B. Planning Commission Tuesday, October 17, 1972 Page 2 CONDITIONAL EXCEPTION NO. 72-15 Applicant: Southern California Edison Co. A request to permit the construction, operation and maintenance of six combined cycle generating units having a height of 53 feet, excluding stacks, to be located on property north of Pacific Coast Highway between Newland and Magnolia Streets in the M2-0 Heavy Industrial District combined with oil production. In conjunction with ADMINISTRATIVE REVIEW NO. 72-93 Applicant: Southern California Edison Co. The request is to permit the construction, operation and main- tenance of six combined cycle generating units at applicant's Huntington Beach Generating Station pursuant to S.9551 of the Ordinance Code. Each unit consits of two gas turbines, two heat recovery steam generators and one steam turbine. The units are designed to use either natural gas or distallate for fuel. Also, as indicated on the development plans, construction of a shop and warehouse building of 40,000 sq. ft. Construction will be of concrete block with a height of 25 ft. Referred to the Planning Commission by the Board of Zoning Adjustments. The Acting Secretary informed the Commission that on October 13, 1972 the City Attorney advised that Conditional Exception No. 72-15 and Administrative Review No. 72-93 be referred by the Commission back to the Board of Zoning Adjustments to be held in abeyance until an Environmental Impact Statement is submitted. Since that time, there has been discussion between the Edison Company, City Administrator, City Attorney and members of the City Council, and it is the City Administrator's recommendation that the Planning Commission continue Conditional Exception No. 72-15 and Administrative Review No. 72-93 and the Edison Company be allowed to address the Commission on October 24, 1972 to inform the Commisssion as to what is taking place concerning the proposed plant expansion. Mr. Paul Richardson, District Manager, Southern California Edison Company addressed the Commission and stated that he is appearing before the HOME Council on October 25 to make a full presentation of plans for the generating station. He requested that he be permitted to appear before the Planning Commission on October 24 to make a public presentation on the proposed plant expansion. He further stated that in addition to meeting requirements of the City of Huntington Beach, the requirements of 18 other agencies must be complied with. Subject property is located 300 ft. northeast of Pacific Coast Highway and 300 ft. north of Warner Avenue. Planning Commission Tuesday, October 17, 1972 Page 3 The Actin: Secretary stated that this matter relates to Tentative Tract No. 8039, the next item on the agenda, and if the zone change is approved, the property will be developed as a part of Tentative Tract No. 8039. A vu-graph and slides of the property were shown. The Chairman opened the public hearing. Mr. Don Byrnes, representing the applicant, addressed the Commission speaking in favor of the zone change and stated that the Huntington Harbour Property Owners Association has been informed of the request and is not opposed to the change of zone. There being no one further present to speak, the Chairman closed the public hearing. ON MOTION BY HIGGINS SECOND BY BOYLE, ZONE CASE NO. 72-32 WAS APPROVED FOR THE FOLLOWING REASONS, BY THEJOLLOWING ROLL CALL VOTE: 1. R2 zoning conforms to the master plan. 2. It is impractical to develop the property as C4 because of its small size and the lack of access to dedicated streets. 3. The property should be developed in conjunction with the adjacent R2 property. AYES: Kerins, Porter, Wallin, Boyle, Higgins NOES: None ABSENT: Slates, Bazil TENTATIVE TRACT NO. 8039 In conjunction with USE PERMIT NO. 72-64 Subdivider: Huntington Harbour Corp. The request is to allow the construction of a planned residential development on 12.7 acres of land, consisting of 186 units and related amenities and facilities in the R2 ' Medium Density Residential District, R3 Medium High Density Residential District and C4 Highway Commercial District on two lots located 300 it. north of Warner Avenue and 300 ft. northeast of Pacific Coast Highway. 