To permit the construction of an office building with a zero side yard setback in lieu of 5 ft. required by Code, S. 9404.3 (c) located on the east side of Main Street approximately 400 ft. south of the intersection of Beach Boulevard in the R5 Office -Professional District. The Board had received a request by the applicant for withdrawal of the subject appli- cation. A MOTION WAS MADE BY PALIN AND SECONDED BY MCFARLAND TO ACCEPT THE APPLICANT'S REQUEST FOR WITHDRAWAL OF CONDITIONAL EXCEPTION NO. 72-92. Board of Zoning Adjustments Wednesday, November 15, 1972 Page 2 REGULAR AGENDA ITEMS FOR PUBLIC HEARING: DIVISION OF LAND NO. 72-34 - Continued Applicant: Business Properties, Inc. To permit the creation of two lots from one existing lot in the C2 Community Business District, located near the intersection of Adams and Magnolia Avenue approxi- mately 210 ft. east of Magnolia and 210 f t. south of Adams Avenue. Mr. Bob Kirkpatrick, representing the applicant, addressed the Board and presented a layout of the proposal. The conditions of approval were considered along with a tentative development plan for the property. Mr. Kirkpatrick then submitted a letter from R. B. Franks, Real Estate Representative, California South Coastal Division, Union Oil Company of California, explaining an exchange in escrow on the subject property. A MOTION WAS MADE BY PALIN AND SECONDED BY MCFARLAND TO APPROVE DIVISION OF LAND NO. 72-34 WITH THE FOLLOWING CONDITIONS: 1. The plot plan received October 13, 1972 shall be the approved layout. 2. Adams Avenue and Magnolia Street shall be dedicated and fully improved to City standards at the time each parcel is developed. Improvements shall include street trees, street signs, street lights, fire hydrants, sewer and water main extensions. 3. Water supply shall be through the City of Huntington Beach's water system. 4. Sewage disposal shall be through the City of Huntington Beach's sewage system. S. The water, sewer, and fire hydrant system shall be ap- proved by the Department of Public Works and Fire Department. 6. The property shall participate in the local drainage assessment district. 7. All utilities shall be installed underground at the time each parcel is developed. 8. All applicable City Ordinances shall be complied with. 9. A Parcel Map shall be filed with the City and recorded prior to framing inspection of any structures on any parcel. 10.. The Division of Land shall not be effective until an agreement is signed and recorded agreeing to the con- ditions listed above. Wilmot To permit the sale of Christmas Trees on a church lot pursuant to S. 9730.25.2 of the Ordinance Code, located at the northeast corner of Springdale Street and Heil Avenue in the R1 Low Density Residential District. The Board reviewed the request. A MOTION WAS MADE BY MCFARLAND AND SECONDED BY PALIN TO APPROVE ADMINISTRATIVE REVIEW NO. 72-113 WITH THE FOLLOWING CONDITIONS: 1. The applicant shall comply with S. 9730.25.2 of the Ordinance Code. 2. The applicant shall also obtain the proper fire permits and conform with all fire and building requirements. ROLL CALL VOTE: AYES: Spencer, McFarland, Palin NOES: None ABSENT: None THE MOTION CARRIED. ADMINISTRATIVE REVIEW NO. 72-116 Applicant: Signal Landmark, Inc. To permit the use of a trailer as a construction office pursuant to S. 9730.25.3 of the Ordinance Code, located at the west side of Magnolia approximately 170 ft. south of Adams Avenue in the R1 Low Density Residential District. Mr. C. M. Brown, representative of the applicant, addressed the Board and explained that the use of the trailer would be a construction and . customer service office. The Board then discussed the plans with Mr. Brown. A MOTION WAS MADE BY PALIN AND SECONDED BY SPENCER TO APPROVE ADMINISTRATIVE REVIEW NO. 72-116 WITH THE FOLLOWING CONDITIONS: 1. The plot plan received October 31, 1972 shall be the approved layout. 2. No signs shall be posted at the facility. 3. The subject application shall be reviewed by the Board of Zoning Adjustments in six months for possible continuance. Small To permit the construction of a temporary carport located at the east side of Delaware Street approximately 600 ft. north of Garfield Avenue in the R5 Office -Professional District. There was no one present to rep - resent the applicant. The Board discussed the plot plans and recommended that a 3 ft. wall be constructed along the south property line. A MOTION WAS MADE BY PALIN AND SECONDED BY SPENCER TO APPROVE ADMINISTRATIVE REVIEW NO. 72-117 WITH THE FOLLOWING CONDITIONS: 1. The structure shall be located as shown on the approved plan received October 31, 1972. 2. All applicable City Ordinances shall be complied with. The Board noted that the area would not necessarily require a 25 ft. pole sign. Discussion of Code requirements for signs ensued. The Planning Department recommended the use of a monument type of sign. The Board directed the acting secretary to check on the wording in the "SS" (Service Station) Ordinance, Article 948, about signing.
