USE PERMIT NO. 72-74 - APPEAL Appellant: Joseph P. Boyle To allow the construction of a professional office building pursuant to S.9472.1 of the Huntington Beach Ordinance Code which is located on the southeast corner of Brookhurst Street and Adams Avenue in the C4 Highway Cormnercial District. The Acting Secretary suggested that the Planning Commission review the Board of Zoning Adjustments action regarding the conditions of approval. Commissioner Boyle stated he feels the conditions of approval should be spelled out in greater detail. The Acting Secretary informed the Commission that the applicant requested continuance to December 5, 1972 to allow time to file an exemption declaration. A MOTION WAS MADE BY BAZIL AND SECONDED BY HIGGINS TO CONTINUE USE PERMIT NO. 72-74 TO DECEMBER 5, 1972 AT THE APPLICANT'S REQUEST. CONDITIONAL EXCEPTION NO. 72-16 Applicant: Robert Stellrecht To permit a division of land into two separate parcels each having 57.5 ft. frontage and 135 ft. in depth located on the north side of Alhambra Avenue, 660 ft. west of Beach Boulevard. The conditions of approval were discussed. The hearing was opened to the audience. Robert Stellrecht, applicant, addressed the Commission and agreed to the suggested conditions. There being no other comment, the hearing was closed. Commission discussion followed. A MOTION WAS MADE BY BAZIL AND SECONDED BY BOYLE TO APPROVE CONDITIONAL EXCEPTION NO. 72-16 UPON THE FOLLOWING CONDITIONS AS AMENDED: 1. TO BE COMPLETED PRIOR TO ISSUANCE OF BUILDING PERMITS: a. Alhambra Avenue shall be dedicated to City standards at the time each parcel is developed. b. The Division of Land shall not be effective until an agreement is signed and recorded agreeing to the conditions listed above. 3. TO BE COMPLETED PRIOR TO FRAMING INSPECTION: a. A Parcel Map shall be filed with the City and recorded prior to framing inspection of any structure on any parcel. 4. TO BE COMPLETED PRIOR TO FINAL INSPECTION: a. All utilities shall be installed underground at the time each parcel is developed. 5. TO BE COMPLETED PRIOR TO ISSUANCE OF A CERTIFICATE OF OCCUPANCY: a. Water supply shall be through the City of Huntington Beach's water system at the time each parcel is developed. b. Sewage disposal shall be through the City of Huntington Beach's sewage system at the time each parcel is developed. c. The property shall participate in the local drainage assessment district at the time each parcel is developed. d. Alhambra Avenue shall be fully improved to City standards or the developer shall enter into an agreement with the City and post a bond guaranteeing such improvements. Improvements shall include street trees, street lights, fire hydrants, sewer and water main extension. e. All applicable City Ordinances shall be complied with. AND FOR THE FOLLOWING REASON: 1. This lot is one of 40 lots in the Boulevard Gardens area that originally had 115 ft. of lot frontage. Most of these lots have been divided, creating two separate lots of,57.5 ft. of frontage - such as this request. Similar divisions have also created one 60 ft. lot and one 55 ft. lot from 115 ft. lot of frontage. Because this area is zoned R2 and the density is determined by net area in each lot, this division of land should not have an adverse effect on the area. The hearing was opened to the audience. Mr. West, one of the owners of subject property, addressed the Commission and explained the proposal. There being no other comment, the hearing was closed. Goddell A prezone on 6.2 acres of land from Al General Agricultural District to C2 Community Business District with a 50 ft. setback from the ultimate right of way line, located on the east side of Bolsa Chica Street 523 ft. south of Los Patos Avenue. The hearing was opened to the audience. Don Goddell, applicant, addressed the Commission and stated that he was concerned with access to his property. Mr. Goddell informed: the Commission that the adjacent property is zoned R1 and present use being of an industrial nature. There being no other comment, the hearing was closed. Commission discussion followed. It was noted that the proposed use can be compatibly included in the overall plan for the area; however, there should be further studies pertaining to the Master Plan of Land Use and arterial highways. Also, the City should coordinate with Signal Properties in reviewing the possibilities of realigning Bolsa Chica Street. The Acting Secretary stated that the staff recommends this item be continued to December 19th in order to allow time for study relating to land use and street alignment. Commissioner Wallin stated she was concerned because said request should be subject to a use permit application. Mrs. Wallin further stated that she feels this case should be continued until such time as provisions are made for a formal review of the proposed use by the city. A FURTHER MOTION WAS MADE BY BOYLE AND SECONDED BY WALLIN TO DIRECT THE STAFF TO PREPARE A CODE AMENDMENT PERTAINING TO THE REQUIREMENT OF RIGHT OF WAY DEDICATION AND IMPROVEMENT OF ALL STREETS ABUTTING AGRICULTURAL USES AND FOR THE STAFF TO SET SAID AMENDMENT FOR PUBLIC HEARING TO BE HEARD AT THE DECEMBER 12th MEETING. ADDITIONAL INFORMATION: The Chairman stated that all applicants are entitled to a decision and that the Commission should be prepared to make this decision when an application is reviewed at the hearing. ZONE CASE NO. 72-37 Applicant: K & W Development Corp. A change of zone on approximately 28.4 acres of land from RA Residential Agricultural District to C4 Highway Commercial District with a 50 ft. setback from the ultimate right of way line and is located approximately 1750 ft. north of Edinger Avenue and east of the Pacific Railroad right of way. Vu-graphs were shown of the subject property. The hearing was opened to the audience. This proposal is consistent with Master Plan for subject property. ROLL CALL VOTE: AYES: Porter, Wallin, Higgins, Boyle NOES: None ABSENT: Kerins, Bazil THE MOTION CARRIED. MASTER PLAN AMENDMENT NO. 72-7 Said Master Plan Amendment was initiated by the Planning Com- mission for a change from low and high density residential to medium density residential. Subject property consists of 104 acres on the north side of Palm Avenue approximately 2300 ft. west of Goldenwest Street. The hearing was opened to the audience. There being no comment the hearing was closed. It was suggested by the Commission that this item be continued to November 28, 1972, since there were only four Commissioners present and Commissioner Higgins abstained from voting on all Huntington Beach's Company items. ZONE CASE NO. 72-39 Applicant: Huntington Beach Company A change of zone on approximately 104 acres of land from R1-0, R3-0, R4-09 R1-01, R3-01 and R4-01 combined with oil production to R2-PD-0 and R2-PD-01 Medium Residential District Planned Development Suffix combined with oil production, located on the northwest side of Palm Avenue as extended 922 + ft. northwesterly of intersection of Palm and Ofelia. It was the consensus of the Commission to continue Zone Case No. 72-39 since it is in conjunction with Master Plan Amendment No. 72-7 and only four Commissioners were'present. Planning Commission November 21, 1972 Page 9 CODE AMENDMENT NO. 72-30 The intent of Code Amendment No. 72-30 is to amend the R4 High Density Residential District by adding Section 9231.1.1 which will permit Planned Residential Development pursuant to Article 932 Planned Residential Developments. The hearing was opened to the audience. There being no comment, the hearing was closed. INFORMATION: The Acting Secretary informed the Commission that the ity ouncil asked the Planning -Commission to initiate a zone change on property at the northwest corner of llth Street and Orange Avenue from C3 to R3. The Acting Secretary reminded the Planning Commission that the City Council should be advised of progress for Town Lot Study, since the moratorium will expire December 18th and that the Council may wish to extend the moratorium. DISCUSSION: Commissioner Wallin suggested that the Commission requests the presence of City Administrator Rowlands, the Building Director, Mr. John Behrens and Mr. Bill Reed, Public Information Officer to attend the Planning Commission Study Session on December 12th to discuss relationship with the Planning Commission and communication.