186 units on 11,626 acres of land. The Acting Secretary stated that he has been informed by Mr. Tom Severns, Environmental Resources Director, that the City is not in a position to conditionally approve the proposal on the basis of the Environmental Impact Statement submitted by the applicant. A vu-graph and slides of the property . were shown. The Chairman opened the public hearing on Use Permit No. 72-64. Mr. Don Byrnes, representing the applicant, stated that he concurs with the conditions of approval recommended by the Subdivision Committee. He reported that the Huntington Harbour Property Owners Association does not object to the proposed development. He stated that the format of the City+s Environmental Impact Statement on the proposed fire station and harbor facility had been followed in preparing -3- 10-17-72 PC Minutes: H. B. Planning Commission Tuesday, October 17, 1972 Page 4 the statement submitted on this project and if it has been found to be inadequate, he requested approval of the project conditioned on a new Enviornmental Impact Statement being submitted and approved by the City. The development is to be constructed in two increments, the first half to be completed by June 1973. Mr. Thomas Whaling, a resident of Huntington Barbour, addressed the Commission and stated that he had not been apprised by the property owners association of the proposal, questioned the increased traffic on the Warner Avenue bridge which he understands is in poor condition, and suggested that the homeowners be informed of requirements concerning Environmental Impact Statements. "Commissioner Bazil arrived at 7:50 p.m. Mr. John McDonald, a resident of Huntington Harbour, addressed the Commission and inquired as to what appears to be a reduction in the amount of water area. Mr. Milton Beychok, a resident of Huntington Harbour, addressed the Commission, with reference to the inadequacy of the Environmental Impact Statement submitted. Mrs. Beverly Dalsimer, a resident of Huntington Harbour, addressed the Commission and inquired as to whether the proposed boat docks were private or public. Commissioner Boyle briefly reviewed the history of the property. Mr. Bill Hartge, City Engineer, stated that the Warner Avenue bridge was'being repaired and constituted no problem, and that there was an increase in the total amount of water area over the original plan, achieved through a change in configuration of the channels and lagoon. Mr. Byrnes stated that there would be 50 boat slips or less and they are private. There being no one further present to speak, the Chairman closed the public hearing. The Commission discussed a letter received from the Orange County Health Department stating that action should be taken to control rats in the area, emission of gases with odors from the marshlands, and surface drainage from entering the harbor or lagoon waters. The Chairman directed the Acting Secretary to request elaboration by the Health Department on comments relating to surface drainage. The Commission discussed the Environmental Impact Statement and it was the consensus of the Commission that criteria and procedures on Environmental Impact Statements must be received before the Commission can act on this matter. The request is for 129 lots on 46.12 acres of land located 300 ft. northeast of Pacific Coast Highway and approximately 700 ft. north of Warner Avenue. Mr. Edwin K. Hom, architect, described the project as a standard R1 development, with standard lots and fully improved streets meeting City standards. It is a private community with private streets maintained by the owners. All lots front on water, one area on a private sand beach with no boat docks, moorings being provided in the private lagoon, and the other area fronting on bulkheads with private docks. Two tennis courts are provided and two swimming pools. Mr. John Nichol, project engineer, addressed the Commission and stated that circulating pumps will be installed in the lagoon area if it is determined that additional circulation is required. The Acting Secretary informed the Commission that a letter had been received from the Orange County Health Department expressing concern with regard to rat control, gaseous odors and surface drainage into the harbor and lagoon. Elaboration from the Orange County Health Department will be requested by the staff. It was the consensus of the Commission that criteria and procedures on Environmental Impact Statements must be received before the Commission can act on this proposed development. ON MOTION BY KERINS SECOND BY BAZIL, TENTATIVE TRACT NO. 8040 WAS CONTINUED TO NOVEMBER 21, 1972 WITH THE CONCURRENCE OF THE APPLICANT, PENDING ADOPTION BY THE CITY COUNCIL OF CRITERIA AND PROCEDURES FOR HANDLING ENVIRONMENTAL IMPACT STATEMENTS, BY THE FOLLOWING ROLL CALL VOTE: AYES: Bazil, Kerins, Porter, Wallin, Boyle, Higgins NOES; None ABSENT: Slates TENTATIVE TRACT NO. 5613 In conjunction with USE PERMIT NO. 72-61 Subdivider: Sunbeam Homes, Inc. The request is to allow the construction of a townhouse development consisting of 155 units, 10.5 acres of land in the R2 Medium Density Residential District on property located 1345.38 ft. south of Yorktown Avenue, east of Bushard Street. The Acting Secretary stated that the Subdivision Committee has submitted a report and has requested the Commission to address itself to the question of open space. A vu-graph and slides of the area were shown. The Chairman opened the public hearing