REGULAR AGENDA ITEMS FOR PUBLIC HEARING:
USE PERMIT NO. 72-71 - Continued
Applicant: Larwin-Southern California Inc.
To permit the construction of
a private recreation area pursuant to S. 9161.3.4, of the
Huntington Beach Ordinance Code located within Tract 7596
which is bounded on the north by Garfield Ave. and Newland
Ave. on the west in the R2 Medium Density Residential
District.
The hearing was opened to the
audience. Mr. Gerald Wahlstrom and Mr. Rick Macklin,
representatives of the applicant, and Mr. Paul Byrnes,
Toups Engineering, addressed the Board.
It was noted that this item had
been continued from.a previous meeting to allow time for
an evaluation of the parking spaces needed for a rec-
reation facility. The staff established that an average
of 12 to 15 spaces would be needed including street park-
ing.. The Board examined the orientation of the recreation
areas in the subdivision. It was felt by the Board that
the northerly facility would create problems because of
parking layout. Larwin agreed to withdraw the request
for this area.
Upon further investigation of the
plans it was found that the southern facility was de-
ficient in parking spaces which could be picked up on -
site. It was suggested that a condition of approval could
require additional parking if the traffic engineer so
designates, however, a plan with less than four on -site
parking spaces could not be accepted.
Landscaping as required by Code
was discussed, and the Board requested the applicant to
submit renderings.
There being no further comment,
the hearing was closed.
Board discussion followed.
A MOTION WAS MADE BY MCFARLAND
AND SECONDED BY PALIN TO APPROVE USE PERMIT NO. 72-71
WITH THE FOLLOWING CONDITIONS:
1. The plot plan received October 30, 1972 shall be the
approved layout.
2. There shall be a minimum of four on -site parking spaces
with no more than two spaces together and each area
for parking shall be separated with landscaping.
3. The lighting in the tennis court shall have an auto-
matic shut-off at 10:00 P.M.
4. A landscaping plan shall be submitted to the Board of
Zoning Adjustments for approval action, and shall
provide trees along the home sites.
S. Facilities for bicycles and storage shall be provided
in the recreation area.

Applicant: Toups Engineering
To permit a model homes complex
for Tract No. 7991 pursuant to S. 9730.25.4 of the Ordinance
Code, located on the south side of Yorktown approximately
100 ft. east of Newland Avenue in the R1 Low Density Resi-
dential District.
Mr. Paul Byrnes, a representative
of Toups- Engineering, addressed the Board and presented
revised plans.
In reviewing the plans, the model
on lot No. 49 proved to be lacking sufficient open space
as required by Code. Code requirements for open space,
and the layout of the complex were discussed. They further
reviewed a map showing future models for the development.
A MOTION WAS MADE BY PALIN AND
SECONDED BY MCFARLAND TO APPROVE ADMINISTRATIVE REVIEW
NO. 72-104 WITH THE FOLLOWING CONDITIONS:
1. Signing for the complex shall be reviewed by the Board
of Zoning Adjustments for approval action.
2. Lots 44 through 47 as shown on the tentative map shall
be included within the complex for future model homes,
and a revised plot plan designating such shall be sub-
mitted to the Board.
3. Sec. 9730.25.4 of Huntington Beach Ordinance Code shall
be complied with.

ing building for use as a retail produce market pursuant to
S. 9472.1 of the Ordinance Code, located on the east side of
Beach Blvd. approximately 650 ft. south of Heil Avenue in the
C4 Highway Commercial District.
The hearing was opened on Use Permit
No. 72-70. Mr. Hoshide, the applicant, addressed the Board.
It was noted that the use permit
application had been continued to be heard concurrently
with the division of land application.
The Board found, while reviewing
the plans, that the parking conformed with on -site parking
requirements but revisions would have to be made on the
striping and the landscaping. They further reviewed the
suggested conditions of approval and discussed the location
of the driveways.
There being no further comment,
the hearing was closed.

