BOARD MEMBERS PRESENT: BOARD MEMBERS ABSENT: McFarland, Lovejoy, Palin None AGENDA ITEMS TO BE CONTINUED OR WITHDRAWN: USE PERMIT NO. 72-86 Applicant: Florida Gardens To permit the construction of a 63 unit apartment complex pursuant to S. 9202.3.1.3 of the Huntington Beach Ordinance Code located on the east side of Florida Street approximately 628 ft. north of Garfield Avenue in the R3 Medium High Density Residential District. The Board noted a conditional exception application would have to be filed with the use permit for carports at a 0 ft. setback. The applicant requested a continuance to January 10, 1973 to have both applications heard concurrently. E. Bingham To permit the interim use of vacant ground for steel storage yard located on the east side of Stewart Street approximately 160 ft. south of Bolsa Avenue. Mr. Bingham, the applicant, addressed the Board, and submitted a letter from Mr. Greer, the previous land owner. Mr. Greer stated that Mr. Bingham would be continuing the existing use only and had no plans to intensify it. The Board noted that no application would be required for a continuance of this'use as it presently exists. Therefore, Mr. Bingham requested a withdrawal of his application. O'Donnell To permit construction of an industrial building for storage in M1 light industrial district located on the east side of Gothard Street approximately 900 f t. south of Edinger Ave. Mr. O'Donnell, the applicant, addressed the Board, and reviewed the parking on the plot plan. He then considered the suggested conditions of approval and the fire access driveways were marked on the plans. The Board discussed traffic circulation with the applicant and mentioned that the driveways would have to remain free and clear to the sky. ON MOTION BY MCFARLAND AND SECOND BY PAL IN ADMINISTRATIVE REVIEW NO.72-114 WAS APPROVED WITH THE FOLLOWING CONDITIONS BY THE FOLLOWING ROLL CALL VOTE: A. TO BE COMPLETED PRIOR TO ISSUANCE OF BUILDING PERMITS: 1. The plot plan received December 4, 1972 shall be the approved layout. 2. Gothard Street shall be dedicated and fully improved to City standards at the time each parcel is developed. 3. The water, sewer, and fire hydrant system shall be approved by the Department of Public Works and Fire Department. 4. Soil reports as required by the Building Department and the Department of Public Works shall be submitted to the City. 5. The vehicular traffic circulation on site shall be approved by the Fire Department. B. TO BE COMPLETED PRIOR TO FRAMING INSPECTION: 1. Fire alarm system conduit and appurtenances shall be installed by the developer at locations and to speci- fications provided by the Fire Department. 2. A landscaping plan shall be submitted to the Board of Zoning Adjustments for approval action. 3. The structural street section of all drives shall be approved by the Department of Public Works. 4. A Parcel Map shall be filed with the City and recorded prior to framing inspection of any structures on any parcel. C. TO BE COMPLETED PRIOR TO FINAL INSPECTION: 1. Improvements shall include street trees, street signs, street lights, fire hydrants, sewer and water main extensions. 2. Board of Zoning Adjustments Wednesday, December 27, 1972 Page 4 CONDITIONAL EXCEPTION NO. 72-95 Applicant: Ponderosa Homes To permit a reduction of 7 ft. into the minimum open space dimension of 25 ft. required by S. 9103.3.1.1 of the Huntington Beach Ordinance Code on 3 lots of a 63 lot subdivision located approximately 276 ft. west of Magnolia Street and 560 ft. south of Atlanta Avenue in the R1 Low Density Residential District. Mr.. John Van, representing the applicant, addressed the Board. The hearing was opened to the audience. Mr. Van presented building plans for the subject lots and reviewed the open space. The Board suggested the applicant readjust the lot lines to insure open space and file a division of land application. There being no further comment, the hearing was closed. The Board noted that lot 55 and 56 did not require a variance as there was an error on the plans, and lot 11 could be made to conform with readjustment of the lot line. ON MOTION BY MCFARLAND AND SECOND BY PALIN CONDITIONAL EXCEPTION NO. 72-95 WAS DENIED BY THE FOLLOWING ROLL CALL VOTE: AYES: McFarland, Lovejoy, Palin NOES: None ABSENT: None USE PERMIT NO. 72-85 Applicant: Ralph J. Cover To permit the construction of an 8 unit apartment complex pur- suant to S. 9162.3.1 of the Huntington Beach Ordinance Code located on the east side of Delaware Street -approximately 330 ft. north of Yorktown Avenue in the R2 Medium Density Residential District. The hearing was opened to the audience. There was no one present to represent the applicant. It was noted by the Board that access as shown on the plans did not conform to provision of the Ordinance Code. The Board suggested the application be continued to allow time for review of the access. The hearing was closed to the audience. ON MOTION BY PALIN AND SECOND BY MCFARLAND USE PERMIT NO. 72-85 WAS CONTINUED TO JANUARY 10, 1972 BY THEJOLLOWING ROLL CALL VOTE: AYES: McFarland, Lovejoy, Palin NOES: None ABSENT: None CONDITIONAL EXCEPTION NO. 72-104 Applicant: Robert E. Mr. Dennis Burnett, adjacent property owner, presented pictures of the patio structure from his property, and requested denial of the application. Mr. Ted Jackson, adjacent property owner, also stated that he would recommend denial as the view from his house was unsightly. There being no further comment, the hearing was closed. ON MOTION BY PALIN AND SECOND BY MCFARLAND CONDITIONAL EXCEPTION NO. 72-104 WAS DENIED FOR THE FOLLOWING REASONS BY THE FOLLOWING ROLL CALL VOTE: The applicant did not show sufficient hardship. Williams To permit the construction of a 20 unit apartment complex pursuant to S. 9202.3.1.3 of the Huntington Beach Ordinance Code located on the south side of Atlanta Avenue airproximately 380 ft. west of Lochlea Lane in the R3 Medium HighDensity Residential District. The hearing was opened to the audience. Mr. Bob Williams, the applicant, reviewed his plans and the suggested conditions of approval. The Board requested the applicant revise his plans before any building permits were issued. There being no further comment, the hearing was closed. Weatherly, U.S. Auto To permit automobile dismantling and parts storage located south of Talbert Avenue, 2000 ft. west of Beach Blvd. in the M1 Light Industrial District. Mr. Paul Weatherly, the applicant, addressed the Board along with his attorney, Mr. Ray Yinger, and explained the type of operation he was requesting. The Board mentioned it could not approve this type of use unless it complied with the Code which would require auto dismantling inside of a building. They further suggested the applicant file a conditional exception with the Planning Commission if any dismantling is to be done outside the building. Discussion of stacking then ensued and the following recommendations were made for the applicant to evaluate. 1. A concrete or black top pad be provided. 2. Increase the width of the driveway. 3. Install an overhead door or two. 4. Plant trees around the periphery. S. Use baked on enamel fencing around the facility. They further suggested Mr. Weatherly amend the plot plans to include the suggestions by the Board and submit them to be reviewed by the Planning Commission. Miller To permit construction of an office building, museum -auditorium, and 20 apartment units in the C4 Highway Commercial District and R2 Medium Density Residential, located.on the west side of Beach Blvd. 500 ft. north of Adams Avenue and consists of 4.62 acres of land. The hearing was opened to the audience. Mr. Stiteler, representing the applicant, addressed the Board and explained the request. The Board requested a reciprocal agreement and plans for the carport design be filed. There being no further comment, the hearing was closed. The hearing was opened to the audience. Mr. Bowers, the applicant, reviewed his plans with the Board and explained that his pool would be too small if it were more than 10 ft. from the front property line. He further stated that the side entry garages on lots adjacent to his property were constructed at the same setback of 10 ft. that was proposed for the pool. There being no further comment, the hearing was closed. To permit the division of one parcel into two parcels. In Conjunction With USE PERMIT NO. 72-87 Applicant: Snyder -Langston, Inc. To permit the construction and operation of an auto sales and service center located on the west side of Beach Blvd. approximately 195 ft. north of Speer Avenue in the C4 Highway Commercial District. The hearing was opened on the use permit application. Mr. Gary Beckman, representing the applicant, submitted revised plans including dimensions and a revised parking layout. The Board requested the applicant provide a landscape buffer along the rear property line and reviewed the fencing_for the facility along with the conditions of approval. There being no further comment, the hearing was closed.