on Use Permit No. 72-61. Mrs. Beatrice Berghouse, representing the architect Hai C. Brom, President of Sunbeam Homes, Inc.,was present to answer questions of the Commission. Mr. Ron Bunce, a resident in the area, addressed the Commission expressing concern in overloading the schools, lack of privacy of abutting property owners, and the effect the development will have on the value of surrounding property. Mrs. Linda Bunce, a resident in the area, asked for and received clarification as to the difference between a town- house and condominium development. There being no one further present to speak, the Chairman closed the public hearing. Following discussion, Condition 8 of the Staff report was amended to include a 20 inch box tree to be provided in the patio areas to provide screening between the develop- ment and abutting R1 property. Particular attention shall be given the entire north property line. It was further determined that ten parking spaces will be eliminated in the area adjacent to the R1 property line and the area will be landscaped in a manner to be approved by the Planning Depart- ment. Mrs. Berghouse stated that the dimension of the balconies is 10 ft. by 15 ft. and that the dimensions of the patios are 14 ft. by the width of the apartment on the rear property line and 13 ft. by 22 ft. on the front of the units. ON MOTION BY BOYLE SECOND BY BAZIL USE PERMIT NO. 72-61 WAS APPROVED WITH THE FOLLOWING CONDITIONS AS AMENDED, BY THE FOLLOWING ROLL CALL VOTE: 1. Use Permit No. 72-61 received August 31, 1972, shall be the approved layout. 2,. The owners of each of condominium unit shall have an equal and undivided interest in the common area designated as Lot "A" on Final Tract Map No. 6357 and Lot 16 of subject Tentative Tract. This undivided interest shall also include the four lots recorded within Tract No. 6337 and the lots recorded on Tract 7313. 3. The CC&R's shall contain a provision limiting the total number of votes allocated to rental units to 49% of the total vote of the association. 4. The CC&R's and Association rules shall contain a provision prohibiting the outside storage of boats and trailers except within a designated area approved by the Planning Department. S. The developer shall provide 3 single garages and one double garage for each 4-plex. 6. The school walkway shall be improved per Department of Public Works requirements. Said walkways shall not include the installation of a fence or wall. 7. Park fees for this project shall be re -calculated based on the new bedroom count. Said calculation shall take into account the park site previously dedicated by the developer. 8. Landscaping shall be provided where the driveways terminate at the rear property line. Such landscaping shall be approved by the Planning Department. 9. All applicable requirements of the Policy Statement regarding Planned Residential Developments adopted by the Planning Commission on February 1972, shall be complied with. 10. The open parking spaces along the north property line, adjacent to the single family development shall be eliminated and landscaping provided subject to Planning Department approval. 11. The open parking spaces along the east and south property lines shall be eliminated where it creates a conflict with abutting uses. The determination shall be made by the Planning Department. The request is for a change of zone on approximately 37 acres of land from R5 Office -Professional District to MH Mobilehome District. The Acting Secretary reviewed the staff report on Zone Case No. 72-33. The Chairman opened the public hearing. Mr. Ray Elman, project manager for the applicant, addressed the Commission, speaking in favor of the zone change. There being no one further present to speak, the Chairman closed the public hearing. The Commission discussed the need for landscaping to screen the storage area, possibly using "umbrella" type trees. The applicant indicated a willingness to attempt screening but noted that screening is difficult because the Dronerty is 30 to 40 feet lower than the property to the north. The request is for a change of zone on an 8.3 acre parcel of land from R3 Medium High Density to R2 Medium Density Residential District. i The Chairman opened the public hearing. There being no one present to speak, the Chairman closed the public hearing. The Acting Secretary stated that the master plan for the area is in the process of being revised and this zone case is the result of the City Council's request that the Planning Commission study this property because of their concern that some type of development on the parcel is imminent. Commi'sioner Bazil stated that he felt this zone case should be iandled concurrently with the master plan amendment. Planning Dir ctor Kenneth Reynolds stated that the staff agrees that th master plan for this area should be handled as a unit rather 6.han in a piecemeal manner. Mr. Reynolds informed the Planning C mmission that the master plan amendment could be before the Pla ning Commission this year. The staff is completing a study a this time which includes housing and other issues. ON MOTION BE KERINS SECOND BY BAZIL, ZONE CASE NO. 72-34 WAS APPROVED FOR THE FOLLOWING REASONS, BY THE FOLLOWING ROLL CALL VOTE: 1. The zone change'conforms to good planning principles. 