Subject property is located 300 feet northeast of Pacific Coast Highway and 300 feet north of Warner Avenue. The request is for a change of zone on .70 acre parcel of land from C4 Highway Commercial District to R2 Medium Density Residential District. A letter from the applicant was received concurring with the staff recommendation that subject zone case be heard in conjunc- tion with the use permit and tentative map.. ON MOTION BY KERINS SECOND BY BOYLE ZONE CASE NO. 72-32 WAS CONTINUED TO OCTOBER 17, 1972 TO BE HEARD IN CONJUNCTION WITH THE USE PERMIT AND TENTATIVE MAP BY THE FOLLOWING ROLL CALL VOTE: AYES: Bazil, Kerins, Porter, Wallin, Boyle, Higgins NOES: None ABSENT: Slates TENTATIVE TRACT NO. 7692 - REVISED Subdivider: Signal Landmark Inc. Subject property is located south of Adams Avenue and west of Magnolia Street. 584 lots on 130.4 acres of land. The Secretary stated that the revised map was posted and now includes the additional area requested by the Planning Commission. Mr. George Stringer, engineer for the applicant was present and responded to questions of the Commission. ON MOTION BY KERINS SECOND BY BOYLE TENTATIVE TRACT NO. 7692 AS REVISED WAS APPROVED WITH THE FOLLOWING CONDITIONS BY THE FOLLOWING ROLL CALL VOTE: 1. The expiration date for approval of Tentative Tract No. 7692 shall coincide with the expiration date of the originally approved map, April 3, 1973. 3. AYES: Bazil, Kerin, Porter, Wallin, Boyle, Higgins NOES: None ABSENT: Slates ZONE CASE NO. 72-30 Applicant: Seth 0 and Emma Wilson Subject property is located east of Bolsa Chica Street approximately 500 feet north of Warner Avenue. The request is for a change of zone on approximately one acre parcel of land from R2 Medium Density Residential District to C4 Highway Commercial District with a 50 foot setback from the ultimate right-of-way line. The Secretary presented vu-graphs and slides of the area. Mr. Ken Reynolds, Planning Director, discussed the study being conducted by the Meadowlark Airport Study Committee which could effect a realignment of the runways of Meadow- lark Airport. Mr. Reynolds also stated that he will be in a position to report to the Commission on the progress of this study a*c the October 10 meeting. The Chairman opened the public hearing. Mr. Seth Wilson, applicant, addressed the Commission speaking in favor of the zone change and stating that the sale of the property was contingent upon this zone change. Mr. Robert S. Butts, potential buyer of the property, addressed the Commission speaking in favor of the zone change and stating that he plans to establish an overnight recreational vehicle facility. There being no one further present to speak, the Chairman closed the public hearing. Commission discussion followed. ON MOTION BY HIGGINS SECOND BY BOYLE ZONE CASE NO. 72-30 WAS DENIED FOR THE FOLLOWING REASON BY THE FOLLOWING ROLL CALL VOTE: 1. This request, if approved, would increase the surplus of commercial property in the immediate area. 2. Additional commercial zoning northerly along Bolsa Chica would tend to create strip commercial zoning. AYES: Bazil, Kerins, Porter, Wallin, Boyle, Higgins NOES: None ABSENT: Slates MEADOWLARK AIRPORT DISCUSSION Kenneth Reynolds, Planning Director; informed the Commission that the City, in conjunction with the County, is studying the area from Warner to Heil and Bolsa Chica to Springdale. The City may acquire Meadowlark golf course and conceivably, Meadowlark Airport would become a county facility. Should this take place, the runways would be realigned with the golf course to provide a safety zone. The study is a com- bination feasibility and impact study. -2- 10/3/72 PC Minutes: H. B. Planning Commission Tuesday, October 3, 1972 Page 3 ON MOTION BY PORTER SECOND BY WALLIN, STAFF WAS DIRECTED TO PLACE THE SUBJECT OF THE MEADOWLARK AIRPORT STUDY ON THE COMMISSION AGENDA FOR OCTOBER 10, 1972 FOR REPORT AND POSSIBLE ACTION BY THE COMMISSION REQUESTING THE CITY COUNCIL TO PLACE A MORATORIUM ON THE AREA FROM GRAHAM TO BOLSA CHICX AND HEIL TO WARNER, PENDING COMPLETION OF THE AIRPORT STUDY, BY THE FOLLOWING ROLL CALL VOTE: AYES: Bazil, Kerins, Porter, Wallin, Boyle, Higgins NOES: None' ABSENT: Slates ZONE CASE NO. 72-31 Applicant: Rinker Development Corporation Subject property is located on the east side of Brookhurst Street opposite the intersection of Brookhurst and Bushard Streets. The request is for a change of zone on approximately 1.72 acre parcel of land from RA-0 Residential Agricultural District combined with oil production to C4 Highway Commercial with a 50 ft. setback from the ultimate right-of-way line. The Secretary informed the Commission that slides were available