ON MOTION BY KERINS SECOND BY WALLIN, THE MINUTES OF
OCTOBER 17, 1972 WERE APPROVED AS CORRECTED, BY THE

ZONE CASE NO. 72-35
Applicant: Huntington Beach Company
A request for a change of zone on approximately 48 acres of
land from M2-02 Industrial District combined with oil produc-
tion to RA-02 Residential Agricultural District combined with
oil production.
The property is located at the southwesterly corner of
Goldenwest Street and Garfield Avenue.
Commissioner Higgins stated that he would abstain from
voting on this matter.
The Chairman opened the public hearing.
Mr. Bill Wren, Huntington Beach Company, was present to
answer any questions. He stated that the staff report
accurately states the history of the request. It is pro-
posed that a wholesale nursery will be located on approxi-
mately seven acres of the property; the request however,
covers the entire 48 acre parcel.
The Acting Secretary stated that no off -site improvements
are required for the wholesale nursery if the property is
to be rezoned RA-02.
There being no one further present to speak, the Chairman
closed the public hearing.
There was discussion by the Commission as to the reason for
requesting a rezone of the entire parcel. It was explained
that the RA District is basically a holding zone. The area
will be master planned and rezoned by July 1973. The
applicant stated that he had no objection to rezoning only
the seven acre parcel on which the wholesale nursery is to
be located.
ON MOTION BY KERINS SECOND BY BOYLE, ZONE CASE NO. 72-35

ZONE CASE NO. 72-36
Applicant: Charleen Franzen
A request for a change of zone from RA-0 Residential
Agricultural District combined with oil production to
M1-0 Light Industrial District combined with oil production.
The property is located east of Goldenwest Street, 155 feet
north of Garfield Avenue.
The Chairman opened the public hearing.
Mr. Grady Van Houser, owner of the property, addressed the
Commission and spoke in favor of the proposed zone change.
There being no one further present to speak, the Chairman
closed the public hearing.
The Acting Secretary stated that depending on the use,
either a use permit or an administrative review will be
required.
Commissioner Wallin expressed concern about leaving an
adjacent parcel zoned RA. Commissioner Porter expressed
concern about the appearance of property fronting on
Goldenwest Street in the proximity of the Central City
Park. There followed discussion by the Commission concern-
ing the "0" suffix and the Acting Secretary explained that
deleting the "0" would allow existing oil operations to
continue but would prohibit new oil operations or the
redrilling of existing wells.
A vu-graph of the property was shown.
The Acting Secretary stated that the Planning Commission
will probably be reviewing the Master Plan on the area
about January 1973, and that several zone changes have
been made in this area based on the proposed Master Plan.
ON MOTION BY BOYLE SECOND BY KERINS, ZONE CASE NO. 72-36
WAS APPROVED CHANGING THE ZONE TO M1-A FOR THE FOLLOWING
REASON, BY THE FOLLOWING ROLL CALL VOTE:
1. The change of zone to Ml-A conforms to the
Master Plan.

There was discussion by the Commission of the need
to review various land uses at the end of six months
to determine whether there has been compliance with
conditions of approval. This subject is to be
placed on the agenda for discussion by the Planning
Commission at the November 14 study session.

to extend the Civic District in the area of Huntington
Central Park. This subject is to be placed on the

SITE PLAN NO. 72-2
Applicant: Broadway -Hale Department Stores
The request is to permit an on -sale beer and wine
license pursuant to Section 9430.6 of the Huntington
Beach Ordinance Code in the C2 Community Business
District. The property is located at the corner
west of Beach Boulevard and north of Edinger Avenue.

SITE PLAN NO. 72-3
Applicant: Saul Sher
The request is to permit on -site consumption of alcoholic
beverages pursuant to Section 9430.6 of the Huntington Beach
Ordinance Code. The property is located at the northeast
corner of Springdale and Edinger Avenue.
Commissioner Kerins inquired as to State law governing the
on -site sale of alcoholic beverages as it relates to
distances from schools.
The Acting Secretary explained that there is no State law
governing the distance, however, the Alcoholic Beverage
Control Board guideline is 200 yards for on -sale and 600 yards
for package liquor, and that this application must still be
approved by ABC.
There was discussion of the proposed expansion of the restaurant
and Jim Palin stated that additional landscaping will be re-
quired on the property when the addition is made.

DISCUSSION
Huntington Beach Company Master Plan
A request of the Huntington Beach Company to rezone approximately
104 acres located northwesterly of the Huntington Seacliff
Country Club was discussed and the Acting Secretary stated
that the Commission may wish to consider an amendment to
the Master Plan concurrently with the request for zone change
which is set for public hearing on November 21.
It was the consensus of the Commission that additional
information should be reviewed such as the layout, potential
population density, effect on schools, and traffic for the
entire Seacliff project.
The Acting Secretary stated that additional time will be
required to prepare this information and that a continuance
of the zone case may be necessary.

