Planning Commission Tuesday, February 6, 1973 Page 2 Zone Case No. 72-44 is a request for a change of zone on 2.05 acres of land from RA Residential Agricultural District to R3 Medium High Density Residential District on property located on -the -north side of Ellis Avenue, 348 ft. west of Beach Blvd. The property is master planned medium -high density. The Chairman opened the public hearing on Zone Case No. 72-44. Mr. Barry Zimmerman, representing Covington Brothers, agent for the applicant, was present and addressed the Commission speak- ing in favor of the proposed zone change. Mr. Zimmerman stated that the structures would be built into the slope of the property and would give the appearance of being one story buildings from Ellis Avenue. It was noted that the proposed plan provides access to the property to the north. The Chairman closed the public hearing. If it were held there, it would be hoped that more effective land use relating to the existing commercial would be achieved in the long term. If developed as the appli- cant requests, future residents would be facing on the rear of Denny's, a service station and the Five Points Shopping Center plus any additional commercial developed along Beach Boulevard. MASTER PLAN AMENDMENT NO. 73-2 Initiated by the Planning Commission in conjunction with ZONE CASE NO. 72-48 (Continued from 1/16/73) -- Applicant: Daniel/Webb Construction Co. Master Plan Amendment No. 73-2 proposes a change from Office - Professional to -Low Density Residential on 3.58 acres on the south side of Holland Drive, approximately 260 feet east of Beach Boulevard. Holland Drive has been terminated so that the property no longer relates to the R1 on the east. A change in the master plan and zoning on the property accommodates the applicant but may not be in the long term interests of the city because: 1. The argument that Rl would be a lesser intense use is no longer valid since present R5 zoning does not permit resi- dential. Denial of zone changes from non-residential to residential appears to be one of the few legal tools a city has to limit population. 2. The location is undesirable as an R1 living environment. 3. Property over the long term could conceivalby be developed ds presently master planned and zoned R5 - i.e. nursing home, clinic, etc. - TENTATIVE TRACT NO. 7743 (Continued from 1/16/73) In conjunction with USE PERMIT NO. 72-82 (Continued from 1/16/73) Applicant: J.M.C. Construction Co. Tentative Tract No. 7743 is a request for 16 lots, 15 units on 2.616 acres. Use Permit No. 72-82 is to permit a planned resi- dential development. 3. PC 2/6/73 Minutes: H. B. Planning Commission Tuesday, February 6, 1973 Page 4 The Acting Secretary, Jim Palin, stated that it was the recommenda- tion of the Subdivision Committee that the adjacent parcel of property owned by the City of Huntington Beach be included in the project; that T.M.C. Construction Company acquire the parcel and that it become permanent open space. Slides of the property were show. The Chairman opened the public hearing on Use Permit No. 72-82. Mr. Richard Ashby, representing the applicant, addressed the Commission speaking in favor of the Use Permit. Mr., Richard Jennings, attorney representing property owners on Marina View Drive, addressed the Commission i.n opposition to the use permit stating that the subject parcel is zoned R1 and master planned low density in conformity to the surrounding area, and that the planned development proposed is a departure from the master plan and to allow the development would promote a high - density development and is an example of spot zoning. Further, the two story structures would obstruct the view of residents on Marina View Drive. Mr. Jennings urged the Commission to reject Use Permit No. 72-82 and preserve the R1 property. In,response to a question from Commissioner Boyle, the Acting Secretary stated that South Coast Regional Commission approval is required after approval by the City. There being no one further present to spaek, the Chairman closed the public hearing. Following discussion, it was determined by the Commission that formal authorization by the city should be obtained by the applicant with reference'to the inclusion of the city owned parcel in the application. A motion was made by Kerins second by Wallin to deny Tentative Tract No. 7743 and Use Permit No. 72-82 for the reason that it does not conform to planned residential development standards. Following discussion the motion was withdrawn. Commissioner Bazil objected to the line of garages on Marina View Drive which residents of existing dwellings would have to look at. With all the garages taking entry from Marina View, the street would have the appearance of an alley. Commissioner Wallin stated that there was discussion at the Subdivision Committee meeting concerning the'desirability of lowering the building pads and considering one-story development so that the view of existing residents would not be obstructed. 