and a vu-graph and plot plan were shown. The Chairman opened the public hearing. Mr. Warren McFay, representing Rinker Development Corp, addressed the Commission and spoke in favor of the zone change. He stated that tine -seventh of the parcel is required to be dedicated for street purposes and that this zone change has been filed on the total property under lease by the applicant. Mrs. William Poage, resident in the area, addressed the Commission and stated that inasmuch as this is one of the first areas seen upon entering the city from Pacific Coast Highway, it should be considered in a special light; that the area is already over - commercialized and suggested, in view of its proximity to the Santa Ana River recreational trail, it be reserved for a park or rest area. There being no one further present to speak, the Chairman closed the public hearing. Commissioner Kerins stated that this property had been reviewed by the Commission in 1971 and it was determined that it was not a feasible commercial site and had been zoned RA pending a determination of what would be a feasible use. Commissioner Wallin suggested consideration be given to some type of recreational use. ON MOTION BY KERINS SECOND BY BOYLE, ZONE CASE NO. 72-31 WAS DENIED FOR THE FOLLOWING REASONS BY THE FOLLOWING ROLL CALL VOTE: 1. This zone change, if approved, would create spot zoning. 2. The determination on how the property to the north and south of subject property will develop is unknown. 3. A commercial use would create traffic and safety hazards. AYES: Bazil, Kerins, Porter, Wallin, Boyle, Higgins NOES: None ABSENT: Slates CODE AMENDMENT NO. 72-12 A proposed code amendment to the Huntington Beach Ordinance Code by repealing Article 948 Service Station Standards (Special -3- 10/3/72 PC Minutes: H. B. Planning Commission IN - Tuesday, October 3, 1972 Page 4 Commercial Developments), and adding Article 948 - Service Station Suffix. In conjunction with Code Amendment No. 72-20 A proposed code amendment to the Huntington Beach Ordinance Code to amend Section 9711.1 (Abatement of Non -conforming Use) and to repeal Sections 9430.7 (g) service stations in the C2 District and Section 9454.1 service stations in the C3 District.. The Scretary outlined both Code Amendment No. 72-12 and No. 72-20 and suggested the Commission may wish to conduct the public hearing on Code Amendment No. 72-12 in conjunction with Code Amendment No. 72-20. The Secretary stated that the Commission had received copies of a letter from Western Oil and Gas Association commenting on various sections of the proposed code amendments. The Chairman opened the public hearing on Code Amendment No. 72-12 and Code Amendment No. 72-20. Mr. Frank Walker, Western Oil and Gas Association, addressed the Commission and spoke in opposition to the proposed amendments. Based on a survey he has conducted, these proposed requirements are the most restrictive. He then cited specific sections to which his association takes exception. Mr. Ron Wooderidge, U-Haul Company, addressed the Commission and spoke in opposition to the proposed amendments with refer- ence to those sections relating to rental equipment. There being no one further present to speak, the Chairman closed the public hearing. Following discussion by the Commission of various provisions of the proposed amendments, several minor changes were made which the Deputy City Attorney stated did not constitute changes of such significance as to require a further public hearing. ON MOTION BY KERINS SECOND BY BAZIL, CODE AMENDMENT NO. 72-12 WAS APPROVED AS AMENDED BY THE FOLLOWING ROLL CALL VOTE: AYES: Bazil, Kerins, Porter, Wallin, Boyle, Higgins NOES: None ABSENT: Slates ON MOTION BY WALLIN SECOND BY HIGGINS, CODE AMENDMENT NO. 72-20 WAS APPROVED AS AMENDED BY THE FOLLOWING ROLL CALL VOTE: AYES: Bazil, Kerins, Porter, Wallin, Boyle, Higgins NOES: None ABSENT: Slates DISCUSSION - COMMISSION TRANSMITTALS TO CITY COUNCIL The Chairman initiated a discussion concerning transmittals to the City Council. It was suggested by Commissioner Wallin that in transmitting Code Amendments No. 72-12 and No. 72-20 to the City Council, that a slide presentation be made, that all survey information complied by the Commission be trans- mitted excluding the information from Fountain Valley which is no longer valid, and that the aerial slides also be avail- able for the presentation. Planning Commission Tuesday, October 3, 1972 Page 5 that the Council have the benefit of all the research and back- ground material developed by the Commission when considering this and other matters transmitted by the Commission. Commissioner Wallin will draft a letter of transmittal