The Acting Secretary informed the Board that he contacted the Welfare Department regarding said application and was informed that the applicant needs new license before said request can be considered. The Acting Secretary informed the Board that he will meet with Dr. Friedman on January 19th to discuss merits of the plan; therefore continuance to January 24th is recommended. Lindborg To permit the construction of a single family three bedroom residence pursuant to S.9161.2 of the Ordinance Code located on the east side of 16th Street approximately 100 ft. south of Palm Avenue in the R2 Medium Density Residential District. The Board reviewed the proposal. It was noted that the plan, as submitted, did not conform to code requirements with regard to lot coverage. Administrative Review No. 72-141 has been continued several times and the applicant failed to submit revised plans. ROLL CALL VOTE: AYES: Spencer, McFarland, Eadie NOES: None THE MOTION CARRIED DIVISION OF LAND NO. 73-1 To create two lots from one existing lot. In conjunction with USE PERMIT NO. 72-85 Applicant: Ralph J. Cover To permit the construction of an 8 unit apartment complex pursuant to S. 9162.3.1 of the Huntington Beach Ordinance Code located at the east side of Delaware Street approximately 330 ft. north of Yorktown Avenue in the R2 Medium Density Residential District. The hearing was opened to the audience. The applicant addressed the Board and explained the proposal. Conditions for division of land were dis- cussed. It was noted that the applicant did not need the use permit application. There being no further comment the hearing was closed. A MOTION WAS MADE BY MCFARLAND AND SECONDED BY SPENCER TO WITHDRAW USE PERMIT NO. 72-85. A FURTHER MOTION WAS MADE BY MCFARLAND AND SECONDED BY SPENCER TO APPROVE DIVISION OF LAND NO. 73-1 UPON THE FOLLOWING CONDITIONS: A. TO BE COMPLETED PRIOR TO ISSUANCE OF BUILDING PERMITS: 1. The plot plan received January 3, 1973 shall be the approved layout. 2. Delaware and England Streets shall be dedicated and fully improved to City standards at the time each parcel is developed. 3. The Division of Land shall not be effective until an agreement is signed and recorded agreeing to the conditions listed above. B. TO BE COMPLETED PRIOR TO FRAMING INSPECTION: 1. Hill To permit an encroachment of 1 1/2 ft. into the required 5 ft. side yard setback in lieu of S. 9103.2.1 of the Ordinance Code located on the east side of Sea Witch Lane approximately 210 ft. north of Finisterre Drive in the R1 Low Density Residential District. The hearing was opened to the audience. Mr. Hill, applicant,'gave his reasons for the request. Mr. Ron Gardner, 16852 Sea Witch Lane, addressed the Board and opposed the request. hearing was closed. There being no other comment the Board discussion followed. A MOTION WAS MADE BY MCFARLAND AND SECONDED BY SPENCER TO DENY CONDITIONAL EXCEPTION NO. 72-108 FOR THE FOLLOWING REASONS: 1. No hardship was shown for said request. 2. The property can be developed to be consistent with adjacent homes. Foxx To permit the construction of a four unit apartment pursuant to S. 9231.6 of the Ordinance Code located at the west side of 19th St. approximately 180 ft. south of Olive Avenue in the R4 High Density Resi- dential District. The Board discussed the suggested conditions of approval. Mr. James Foxx addressed the Board and explained the proposal. Mr. Foxx stated that he will modify the plan, if necessary, to comply with code require- ments. Further discussion was held regarding the dedication of an additional 2 1/2 feet of alley on lots 14 and 16, Block 219. A MOTION WAS MADE BY MCFARLAND AND SECONDED BY EADIE TO APPROVE ADMINISTRATIVE REVIEW NO. 73-1 UPON THE FOLLOWING CONDITIONS AS AMENDED. A. TO BE COMPLETED PRIOR TO ISSUANCE OF BUILDING PERMITS: 1. The plot plan received January 2, 1973 shall be the approved layout. 2. 19th Street and alley shall be dedicated and fully improved to City standards at the time each parcel is developed. 3. The water, sewer, and fire hydrant system shall be approved by the Department of Public Works and Fire Department. 4. Soil reports as required by the Building Department and the Department of Public Works shall be submitted to the City prior to issuance of building permits. 5. Don Fowler, applicant, addressed the Board and explained the proposal. Mr. Fowler further submitted elevations of the proposed development. Board discussion followed. A MOTION WAS MADE BY EADIE AND SECONDED BY MCFARLAND TO APPROVE ADMINISTRATIVE REVIEW NO. 73-2 UPON THE FOLLOWING CONDITIONS: A. TO BE COMPLETED PRIOR TO ISSUANCE OF BUILDING PERMITS: 1. The plot plan received January 3, 1973 shall be the approved layout. 2. Orange Avenue and 21st Street and alley shall be dedicated to City standards at the time each parcel is developed. 3. The required wall abutting the north and east property line shall be of maintenance free masonry materials and shall be architecturally compatible with the pro- posed development. The height of the wall shall not exceed 9 feet. 2. Storage facilities shall be provided within the carport .area per code requirements. AND FOR THE FOLLOWING REASONS: 1.
