Monday, September 25, 1972
Mayor Coen called the adjourned regular meeting of the City Council of the City
of Huntington Beach to order at 5:00 P.M.
The Pledge of Allegiance was given by all present in the Council Chamber.

ACQUISITION 2Z M2 SURM0 OIL CO. - HUNTINGTON CENTRAL PARK
The City Administrator informed Council that he had negotiated a purchase price
of $5,,400.for a 50' x 240' strip of land located within the Talbert Avenue right-
of-way, west.of Gothard Street; a street easement granted to the City by Standard
ail.Company, which, if abandoned, reverts back to ahem. He stated that :this
situation had arisen ,as a result of the relocation of Talbert Avenue through Hunting-
ton Central Park. He spoke regarding the importance to the City in obtaining clear
title to this property in relation to the HUD Grant. The Administrator .requested
approval of ,the purchase, in order to facilitate the delivery of the $5.000,000 in
Non -Profit Corporation Bonds for the library scheduled to take place September 28,
1972,
The Assistant City Administrator addressed Council concerning the procedures which
must be taken by the City before the sale is consummated.
On motion by Matney, Council.authorired the expenditure of $5,400 to purchase the
50' x 240' strip of land from Standard,oil Company, located within the Talbert
Avenue right-of-way, west of .Gothard Street - Huntington Central Park, and directed
the City Administrator to,complete ,the purchase, by the following roil call vote:
AYES: Councilmen Shipley. 3artlett, Gibbs, Matney, Duke, Coen
NOES: Councilmen: None
ABSENT: Councilmen: Green

Mayor Coen requested the Assistant City Attorney to report on the Judgment and
Peremptory Writ of Mandate issued by the Superior Court of Orange County directing.
the C ty.CounciI to approve Tentative Tract No. 7805, subject to Court imposed
conditions.
The Assistant City Attorney explaitied the action taken by the Court and directed their
attention to the Letter from the City Attorney dated September 21, 1972, detailing
tote background of the matter and recommending that Council grant approval to the
tentative tract.

Considerable discussion was held by Council on the matter.
A motion was made by Councilman Bartlett, to reconsider their denial of Tentative Tract
Itap So. 7805 and was passed by the following vote:
AYES: Councilmen: Shipley, Bartlett, Matney, Coen
NOss: Councilmen: Gibbs, Duke
ABSFXT: Councilmen: Green
A motion was made by Mayor Coen that the Council hereby overrules the decision of the
Planning Commission and approves Tentative Tract Map No. 7805 subject to conditions set
forth in the Court order and pursuant to the directives and mandates of the Superior
Court Judgment contained in Stellrecht & Bartoli vs. City Council of the'City of Hunting-
ton Beach, Case No. 149613. The motion was passed by the following roll call vote:
AYES: Councilmen: Shipley,
NOES: Councilmen: Gibbs
ABSENT: Councilmen: Green

Mayor Coen called an informal meeting of the Council as a Committee -of -the —Whole for
September 25, 1972, at 7:00 P.M. in the Administrative Annex, to meet with members of
the Planning Commission to discuss Planned Unit Development.

On motion by Shipley, the adjourned regular meeting of the City Council of the City of
Huntington Beach adjourned at 5:30 P.M. The motion was passed by the following vote:
