property, addressed the Commission and indicated that his client has re- evaluated the project and would have problems developing this property as a planned unit development at 7 units per acre. He stated that the Orange County density for planned unit develop- ments is approximately 10 units per acre and that the developer is prepared to develop the property with a planned unit develop- ment, however, the cost of the property is too great for only 7 units per acre. Mr. Shelton also indicated that his client would prefer having R2 zoning. Commissioner Kerins asked Mr. Shelton if his client would be in favor of an RI-PD on this property. Mr. Shelton indicated that a planned unit development at 7 units per acre after acquisition of a 3.5 acre park site would not be economically feasible. Commissioner Porter indicated that he is not interested in penalizing the developer on a unit count but would like the midden and bluff open space within a planned unit development. Commissioner Slates asked Mr. Shelton if the development costs for planned developments are greater than the development costs for standard R1 subdivision. Mr. Shelton answered in the affirmative. Planning Commission Tuesday, September 19, 1972 Page No. 3 Commissioner Bazil indicated that the primary reason for City acquisition of the midden was for the burial site remains and relics and questioned the use of a 3.5 acre park site when surrounded by a planned unit development having all private driveways. ON MOTION BY KERINS AND SECOND BY PORTER, THE COMMISSION MOVED TO APPROVE ZONE CASE NO. 72-27 FOR AN Rl-PD. Commissioner Wallin indicated that this zone case could work to the advantage of the sales because of the aesthetic quality of the slope and trees. Commissioner Higgins indicated that the Planning Commission's prior discussion was that if the City didn't buy the bluffs then the planned unit development is the only answer. ROLL CALL VOTE: AYES: Slates, Bazil, Kerins, Porter, Wallin, Boyle, Higgins NOES: None ABSENT: None THE MOTION CARRIED. ZONE CASE NO. 72-29 Applicant: Bell Oil Corp. Ltd. The subject property is located on the north side of Ocean Avenue, 50 feet west of 13th Street. The request is for a change of zone from C3-0 General Business District combined with oil production to R4 High Density Residential District. To allow the construction of a 17 unit apartment complex. Commissioner Slates indicated that he would abstain on any action regarding this matter. Commissioner Bazil indicated he would abstain on any action regarding this matter. The Chairman opened the public hearing. Mr. Bill Wonacott, architect for the project, addressed the Commission and indicated this request was filed as he was seeking 17 units for this beach -oriented development. He stated that the project would have 9 one -bedroom and 8 two - bedroom units. Mr. Don Eggleston approached the Commission and indicated that a Los Angeles Times editorial stated that local govern- ments change the zoning in order to increase the tax base, yet the tax base revenue doesn't equal the demand for the services required by the development. Mr. Eggleston questioned the costs for services on this type development. There being no further speakers, the Chairman closed the public hearing. Commission diseusslon followed ON MOTION BY WALLIN AND SECOND BY BOYLE, THE COMMISSION MOVED TO DENY ZONE CASE NO. 72-29 FOR THE FOLLOWING REASONS: 1. Planning Commission TLesday, September 19, 1972 Ps ge No. 4 Ccmmissioner Boyle indicated that tie would like to review the Gcals Report first and further indicated that a zone change in this area could lead to a domino effect. Mr. Roger Slates, representing Bell Oil Corp., addressed the Commission to answer any questions. Commissioner Kerins asked Mr. Slates if he would like to have a continuance for six months. Mr. Slates indicated that this would be in preference to a denial and he further indicated that Mr. Ken Rogers, the developer, would prefer to have a decision on this matter. ROLL CALL VOTE: AYES: Kerins, Porter, Wallin, Boyle, Higgins NOES: None ABSTAIN: Slates, Bazil ABSENT: None THE MOTION CARRIED. Commissioner Porter indicated that he would like the record to indicate that the extent of this request does not include enough property; it should be the entire block and that he is not opposed to R4 but is opposed to spot zoning. Commissioner Wallin indicated that her concern for the Goals Report was part of the basis for her vote. TENTATIVE TRACT NO. 7930 (Continued from September 6, 1972) Subdivider: William I. Rousey The subject property consists of 18 lots on 3.38 acres of land located 315 feet east of Beach Blvd. south of Terry Drive. The Secretary reviewed City Council action for approval of a master plan amendment and zone change on this property. Mr. William Rousey, developer, addressed the Commission and stated that he had reviewed the staff report and agrees with the condi- tions as outlined therein. ON MOTION BY SLATES SECOND BY BAZIL, THE COMMISSION MOVED TO APPROVE TENTATIVE TRACT NO. 7930 WITH THE CONDITIONS AS FOLLOWS: 1. The tentative map received September 13, 1972 shall be the approved layout. 