SECONDED BY SPENCER TO APPROVE DIVISION OF LAND NO. 72-37
WITH THE FOLLOWING CONDITIONS:
1. The plot plan received October 31, 1972 shall be the
approved layout.
2. Beach Boulevard and Terry Street shall be dedicated
and fully improved to City standards at the time each
parcel is developed. Improvements shall include street
trees, street signs, street lights, fire hydrants,
sewer and water main extensions.
3. Water supply shall be through the City of Huntington
Beach's water system.
4. Sewage disposal shall be through the City of Huntington
Beach's sewage system.
S. The water, sewer, and fire hydrant system shall be ap-
proved by the Department of Public Works and Fire
Department.
6. The property shall participate in the local drainage
assessment district.

Avenue in the R3 Medium High Density Residential District.

right-of-way, and dedication with the applicant.

THE FOLLOWING CONDITIONS:
1. The plot plan received November 8, 1972 shall be the
approved layout.
2. Chapel Lane shall be dedicated and fully improved to.
City standards at the time each parcel is developed.
Improvements shall include street trees, street signs,
street lights, fire hydrants, sewer and water main
extensions.
3. Water supply shall be through the City of Huntington
Beach's water system.
4. Sewage disposal shall be through the City of Huntington
Beach's sewage system.
5. The water, sewer, and fire hydrant system shall be
approved by the Department of Public. Works and Fire
Department.

7. Soil reports as required by the Building Department and
the Department of.Public Works shall be -submitted to
the City prior to issuance of building permits.

by the Board of Zoning Adjustments.
11. A masonry wall shall be constructed along the west.
The height of said wall shall be such that the top will
be six (6) feet above the highest ground surface within
twenty (20) feet of the common property line.
12. There shall be no fence, structure or landscaping
constructed or maintained over 3 1/2 feet high within
.a 10 ft. by 10 ft. triangular area at the intersection
of driveways and streets or within a 25 ft. by 25 ft.
triangular area at the intersection of streets.
13. No structures, other than those shown on the approved
plot plan, shall be constructed within the project.
14. All applicable City Ordinances shall be complied with.

To permit the sale of Christmas
trees pursuant to S. 9730.25.2 of the Ordinance Code,
located at the southwest corner of Beach Boulevard and
Talbert Avenue in the C4 Highway Commercial District.
Mr. Kress, the applicant, addressed
the Board.
The Board discussed code require-
ments for Christmas tree lots and suggested that the
applicant control the driveways onto Talbert Avenue so
as not to have traffic backing directly onto an arterial
highway.

the applicant, addressed the Board and explained the request.
Signing for the proposal was dis-
cussed. The applicant indicated there was no permanent
signing yet proposed.

NO. 72-105 WITH THE FOLLOWING CONDITIONS:

addressed the Board and discussed the channel adjacent
to the property. A previous application on the subject
property, Administrative Review No. 72-41, was reviewed
by the Board.

NO. 72-112 WITH THE FOLLOWING CONDITIONS:
1. The applicant shall file with the City an agreement

To permit a reduction of the
minimum open space dimension of 25 ft. in lieu of
S. 9103.1.1 of the Huntington Beach Ordinance Code,
located on the west side of Magnolia Street approximately
1200 ft. north of Indianapolis Avenue in the R1 Low Density
Residential District.
The hearing was opened to the
audience. Mr. Bill Hossfeld, representing the applicant,
addressed the Board and explained the request.
The Board noted the error in
dimension on lots 82 and 83 as shown on the plans, and
reviewed the calculations submitted on the corner lots. A
lot line adjustment between lots 32 and 31 was suggested to
Mr. Hossfeld, as a 7 i/2 ft. front yard setback is generally
discouraged when it is across the street from a park or
school site. Further discussion of the plans ensued.
The Board then reviewed the open
space provided on the lots, particularly lot 83 at the
corner of Magnolia Street and Vicar Drive. It -was indicated
that the developer has sufficient opportunity to develop
lot 82 within Code requirements by placing a different model
home on it.
There being no further comment, the
hearing was closed.
Board discussion followed, and
plans for a meeting with Mr. Hossfeld were made for further
review of the plans.