4. Planningg Commission Tuesday, February 6, 1973 Page 5 Commissioner Kerins suggested the matter be continued and the applicant be requested to modify the plan and submit it to the Subdivision Committee for further review. Commissioner Higgins suggested that for the benefit of the subdivider, clarification of the requested modification be made. Commissioner Bazil stated that he did not want a line of driveways and that possibly a side entry into garages on Marina View could be taken. Commissioner Wallin prefers to see single story con- struction. ON MOTION BY KERINS SECOND BY BOYLE, USE PERMIT NO. 72-82 AND TENTATIVE TRACT NO. 7743 WERE CONTINUED TO MARCH 6, 1973 WITH CONCURRENCE OF THE APPLICANT TO ALLOW A REVISED MAP TO BE RE- VIEWED BY THE SUBDIVISION COMMITTEE PRIOR TO SUBMISSION TO THE PLANNING COMMISSION, BY THE FOLLOWING ROLL CALL VOTE: AYES: Bazil, Kerins, Porter, Wallin, Boyle, Higgins NOES: None ABSENT: Geiger Mr. Richard Ashby, representing th'e applicant, was informed by the Chairman that written consent from the City to include the city owned property in the application must be submitted to the Planning Commission prior to March 6, 1973. Mr. Ashby was further informed that the Subdivision Committee will meet on February 22 or 23 and he should contact the Planning Department for specific information. Mr. Patin, Acting Secretary, advised homeowners present to con- tact the Planning Department for specific information concerning the matter. TENTATIVE TRACT NO. 7771 in conjunction with USE PERMIT NO. 72-91 Subdivider: Meadow Home-s No. 12, o Alpine Civi 1 lingine ar . Tentative Tract No. 7771 is a request to construct an R1-PD on 29.3 acres, 1S8 units, located at the northwest corner of Newland Street and Ellis Avenue in an R1-PD District. The property is master planned for the -Route 39 Freeway. Use Permit No. 72-91 is to permit the development of a single family Planned development. The Acting Secretary stated that the Environmental Review Board had conducted a public hearing on the environmental impact state- S. PC 2/6/73 Minutes: H.B. The final environmental impact report is to be prepared and the Environmental Review Board recommendations will be ready for the Planning Commission consideration on Feb- ruary 21,. 1973. A revised plot plan was posted for Commission's information: Slides of'the area were shown. In response to a question by Commissioner Wallin, Mr. Palin stated that there is no information from the Engineering Department con- cerning the extension of Newland Street at this time. The Chairman opened the public hearing on Use Permit No. 72-91. Mr. Tom Shelton, Alpine Civil Engineers, addressed the Commission speaking in favor of Use Permit No. 72-91. Mr. Shelton stated that if necessary, the Newland Street extension will be modified. Mr. R.E. Walker, a resident in the area and registered engineer, addressed the Commission speaking in opposition to the Use Permit. Mr. Walker's comments related primarily to areas of environmental impact and he was informed that his comments should be directed to the Environmental Review Board immediately so that -they may be considered in the final report. Mr. Shelton stated that the final report is due to be completed by the consultant on February 9, 1973. Mr. Walker expressed concern about the type fencing to be used in the area of the Classic development and the location of garages in the proposed planned residential development in relation to existing homes. Mr. Shelton stated that it is proposed that the area of the midden be seeded with grass and because of previous delays in the develop- ment, he requested that the matter not be continued beyond February 21, 1973. ON MOTION BY KERINS SECOND BY BOYLE, TENTATIVE TRACT NO. 7771 AND USE PERMIT NO. 72-91 WERE CONTINUED TO FEBRUARY 21, 1973 TO ALLOW COMPLETION OF THE FINAL ENVIRONMENTAL IMPACT REPORT AND RIiCOMMENDA- TIONS OF THE ENVIRONMENTAL