BOARD MEMBERS PRESENT: Spencer, McFarland, Palin BOARD MEMBERS ABSENT: None AGENDA ITEMS TO BE CONTINUED OR WITHDRAWN: USE PERMIT NO. 72-84 - Continued Applicant: Eugh Shibasaki To permit the construction of a lawnmower shop pursuant to S. 9472 of the' Huntington Beach Ordinance Code located on the southwest corner of Warner Avenue and B Street in the C4 Highway Commercial District. The Board noted the applicant had requested his application be tabled•at this time. ON MOTION BY PALIN AND SECOND BY SPENCER USE PERMIT NO. 72-84 WAS CONTINUED INDEFINITELY AT THE APPLICANT'S REQUEST BY THE FOLLOWING ROLL CALL VOTE: AYES: Spencer, McFarland, Palin NOES: None ABSENT: None CONDITIONAL EXCEPTION NO. 72-97 - Continued Applicant: Turner Realty Investment Company To permit a delay in construction of a required block wall between commercial zoned property and a proposed 80 unit apartment complex located on the south side of Heil Avenue approximately 340 ft. west of Magnolia Avenue in the R3 Medium High Density Residential District. Mr. Turner, the applicant, had requested withdrawal of his application. ON MOTION BY PALIN AND SECOND BY SPENCER APPLICANT'S REQUEST FOR WITHDRAWAL WAS ACCEPTED BY THE FOLLOWING ROLL CALL VOTE: AYES: Spencer, McFarland, Palin NOES: None ABSENT: None CONDITIONAL EXCEPTION NO. 72-96 - Continued Applicant: Addison C. Bowers To permit construction of a wall to within 10 ft. of the front property line in lieu of S. 9104(a) of the Huntington Beach Ordinance Code located on the north side of Edgewater Lane approximately 106 ft. east of. Waverly Lane in the R1 Low Density Residential District. Mr. Bowers, the applicant, addressed the Board. The hearing was opened to the audience. Mr. Bowers presented pictures of the adjacent properties and explained how the setback affected his property. There being no further comment, the hearing was closed. The Board noted the Planning Commission has expressed concern in construction of walls within an established area. However, Minutes: H.B. The Board members felt this request was justifiable to allow a continuity of design. ON MOTION BY MCFARLAND AND SECOND BY PALIN CONDITIONAL EX- CEPTION NO. 72-96 WAS APPROVED WITH THE FOLLOWING CONDITIONS BY THE FOLLOWING ROLL CALL VOTE: 1. The architectural design and wall materials shall be re- viewed by the Board of Zoning Adjustments. AND FOR THE FOLLOWING REASONS: 1. The Wall is approximately 20 ft. in length and is 10 ft. from the property line. 2. Subject wall will not be constructed closer to the front property line than other existing walls. AYES: Spencer, McFarland, Palin NOES: None ABSENT: None ADMINISTRATIVE REVIEW NO. 72-148 - Continued Applicant: Kaino Hamu To permit construction of an industrial building pursuant to S. 9511. In Conjunction With CONDITIONAL EXCEPTION NO. 72-103 - Continued Applicant: Kaino Hamu To permit zero side yard setback in lieu of the required 15 ft. as per S. 9513.3 located on the west side of Commerce Street approximately 261 ft. north of Research Street in a 100-M1-A-20,000 district. The hearing was opened on the conditional exception application. Mr. George Lusk, representing the applicant, addressed the Board. The Board noted revised plans showing parking and landscaping had been submitted and reviewed the suggested conditions of approval with Mr. Lusk. There being no further comment, the hearing was closed. It was the consensus of the Board to require the abutting property to be constructed at a 0 ft. setback or maintain a minimum of 30 ft. from the property line. ON MOTION BY MCFARLAND AND SECOND BY PALIN ADMINISTRATIVE REVIEW NO. 72-148 WAS APPROVED WITH THE FOLLOWING CONDITIONS BY THE FOLLOWING ROLL CALL VOTE: A. TO BE COMPLETED PRIOR TO ISSUANCE OF BUILDING PERMITS: 1. The revised plot plan received January 2, 1973 shall be the approved layout. 2. Soil reports as required by the Building Department and the Department of Public Works shall be submitted to the City prior to issuance of building permits. 3. In Conjunction With DIVISION OF LAND NO. 72-40 - Continued Applicant: Brookhurst Associates To create two lots from one existing lot located on the west side of Brookhurst Street approximately 450 ft. north of Hamilton Avenue in the C2 Community Business District. Mr. James Kent, representing the applicant, addressed the Board. This application had been continued for an exemption declaration and a division of land application to be processed by the City. The Board reviewed the conditions of approval with Mr. Kent and indicated the signing for the facility would have to be a monument type. ON MOTION BY PALIN AND SECOND BY MCFARLAND ADMINISTRATIVE REVIEW NO. 72-122 WAS APPROVED WITH THE FOLLOWING CONDITIONS BY THE FOLLOWING ROLL CALL VOTE: A. TO BE COMPLETED PRIOR TO ISSUANCE OF BUILDING PERMITS: 1. The plot plan received November 3, 1972 shall be the approved layout. 2. The water., sewer, and fire hydrant system shall be approved by the Department of Public Works and Fire Department. 3. The only signs permitted shall be those submitted and approved by the Board of Zoning Adjustments at the time of the original application. B. TO BE COMPLETED PRIOR TO FRAMING INSPECTION: 1. Fire alarm system conduit and appurtenances shall be installed by the developer at locations and to specifications provided by the Fire Department. C. TO BE COMPLETED PRIOR TO FINAL INSPECTION: 1. Brookhurst Street shall be dedicated and fully improved to City and/or State standards at the time each parcel is developed. Improvements shall include street trees, street signs, street lights, fire hydrants, sewer and water main extensions. 2. All utilities shall be installed underground. 3. The plot plans were reviewed along with dedication of property and radius at the corner cut-off and the ends of the property. ON MOTION BY PALIN AND SECOND BY MCFARLAND ADMINISTRATIVE REVIEW NO. 72-130 WAS APPROVED WITH THE FOLLOWING CONDITIONS BY THE FOLLOWING ROLL CALL VOTE: 1. A revised plot plan shall be submitted prior to the issuance of building permits. 2. Pacific Coast Highway and 12th Street shall be dedicated and fully improved to City and/or State standards at the time each parcel is developed. Improvements shall include street trees, street signs, street lights, fire hydrants, sewer and water main extensions. 3. Water supply shall be through the City of Huntington Beach's water system. 4.
