pursuant to S. 9430. Division of Land No. 72-35 is a request
to create three parcels from one existing parcel. Conditional
Exception No. 72-93 is a request to permit the construction
of a separation wall to be located 19 ft. west of the exist-
ing property line of a proposed commercial complex, in lieu
of 5.'9792.1.3 for the purpose of the wall setback to allow
parking spaces related to the proposed complex to be located
adjacent to an existing alley. Subject property is located
at the northeast corner of Stark Street and Beach Blvd. in
the C2 Community Business District.

Mr. Everett Dodge, representing the applicant, was present
and described the proposed project.
Mr. Jim Palin stated that a letter has been received from
adjacent property owners objecting to the proposed wall and
suggesting there would be traffic problems.
Mr. Adolph Lear addressed the Board in opposition to the
project.
Mr. Gordon Combs, a property owner in the area, addressed
the Board in opposition to the project.
Mr. E. Pessek, a property owner in the area, addressed the
Board in opposition to the project.
There being no one further present to speak, the Chairman
closed the public hearing.

Administrative Review No. 72-121 is a request to permit the
construction of a duplex pursuant to S. 9161.2 of the Ordinance
Code on property located on the west side of 21st Street
approximately 80 ft. north of Pecan Avenue in the R2 Medium
Density Residential District.
Mr. Gerald Jones, applicant, was present.
Mr. Jim Palin stated that this project is within the moratorium
area and advised the applicant that the following conditions
would be imposed if the application is approved:
1. If the development standards are amended by the city,
Administrative Review No. 72-121 becomes null and void.
2. If approved, Administrative Review No. 72-121 will be
subject to development standards in effect at the time
building permits are issued.
Jim Palin stated that the applicant would be required to show a
20 ft. alley since the adjacent property is not developed. Mr.
Jones stated he could adjust his plan to do this.

Mr. Jim Palin encouraged the use of material other than grape stake
for fencing.
Mr. Shaffer stated that the fence will be constructed of bat -on-
board.
Mr. Palin stated that regarding open space to the units, Units A
and B are very good. Behind the structure is 102 sq. ft. for Unit
A; but there has been no door provided to enable using it. He
suggested removing the designation of A and B and a rear open space
and leave it undesignated. If the open space is designated, it
should be designated for Units C and D.
Mr. Pat Spencer stated that dedication would be required for a
future curb line development and dedication is required prior to
issuance of building permits.

Use Permit No. 72-80 is a request to permit the operation of a
service station within an existing service station site pursuant
to S. 9480 of the ordinance code on property located on the south-
west corner of Warner Avenue and Newland Street in the C2 Community
Business District.
The Chairman opened the public hearing on Use Permit No. 72-80.
Mr. Carl Rodeheaver, representing'the applicant, was present.
Mr. Jim Palin stated that the plan does not conform to Article 948
in the following areas:
1. The six percent landscaping requirement
2. Screening of restrooms and enclosed areas
3. On site 15 gal. trees
4. The Board of Zoning Adjustments recommends a monument sign
Mr. Palin stated that he had contacted the architect to obtain a
revised plot plan but was unsuccessful in doing so.
Mr. Rodeheaver stated that he can conform to the requirements and
sketched out areas on the plan and stated that a 6 ft. monument
is proposed.
Following discussion it was determined that the applicant will
submit a revised plot plan by Monday noon. It was determined
that the underground tanks are alright as they have been sealed.
Elevations are to be submitted indicating compatability of
monument stone and facing on some surface of the building and
the trash area is to be enclosed with the same material as used
on the building.

ADMINISTRATIVE REVIEW NO. 72-103
Applicant: Jorgen D. Hansen
Administrative Review No. 72-103 is a request to permit construc-
tion of an industrial building pursuant to S. 9530 of the ordinance
code on property located on the east side of Palmdale Street,
approximately 45 ft. north of Cedar Avenue in the M1 Light
Industrial District.
Mr. Jim Palin briefly reviewed the history of the request. A
revised plot plan has been submitted to allow a turning radius and
including garage doors.
It was the Board's suggestion that the 10' X 18' overhead doors
located at the southwest corner of the building be relocated east-
erly between parking spaces No. 67, 68 and 69, to facilitate
turning radius.

Mr. Palin stated that the Board of Zoning Adjustments does not
feel the open space is usable with a wall around it as shown.
The Board suggests providing a gate and a 6 ft. wall to within
five feet of the corner and then step down to 42". This accomp-
lished the turning radius in the alley and on site. The applicant
was advised that the project is within the moratorium area.