2. No final map shall be recorded until Zone Case No. 72-24 is effective. 3. A 6 ft. high masonry wall shall be constructed along the Orange County Flood Control District channel to the south. Said wall shall be designed to meet the Department of Public Works and Flood Control District requirements. 4. An 8 ft. high decorative masonry wall shall be constructed along the west property line separat- ing subject tract from the automobile dealership to the west. The design of such wall shall be approved by the Planning Department. 5. All "Standard Conditions of Approval" for tentative tracts that are applicable shall be complied with. -4- 9/19/72 - PC Minutes: H.B. Planning Commission Tuesday, September 19, 1972 Page No. 5 Commissioner Wallin discussed an additional possible condi- tion to require the developer to submit a landscape plan for trees to muffle the sound between this development and the commercial development to the west. The Chairman directed the Board of Zoning Adjustments to require landscaping within Phase 2 of the commercial property similar to that required within the initial phase at the time of development. TENTATIVE TRACT NO. 7495 Extention of Time (Continued from Subdivider: Signal Landmark, Inc. August 1, 1972) The subject property is located southwest of the Huntington Beach boundary from Ellis Avenue, north- west to Bolsa Chica Street and north of the adopted route of Pacific Coast Freeway. The request is for 960 R1 lots on 392 acres of land. The Secretary informed the Commission of the Archaeological Research, Inc. report upon a portion of this property within Tentative Tract No. 7495. He stated that the Commission may wish to re -revaluate this map because of the Coast Free- way deletion, adoption of equine trails, the arterial high- way study, the high school site which was to be considered for the area, and the tidelands exchange between Signal and City. Commission discussed a continuance to allow time to review Signal's master plan for the area. Mr. George Stringer, engineer, indicated that all the R1 has had final maps prepared and they are ready to be submitted to the City for recordation. ON MOTION BY BOYLE AND SECOND BY WALLIN, THE COMMISSION MOVED TO CONTINUE ACTION ON TENTATIVE TRACT NO. 7495 TO THE SEPTEMBER 269 1972 AFTERNOON MEETING. ROLL CALL VOTE: AYES: Slates, Bazil, Kerins, Porter, Wallin, Boyle, Higgins NOES: None ABSENT: None THE MOTION CARRIED. TENTATIVE TRACT NO. 7888 (Continued from September 6, 1972) Subdivider: Classic Development Corp. 83 lots on 15.96 acres of land located east of Southern Pacific Railroad, north of Taylor Avenue and west of Huntington Street. The Secretary reviewed prior Planning Commission action on this property and stated that the City Council has sustained the Planning Commission by denying the appeal on Zone Case No. 72-21, therefore, Tentative Tract No. 7888 does not conform to the master plan as required by State law. -5- 9/19/72 - PC Iv;inutes: H.B. Subject property does not have proper zoning for residential subdivision. 2. The Zone Change to effect phis subdivision was denied by the City Council. PRECISE PLAN NO. 72-7 Said plan proposes to amend the street alignments for Hoyt Lane, Modale Drive, Demion Lane, Lister Lane, Constantine Drive and Carolyn Lane located approximately 600 ft. east of Beach Boulevard be- tween Ellis Avenue and Garfield Avenue. The Secretary reviewed the proposed alignment with the Commission. The Chairman opened the public hearing. Mr. Ray Clancy, a realtor in the area, addressed the Commission and submitted a letter from Millie Rauch, property owner, authorizing Mr. Clancy to represent her and agreeing to the proposed street alignments. The Secretary received the letter for file. Mr. Bill Richardson addressed the Commission and indicated that he was in favor of the precise plan. Mr. Robert Potter addressed the Commission and asked for clari- fication on the exact alignment of the proposed cul-de-sac on Hoyt Lane. There being no further speakers the Chairman closed the public hearing. ON MOTION BY SLATES AND SECOND BY BAZIL, THE COMMISSION MOVED TO APPROVE PRECISE PLAN NO. 72-7 WITH THE CONDITION THAT THE PRECISE PLAN NOT BE EFFECTIVE UNTIL A FINAL MAP HAS BEEN SUB- MITTED FOR RECORDATION. TENTATIVE TRACT NO. 8011 In conjunction with USE PERMIT NO. 72-49 Subdivider: Classic Development Corp. 78 lots on 6.44 acres of land located 1320 feet south of Ellis Avenue and 330 ft. east of Beach Blvd. The request is to allow the construction of a planned residential development consisting of 78 individually owned townhouses with recreational facilities on 6.44 acres of land in the R3 Medium High Density Residential District. -6- 9/19/72 - PC Minutes: H.B. Mr. Robert De Almeida addressed the Commission to answer any questions. The Secretary indicated that the minimum separation between buildings has not been met by the plans. Mr. De Almeida indicated that there would be a trellis attachment in those areas. Mr. Richardson addressed the Commission and stated that Classic Development Corp. is in agreement with the conditions as proposed in the staff report. The Secretary further indicated that there was a need to meet the minimum dimensions for patio areas. Commissioner Wallin indicated that the minimum dimensions should be subject to the approval of the Planning Department. There being no further speakers, the Chairman closed the public hearing. ON MOTION BY SLATES AND SECOND BY BOYLE, THE COMMISSION MOVED TO APPROVE THE USE PERMIT NO. 72-49 WITH THE FOLLOWING CONDITIONS: 1. The tentative ma and precise plan received September 13, 1972 shall be the approved layout. 2. A 6 ft. high masonry wall shall be constructed along that portion of the north property line where it is deemed necessary by the Planning Department. 3. The CC&R's and Association rules shall contain a provision prohibiting parking of boats and trailers within the private drives and within the parking area provided for guest parking. It shall further state that any area provided for the storage of recreation vehicles shall be screened from view and subject to the approval of the Planning Department. 4. The elevations shall comply with the elevations sub- mitted for Planning Commission review. 5. Hoyt Lane shall be 52 ft. wide. 6. The walkway between the garages entered from the auto court shall be provided with adequate lighting. Such lighting shall be subject to the approval of the Planning Department. 7. Garage doors shall be equipped with automatic garage door openers. 8. Constantine Lane, between Hoyt Lane and Beach Blvd. shall be approved to Department of Public Works requirements. 9. All requirements of the policy statement for Planned Residential Developments adopted by the Planning Commission on February 8, 1972 shall be complied with unless otherwise approved on the development plan. -7- 9/19/72 - PC Minutes: H.B. Plans and engineering calcula- tions for such systems shall be submitted to the Fire Marshal for approval. 11. The sewer, water and fire hydrant systems shall be designed to city standards. Such a system shall be located within the streets, alleys or drives. A five foot wide exclusive easement shall be provided for each of these facilities. 12. Planters shall be installed between garages within the auto court as per Planning Depart- ment requirements. 13. MISCELLANEOUS METROPOLITAN WATER DISTRICT REPORT RESOLUTIONS The Commission discussed the resolutions on Metropolitan Water District's report and the Council action was ex- plained by the Secretary. TENTATIVE TRACT MAP APPLICATION FORM The Commission reviewed the tentative map application form and the Secretary informed the Commission that this was a new form for the processing of tentative maps. MEMORANDUM ON PLANNING COMMISSION AUTHORITY TO REVIEW SIGN APPLICATIONS The Commission discussed the memorandum by the City Attorney's office. Commissioner Wallin and Commissioner Kerins discussed the appeal procedure. No further action. MAIN STREET RECONSTRUCTION Commissioner Bazil indicated that there is a need for Planning Commission action relative to the Main Street reconstruction that is taking place. He discussed the feasibility of deleting Main Street from the arterial street system from 17th Street to Mansion. Bill Hartge, City Engineer, indicated that Main Street at that point is a major access for the new police facility. Commissioner Bazil indicated that there is a growing deterioration of this nice residential area. Commissioner Porter indicated that everything has stopped with reference to the reconstruction until the Council meets on this matter. ON MOTION BY KERINS AND SECOND BY BAZIL, THE COMMISSION MOVED TO ADOPT THE FOLLOWING RESOLUTION: RESOLUTION NO. 1100 - A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF HUNTINGTON BEACH, CALIF- ORNIA, RELATING TO STREET IMPROVEMENT ALONG MAIN STREET BETWEEN SEVENTEENTH STREET AND MANSION AVENUE. -9- 9/19/72 - PC Minutes: H.B. COMMISSION COMMENTS Commissioner Kerins discussed the parlimentarian session to be held at Goldenwest College. Commissioner Porter asked if there was money-in'the-=budget for such classes as are being held at the University of California -Irvine related to planning. Commissioner Slates discussed the Community Congress which is to be held at Goldenwest College on November 11. -1, Commissioner Boyle discussed an editorial which appeared in the Los Angeles Times with reference to growth policy. STAFF COMMENTS Bill Hartge, City Engineer, discussed AB 1665 and indicated that the Engineering Department would be setting up standards, _ pursuant to,, this bill. _c.,.a FIELD TRIP Ken Reynolds, Planning Director, indicated that he was in receipt of a letter from VTN inviting the Commission to visit their new photogrammetric division. A field trip has been scheduled for the afternoon of October 10, 1972.