to the Council on these two amendments. Following discussion by the Commission, staff was directed to make all studies and background information avail- able to the City Council on future transmittals. MASTER PLAN AMENDMENT N0, 12-6 Said amendment is an Interim Open Space Plan which is an element of the Master Plan. This interim plan recommends goals and general policies for preservation of open space in Huntington Beach. Mr. Fred Ritter, Planning Aide, presented an overview of the Interim Open Space Plan and stated that Assembly Bill 966 moved the date for adoption of an Open Space Plan to June 30, 1973 and required an interim plan to be adopted until then. Mr. Kenneth Reynolds, Planning Director, displayed a map entitled "Proposed Area of Influence - Environmental Impact Statements" adopted by the City Council at the October 2 meeting, and explained the map to the Commission. Generally, those areas requiring impact statements are: The beach and three miles seaward, the bluff lines, estuaries and marshes, the undeveloped portions of Huntington Harbour and the Signal properties. He stated that the next step is to develop an ordinance and procedures for implementation. There was discussion as to whether certain other areas such as the Talbert Channel and Santa Ana River should be included. Mr. Reynolds explained that this was an interim action on the part of the City Council until clarification is received and guidelines are established on environmental impact statement requirements. The Chairman opened the public hearing on Master Plan Amendment No. 72-6. Mrs. Margaret Carlberg, Chairman of the Huntington Beach Environ- mental Council, addressed the Commission and stated that the Environmental Council has reviewed the plan, has had input into it and has submitted a report to the Commission; that it is under- stood that this is an interim plan and the final plan will be more comprehensive and that areas of concern to the Environmental Council will be covered in the final plan. ON MOTION BY BOYLE SECOND BY BAZIL, THE COMMISSION ADOPTED RESOLUTION NO. 1102 APPROVING MASTER PLAN AMENDMENT NO. 72-6 BY THE FOLLOWING ROLL CALL VOTE: AYES: Bazil, Kerins, Porter, Wallin, Boyle, Higgins NOES: None ABSENT: Slates MISCELLANEOUS Bruce Bros, Materials Pit The Commission considered a letter from the City Engineer requesting a decision as to whether an environmental impact statement is required for the landfill operation to be conducted. He stated that the property is within Huntington Central Park and that materials are being mined at present. Excavation will -5- lo/=3/73 PC Minutes: H. B. Planning Commission Tuesday, October 3, 1972 Page 6 be completed within 60 to 90 days at which time a fill operation will be started. Following discussion it was determined that the City Engineer will submit a negative declaration on the extraction operation. ON MOTION BY KERINS SECOND BY BOYLE, COMMISSION DIRECTED THAT AN ENVIRONMENTAL IMPACT STATEMENT ON THE FILL OPERATION BE REQUIRED BY THE FOLLOWING ROLL CALL VORE: AYES: Kerins, Porter, Wallin, Boyle NOES: Bazil, Higgins ABSENT: Slates RAL COMMUNICATIONS Mr. Clarence Casper, a resident of Fountain Valley and member of the Santa Ana River Greenbelt Committee, addressed the Commission as a private citizen and requested the Commission reserve an area 200 feet wide along the Santa Ana River for the greenbelt. Commissioner Kerins explained that he too is a member of the Santa Ana River Greenbelt Committee and maintains communication with the Commission on matters relating to the greenbelt program. COMMISSIONERS t COMMENTS Planned Unit Development Moratorium In response to Commissioner Wallints inquiry, Kenneth Reynolds, Planning Director, informed the Commission that a joint meeting is tentatively scheduled with the City Council on October 30. Agenda Change Following discussion initiated by Commissioner Wallin, a note will be added to Commission agendas indicating that a limited number of staff reports are available at the Commission meetings. New Towns Presentation Commissioner Boyle will schedule a New Towns presentation'to the Commission at the October 25 meeting. STAFF COMMENTS Edison Plant Expansion The Secretary informed the Commission that Southern California Edison Company has filed an application relating to expansion of their plant and the schedule for reviewing the application is: October 11, Board of Zoning Adjustments; October 17, Planning Commission; October 24, City Council. Field Trip A field trip to the Photogrammetric Division of VTN is scheduled for October 10, 2:00 p.m. ADJOURNMENT There being no further business, the Commission adjourned at 12:10 a.m. � Y , K. A.
