To permit the construction of an office building with a zero side yard setback in lieu of 5 ft. required by Code, S. 9404.3 (c), located on the east side of Main Street approximately 400 ft. south of the intersection of Beach Boulevard in the R5 Office -Professional District. The Board noted there were problems with the easements for the proposal and the applicant had requested a continuance. The applicant had filed an exemption declaration with the Environmental Review Board, however the 10 day Public input must transpire before the Board of Zoning Adjustments could act on the subject appli- cations. REGULAR AGENDA ITEMS FOR PUBLIC HEARING: ADMINISTRATIVE REVIEW NO. 72-123 - Continued /f Applicant: Don Pulver To permit a temporary Christmas tree lot pursuant to S. 9730.25.2 of the Ordinance Code located on the south side of Edinger Avenue approximately 150 ft. west of Sher Lane in the C2 Community Business District. This application has been con- tinued to allow the Building Department time to contact the applicant about access to the lot and blockades for traffic control onto Edinger Avenue. As no revised plan - had yet been submitted, the Acting Secretary suggested the Board not take action on the application until such time as the applicant complies with the Board's request for a ,revised plan. 12/6/72 - BZA Minutes: H.B. Lindborg To permit the construction of four unit apartments, located at the east side of 9th Street approximately 50 ft. south of Walnut Avenue in the R4 High Density Residential District. Mr. Clyde Cropper, representing the applicant, addressed the Board and presentdd a floor plan for evaluation of the open space to the units. A MOTION WAS MADE BY PALIN AND SECONDED BY MCFARLAND TO APPROVE ADMINISTRATIVE REVIEW NO. 72-106 WITH THE FOLLOWING CONDITIONS: 1. The applicant shall comply with all applicable City Ordinances. 2. The plot plan received December 6, 1972, for open space shall be the approved layout. 3. The front entry of Unit "C" shall be relocated to afford additional open space area for balcony purposes. Lindborg To permit the construction of four unit apartments located on the west side of loth Street approximately 150 ft. north of Orange Avenue in the R3 Medium High Density Residential District. Mr. Clyde Cropper, representing the applicant, reviewed the patios, open space, and floor plans with the Board. A MOTION WAS MADE BY PALIN AND SECONDED BY MCFARLAND TO APPROVE ADMINISTRATIVE REVIEW NO. 72-107 WITH THE FOLLOWING CONDITIONS: 1.' The plot plan received October 24, 1972 shall be the approved layout. 2. Board of Zoning Adjustments Wednesday, December 6, 1972 Page 4 Mr. Clyde Cropper, a representative of the applicant, reviewed the relation of the court area to the structure and open space. They further discussed parking arrangements for the units after obtaining a bed- room count for the complex. Elevations along with building materials and design of the units were then considered. A MOTION WAS MADE BY MCFARLAND AND SECONDED BY SPENCER TO APPROVE ADMINISTRATIVE REVIEW NO. 72-108 WITH THE FOLLOWING CONDITIONS: 1. The plot plan received December 6, 1972 shall be the approved layout. 2. Open space and orientation shall be as submitted on the approved plot plan. 3. ADMINISTRATIVE REVIEW NO. 72-122 - Continued Applicant: Milton Enterprises To permit the construction and operation of a drive-thru restaurant in an existing shopping center, located on the west side of Brookhurst Street approxi- mately 450 ft. north of Hamilton Avenue in the C2 Community Business District. In Conjunction With DIVISION OF LAND NO. 72-40 Applicant: Brookhurst Assoc. The Board noted that the plans submitted had parking,access, and signing problems, and revised plans had not yet been received from the applicant. It was suggested that the staff contact the applicant to arrange a meeting to coordinate signing, parking, and the division of land. A MOTION WAS MADE BY MCFARLAND AND SECONDED BY SPENCER TO CONTINUE ADMINISTRATIVE REVIEW NO. 72-122 AND DIVISION OF LAND NO. 72-40 TO JANUARY 3, 1973 FOR REVISED PLANS. The Board noted this application would not require an exemption declaration pursuant to a City Council resolution. The applicant discussed with the Board the relation of the waterfront lot to Code requirements for setbacks. It was the consensus of the Board that the applicant shall maintain a maximum drive- way width of 18 ft. There being no further comment, the hearing was closed. A MOTION WAS MADE BY PALIN AND SECONDED BY MCFARLAND TO APPROVE CONDITIONAL EXCEPTION NO. 72-94 WITH THE FOLLOWING CONDITIONS: 1. The applicant shall relocate the house to within 9 ft. of the rear property line to allow for additional front yard setback. 2. The maximum driveway width shall be 18 ft. AND FOR THE FOLLOWING REASONS: 1. The property is an irregularly shaped lot on a cul-de-tac and it would be overly restrictive to require the applicant to move the garage to the south property line for a 20 ft. setback. MISCELLANEOUS: Administrative Review No. 72-146 Applicant: Messnick To permit a temporary Christmas tree lot pursuant to S. 9730.25.2 of the Ordinance Code, located at 16622 Beach Blvd., Huntington Beach, Calif. The Board noted that the property had good access and an excess of parking space. A MOTION WAS MADE BY PALIN AND SECONDED BY SPENCER TO APPROVE ADMINISTRATIVE REVIEW NO. 72-146 WITH THE FOLLOWING CONDITION: The applicant shall comply with S. 9730.25.2 of the Ordinance Code.