The Acting Secretary stated that additional information on the
total Seacliff project will be requested from the Huntington Beach
Company and the staff will proceed with preparing projections for the
Commission's consideration. Mr. Harlow also stated that it will
probably not be possible to have all the information available for
a hearing on November 21, 1972 and that if the applicant concurs,
the hearing will be scheduled for December 5, 1972.
ON MOTION BY BOYLE SECOND BY WALLIN, STAFF WAS DIRECTED TO
BRING ZONE CASES INVOLVING TEN OR MORE ACRES REQUIRING A CHANGE
IN THE MASTER PLAN TO THE PLANNING COMMISSION PRIOR TO STAFF
SETTING A PUBLIC HEARING. FOLLOWING DISCUSSION THE MOTION
WAS AMENDED TO INCLUDE ALL ZONE CASES REQUIRING A CHANGE IN
THE MASTER PLAN. THE MOTION AS AMENDED WAS APPROVED BY THE
FOLLOWING ROLL CALL VOTE:

CODE AMENDMENT NO. 72-11 - M1-A DISTRICT
Code Amendment No. 72-11 in the M1-A District provides for
variation in the yard requirements, establishes procedures
for review of truck and rail loading facilities and amends
landscaping requirements of off-street parking facilities
(Article 979).
The Acting Secretary stated that this proposed amendment has been
in process for some time, that it has previously been discussed
by the Commission and reviewed by the Chamber of Commerce.
Commissioner Wallin questioned the need for the code amendment.
The Commission briefly reviewed the history of the code amend-
ment. Requests of this nature have previously been reviewed
by the Board of Zoning Adjustments. Commissioner Wallin inquired
as to whether the Industrial Committee, composed of members of the
Chamber of Commerce, Commission and City Council had reviewed the
amendment. Commissioner Slates stated that the committee to which
she referred was established to promote industrial development
rather than to review matters such as this.

ON MOTION BY KERINS SECOND BY BOYLE, COMMISSION DIRECTED
THAT CODE AMENDMENT NO. 72-11 AS AMENDED BE SET FOR
PUBLIC HEARING BY THE FOLLOWING ROLL CALL VOTE:
AYES: Slates, Bazil, Kerins, Porter, Wallin, Boyle, Higgins

DISCUSSION
Setback Reauirements in Industrial Areas
Commissioner Slates introduced discussion concerning
the 45 ft. setback requirement in industrial areas and
stated that he is convinced that this is not in the best
interest of the city; that a 10 ft. setback with no doors
or windows would best serve the city in those areas abutting
residential development. There was discussion by the
Commission as to the noise problems and the possible need
for updating some of the commercial and industrial zones with
this factor in mind. Commissioner Wallin volunteered to
check out some of the problem areas and report back to the
Commission.
Dan McFarland, Building Department, stated that the only
real answer to alleviating this type problem is to have a
buffer of a different land use between residential and
industrial zones.
DISCUSSION
Article 931 - Proposed Code Amendment No. 72-28
Planned Residential Developments
The Acting Secretary stated that this Code Amendment is set
for public hearing on November 14, 1972.
There was a brief review of the proposed amendment and some
further changes and corrections were made. These will be
incorporated into the amendment prior to the public hearing.
DISCUSSION
Proposed Amendments to Article 974 and 998 - Park and
Recreation Facilities
The Acting Secretary stated that this Code Amendment is
set for public hearing on November 14, 1972.
There was discussion by the Commission concerning present
policy of allowing credit for certain recreation facilities
and staff was requested to obtain a recommendation from
the City Administrator relative to the amount of park
credit that should be given for special facilities such as
golf courses and public waterways.
Mr. Bill Wren, Huntington Beach Company, briefly addressed
the Commission discussing the philosophy of what is public,
what is not.
Mr. Ken Reynolds, Planning Director, stated that the City
Administration is now establishing a six year capital improve-
ments program and that Tom Severns, Environmental Resources
Director, and Norman Worthy, Recreation and Parks Director,
have been assigned responsibility to develop a cost analysis
of maintenance of parks, and to evaluate the city's ability
to maintain these facilities.

MISCELLANEOUS
Tract No. 7850 - Huntington Harbour Corp.
The Acting Secretary stated that a memorandum has been received
from the City Attorney's office concerning Tract No.7850 and
that copies have been provided each Commissioner.
The Chairman directed that Mr. Milton Beychok be provided a
copy of the memorandum from the City Attorney.
There followed discussion as to the construction activities
taking place in the area of Tract No. 7850 and whether or not
this work is within the scope of the permits issued. Staff will
investigate and determine whether there is any v�.olation, in
which case, action will be taken by the enforcing department.
Commissioner Wallin reported that she attended the meeting of
the Water Quality Control Board hearing on Tract No. 7850 and
that a decision by that board has been deferred until response
is received to an inquiry to the Huntington Harbour Corp. Staff
will obtain a copy of the Board's letter of inquiry and will be
prepared to comment to the Commission. Questions raised by the
Water Quality Control Board were: What role, if any, will the
City of Huntington Beach assume regarding water quality in the
harbor and does the City of Huntington Beach accept this
responsibility?
Commissioner Wallin again inquired as to when the Corps of
Engineers will be conducting a hearing on the matter of
Tract No. 7850 and was informed by the Acting Secretary that
Mr. H. McK. Roper, Jr. of the Corps of Engineers has stated
by letter that the City will be notified when a hearing is
scheduled.
Request for Study of Land Use - Mr. Robert Zinngrabe

The Acting Secretary stated that a letter has been received from
Mr. Robert Zinngrabe requesting a study of property within
Study Area 5 of the Master Plan. This will be scheduled for
discussion at the November 14 Commission study session.
Environmental Impact Statements for Subdivisions
The subject of environmental impact statement requirements for
subdivisions will be scheduled for discussion by the Commission
at the November 14 study session.
Bicycle Trails
Commissioner Boyle requested that the proper department in-
vestigate the possibility of constructing an asphalt strip for
use as a bicycle trail on the west side of Magnolia Street north
of Edison High School to alleviate what is a dangerous condition.
Request for Pedestrian Crosswalk
Commissioner Boyle requested that a cross walk be provided be-
tween Edison Park and Edison School.
Staff will bring this matter to the attention of the appropriate
city department.
Grading Activities - Signal Landmark Corp
Commissioner Kerins requested a review of the grading activities
of Signal Landmark Corp. in the Bolsa Chica area.
This matter will be scheduled for the November 14, 1972 study
session of the Commission.
