BOARD MEMBERS PRESENT: Spencer, McFarland, Palin BOARD MEMBERS ABSENT: None REGULAR AGENDA ITEMS FOR PUBLIC HEARING: ADMINISTRATIVE REVIEW NO. 72-85 - Continued Applicant: Harold D. McClard To permit the construction of a real estate office with facilities for parking. In Conjunction With DIVISION OF LAND NO. 72-27 - Continued Applicant: Harold D. McClard To permit the creation of two existing lots by readjustment of property lines. The subject property is located on the southeast corner of Springdale Street and Bolsa Avenue in the C2 Community Business District. Mr. McClard, the applicant, had submitted development plans to the staff as requested by the Board at a previous meeting. The Board indicated that the street frontage on both parcels would have to be developed. They further discussed landscaping as required by Article 979, the perimeter wall, and driveway approaches. A revision was made to the plan for the driveway on the west side of the property along the Springdale frontage. A MOTION WAS MADE BY PALIN AND SECONDED BY SPENCER TO APPROVE ADMINISTRATIVE REVIEW NO. 72-85 WITH THE FOLLOWING CONDITIONS: 1. The plot plan received October 12, 1972 shall be the approved layout. 2. Bolsa Avenue and Springdale Street shall be dedicated and fully improved to City standards at the time said parcel is developed. Improvements shall include street trees, street signs, street lights, fire hydrants, sewer and water main extensions. 3. Water supply shall be through the City of Huntington Beach's water system. 4. Sewage disposal shall be through the City of Huntington Beach's sewage system. S. The water, sewer, and fire hydrant system shall be approved by the Department of Public Works and Fire Department. 6. The property shall participate in the local drainage assessment district. 7. Said plan shall be approved by the Board of Zoning Adjustments. 11. A masonry wall shall be constructed along the east and south property lines. The height of said wall shall be such that the top will be six (6) ft. above the highest ' ground surface within twenty (20) f t. of the common property line. 12. No structures,*other than those shown on the approve plot plan, shall be constructed within the project. 13. All applicable City Ordinances shall be complied with. 14. A Division'of Land application, separating this parcel from the remaining property held under the same ownership shall be filed with the City, approved and recorded. 15. Signs shall -be referred to the Board of Zoning Adjustments for approval action. 16. Rooftop mechanical equipment shall be screened from view. A FURTHER MOTION WAS MADE BY PALIN AND SECONDED BY SPENCER TO APPROVE DIVISION OF LAND NO. 72-27 WITH THE FOLLOWING CONDITIONS: 1. The plot plan received September 7, 1972 shall be the approved layout. 2. Bolsa Avenue and Springdale Street shall be dedicated and fully improved to City standards at the time each parcel is developed. Improvements shall include street trees, street lights, street signs, fire hydrants, sewer and water main extensions. 3. Water supply shall be through the City of Huntington Beach's water system at the time each parcel is developed. 4. Sewage disposal shall be through the_Ci__ty of Huntington Beach's sewage system at the time each parcel is developed. 5. Groth To permit the construction of a parking lot to be utilized in conjunction with an existing automobile sales agency pursuant to S. 9472.1 of the Huntington Beach Ordinance Code. In Conjunction With DIVISION OF LAND NO. 72-31 Applicant: Jack E. Groth To permit the creation of two lots from one existing lot. The subject property is located approximately 350 ft. north of Taylor Avenue and 330 ft. west"of Beach Boulevard in the C4 Highway Commercial District. The hearing was opened to the audience. Mr. Jerry Bryan, representing the applicant addressed the: Board and explained the request. Mr. Bryan presented a sketch of the property lines and parcels. The access to Beach Boulevard through both parcels and the driveway was revised on the plans. It was established by the Board that the use of the property would be through a lease and access would be through the agency itself. The suggested conditions of approval were discussed along with the recording of the easement and how the existing