REVIEW BOARD, BY THE FOLLOWING ROLL CALL VOTE: AYES: Bazil, Kerins, Porter, Wallin, Boyle, Higgins NOES: None ABSENT: Geiger Commissioner Wallin requested that report on the extension of New- land Street be prepared for Commission consideration at the Feb- ruary 21, 1973 meeting. Planning Commission, Tuesday, February 6, 1973 Page 7 Chairman Porter inquired as to whether the City of Fountain Valley -will acquire property in the area for a public park. The Actingg Secretary stated that Recreation and Parks Director Norm Worthy willbe requested to report on the status of Fountain Valley's park proposal at the February 21, 1973 Commission meeting. ZONE CASE NO. 72-49 Applicant: Lincoln Property_ Zone Case No. 72-49 is a request for a change of zone on approx- imately 12.3 acres from R3 Medium High Density Residential Dis- trict to R3-PD-28 Medium High Density Residential District - Planned Development - 28 units per gross acre. The property is master planned Medium -High Density. The zone change request has been filed to facilitate conversion of an existing 342 unit apartment complex to a condominium. Commissioner Wallin questioned the zone change request to allow 28 units per gross acre when the existing development exceeds this density. The Chairman opened the,public hearing on Zone Case No. 72-49. Mr. Joel Landau, representing Lincoln Properties, addressed the Commission speaking in favor of the proposed zone change. There being no one further present to speak, the Chairman closed the public hearing. Commissioner Bazil stated that he felt the Use Permit and Tentative Tractshould be heard together with the zone change request since there is the issue of ownership. The Chairman stated that if the applicant had been advised to file for a 28 unit per acre zone change by the staff, then the city should readvertise the request if this advice was in error. ON MOTION BY KERINS SECOND BY BAZIL, ZONE CASE NO. 72-49 WAS DENIED FOR THE REASON THAT IT DOES NOT MEET THE R3 PD DENSITY CRITERIA OF 25 UNITS PER ACRE, BY THE FOLLOWING ROLL CALL VOTE: AYES: Bazil, Kerins, Porter, Wallin, Boyle, Higgins NOES: None ABSENT: Geiger Staff was directed to investigate the conditions surrounding the application and report its findings to the Commission and if incorrect information was given the applicant, staff was directed to initiate a zone change. 7. The primary question Commission would like answered is whether an applicant can convert to an "air space" condominium. ZONE CASE NO. 73-2 Applicant: Tamura Enterprises Zone Case No. 73-2 is a request for a change of zone on 1.6 acres of land from Al General Agricultural District to C2 Community Business District with a 50 ft. setback. The property is master planned for Commercial. The Chairman opened the public hearing on Zone Case No. 73-2. Mr. Richard Mantle, agent for the applicant, was present and spoke in favor of the zone change on the basis that the property is master planned for commercial use. There being no one further present to speak, the Chairman closed the public hearing. The Chairman opened the public hearing on Master Plan Amendment No. 73-1. There being no one present to speak, the Chairman closed the public hearing. Weatherly, U.S. Auto The request is to permit an automobile dismantling and parts storage operation on propoerty located on Talbert Avenue, be- tween Beach Boulevard and Gothard Street. The property is zoned Mi. The Acting Secretary stated that this matter was referred to the Planning Commission by the Board of Zoning Adjustments at the request of the Planning Commission. The Acting Secretary stated that a letter has been received from the applicant requesting a continuance, however, the staff feels there should be some discussion. The Chairman opened the public hearing on Use Permit No. 73-7. Mr. Paul Weatherly, applicant, addressed the Commission speaking in favor of the proposed use. Mr. Eugene J. Long, attorney representing the owner of the property addressed the Commission speaking in favor of the proposed use. Mr. Harold J. Lewis, representing the owner of the property, addressed the Commission speaking in favor of the proposed use. Mr. John Kingston, a property owner in the vicinity, addressed the Commission speaking in opposition to the proposed use. Mr. Nick Oprian addressed the Commission and discussed access for the property to the south of the proposed use. The Chairman closed the public hearing. It was the