2. It was the consensus of the Commission that staff should as considerable time and work could he saved by processing master_ plan_amendments concurrently with the zone case. Lockhart The request is to allow the construction of a commericial equine stable in the RA-0 Residential Agricultural District combined with oil production on property located on the east side of Edwards Street, commencing 825 ft. south of the centerline of Ellis Avenue. The Acting Secretary stated that a map showing the equine trails and stable inventory was posted for information of the Commission, and informed the Commission that Tom Severns, Environmental Resources Director for the City has stated that the proposed use is compatible with the proposed Phase III of the Central City y_Paxk.. _ The Chairman opened the public hearing. Mrs. Pat Lockhart, wife of the applicant, addressed the Commission and stated that the barns will be upgraded from the original plan and will be 13 ft. x 12 ft. 8 in. in size and that back flow prevention valves will be installed in the water system lines. There being no one further present to speak, the Chairman closed the public hearing. In response to inquiry by the Commission, Norm Worthy, Direttor of Recreation and Parks Department, stated that the proposed use would not be incompatible with a golf course which is the planned use of Phase III park property. During the course of discussion it was determined that the stable is not adjacent to an equine trail, and that additional acreage will be'required for a riding area to meet the require- ments of the code. Mr. Joseph Lockhart, applicant, addressed the Commission and stated that he proposes to build and operate a first class stable, unlike any presently in the city. He has a five year lease on the property with an option for additional periods because of the improvements planned, five years is the minimum period for amortization of the investment. He further stated that he is able to arrange for the additional acreage required to satisfy code requirements. ON MOTION BY KERINS USE PEF11IT NO. 72-65 WAS CONTINUED TO NOVEMBER 7, 1972. FOLLOWING DISCUSSION, THE SECOND WAS WITHDRAWN AND THE MOTION FAILED. ON MOTION BY HIGGINS SECOND BY BAZIL, USE PERMIT NO. 72-65 WAS APPROVED WITH THE FOLLOWING CONDITION, BY THE FOLLOWING ROLL CALL VOTE: , 1. Use Permit No. 7r2-65 shall become null and void on October 17, 1977. 2. Additional adjacent acreage must be provided by the applicant to conform to the code requirement in lieu of the stable not being located adjacent to an equine trail. Planning Commission Tuesday, October 17, 1972 Page 10 ORAL COMMUNICATION: TRACT NO. 7850 Mr. Milton R. Beychok, a resident of Huntington Harbour, addressed the Commission in regard to the Planning Commission approval of Tentative Tract No. 7850 and Use Permit No. 72-26 granted to the Huntington Harbour Corp, for construction of a planned residential development. Mr. Beychok requested the Planning Commission to rescind approval of Tentative Tract No. 7850 and that all permits already granted be suspended until such time as the City prepares, circulates and holds public hearings on an adequate environmental impact statement. Mr. Beychok submitted the following items and requested that they be made a part of the record: 1. Statement read to the Commission. 2. Stanford Research Institute -,Preparation of Environmental Impact Analysis - A Model Proposal. 3. EDF V. Coastside County Water District. 4. California Environmental Quality Act of 1970. Following discussion by the Commission, the matter was referred to the City Attorney for an opinion as to the authority of the Planning Commission to take such action as requested by Mr. Beychok. REVIEW Proposed Amendments to Article 974 and 998, Park and Recreational Facilities The Acting Secretary stated that the Commission had received copies of staff reports and statistical data relating to the proposed code amendment as well as a report on open space requested by the Commission. Norm Worthy, Director of Recreation and Parks, addressed the Commission and stated that the Recreation and Parks Commission has reviewed the proposed amendment and unanimously approved the amendment as presented, based on Deputy City Attorney Dan Whiteside's recommendation that League of California Cities model ordinance be closely followed. Commission discussion followed.