house on the property would be affected. The Board expressed a need for a plan delineating easements and the property to the south and adjacent to the proposed use. Joann kleinpeter, 7812 Taylor Avenue, Huntington Beach, addressed the Board and explained the problem of the additional use and parking on Taylor Avenue when the agency was unloading new cars. The members of the Board suggested that Mr. Bryan meet with the staff to discuss the various problems and plans for the proposed use. A MOTION WAS MADE BY MCFARLAND AND SECONDED BY PALIN TO CONTINUE USE PERMIT NO. 72-72 AND DIVISION OF LAND NO. 72-31 TO NOVEMBER 1, 1972 TO ALLOW THE APPLICANT TIME TO MEET WITH THE STAFF. ROLL CALL VOTE: AYES: Spencer, McFarland, Palin NOES: None THE MOTION CARRIED. CONDITIONAL EXCEPTION NO. 72-90 Applicant: C. Thomas Mallos To permit the construction of carports for a proposed 22 unit apa'rtment complex with zero side and rear yard setbacks in lieu of S. 9166.2, 9163.2.1. and 9165.3 (c), of the Ordinance Code. -3- 10/18/72 - BZA Board of Zoning Adjustments October 18, 1972 Page 4 In Conjunction With USE PERMIT NO. 72-69 Applicant: C. Thomas Mallos To permit the construction of a 22 unit apartment complex pursuant to S. 9162.3.1 of the Ordinance Code. The subject property is located on the east side of Florida Street, approximately 180 ft. south of the intersection of Florida and Utica Streets in the R2 Medium Density Residential District. The hearing was opened to the audience. Mr. Mallos, the applicant, addressed the Board and described his units as including balconies and a large recreation area with a pool. The Board expressed the need for elevations, and explained that the current plot plans were short by one guest parking space on -site as required by Code. Landscaping requirements were discussed with the applicant. The Board suggested Mr. Mallos provide a 2 ft. planter adjacent to the building at the driveout and landscape the northeast corner of the property. Mr. Lauter, representing the church to the south and immediately adjacent to the applicant's property presented a letter to the Board in opposition to the use. It was suggested by the Board that a fence could be built at the south property line to separate the uses. There being no further comment, the hearing was closed. A MOTION WAS MADE BY PALIN AND SECONDED BY SPENCER TO APPROVE USE PERMIT NO. 72-69 WITH THE FOLLOWING CONDITIONS: 1. A revised plot plan shall be submitted prior to issuance of building permits. 2. Florida Street shall be dedicated and fully improved to City standards at the time each parcel is developed. Improvements shall include street trees, street signs, street lights, fire hydrants, sewer and water main extensions. 3. Water supply shall be through the City of Huntington Beach's water system. 4. Sewage disposal shall be through the City of Huntington Beach's sewage system. S. A 6 ft. high masonry wall shall be constructed along the east 145 ft. of the south property line. The remainder of the south property line shall be fenced with any suitable material. The carport construced at 0 ft. setback shall be constructed of maintenance -free material not to exceed 9 ft. in height. ADMINISTRATIVE REVIEW NO. 72-94 Applicant: Huntington Beach Industrial Park To permit the construction M=1. multi -purpose industrial and storage units; a zero side yard adjoini4g contiguous M1-A properties; and a sixteen foot high wall between buildings at various points along the perimeter of the property pursuant to S. 9Sll of the Ordinance Code. In Conjunction With CONDITIONAL EXCEPTION NO. 72-91 Applicant: Huntington Beach Industrial Park To permit the construction of multi -purpose industrial and storage units with a zero side yard setback in lieu of 15 ft. as required by S. 9513.3 of the Ordinance Code. The subject property is located between McFadden Avenue, Product Lane, and Research Drive in the 100-M1-A-20,000 District. -5- 10/18/72 - BZA Board of Zoning Adjustments October 18, 1972 Page 6 The hearing was opened to the audience on Conditional Exception No. 72-91. Mr. Byron Tarnutzer, the representative from Huntington Beach Industrial Park, addressed the Board. Mr. Carl Duncan, Deputy Fire Marshall maintained that the Fire Department would require a driveway at