consensus of the Commission that the proposed location was unacceptable because of the possible school site relocation and proximity to Talbert Avenue which is a major street to and through Huntington Central Park. The Acting Secretary stated that the City Attorney has been requested to investigate the granting of exceptions by condi- tional use permit and to draft new language for the section of Intent and Purpose. This work has not yet been completed. Following discussion, the draft was amended to include a section on public hearing provisions. Brock $ Sons The Acting Secretary stated that a letter has been received, a copy of which has been furnished each Commissioner, from M.J. Brock F Sons relative to property located at the hortheast corner of Atlanta and Beach Boulevard, presently zoned C4 Highway Commer- cial District. Mr. Robert S. Wible, representing M.J. Brock & Sons was present. The letter requests consideration of a proposed planned community development on the subject property on the basis that the shopping center located at the southeast corner of Atlanta and Beach Blvd. has pre-empted the market for development of the northeast corner of Atlanta and Beach as commercial. FIELD TRIP SCHEDULED FOR FEBRARY 13, 1973 The Acting Secretary stated that a field trip has been scheduled for February 13, 1973, 1:30 p.m. to view existing multi -story structures in the cities of Newport Beach, Costa Mesa and Long Beach. The Citizens' Committee on High -Rise will be notified of the scheduled field trip. BILLBOARD LITIGATION Assistant City Attorney Willis Mevis reported briefly on a recent Supreme Court ruling relative to removal of billboards. PHASE II, SIGN CODE Assistant City Attorney Willis Mevis was requested to review proposed amendments to the sign code and staff was directed to invite Director of Building and Community Development to be present at the February 27 study session for a discussion on amendments to the sign code. STUDY SESSION COMMISSIONERS PRESENT: Bazil, Kerins, Porter, Wallin, Boyle, Higgins COMMISSIONERS ABSENT: Geiger NOTE: A TAPE RECORDING OF THIS MEETING IS ON FILE IN THE PLANNING DEPARTMENT OFFICE. CODE AMENDMENT NO. 72-21 (Fifth Draft -Corrected) Code Amendment No. 72-21 proposes to establish a multi -story suffix which will provide standards by which land development located within certain areas of the city may exceed the maximum height limit. Mr. Kenneth Reynolds, Planning Director, stated that the field trip to view multi -story structures in the cities of Newport Beach, Costa Mesa, and Long Beach has been postponed:until Feb- ruary 27, 1973. He further stated that the Citizens High -Rise Committee has been notified of today's discussion and although there are no members present, Mr. Art Knox, chairman of the committee,has reviewed the fifth draft -corrected with staff members. Commission reviewed the draft page by page and a number of amend- ments were made. Staff will prepare a sixth draft incorporating the suggested amendments for further study by the Commission on February 27, 1973. PLANNING COMMISSION GOALS - 1973 (Work Program) Messrs. Ed Selich and Robert -Joe Vasquez displayed wall charts depicting a work program encompassing Planning Commission goals. Included were code amendments, master plan studies, special studies and recurrent activities. Shown on the charts were target dates for Commission hearing. The charts as prepared were, according to Planning Director Ken Reynolds, based on the staff's estimate of when the projects can be completed. Commission reviewed the projects, made some changes in priorities and added a few items which had been left off the listing. Mr. Reynolds stated that based on the Commission's satisfaction with the work program as modified, a report will be prepared for the 1. PC 2/13/73 Minutes: II.B. Planning Commission Tuesday, February 13, 1973 Page 2 Commission's transmittal to the City Council preparatory to the Commission's meeting with the City Council to review 1973 goals, scheduled for 7:00 p.m., February 26, 1973. TENTATIVE TRACT NO. 7850 Subdivider: Huntington Harbour Corp. Acting Secretary Jim Palin stated that the Environmental Review Board solicits Planning Commission comments on Tentative Tract No. 7850 preparatory to completion of a final environmental impact report. The Chairman suggested that if Commissioners had any comments, to make them directly to Richard Harlow, City Admini-• strator's office.