the southeast end of the property. The Board reviewed various possibilities for creating the access with the applicant. It was further noted that a minimum of 25 ft. to 30 ft. would be required for gating at the entrance to the complex. Sidewalks, approaches, and curbs for the facility were reviewed along with the materials to be used in the complex itself and in the proposed signing. There being no further comment, the hearing was closed. A MOTION WAS MADE BY PALIN AND SECONDED BY MCFARLAND TO APPROVE ADMINISTRATIVE REVIEW NO. 72-94 WITH THE FOLLOWING CONDITIONS: 1. A revised plot plan shall be submitted prior to issuance of building permits. 2. All conditions of approval for Tract 7999 shall be complied with and Tract 7999 shall be recorded prior to issuance of building permits. 3. McFadden Avenue, Product Lane, and Research Drive shall be dedicated and fully improved to City standards at the time each parcel is developed. USE PERMIT NO. 72-71 Applicant: Larwin-Southern California Incorporated To permit the construction of a private recreation area pursuant to S. 9161.3.4, of the Ordinance Code. The subject property is located within Tract 7596 which is bounded on the north by Garfield Avenue and Newland Avenue on the west in the R2 Medium Density Residential District. Mr. Dave Arntz, representing the applicant addressed the Board and explained the recreation facility in relation to the lot orientation and the revisions. that would occur in Tract 7596. It was noted that the changes in the tract would have to be reviewed by the Planning Commission. The Board discussed the type of fencing required for such a facility and available parking immediately adjacent. Michael'Duffy 7-7- 10/18/72 - BZA Board of Zoning Adjustments October 18, 1972 Page 8 To permit the construction of a rectory pursuant to S. 9811.4 and S. 9811.4.1 of the Ordinance Code. The subject property is located on the east side of Springdale Street approximately 200 ft. north of Heil Avenue in the R1 Low Density Residential District. The hearing was opened to the audience. Reverend Michael Duffy, the applicant, and Ted Bartlett, his representative, addressed the Board. The Board reviewed the original parking, plans, and conditions of approval for the prior Plot Plan Amendment No. 70-1 with the applicant. There being no further comment, the hearing was closed. Improvements shall include street trees, street signs, street lights, fire hydrants, sewer and water main extensions. 2. Water supply shall be through the City of Huntington Beach's -water system. 3. The sign was found to be contrary to Code requirements as it incorporates flashing lights and projects over the front property line. The Board reviewed the sign proposal, however, the location of the store within the shopping center was unclear. The applicant shall comply with S. 9730.25.4 of the Huntington Beach Ordinance Code. 2. The feature sign is to be a minimum of 60 f t. on center. 3. Use Permit No. 71-64 - Review of revised plot plan Applicant: Signal Oil and Gas Company The Board reviewed and approved the relocation of the office structure to the other side of the driveway. Conditional Exception No. 72-21 Applicant: Daylin, Inc. The applicant had requested by letter that his application be withdrawn. A MOTION WAS MADE BY PALIN AND SECONDED BY SPENCER TO ACCEPT THE APPLICANT'S REQUEST FOR WITHDRAWAL. ROLL CALL VOTE: AYES: Spencer, McFarland, Palin NOES: None THE MOTION CARRIED. Use Permit No. 71-59 - Review of Landscaping Revision Applicant: Atlantic Eneineering The Board reviewed the request by Standard Oil Company for deletion of the planter next to the pump island on Edinger Avenue. It was felt that since it was a condition of approval it would be in the best interest of the City to deny the request. SPECIAL EVENTS: Turkey Shoot by Indian Guides The proposed event requested - by the YMCA Indian Guides to have a turkey shoot was reviewed by the Board. The Police Department had.submitted a memo to the Board recommending approval of the event. Recommendation for approval was made by the Board members with the following conditions: 1. Proper guidance shall be provided during the activities. 2. Police supervision shall be maintained. 3. Sufficient parking shall be provided by the applicant.
